MightySparrow:yes soo |
Bobloco:it’s very unfortunate, he knows the truths but he’s shying away with it. He forgot that there’s repercussions for it either in the good way or bad way. |
Too much anger in the land. Very unfortunate seriously |
garfield1:it’s very unfortunate that the people aren’t ready to say the truths again. The law and the constitution is there to be enlightened, but the people shy away to stand by the truths and the law. Now when Supreme Court of justice struck out APC cross appeal in the court, there will be series of propaganda against the judges sitting on the appeal the Pdp and Nnpp in the Court |
garfield1:just to tell you that Gawuna appeal is a pre election matters and his cross appeal will be struck out in the Supreme Court of justice. Supreme Court of justice has dealt with pre election matters cases in the court of justice. Just to make some clarification to you |
garfield1:Visit this thread: https://www.nairaland.com/7753103/obi-not-member-labour-party#124226839 Olanipekun submitted the membership register of Labour Party and Obi's name was missing. Olanipekun further argued on behalf of Tinubu and Shettima that Obi had no locus to file same because he is an independent Candidate. The tribunal held that only a Party can determine her members. A tribunal sits in 5, that means their decision even supercedes this judgement, the Courts must provide clarity and not cherry-pick Judgements like we saw in Plateau. This was what the tribunal said when Olanipekun submitted the register! |
fergie001:you are very right barrister fergie001. Always on point here |
yarimo:good . Just to make some clarification about the so called issue of alleged invalid votes you are mentioning on Kano case. |
MightySparrow:yes. Anyone win in the Supreme Court of justice will be crowned the governor . Governor mutfwang still has huge advantage in the Supreme Court of justice. Pre election matters cases won’t be entertained in the Supreme Court. It will be struck out in the Supreme Court of justice |
fergie001:the judges agree that the case is pre election matters and it can’t entertain it. It’s very unfortunate, the will of the people are not prevail in the court of justice again. |
garfield1:how is it different, don’t forget that Wole Olanipekun petition supreme Court of justice that Obi was not duely Lp member in his petition. The Supreme Court of justice panel sitting on the PEPTIDE struck out Wole Olanipekun case that it’s pre election matter. Maybe you read the judgement well again. Everything is online now. Supreme Court of justice will interpret the law on the Kano case that present a pre election matters |
yarimo:I have send the screenshot, you can read it from here and interpret it well |
Bobloco:yes you are talking about this section in the amended electoral act 2022. You are very right here. I strongly believe, Governor of Kano State, Abba Yusuff will win his appeal in the Supreme Court of justice especially on the alleged invalid votes APC said Inec added to Pdp votes. Supreme Court of justice will interpret the law to us. Supreme Court of justice will present the law as it is especially ok the pre election matters and the alleged invalid votes
|
Kano case: Amended electoral act 2022 (3) A political party shall not impose nomination qualification or disqualification criteria, measures, or conditions on any aspirant or candidate for any election in its constitution, guidelines, or rules for nomination of candidates for elections, except as prescribed under sections 65, 66, 106, 107, 131, 137, 177 and 187 of the Constitution.
|
Bobloco:sir maybe you should tell him the subsection in the electoral act to him. |
yarimo:ok |
yarimo:the section you quote here’s not in the 2022 amended electoral act |
yarimo:Supreme Court of justice the Apex court of justice will interpret the law to us. Let’s keep our fingers crossed |
fergie001:can please post the judgement here for people to see and we’ll informed. |
yarimo:Here is what the law says as regards ballot papers not signed and stamped "(1) Subject to subsection (2), a ballot paper which does not bear official mark prescribed by the Commission shall not be counted. (2) If the returning officer is satisfied that a ballot paper which does not bear the official mark was from a book of ballot papers which was furnished to the presiding officer of the polling unit in which the vote was cast for use at the election in question, he or she shall, notwithstanding the absence of the official mark, count that ballot paper". From the above, the law provided a leeway to the issue of unsigned and unstamped ballot papers. Supreme Court of justice will help us to interpret it according to the law of Nigeria constitution and the amended electoral act. Let’s keep our fingers crossed till December |
slivertongue:I’m waiting for the Supreme Court of justice verdict on the pre election matters cases too. Since they have done the needful on the Obi petition that relates to the presentation of pre election matters, it was rightly struck out in the Supreme Court of justice. Supreme Court of justice will do the needful by interpret the law |
yarimo:in as much the Returning officer don’t reject the alleged votes APC claimed it’s invalid, definitely it shouldn’t be presented in the court of justice. Supreme Court of justice will interpret it well to protect the law. |
Plateau Case: Of the truth PDP did the primaries and INEC tendered the evidence to that effect. was there a valid primaries?was the primaries witnessed by inec?was the APC candidate part of the so called primaries??This is clearly a pre election matter that should have originated from the high court before the election and secondly, the APC candidate does not have the locus standing to challenge it as he was neither a PDP member and did not take part in the primaries of the PDP.He does not have the right to question another party on the nomination of it's candidate. it's a pre election matter and should have originated from the high court.Bayelsa and zamfara cases we love to site as examples originated from the high court. The Appeal Court of justice lack the jurisdiction to entertain the case . Zamfara case was APC vs APC and it originated from the federal high court and not the tribunal, Appeal and Supreme Court of justice. The tribunal, Appeal and Supreme Court of justice lacks the jurisdiction to entertain it. |
yarimo:Kano Case: Section 177 of Nigeria constitution interpret party membership for election. Here is what the law says as regards ballot papers not signed and stamped "(1) Subject to subsection (2), a ballot paper which does not bear official mark prescribed by the Commission shall not be counted. From the above, the law provided a leeway to the issue of unsigned and unstamped ballot papers. |
slivertongue:The amended electoral act 2022 affirmed the victories of Governor dauda Lawal of Zamfara 2019 poll but the plateau case is different cos’ it’s a pre election matter and also the tribunal affirmed it that the petition of APC is highly preelection matter |
seunmsg:in Zamfara you are referring to, it’s between APC faction and APC faction. On plateau case, the Supreme Court of justice will do justice in the matter cos’ it’s a pre election and post election matters. It will be struck out for lacking merit. |
Triplerg:they forgot that one ooo. Supreme Court of justice will do the needful by strucking out the pre and post election matters presented in the court. |
fergie001:barrister fergie001, you are very right here. It’s very unfortunate. Both Kano and plateau are pre and post election matters. Appeal Court of justice shouldn’t allow the Appeal in the court of justice |
