Supreme Court to fix hearing in PDP's suit seeking Uzodinma sack The Supreme Court is expected to fix hearing date anytime soon in a motion filed by the Peoples Democratic Party (PDP) seeking to sack the Governor of Imo State, Hope Uzodinma. It was learnt that parties have filed some additional processes in relation to the motion filed last year and that the PDP, through its lawyer, Phillips Umeadi recently filed a fresh document, requiring the Supreme Court to set the case down for hearing. Information at the court’s Registry revealed the motion by the PDP, in which it’s praying the Supreme Court to reverse its decision sacking Emeka Ihedioha, is now ripe for hearing because some processes were recently filed by some of the parties. It was gathered that the next step is for the Deputy Registrar (Litigation) to liaise with the Chief Justice of Nigeria (CJN) for a hearing date, which would soon be communicated to parties. Listed as respondents to the motion on notice, filed by the PDP in an earlier appeal by Ugwumba Uche NWosu, marked: SC/1384/2019 are: Nwosu, the Action Peoples Party (APP), Uche Nnadi and the Independent National Electoral Commission (INEC). It is PDP’s contention that it was wrong for the court to declare Hope Uzodinma of the All Progressives Congress (APC) the winner of the March 9, 2019 governorship election in Imo State after disqualifying Nwosu from contesting the election on the grounds that he allowed himself to be nominated as the governorship candidate of both the Action Alliance and APC for the same election. It wants the court to declare that both the AA and the APC did not sponsor any candidate for the election in view of Nwosu’s double nomination by the AA and APC and his subsequent disqualification by the court in its judgment given on December 20, 2019 The PDP also wants the court to order that Hope Uzodinma was not a candidate by himself or of any political party at the election; and to order INEC to withdraw the certificate of return issued to Senator Hope Uzodinma. The party is equally praying the court to order INEC to issue a certificate of return to its candidate in the election, Emeka Ihedioha “as the duty elected Governor of Imo State, having scored the second highest number of votes in the said election sequel to the judgment of this court in Appeal No: SC/1462/2019 – Senator Hope Uzodinma & another v. Rt.Hon.Emeka Ihedioha & others delivered on 14th January, 2020. It is further praying the court to issue an order, directing that Ihedioha be immediately sworn-in as the Governor of Imo State. The grounds relied on by the PDD in seeking the reliefs includes that the court had, in its December 20, 2019 judgment, found that the Nwosu was nominated by both APC and AA as their candidate for election held on 9th March, 2019, and conclusively held that he was disqualified by the provisions of Section 37 of the Electoral Act for double nomination. It stated that although Ihedioha was declared winner of the election and subsequently sworn-in, the Supreme Court in its judgment delivered on January 14, 2020 in the appeal, marked: SC1462/2019, filed by Uzodinma, held that the appellant (Uzodinma) and not Ihedioha that scored the highest number of votes in the election and ought to be returned as the duly elected governor. The PDP added that by the clear terms of the Supreme Court’s judgment of December 20, 2019 in the appeal by Nwosu, it was obvious that neither the AA nor the APC fielded any a candidate for the election held on 9theMarch 2019 and as such Uzodinma could not have been returned as the election as a candidate of the APC, It said: “APC could not have substituted the appellant (Nwosu) with a view to further nominating the said Senator Hope Uzodinma as their candidate because that right is not available to the party under the Electoral Act. “Senator Hope Uzodinma could not have been a candidate in the election as an independent candidate as such right is not available to him. “Rt. Honourable Emeka Ihedioha, who is the candidate nominated by the third respondent/applicant (PDP), and who scored the second highest number of votes after Senator Hope Uzodinma, from the judgment of this court, ought therefore to be issued a certificate of return by the fourth respondent (INEC) and sworn in accordingly. A legal officer in the PDP, Adedamola Farokun stated, in a supporting affidavit, that by virtue of the Supreme Court’s judgment in Uzodinma’s appeal, Ihedioha scored the second highest votes after Uzodinma. Farokun added that by virtue of the Supreme Court’s earlier judgment in the appeal by Nwosu, which nullified the candidature of Nwosu as the duly nominated candidate of the APC, the APC had no candidate for the governorship election held on the 9th March, 2019. https://www.youtube.com/watch?v=o8BPtxS95mY

DSS Invites Sheikh Gumi After Alleging Military-Bandits’ Collusion In Attacks On Citizens Sahara Reporters4h Gumi is known for making controversial statements regarding bandits and killer herdsmen. The State Security Service, also known as the Department of State Services (DSS) has invited controversial Islamic cleric, Sheikh Ahmad Gumi, for questioning. The VOA Hausa reported the DSS invitation, days after a controversy between Gumi and the Nigerian Army. Sheikh Ahmad Gumi Speaking on an interview on ARISE Television on Wednesday, Gumi had alleged that security agents played a role in the insecurity plaguing Nigeria by collaborating with the bandits who engage in killing and kidnapping for ransom. The Nigerian Army had replied to Gumi, same day saying his statement is both sad and unfortunate. The Director, Army Public Relations, Brig Gen Onyema Nwachukwu, had said that “the sweeping allegation peddled by the scholar is not only sad and unfortunate, but a calculated attempt to denigrate the Nigerian military and undermine the sacrifices of our patriotic troops, who are working tirelessly to restore peace and stability across the country. “It is essential to remind ourselves that these same military, being accused of connivance, are the ones who recently put their lives on the line to rescue abductees of the Government Secondary School, Birnin Yawuri from kidnappers. “While the army will not attempt to excuse the possibility of black sheep amongst its fold, it must be stated unambiguously that it will not condone any form of sabotage or aiding and assisting the enemy by any personnel, as provisions for dealing decisively with such acts are crystallised in Section 45 (1) of the Armed Forces Act CAP A 20 Laws of the Federation of Nigeria 2004. “It must also be pointed out, that while the military is very much receptive to constructive criticism, it should not be perceived as a gateway for derogatory comments that have the potential to embolden criminals. It is also necessary to reiterate that patriotism must be taken to a trajectory where subversive conversations on the state are brought to the barest minimum. “Opinion leaders are enjoined to demonstrate patriotism in building the peace, rather than being agents of distabilisation, thereby aggravating the current security challenges facing the nation.” Gumi is known for making controversial statements regarding bandits and killer herdsmen. On Wednesday, he had described bandits and killer herdsmen’s atrocities as “a tribal war,” accusing the government of taking sides. “What you call banditry when you cross to the other side, you find out Nigeria is fighting a tribal war,” he explained. https://www.youtube.com/watch?v=O7gfWRz-tkE

2023 Presidency: Buhari will hand over to another of his apostle – Osinbajo Daily Post2d Vice President Yemi Osinbajo, SAN, has said that President Muhammadu Buhari will hand over to another apostle of his when he completes his assignment in 2023. President Buhari’s tenure is expected to come to an end in 2023 when he must have completed another four years in office. Osinbajo spoke at the Army Resource Centre, Abuja on Tuesday during the presentation of a book entitled ‘Buhari in Us’ written by Haruna Abdullahi. The VIce President, who said that Buhari was conspired against and removed during his military regime, insisted that the President has given his best to Nigeria in his second coming “and will continue to do so without apology.” “Those who are crying now and abusing our hero when you take what does not belong to a thief from a thief what do you expect him to do? Not to cry? Not to fight back? To fold his hands and begin to clap for you?” Osinbajo said. The Vice President, represented by Senator Babafemi Ojudu, Special Adviser to the President on Political Matters, (Office of the Vice President), continued, “They will continue to cry while we continue to convince them that Mr. President is working for their long term benefit and that of their children… imagine that if he[Buhari] would have allowed to carry out the assignment then[as the military head of state] we wouldn’t have been where we are today. “All the basic things he is putting in place today would long been done. But it was possible then for them to do what they did [over threw him] because it was military regime… what we are saying is that this man meant well for this country. He’s a creature per excellence. “Personal wealth means nothing to him. Who among us will be in charge of petroleum the time he was and will not tremendously wealthy. “Here is a man who was GOC, who was Governor, Minister and yet no single corruption allegation on his head… let us tell them this time that Buhari will complete his appointment unblemished for he has got majority of Nigerians benefitting from his progressive initiatives. “And when he’s through, he will hand over to another apostle of his who would continue and consolidate on his achievements.” https://www.youtube.com/watch?v=yAG-S5LWFHo

Imo: Punch reporter abducted, beaten, held in Govt House for interviewing protesters …NUJ, PDP, CSOs, others kick The Correspondent of the Punch newspaper, Chidiebube Okeoma Monday evening narrowly escaped death when security men attached to the Imo State government abducted and brutalized him for interviewing street sweepers, who were protesting six months unpaid stipends. The thugs and policemen, who attacked and abducted Okeoma, took him to the Governor’s Office where the Governor’s Chief Security Officer, Shabba Adamu interrogated him for daring to interview the protesting sweepers ‘without a permit’. This is also as the Nigeria Union of Journalists (NUJ) Imo State Council, led by Comrade Precious Nwadike, the Peoples Democratic Party (PDP) and Civil Society Organisations (CSOs) in the state have in strong and unmistakable terms condemned the abduction and brutality meted out on the newspaper’s correspondent. A statement signed by the Caretaker Committee Chairman and Secretary of the Imo NUJ, Comrade Precious Nwadike and Comrade Austin Okoro respectively, regretted that Okeoma’s only offence was that he was seen at the scene of the protest, reporting the dehumanizing treatement of the 750 widows engaged to sweep streets of Owerri and some major roads. The statement reads in part: “We had before now, raised the alarm over the frequent resort to violence and hostile self-help by agents of the Imo state government when dealing with journalists in the state. It appears that the deployment of such draconian measures to civil matters is beginning to take a frightening dimension. “We therefore, call on the government of Imo State to release every gadget belonging to Okeoma and ensure that those involved in this dastardly act are brought to book to serve as a deterrent to others. We also demand that his medical bills are fully paid and a formal apology tendered to the innocent journalist . “As a union, we shall not hesitate to take every legally permissible measure to enforce his rights to practise journalism in Imo State without fear. Journalists are not threats to our democracy. We promote democratic values and should always be seen as partners in progress rather than enemies. https://www.youtube.com/watch?v=F3Wvdmgx0I8

Wike in trouble as Police recovers N114 million used to bribe Electoral Officers Governor Nyesom Wike of Rivers state may be in trouble as the Nigerian police force has announced the recovery of over N114 million out of N360 million he allegedly used to bribe electoral officers in the 2016 bye-elections. Wike reportedly doled out the huge sum to 23 staff members of the Independent National Electoral Commission (INEC) as bribe to sway the election in his favour. The Deputy Inspector General of Police (DIG), Joseph Egbonike, disclosed this on Tuesday while appearing before the House of Representatives Ad hoc Committee on assessment and status of all recovered loot, movable and immovable assets from 2002 to 2020. “There was a governorship rerun in 2016 between Governor Nyesom Wike of the Peoples Democratic Party (PDP) and the main opposition at that time, which was the All Progressives Congress (APC), and the sum of N360 million money was offered as bribe to Independent National Electoral Commission (INEC) officials during the 2016 rerun governorship election in Rivers State.” “The said matter is still in court and I wouldn’t want to speak much on it, but the said amount you are referring to was recovered from 23 officials of INEC during the 2016 rerun elections of the National and State Assembly which was rigged in favour of PDP.” “Although, the persons involved have been prosecuted and convicted, the matter has been appealed and not dispensed.” A report released to newsmen after the committee’s sitting shed more light on the matter. “On 10th December, 2016, during the National and State Assembly rerun elections in Rivers State, efforts were put to rig the said election through inducement, bribery and intimidation of electoral officials, as the sum of three hundred and sixty million naira (N360, 000,000.00) was given by governor Nyesom Wike of Rivers State, to twenty three (23) electoral officials, deployed to Rivers State from Anambra, Oyo and Plateau States, to compromise and influence the outcome of the election.” “Consequently, on receipt of the intelligence, our investigation panel under the IGP Monitoring unit was set up, following which the sum of 114 million, two hundred and and ninety thousand (114, 290, 000.00) was recovered from the 23 INEC officials and deposited into the Central Bank of Nigeria.” “Account Name: IGP Special Joint Investigation Panel on Rivers Re-run Election of 10/12/2016 with Remita Retrieval Reference number 3401-58076328.
