Let me be sincere here: I expect this article to get me the chastisement and ire of some unscrupulous colleagues of mine in the medical profession who have embraced illegality and wanton unprofessionalism as their guiding principles.


But like seriously.....


.......I don't give a hoot!


If this article would make even one reckless doctor or nurse or any other health caregiver to shape up and practise medicine according to the guiding principles of professional excellence, then it would have been a huge success.


It is really a sad thing, because a lot of medical practitioners commit unspeakably horrible crimes and go scot-free just because majority of Nigerians are unaware of their health rights or even when they know about them, there are no available institutions and structures on ground to investigate these cases of malfeasance to a final conclusion. Because of this, doctors and other health care practitioners arrogate to themselves the power of a god- everyone else must worship and bow before them, even if by force. This ought not to be. And as such, we must take it upon ourselves to work collectively in identifying the few bad eggs in the system, who are denting the image of this nobel profession lest they cause us all to lose our worth and social value.


The follwoing are the 5 UNFORGIVABLE medical mistakes which anyone can sue his or her doctor for:



1. BREACH OF PATIENT CONFIDENTIALITY

This one is like the holy grail of medical practice. It is talked about so much that it is impossible for any doctor who trained from an accredited medical school to claim to be ignorant of it. And the rule is simple: at no time should a doctor or any other member of the health team discuss or disclose the patient's medical information or state of health to anyone who is not part of the medical team caring for him or her. The patient's medical information must be kept confidential at all times, except at such a time when it becomes inevitable to discuss the said patient with another doctor or member of health team in order to reach a final diagnosis or agreement on the best treatment modality for the patient. If evidence, at any time, abounds that a doctor has disclosed your medical information to someone who should not be privy of such information, you have the legal backing to sue that doctor and take away his/her practicing medical licence!



2. FAILURE TO GET INFORMED CONSENT

What is informed consent? It the permission (in the form of a signed document) granted in full knowledge of the possible consequences, given by a patient to a doctor for treatment with full knowledge of the possible risks and benefits. A bit technical, right? Here is what it means- before any doctor performs any medical procedure on you, that doctor must first explain the procedure in detail, including all the risks involved with that procedure to you, after which you can decide to give or not give the doctor the go ahead to carry out the procedure. Without your approval, it is an offence for any doctor to perform any medical procedure on you, EXCEPT at such a time when you are unconscious or in a very critical situation during which no family member of yours is available give assent to the procedure on your behalf. Any doctor found culpable of this offence can and should be sued.



3. ASSAULT OF PATIENT(S)

Assault, in any form, is an offence, even more so in the medical profession where there is zero tolerance for such. It is considered a rare privilege that we, medical practitioners, find ourselves in a position where we can save people's lives and determine the quality of life they live subsequently. This is very rare privilege that must never be abused but should instead fill the caregiver with so much compassion to treat patients with some respect and dignity. This is the standard practice. It is part of the hippocratic oath of medical practice. So really, it becomes very worrying and quite appalling when patients complain about doctors or nurses who assaulted or are assaulting them. It is evil and criminal for a doctor to assault you physically, sexually or psychologically. If you the courage to expose that evil doctor or health care practitioner to the right authorities, he or she would adequately sanctioned and dealt with.



4. SOLICITING SEXUAL FAVOURS BEFORE TREATMEMT

This is one that is quite common in this part of the world. I first encountered it when a friend of mine told me of an instance when she visited a particular hospital (name withheld) for treatmentg for some condition she didn't want her immediate family members to know about. The doctor who saw her, after she had made it clear she didn't want her immediate family to know about it, threatened to expose her if she refused sex with him! Yes, it happened here in Lagos. That is just one incident out of thousands of other unreported cases. And it is very disgraceful and evil and sick. Any doctor, male or female, who solicits sexual favours from his or her patient in return for treatment is culpable of professional misconduct and hence liable to be sued and jailed! In fact, the code of medical ethics prohibits sexual relationship with a doctor and a current patient (when the patient is still undergoing treatment). So really, except a medical practitioner wants to risk litigation, it is to his or her benefit to desist from soliciting or accepting sexual gratifications, even when willingly offered to the doctor by the patient during the course of treatment.



5. COMPLICATIONS RESULTING FROM FAILURE OF THE DOCTOR TO REFER A PATIENT AT THE RIGHT TIME

Standard medical practice makes it very clear that a doctor must, quickly and without delay, refer his or her patient to the next doctor with the requisite skills to treat the patient's condition when it becomes apparent that his (the first doctor) skill or experience is not sufficient to give the patient the best possible treatment.This is how it should be. But trust some doctors to hold on to their patients, ceasing the opportunity to extort and milk them dry until the patient's condition detoriates to a critical stage where complications arise, and in some unfortunate instances, even death occurs. This is pure wickedness from the pit of hell! Now, if it can be proved that the said doctor truly did hold on to a patient even when he or she knew that prompt referral was mandatory and the next line of action, he or she can and should be sued for gross professional misconduct. It is one of the unforgivables of medical jurisprudence.

1. Ask yourself the processes your company does repeatedly that when automated (computerized) can increase productivity and reduce cost in the long run.

2. Somebody suggested placing FAQ (frequently asked questions) and Answers on the company's website. What other information does clients (including prospective clients) often inquired about. In short make the site a one - stop information portal about the company and its products/services, such that anyone can get information in the middle of the night without bugging support often. Such information should be well structured to enable visitors easily access it.

3. Take a survey within the company asking the staff how their ICT equipment affects their productivity. something like "How fast do i complete a task when using a particular device and what do you think can improve your productivity".

There are a number of postgraduate scholarships for Nigerians who intend undertaking postgraduate studies abroad (MSc and PhD). These scholarships are provided by governments, development organizations and universities. Some are fully-funded (covering all expenses from tuition to living expenses and flight costs) while others are partial scholarships. Federal Government Scholarship

This scholarship aims to improve the quality of education in Nigeria and welfare of students. It is co-ordinated by the Overseas Awards division of The Federal Scholarship Board. The participating institutions include all accredited institutions of higher learning in the participating countries that have Bilateral Educational Agreements (BEA) with Nigeria. Commonwealth Masters and PhD Scholarship

Commonwealth Scholarships for Master’s and PhD study in the UK are offered for citizens of developing Commonwealth countries. These scholarships are funded by the UK Department for International Development (DFID), with the aim of contributing to the UK’s international development aims and wider overseas interests, supporting excellence in UK higher education, and sustaining the principles of the Commonwealth. The scholarship supports both Masters (one year taught) and PhD.

Commonwealth Shared Scholarship

This is similar to the Commonwealth Masters and PhD Scholarship. It is also offered by the UK Department for International Development (DFID). The difference is that for the one above, the selection of candidates is done by a nominating body which is usually the Federal Scholarship Board (FSB), Nigeria. For the Shared Scholarships, selection of candidates is done by the participating university in the UK. British Chevening Scholarship

Chevening Scholarships are awarded to outstanding emerging leaders to pursue a one-year master’s at any UK university. We have researched on some of the hidden secrets lawyers won’t tell their client. Our goal is not to paint lawyers as villains but to find out some deep mysteries in the legal profession.

The Big Secret includes:

(1.) Sue for negligence: This is top of the chart because Lawyers all over the world will never tell their clients that they can sue them for negligence as regards their duty to them. I sincerely wish you great luck finding at what point your lawyer was negligent because that is no small discovery.

(2.) He never tells you all his mistakes in your case. No Lawyers want to show his weaknesses to his client. Every day, millions of mistakes are made by Lawyers in their client’s case but trust me only very few are detected by the client.

(3.) I will charge as much as you let me is the slogan for lawyers. It is honestly really difficult to equate a lawyer’s fee because the same job that is done for a few dollars by a Solicitor can be done by another solicitor for a million dollars.

(4.) Some of the jobs they charge you for can be done by you. Your lawyer will always give you the impression that you have no other option than to pay for his expert supervision and drafting of all legal and paralegal processes. Well, there is nothing stopping you as a client to draft a letter in your name, even draft your own will, etc. However, there are some minimum requirements for drafting a will by yourself. James, an insurance broker, still feels it is safer to use a lawyer, because their professionalism and experience enables them the opportunity to avoid little mistakes, that he personally could have avoided in his demand letter for a loan. However, you commit a crime if you draft any legal instrument meant to be drafted by a lawyer by Law.

(5.) Lawyers don’t tell their clients they are not expected to have any extra relationship with them aside being their lawyer. It is a breach of trust for a lawyer to be having any sexual relationship with his or her client. As a lawyer, you are considered to be in a fiduciary relationship with your client, and the law presumes the client to possible vulnerability. Lawyers are not expected to take undue advantage or get personally involved in a client’s divorce case or have a sexual relationship with them. To be free from this burden, a lawyer is expected to either break the bond between himself and the client or wait until the client’s case is over. Mary, a businesswoman, told us how she almost lost her husband due to the pressure she got from a lawyer who was only encouraging her to divorce the husband only because of his self-fish interest in her while she only asked him to commence a case of breach of contract between her and her husband. Mary’s story is one of the little stories we hear every day.

(6.) That he is not as good as he looks or sounds. Once a client briefs his lawyer, the next thing he does once you leave his office is to consult his library. Lawyers will always speak like they were actually ready for the brief before you narrated it, but the truth is they might have probably given you a wrong advice, but they are quick to consult the books and the library on the right thing. Take note, your lawyer will impress you more on the second meeting with perhaps a counter advice and will make it sound convincing. Next time you notice this, just smile because he has gone to dig the real gist from his library.

(7.) Lawyers don’t tell their clients that they are not the best in a particular field of law and not totally an expert in every area of law. Anyways, with the much preaching about specialisation, some Lawyers are now open to discussing this with their client.

(8.) Lawyers will not tell you the simple solutions to your problems that will not involve his expertise. This is due to the fact that he won’t be paid except he can secure payment from such advice then he will let the cat out of the bag.

(9.) Lawyers most times don’t know a lot outside the walls of law. Asking a lawyer some basic question can put him entirely off the guard, but the unique thing about these wonderful creatures is their acute acumen for swift thinking. Lawyers are trained to be smart thinkers, so they find a way to manoeuvre their way. Can’t blame them, they are trained to at least know a little about everything, or perhaps pretend that they know a little about everything.

(10.) Lawyers don’t tell their clients that they consult their fellow Lawyers to get their advice and opinions on how to handle your case. Sometimes they ask for law reports, steps to take, or simple things like how to charge you more, how or where to pay a particular fee.

(11.) Lawyers don’t tell you that they appear all rich and neat just to get more money from you and appear intelligent. You see a lawyer and his big car and clean three-piece suit, you assume he is all rich and all intelligent. Well, looks can be deceptive. He might not be totally intelligent or rich, it is just part of the business. Andy, a promising accountant, told us how his lawyer with all the glamour couldn’t say anything in court but kept on asking for more bountiful remuneration and fees.

(12.) Lawyers don’t tell their clients that they will most likely abandon their matter in court or give their younger lawyers and workers all the dirty work for a more tantalising one. According to them, this will afford the younger ones the opportunity to learn the ropes of the profession.

(13.) Lawyers are egocentric beings, they will never tell you another lawyer is better than them except it is a matter of specialisation. Where they can easily say, Attorney Thomson is a better marine lawyer than myself, but I am ahead in crime advocacy.

Have you ever wondered why employees involve themselves in private practice (popularly referred to as “PP”)? Comparing employees in multinationals such as GE, Shell, Coca-cola and Mobil, and their contemporaries in African firms, especially Nigeria (kindly help insert their names here…LOL.), you will realize that most (if not all) in the multinational organizations tend to be dedicated to their job without any room for private practice. On the other hand, in the typical Nigerian firm, almost every employee seeks private practice at every opportunity. The latter even believe that those who are not involved private practice are not smart enough and at higher risk of financial loss because of the lack of multiple streams of income to meet ever-increasing financial obligations.

Although there could be several reasons why employees in indigenous firms engage in PP, these 4 broadly cover a number of them:

1. No Clear Career Path

When it is difficult for an employee to have a clear picture of a career path in any organization, the employee will seek direction elsewhere. It is quite funny when some organizations speak of job rotation as a career path for employees without a clear picture of the level the employee can attain in the organization at any specific future time. This often leaves employees dissatisfied.

2. Low Capacity Development

Capacity development should be key in every organization in order to empower employees to attain optimal performance and achieve career growth. However, when organizations fail to fulfil this obligation, employees tend to spend extra time and resources finding other avenues in developing themselves for better opportunities elsewhere.

3. Non-competitive Remuneration

Although there is no standard for remuneration but employees expect their pay to be competitive when compared with those of their contemporaries. In some organizations, there are no rules and what you get is based on your negotiation skills. This often leads to a system where workers might be on the same level but earn incomes that are miles apart. In addition, this provokes enmity among employees and, as such, appraisal will be subjective rather than objective. As a result, employees look outside for better remuneration to meet financial obligations.

Imagine when last some workers’ salaries was increased, although the prices of everyday commodities are on a constant rise.

4. No Retirement Plan

In many organizations, there is no retirement plan for workers and anyone can be let off employment at any time. No job security of any sort! Surely, such organizations do not have any exit plan for their workers. This plan is not just about pensions but an implementable assurance, through an organization-wide policy, for a better life after many years of dedicated service. Without a system of this kind, workers believe their organization only wants to suck their productive life out of them and dump them at the last moment - when the juice is out and dry. And for them, the only wise thing to do is to secure their own future, since their employer cannot help them.

There is no need to deny that “PP” is very much in many indigenous organizations. It is everywhere and most employees are involved. This can have a number of downsides on certain organizational goals.

So, let's talk: how do you think employees and employers can assume a common ground? Why do employers fail in their obligations to employees? At what level can employees be satisfied and not to consider “PP”? Or is satisfaction at work impossible? Is it possible to eliminate “PP” completely? Do you practice “PP” too? Let's talk!
