A Federal High Court sitting in Port Harcourt Thursday declared the Accord Party governorship candidate in Rivers State, Dumo Lulu Briggs, unfit to contest in the March 9 governorship election.

According to the presiding judge, Justice Emmanuel Obile, Lulu Briggs did not participate in the primaries conducted on October 4, 2018.

The judge said Briggs was a governorship candidate of the All Progressives Congress (APC) at the time of conducting the primary.

Obile, therefore, declared Briggs’ candidacy as null, void and unconstitutional.

The court, thereafter, ordered INEC to replace his name with the plantiff, Precious Baridoo as the candidate of the party.

The Peoples Democratic Party (PDP) has charged President Muhammadu Buhari and the All Progressives Congress (APC) to stop whining over their “rejection” in the presidential election and quietly accept the will of the people.

The party said the APC and agents of the Buhari Presidency, were bewildered by defeat and thus plotting to discredit the votes which the opposition party sad Nigerians freely delivered to its candidate, Atiku Abubakar at their polling units.

A statement last night by the spokesman for the PDP, Kola Ologbondiyan, said part of alleged plot is to trigger mayhem and burn down Independent National Electoral Commission (INEC) offices in order to destroy all evidence of poll results.

The statement said, “The PDP reminds President Buhari and the APC that the polling unit is the foundation of the election and all our agents and supporters already have the results in all the polling centers and voting points across the country.

“As such, our party is holding strongly to our results as already delivered by the people at the polling units and such cannot be altered.

“The PDP, therefore, counsels President Buhari and his APC to respect the will of the people and accept the verdict of the election. It is not for President Buhari to direct his campaign spokesperson to tell Nigerians that no party should rejoice.

“For us in the PDP, we already have the figures and we are aware that Nigerians in their resolve and consensus have settled their votes in favour of the people’s candidate, Atiku Abubakar, as the next President of our country.

“President Buhari should be prepared to take his defeat in good faith. After all, he will not be the first sitting President to lose in an election”.

The Rivers state governor, a member of the Peoples Democratic Party (PDP), Nyesom Wike, has taken to his official Twitter page to mock the All Progressives Congress (APC) candidates following the Supreme Court ruling which reaffirms the nullification of APC primaries in the state.


The governor, while rubbishing Tonye Cole, the candidate of the All Progressives Congress (APC) in the state on the social media said, "politics isn't for errand boys".

Nigerian election thrown into chaos as Buhari suspends country's top judge

Lagos, Nigeria (CNN) Nigerian President Muhammadu Buhari has come under intense scrutiny for suspending his country's Chief Justice just weeks before a general election, a move that critics have attacked as tyrannical and unconstitutional.

Buhari defended his decision on Twitter, saying corruption allegations against Chief Justice Walter Onnoghen -- who has been accused of failing to disclose bank accounts in foreign currencies -- are "grievous."

But the move was labelled a "coup against democracy" by the President of the Nigerian Senate, and prompted an outcry from the country's major opposition party, which halted its presidential election campaign in protest.

Describing the action as a "dangerous and brazen assault on the constitution," the Campaign Council of the opposition People's Democratic Party (PDP) said Friday that there was no point in campaigning in an election whose basis has been so flagrantly undermined.

"When democracy comes under this kind of virulent attack, then the election itself becomes superfluous," the statement said.

Buhari is seeking a second term as president in next month's elections, but his party has been accused of vote-buying by political opponents.

As the country's top judge, Onnoghen would have ruled on any legal challenge to the election.

That potential responsibility would now fall to Ibrahim Tanko Muhammad, whom Buhari swore in as acting Chief Justice of Nigeria (CJN) following his suspension of Onnoghen.


But many Nigerians have used social media to criticize Onnoghen's ousting, calling Buhari a tyrant and saying it's the President who should go.

They have been joined by numerous politicians from opposition parties, who have launched a cascade of condemnation against Buhari and urged him to reverse the decision.

"President Buhari has sent a dangerous signal to the entire world that Nigeria is no longer a democratic nation and that we have returned to the old, jaded era of military dictatorship," Senate President Bukola Saraki said in a statement, adding that he has "precipitated a constitutional crisis."

'Brazen dictatorial act'
Chief Justice Onnoghen was charged on 12 January with breaching a rule that public officials disclose foreign bank accounts.

He had secured a temporary injunction to his hearing on Thursday, which seemingly prompted Buhari's move.

"One expected that with his moral authority so wounded, by these serious charges of corruption, more so by his own written admission, Mr. Justice Onnoghen would have acted swiftly to spare our Judicial Arm further disrepute by removing himself from superintending over it while his trial lasted," the President wrote on Twitter.


"Unfortunately, he has not done so," he wrote, adding: "If Justice cannot be done and clearly seen to be done, society itself is at risk of the most unimaginable chaos."

But the President's critics argued that due process had not been afforded to Onnoghen, and painted Buhari's move as a flagrant attempt to influence the outcome of the upcoming vote.

"This brazen dictatorial act is the latest action in the ongoing rape of our nation's hard earned democracy," PDP challenger and former Nigerian Vice President Atiku Abubakar wrote on Twitter.

"The case involving the legality or otherwise of the charges against Chief Justice Walter Onnoghen is in court, as it should be," he added. "Why not allow the court to adjudicate on the matter?"


The European Union (UN), which had been asked to observe the elections by the National Electoral Commission, said it was "very concerned" by the judge's suspension.

"The decision to suspend the Chief Justice has led to many Nigerians, including lawyers and civil society observer groups, to question whether due process was followed," a spokeswoman for the EU's Election Observation Mission said in a statement.

"The timing, just before the swearing in of justices for Electoral Tribunals and the hearing of election-related cases, has also raised concerns about the opportunity for electoral justice," she added.

Next month's election is seen by many as a two-horse race between Buhari and Abubakar.

But Bring Back our Girls activist Oby Ezekwesili, who withdrew her candidacy on Thursday, promised to build a coalition capable of defeating both parties in order to "disrupt the politics of failure" in Africa's most populous nation.

If you are educated and not just here cause of your hate for buhari, you will know that the president has the power to suspend the CJN by section 11 of the IA
If you can be truthful to yourself as an alleged lawyer you claimed you are, can you reel out the stipulated process for the suspension of a CJN in Nigeria according to our constitution?. And was that process lawfully complied with in this present circumstance.

He has simply sent a dangerous signal to the entire world that Nigeria is no longer a democratic nation and that we have returned to the old, jaded era of military dictatorship .

“Our constitution makes no provision for suspension of the nation’s highest judicial officer. The constitution provides a clear process for removal of the CJN and specify the roles of the three arms of government, beginning from the National Judicial Council (NJC), the National Assembly and lastly, the Presidency, have different roles to play in that process. There is no condition under which the President can usurp the powers of other arms of government. I do not know where the President and his advisers got this idea of suspending the CJN on the so-called order of the Code of Conduct Tribunal but this is novel, disingenuous and alien to our laws.

“The President and his team must have seen this so-called suspension as a short-cut to getting Hon. Justice Onnoghen out of the way since the appellate court has eventually stopped the CCT from continuing with the trial of the CJN. It is strange that President Buhari is claiming to be taking orders from a Tribunal which has been ordered by a superior court to halt all actions on the trial.

“With this action, President Buhari has initiated a process the consequence of which nobody can predict. They have precipitated a constitutional crisis.

“At this point, all democratic institutions in the country, the international community and democrats across the world should rise against this blatant act of impunity. We should jointly condemn this retrogressive, uncivilized and despotic measure”, Saraki stated.

He however called on President Buhari to immediately reverse this decision and allow the due process of law to take its natural course in determining the guilt or otherwise as well as the suitability of Hon. Justice Onnoghen to continue as the head of the nation’s judiciary.

First of all, the word removal is not synonymous to suspension, unless there is precedent for this, buhari has not gone contrary to law, it is left for the court to use the mischief rule to adjudicate this matter... The word removal is not defined

Secondly, Walter for fear that the NJC would suspend him, adjourned the NJC seating indefinitely... That just reaffirms his guilt.


Thirdly, why are you putting out your neck for someone you are sure is guilty, do you know how many supreme Court cases has suffered due to this struggle, today was suppose to be the hearing of the APC portharcourt case, but nothing... Cause of one man


The fight against corruption in Nigeria is a hard one, I commend Buhari for this, I am a lawyer, part of the judiciary, I do not see this as an attack on the judiciary, but a cleansing, after all, he who comes to equity must come with clean hands...
