SEC steps up fight against Ponzi schemes and illegal capital market operators Chike Olisah by Chike Olisah August 14, 2021 Reading Time: 3 mins read SEC steps up fight against Ponzi schemes and illegal capital market operators The Securities and Exchange Commission (SEC) on Friday vowed to clamp down on illegal capital market operators, especially operators of Ponzi Schemes. This is as the commission has identified their activities as a huge problem for the economy and the country in general. This riot act was read by the Director-General of SEC, Mr Lamido Yuguda, to capital market operators at the second post-Capital Market Committee (CMC) virtual news conference, who said that the commission would remain committed to zero tolerance for market infractions. What the Director-General of SEC is saying Yuguda said the commission would continue with the campaign against illegal operators in the capital market, especially Ponzi Schemes, according to the News Agency of Nigeria. He said, “SEC has adopted multi-level engagements with media platforms and regulators of publicity agencies in order to curb the reach and activities of these illegal operators. While we continue our activities to resolve the complaints that have been forwarded to the commission through the official channels.’’ He warned the investing public to be wary of unscrupulous schemes that promised unrealistic returns on investment. The SEC boss said, “We will like to use this opportunity to reiterate our commitment towards zero tolerance for market infractions. We urge every capital market operator to operate within the market functions approved for it by the commission. “The commission will not hesitate to deal decisively with any operator who carries out any activity outside the function(s) approved for it by the commission. No capital market can grow without discipline and adherence to laid down rules and regulations. “Every month, every day, many of our citizens lost huge monies to Ponzi Scheme operators and the commission has adopted a variety of measures.’’ He said that part of the measures adopted by the commission to check the activities of these illegal operators include putting up the list of the authorised operators on SEC’s website so that interested investors will confirm that the scheme they intend to invest in is through a registered operator. He said that many of the Ponzi scheme operators give mouth watery promises and entice many gullible investors and in the end, monies are lost and these investors start flocking to SEC offices to complain. Yuguda said, “We have engaged a number of regulators and a number of media platforms to ensure that the message is actually delivered to the public that any promised return that looks so generous should actually be suspicious. “It is a continuous fight, we are not resting on our oars in this. These Ponzi Schemes are truly a cancer in our society and every hand must be on deck to fight this cancer.’’ What you should know SEC has been at the forefront of the fight against Ponzi schemes and illegal capital market operators, by stepping up its enforcement actions to safeguard the investing public, following an upsurge in their activities since 2019. The commission had in March 2020, warned stakeholders and the investing public against the activities of some unlawful/unlicensed market operators and promoters of fraudulent schemes as they listed 12 fraudulent Ponzi schemes with bogus investment and return claims. They had also in 2019, clamped down on some of these Ponzi scheme operators by blocking their bank accounts and real estate properties linked to them in addition to sealing off their premises. A Ponzi scheme is a fraudulent investing scam promising high rates of return with little risk to investors. A Ponzi scheme is a fraudulent investing scam which generates returns for earlier investors with money taken from later investors. This is similar to a pyramid scheme in that both are based on using new investors’ funds to pay the earlier backers. |

BY SAHARAREPORTERS, NEW YORKAUG 12, 2021 Victims of an alleged scam perpetrated by a Lagos-based forex training and capital investment company, MBA Capital and Trading Limited Wednesday protested against an alleged scam perpetrated by the company. The demonstrators stormed the headquarters of the Economic and Financial Crimes Commission (EFCC) in Abuja to demand the arrest and prosecution of the company's Chief Executive Officer, Maxwell Odum. Aggrieved investors protesting at EFCC Headquarters in Abuja The protesters alleged that they were defrauded of a whopping sum of N122,510,000 in a scheme promoted by the firm with a promise that they would be getting a 15 percent return on investment every month. The company has since reneged on its promise in the payment of dividends, according to the protesters. The protesters in their numbers displayed placards calling on the commission to intervene in their plight by arresting and prosecuting Odum. Aggrieved investors protesting at EFCC Headquarters in Abuja Chairman, Victims of MBA Forex Fraud, Christian Agadaga said, "We did not invest in a Ponzi scheme, we invested in forex and forex is a legitimate business all over the world. We invested in a company that gave us contracts to sign and we all signed the contracts, making it a legitimate business. "Now all branches of the company have been shut down and we don't know where the CEO of the company is. Our investment capital has been trapped since November 2020 and there is nowhere to retrieve it. "We call on the EFCC and Interpol to immediately swing into action, get Maxwell Odum arrested, and compel him to refund the investors' money. This is our demand." The protesters, while accusing the anti-graft agency of conniving with the company, threatened to shut down the offices of the commission across the country if they fail to arrest and prosecute Odum within a reasonable time. They maintained that a formal petition has been submitted to the Zonal office of the commission in Port Harcourt, Rivers State, and vowed to mobilise all investors across the country to occupy the EFCC headquarters if they fail to take action on the matter. Also speaking, the Executive Director, Leadership and Citizens Development Centre, Comrade Enefaa GeorgeWill also accused the anti-graft agency of conniving with the company. therefore threatened to mobilise other investors across the country and shut down the headquarters of the commission if they fail to arrest him. "We are saying we will give the EFCC the benefit of doubt, though we have been enjoying a fraternity relationship with the zonal office of the EFCC in Port Harcourt before this rumour came up. "The rumour making the rounds, especially in Port Harcourt where the MBA office is located, is that there is nothing investors can do, and that all the noises we are making are just the usual Nigerian drama and that MBA has bought over EFCC headquarters and that there is nothing we can do. "We are saying after giving EFCC reasonable time, if they do not arrest and prosecute Maxwell Odum, we will be left with no other choice but to shut down the EFCC headquarters," he said. They are and have succumbed to a terrorist organization who is not dictating when citizens should come out and or stay home. Xbobtage:My friend, yes there is nothing wrong about wearing a shirt saying anything, but as long as your right to do or say anything you want does not infringe on my right. They went to a church and intentionally use that as the stage to express their right or displeasure. In so doing, they are infringing on other worshippers right to worship God purely without any motive whatsoever.
