An Ekiti State High Court, sitting in Ado Ekiti, has sentenced 36-year-old Fakorede Olawale and 39-year-old Tunji Olaitan to death for armed robbery. The two men were tried on three counts bordering on attempted murder, attempted rape and armed robbery. The charge read, “The defendants on November 24, 2015, at the Adehun area, beside Petim Sawmill, Iworoko Road, Ado Ekiti, within the jurisdiction of the court, did attempt to murder, attempt to rape and rob one Titilope Ayeni on the same day. “The offences are contrary to sections 320 and 559 of the Criminal Code Law, Cap. C16 Laws of Ekiti State, 2012, also Section 1(2) (a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Laws of the Federation of Nigeria, 2004.” In her statement to the police, the victim, a 53-year-old lecturer, said, “I was about to sleep around 8pm when my generator suddenly stopped working. I went to check what happened to it; in the process, the defendants emerged from my compound. “Before I said a word, they started cutting me with machetes. I shouted, as I defended my head and face. They dragged me inside my room and attempted to rape me, but they got distracted when my phone rang. “Thereafter, they tried unsuccessfully to dump me inside my well. Following my shout, my neighbours called the police who came on time in a patrol van. One of the robbers, Fakorede Olawale, escaped with my N15,000 cash, my gold valued at $350, my phone, ATM cards and other valuables I cannot remember. He was later arrested. “I was taken to a hospital by the police for treatment due to the deep machete cuts sustained in both arms. “Olawale had once broken into my house and was arrested. That time, he was charged to court, but later released on bail. He had threatened to kill me until he came back with his gangs.” The police prosecutor, Gbemiga Adaramola, called four witnesses and tendered the victim’s photographs, statements, and bond to release recovered items to the owner, among others, as exhibits. The defendants spoke in their own defence through their counsel and did not call any witness. They urged the court to temper justice with mercy. Justice Adeniyi Familoni said the prosecution proved the offences of attempted murder, attempted rape and armed robbery against the first defendant and attempted murder and armed robbery against the second defendant. The judge said, “On count one, attempted murder, the two defendants are sentenced to life imprisonment. On count two, attempted rape, the first defendant is sentenced to 14 years’ imprisonment without a fine option, while the second defendant is discharged and acquitted. “On count three, armed robbery, the two defendants are sentenced to death. A former Governor of Kano State, Senator Rabi’u Kwankwaso, has said a former Governor of Anambra State, Peter Obi, might have become his running mate if the latter had joined the New Nigeria Peoples Party, instead of the Labour Party, after exiting the Peoples Democratic Party. Kwankwaso, who is now presidential candidate of the NNPP, said the party would hold its presidential primary next week, even though he was the only aspirant who obtained the forms of the NNPP. The presidential aspirant also said the NNPP would shop for a popular vice-presidential candidate from the South after its national convention. Kwankwaso who featured on Politics Today, a current affairs programme on Channels Television, on Monday, was asked about the reports that Obi was to continue his presidential race on the platform of the NNPC after quitting the PDP. Kwankwaso said, “Actually we had opportunities to talk to ourselves on many national issues, until few days to the time when he declared for the Labour Party, of which he is now the presidential candidate. I wish him well and I wish all other presidential candidates well. I’m sure all these would be decide by the electorate across the country who are going to vote on the 25th of February, 2023.” On whether he thought of Obi being his running mate, Kwankwaso said, “Yes, many people suggested that. I believe it could have been possible if not because he joined another party. Now, he is a (presidential) candidate as we have seen from the news just now. We look forwards to seeing what happens in the next few days or weeks.” When asked about picking a running mate from the South-East, the ex-governor said, “We are not there yet. After the convention (of the NNPP), then the party would sit down and look around and see if we can have a very good, credible somebody who is acceptable, somebody who can bring as many people as possible to come and vote for our party as the Vice-President of the NNPC from the Southern part of the country.” Obi clinches Labour Party’s presidential ticket, promises change Meanwhile, Obi has clinched the Labour Party’s ticket for the 2023 presidential election. It was gathered that two aspirants, Prof Pat Utomi, and the youngest presidential aspirant, Mr Joseph Faduri, stepped down for Obi. But there was a mild drama as the only female aspirant, Mrs Olubusola Emmanuel, announced her withdrawal from the race at the middle of voting after about 19 states had cast their votes. Obi polled 97 votes out of the total 104 accredited delegates to clinch the ticket. The electoral committee’s chairman, Usman Aliu, declared Obi the winner of the exercise. “Having certified all requirements by scoring the highest number of votes, I hereby declare Mr Peter Obi as the party standard bearer for the 2022 presidential election,” he declared In his acceptance speech, Obi attributed the problems of Nigeria to leadership, saying that he would change Nigeria from a consumption nation to a production nation. While thanking the aspirants who stepped down for him, Obi stated, “We will join hands together to deliver the country from the shackles of those holding us hostage. “We are going through leadership failure in Nigeria. I only want to change Nigeria from a consumption country to a production nation. “I also want to change Nigeria from a sharing nation to a creating nation. There is a lot of waste in the government.” He said Nigeria needed a visionary leader that can deliver the country. The highlight of the occasion was the presentation of the flag to Obi by the party’s National Chairman, Mr Julius Abure. Embattled former governor of Imo State, Rochas Okorocha, on Monday asked a Federal High Court in Abuja to declare the invasion of his residence by operatives of the Economic and Financial Crimes Commission illegal and unconstitutional. Okorocha, who is the lawmaker representing Imo West Senatorial District in the National Assembly, also demanded N1bn damages from the Federal Government for the May 24, 2022 invasion of his Abuja residence. The EFCC and Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN), were listed as first and second respondents at the fundamental human rights enforcement suit filed by a constitutional lawyer and human rights activist, Dr. Mike Ozekhome (SAN). With the engagement of the services of Ozekhome, Okorocha now has five Senior Advocates of Nigeria to defend him. Ozekhome’s suit came some hours after his appearance before a Federal High Court in Abuja where he pleaded not guilty to the N2.9bn corruption charges brought against him by the EFCC. Ozekhome wants a declaration that the siege on Okorocha’s residence at No.3 Nyasa Close, Mississippi, off Ontario Crescent on May 24 2022, without any legal justification, thereby denying him his constitutional right to privacy, was illegal. He also wants an order of the court directing the respondents to tender apology in at least three national newspapers. Earlier, Okorocha was, in the 17 counts, accused of diverting N2.9bn from Imo State Government House Accounts and that of Imo State Local Government Joint accounts to private companies. The alleged offence was said to have been perpetrated by Okorocha and one Anyim Inyerere with the use of their private companies between 2014 and 2016 when he held sway as the Governor of Imo State. Although he denied all the charges, Okorocha has however engaged the services of Okey Amaechi (SAN), Solomon Umor (SAN), Ola Olanipekun (SAN) and Kehinde Ogunwumiju (SAN) to defend him. Shortly after the taking of plea, EFCC counsel, Gbolahan Latona asked the judge for an adjournment to enable him to assemble his witnesses that will testify during trial. He informed the court that 15 witnesses have been arranged to testify him and that most of the witnesses are outside the court jurisdiction because of the peculiar nature of the charge. Okorocha’s counsel, Okey Amaechi, told the court that he had filed application for bail of his client and had also served same on the EFCC. He attempted to argue the application but was opposed by the anti-graft agency which claimed that it intends to file counter affidavit against the bail issued. Although, the EFCC lawyer sought adjournment to June 1 for arguments on bail, Justice Ekwo ruled that he would take all the bail applications on May 31 and directed EFCC to file its opposition within time. The Senate Chief Whip, Senator Orji Uzor-Kalu, has congratulated the Peoples Democratic party for electing former vice-president Atiku Abubakar, as the party’s candidate for the 2023 presidential election. President Muhammadu Buhari, yesterday expressed his commitment to seeing candidates with integrity prevail in next year’s general elections. He also said he is determined to ensure peaceful and fair elections in 2023. The President said this when he received in audience an All Progressives Congress aspirant vying for the Kano Central Senatorial district seat, Senator Basheer Lado. Lado’s meeting with the President comes a day before the senatorial primary elections of the APC holding Friday, May 27, 2022. Addressing State House Correspondents after his meeting with the President, he said “As you are aware, Kano State is the largest producer of votes in Nigeria. “It is the decider of who becomes the next president in the presidential election. “Just like my Governor Dr Abdullahi Umar Ganduje has done in the past, I respectfully informed and reassured Mr President that the APC is still the party to beat in Kano despite recent defections.” According to him, Buhari declared his commitment to credible elections that would ensure the emergence of candidates with integrity. “After my briefing, Mr. President reiterated his commitment to credible and peaceful elections and also his desire to see candidates with integrity prevail at the polls all across Nigeria,” Lado said. An Abia High Court sitting on Thursday ruled against the victory of All Progressives Congress aspirant, Chief Ikechi Emenike, the acclaimed winner of the governorship primary election. Emenike had been declared the victor of Thursday’s controversial primary election in Abia state but Justice O. A. Chijioke nullified the result. In the suit instituted by Mr. Chinedum Nwole and two others, the judge declared that Emenike lacks the locus standi to contest the primary election because he had earlier been suspended from the party. The court ruled that both Emenike and the APC State Chairman, Chief Donatus Nwakpa breached article 9.3 of the APC constitution by going ahead to participate in the primary election. Justice Chijioke declared their participation in the ward, local council, state and the recently held national convention of the party as illegal. The ruling read in part, “That by the virtue of the suspension of the first defendant (Emenike) as a member of the second defendant (APC), the first defendant cannot participate in whatever form whatsoever in the activities of the second defendant including the scheduled ward, local government, state and national congresses of the second defendant due to to take place between 2021 and 2022. “That order of injunction is hereby made restraining the first defendant from parading, dignifying and or posturing himself as a legitimate member of APC during the subsisting of his suspension from the party as prescribed by the constitution.” Consequently, the judge directed the National Working Committee of the party to desist from having further dealing with the duo based on the subsisting court order. https://punchng.com/hours-after-victory-abia-court-disqualifies-apc-gov-aspirant-emenike/
