Saraki seems to be chasing shadow

Federal High Court in Abuja has rejected a fresh application by Senate President Bukola Saraki seeking an order of interim injunction halting his trial on charges of false assets declaration preferred against him before the Code of Conduct Tribunal.

Rather than grant the ex parte application filed and moved by the Senate President’s lawyer, Mr. Ajibola Oluyede, on Monday (November 16), Justice Abdulkadir Abdul-Kafarati ordered the respondents to the suit to appear before the court on Friday to show cause why the prayers sought by Saraki should not be granted.

A copy of the order sighted by our correspondent on Wednesday showed that the fresh suit was filed by Saraki the same day a similar one which he filed before Justice Ibrahim Buba of the Lagos Division of the Federal High Court was struck out for lack of jurisdiction.

Justice Buba had struck out the suit on the grounds that it ought to have been filed in Abuja where he said was the place issues that were being complained of by Saraki arose instead of Lagos.

The Supreme Court had earlier on November 12 granted an order of stay of proceedings of Saraki’s trial before the CCT, pending when his main appeal challenging the competence of the charges and the jurisdiction of the tribunal to try him would be determined by the apex court.

The 11 respondents to the fresh suit are Attorney-General of the Federation, Mr. Abubakar Malami (SAN), the Economic and Financial Crimes Commission, the Independent Corrupt Practices and other related offences Commission, and the Inspector General of Police, Mr. Solomon Arase.

Tinubu has done well

NATIONAL Leader of the All Progressives Congress (APC), Senator Bola Tinubu, says he has no doubt that former governor of Lagos State, Mr Raji Fashola, will excel in his new ministerial assignment.

Referring to the minister as his political product, Tinubu recalled how he was antagonised over the choice of Fashola as his successor.

Tinubu was speaking at the commissioning and launch of the Mile 12-Ikorodu Road widening and Bus Rapid Transit (BRT) operation.

“We conquered the enemy when they said it was impossible through Raji Fashola,” he said.

“You saw what happened when he was made minister yesterday. Lagos took the front seat. I am now a proud grandfather and I have no doubt he will succeed in that assignment.

“Leadership is about how many people you are able to bring up, build up and develop. I have done my bit.”

He also commended Akinwunmi Ambode, governor of the state, whom he said was “sought out” to lead the state.

The APC leader described the governor as “very creative” and commended him for his contributions toward making Lagos a model city.

Tinubu expressed optimism that Nigeria would succeed beyond people’s imaginations.

“We are in the front row now and we will ensure that Nigeria is turned around and succeeds beyond your imagination,” he said.

On his part, Ambode reassured the people of Lagos that he would address the issue of traffic congestion and improve road networks in the state.

He also pledged his government’s commitment to the infrastructural renewal and development of the state.

“Today’s commissioning is a milestone in public transportation system in the state,” he said.









“It is a delivery of world-class transport infrastructure that will bring comfort and convenience to commuters, particularly Ikorodu residents.”

He said that the BRT system was initiated as part of strategies to modernise the public transport, like other major city states in around.

“It is intended to provide efficient service that will encourage patronage by the middle-class thereby reducing the number of private vehicles on our roads,” he said. “Today, the BRT system has to a large extent lived up to that expectation.”

Mr Rauf Aregbesola, governor of Osun State, was also present at the occasion.

The Medical Director, the Chief Accountant and the Director Of Administration were said to have been suspended about 6 months ago by the federal Ministry Of Health.

he Economic and Financial Crimes Commission, EFCC, on Tuesday, November 10, 2015 arraigned a former Medical Director of the Federal Medical Centre, Owo, Ondo State, Dr Olufemi Abiodun Omotosho and four other suspects: Adebayo Sunday Dada; Yusuf Saka Olarenwaju; Ogunleye Samson Adeyemi and Azeez Dayo Kola before Justice M.I Sani of the Federal High Court sitting in Akure, Ondo State, on an eight count charge bordering on conspiracy and money laundering.

The accused persons were docked for allegedly colluding to convert and launder the sum of N84,884,005 (Eighty Four Million, Eight Hundred and Eighty Four Thousand, Five Naira Only) illegally obtained from the Federal Government.

The first accused person was said to have connived with other four suspects, to steal various sums of money belonging to Federal Medical Centre, Owo, by using his position as the Medical Director of the institution through inflation of contracts, accounts manipulation and non- remittance of the institution's account balances as mandated by the Central Bank of Nigeria at December 31 of each year.

The first accused person is already facing a corruption charge before Justice Lateef Lawal Akapo of the Lagos State High Court, for allegedly conniving with his lawyer to bribe operatives of the EFCC.

One of the charges read; “You Dr Olufemi Abiodun Omotosho, Adebayo Sunday Dada, Yusuf Saka Olarenwaju, Ogunleye Samson Adeyemi, Azeez Dayo Kola sometimes in July 2013 at Owo, within the jurisdiction of this honourable court did convert the sum of N22,641,164.92 ( Twenty Two Million, Six Hundred and Forty One Thousand, One Hundred and Sixty Four Naira, Ninety Two Kobo) property of the Federal government of Nigeria which sum you knew represented the proceeds of a crime with the aim of concealing the nature of the proceeds of the said crime and thereby committed an offence punishable under section 15 of the Money Laundering ( Prohibition ) Act No11, 2011 (as amended)”.

The accused persons pleaded not guilty to all the charges. Counsel representing 2nd and 5th defendants, Femi Emmanuel as well as counsel representing the 3rd and 4th defendants, Dapo Agbede, both filed formal bail applications before the court. However, the counsel representing the first defendant, Rotimi Olorunfemi moved an oral bail application praying the court to admit his client to bail.

Justice Sani adjourned the case to November, 17, 2015 for the hearing of bail applications and ordered that the defendants be remanded in EFCC custody pending the determination of bail.

No fewer than twelve people were on Sunday killed in Wukari during a violent clash between supporters of All Progressives Congress (APC) and Peoples Democratic Party ( PDP ).

The clash, which started late in the night on Saturday, was a fallout of the judgement of the Taraba Governorship Election Petition Tribunal which declared Senator Aisha Jummai Alhassan as the duly elected governor of the state.

Besides, several people sustained varying degrees of injuries during the clash while properties worth millions of naira including houses and vehicles were destroyed.

Confirming the incident in a telephone interview with Thisday, the Police Public Relations Officer ( PPRO ), Mr Joseph Kwaji said the situation has been brought under control by a combined team of police and soldiers drafted to the town.
Though he declined to disclose the number of casualty recorded in the crisis, an indigene of the town, Henry Audu told Thisday that at least twelve people were lost in the clash.

The leader of 8th Senate, Senator Mohammed Ali Ndume, represents Borno South in the Red Chambers. He was minority leader of the House of Representatives on the platform of the defunct All Peoples Party (later ANPP). He won elections to the Senate in 2011 and was re-elected, now the senate leader, where he has been holding sway for the ruling All Progressives Congress. In this interview with TORDUE SALEM, he speaks on President Buhari’s plans for anti-graft agencies, oil subsidy and how the APC plays out matters with the minority Peoples Democratic Party (PDP) in the Senate.

The Senate president just announced the Senate Committee Chairmen, there are some members of your party who are not satisfied even though the APC got over 40 Committees and the PDP got lower. What do you say about this?

Well let me say that I think the problem is that we are still having the hangover of the past administration. We have changed the way thibgs were done in the past. We had the committee chairmanship based on equity, justice and fairness and so when we had to appoint chairmen of the various committees, we made sure that every zone had at least 10 committee chairmen. Fortunately or unfortunately, in two of our zones we have only one APC member and we cannot give chairmanship to areas we do not have a member. We also must be seen to have acted in line with equity, justice and fairness. In South-South we have only one member in Southeast we do not have any.

To be fair and equitable as demanded by the constitution of the Federal Republic of Nigeria and our Order paper, even in the distribution of the so called ‘grade A’ Committees. You cannot say because you are in the ruling party, we should do what PDP did in time past and keep everything to itself. We felt we should do things differently according to the change mantra, we should be fair to even the opposition and I think we were fair. As to the issue of complaints by individuals, I think it is normal. When you have 109 members with only 65 committees, it means that about 44 members would go without chairmanship positions. It is a normal thing but let me confess that I am just hearing this for the first time as no Senator came to complain about the issue.

We reached out to some of the Senators although they craved anonymity

So it means that if someone is complaining and he does not want his names to be mentioned, that means that there is something wrong somehow. There is no way you can give everyone chairmanship, because we are the government in power. We are preaching the gospel of equity, justice and fairness, we cannot be found to be gluttonous in any way by taking all the committees to ourselves. We cannot also take what people term the scrap committees and also give it to the opposition that is not APC. That was PDP.

What yardstick will the senate use to esnure effective oversight of the execuitive?

We are going to introduce what we call oversight tracking system and also introduce the committee tracking system. As you may have noticed, this Senate is trying to improve on its way of doing things by improving on the way we play our oversight functions. When committees now go on oversights, they immediately file a report once they are done and such reports will be analyzed and laid before the Senate and deliberated upon and the recommendations so reached will be sent to the president who is the Commander-in-Chief, who is also the executioner of the executive arm of government.

What will be the purpose of this?

If there are observations, the president can now depend on the report from the national assembly to have an insight and an independent assessment of the performance of various ministries and that too will also show to the world and the Senate what a particular Committee is doing.

What are your expectations of the incoming cabinet?

The president is very concerned about securing the country. That is one of his priority and since the Service Chiefs are on board, a minister of defense will now coordinate the activities of that area and the president’s agenda in that regard will continue. Secondly, is the issue of capital infrastructure and this includes power, roads, health, agriculture and so on.

What about the fight against corruption?

The president is very resolved in the issue of fighting corruption, that is very critical to his administration and it is on-going, practically and effectively. But on the overall, this Senate is poised to provide the necessary legislation for this new government in order to achieve the desired change Nigerians are craving to see.

In one of your sessions, the issue of N5,000 monthly stipends for indigent was really a controversial issue

I think that there was a political ambush there, if not, how would the senators of the Federal Republic tell the president to start the implementation of payment of N5000 to youths who are not working. I was of the opinion that if they were serious and patriotic about it, and that is why I wanted to amend the motion, that the Senate would have asked the president to bring a supplementary budget to cover such expense. That what I wanted to amend but that would have been a better prayer to ask Mr President to bring to the National Assembly, a supplementary budget that will be approved to enable him to start implementing the payment of N5000 to indigent people.

The president cannot just pay such monies, where will he get it from without Appropriation? So, the National Assembly cannot be part of that unless the resources were appropriated for and the president says he has only about 30 million in the bank. You cannot use that to pay people. PDP wanted to use that for a cheap blackmail but that did not work, Nigerians are more educated than that. But the president is still serious about it and we are looking for all avenues to be able to raise resources to be able to execute the project which is laudable. I am sure that by 2016 when the budget is brought room will be made for it.

Also, you have to build a data base because if you start paying, who will you pay to? The first thing now is for the government to be able to have the statistics of all those concerned, the indigent, the unemployed, the elderly and then you know where they are including their data before you start payment.

During the ministerial confirmation sessions, the PDP staged a walkout and had the confidence that the sessions would stop. What do you think gave them the confidence?

The confidence they have is in their number because they occupy 49 seats. So, they are thinking that since they have about 40 percent, they can be a clog in the wheel of our progress but it does not work that way. In the US Congress as it stands now, Republicans are 54, Democrats are 44 and you have 2 independent candidates yet, they working. My question therefore will be, is it in the interest of PDP to make things not work? Is that why they are in the Senate? I do not think so. They are senators of the Federal Republic and not senators of PDP. So, those statements are just coming out of emotions. Besides, the day to day decisions of the Senate chambers require a simple majority and the business of the Senate starts with a simple quorum. 60 is more than a quorum, it is in fact, double the quorum and if we had six more members, we would have had two-thirds.

Do you see them crossing over to the APC?

Yes, because PDP is in a coma and only God knows when it will recover. As you can see now, they do not have any doctor or pharmacist and the only nurse is Olisa Metuh.

There are speculations making the rounds that later on in the life of this Senate, some bigwigs may join the PDP with the hopes of having the party ticket. Can you substantiate this?

No! I am part of some of the APC members trying to convince some of them over to move over to our side and they will soon move in their numbers in the Senate. So, when you tell me that APC members are going over to the PDP, it is strange to me because like I said earlier, I am trying to convince some of my colleagues over to the APC. And you know that electoral shock is worse than electric shock. That was what PDP suffered and they had a relapse again by the decisions at the tribunals so, we do not know when they will get out of it.

On the issue of corruption, are you satisfied with the way it is going because there are allegations and counter allegations over the head of EFCC and where do you think this will take us especially that people think now that the Senate is also investigating the agency, it may weaken it.

Well, this anti-corruption crusade is being led, fortunately by the Commander-in-Chief who is known for honesty and accountability. The institutions on ground which he has to use are what you are talking about. Is credibility there? And President Muhammadu Buhari is looking at those issues. It is not only the EFCC alone, but all other institutions while the work is still going on. But the luck Nigeria has in terms of the fight against corruption, is that the head is clean, active and alive and it is the head that normally controls the body and the tail. So, once you have a sound and good head, the other parts of the body simply join the head. But in those days, it was the tail that was controlling the head.

We are aware that the president is very interested in what is going on in the Northeast..

And the Senate is giving him all the necessary support to do the needful, secure the Northeast and you can see that there is light at the end of the tunnel. Not only there but the entire nation, to see that crimes are reduced to the barest minimal. Armed robbery and kidnapping in the Southeast is being addressed seriously. Therefore, it is part of our agenda to provide all the necessary supporting legislation. We are actively involved in the presidential initiatives for the Northeast and we are there to provide all the necessary legislative assistance in order to reconstruct, rehabilitate and resettle the northeast. The Senate is also thinking of going out to follow up on the efforts of the president in the international community by visiting other parliaments. The Senate President started that and the 8th Senate is poised, with the formation of the committees to continue in that direction.

Are you satisfied with the Zero budget system the President is introducing?

I am a pro zero budget person so, I will support the government on that because you cannot be spending what you do not have. You are not eliminating anything but spending what you have from what you get. Zero Budget is done to eliminate deficit and even when you borrow, it is from the anticipation of what you will have. So I support it. In any case, we do no decide for the government. The Nigerian populace has given President Muhammadu Buhari the mandate. What he needs to do is to lay it before the National Assembly, that is what the constitution requires. If the president feels that adopting zero budget will enhance the livelihood of Nigerians, fine.

What about subsidy?

It is really a big cartel. Every government has to manage it carefully and whenever subsidy debt accumulates, the major oil marketers will strategically try to blackmail the government and I think this is almost what is happening. It is a filth that needs to be cleaned up gradually. In the long run, this government will know what to do in order to break this cartel. Senate President, Senator Bukola Saraki will tomorrow, Monday, November 9, 2015, declare open the 2015 Annual National Environmental Consultation of the Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN), which will hold in Port Harcourt, the Rivers State capital on November 9, 2015.

Also expected at one-day conference, which has the theme: “Extractives and Energy Transition: Roadmap for Zero-Carbon Development in Nigeria”, is Rivers State Governor, Chief Ezebunwo Nyesom Wike.

A release signed by Philip Jakpor, head of Media, ERA/FoEN, and made available to newsmen in Port Harcourt, said the conference will also attract critical stakeholders, experts and community people in the Niger Delta region, who will have robust discussions on energy sustainability, energy efficiency and how to utilize advanced technologies to attain zero-carbon development.

Jakpor said, “Hydrocarbon perhaps has become the quintessential product driving our existence. Almost all human activity is either directly or indirectly powered by fossil energy. The over- dependence on fossil fuel easily explains why earlier discussions about alternatives or energy transition were greeted with cynicism and rejection.

“Unfortunately, from extraction to usage, fossil fuel bequeaths conflicts, human rights abuses, environmental despoliation, and destruction of local livelihoods. It is not renewable and as such, a reckless and unsustainable use of earth’s gift.

“On the global perspective, the fossil fuel driven world has led to environmental disasters. Sea levels are on the rise, extreme weather conditions, floods, heat wave etc. are on the increase. More and more people are being displaced as a result of climate induced disasters.

The legal team of the Senate president, Dr Bukola Saraki, has vowed to send a protest letter to the National Judicial Council (NJC) over the alleged biased conduct of the chair of the Code of Conduct Tribunal, Mr. Danladi Umar, in the trial of their client who is facing charges of false assets declaration in Abuja.

Yesterday, three Senior Advocates of Nigeria (SANs), Mr. Ahmed Raji, Alhaji Mahmoud Magagi and Saka Abimbola Isah, who led the legal team of the Senate president, all staged a walkout on the conduct tribunal chairman to protest alleged bias in the trial.

A source last night said that the legal team had resolved to report the tribal chairman to the NJC.

“You just wait and see the action we will take in the next few days. We cannot continue like this in this country. The judicial body has to intervene in this matter,” the source said.

The angry lawyers, accompanied by about 100 others, withdrew their services in the prosecution of Saraki by federal government, accusing the tribunal of open bias against the number three citizen and displaying judicial rascality in handling the case.

The anger of the lawyers arose when the tribunal chairman, Mr. Umar, ruled that he would not stay the trial in spite of Saraki’s pending appeal at the Supreme Court.

Magaji, who first withdrew his services in the trial, told the tribunal point-blank that going ahead with the prosecution amounted to daring and prejudicing the Supreme Court in the pending appeal case of the Senate president.

He told the chairman that, as a senior counsel in the bar and a minister in the temple of justice, he would not wish to be part of an illegality and an affront on the apex court.

Mr. Raji, who followed suit in withdrawing from the suit, told the tribunal chairman he was setting a bad precedent by sitting on the same issue at the same time with the Supreme Court.

Raji explained that apart from the law and practice, it was the tradition of respect that when the Supreme Court had been invited into a matter, the lower court will, as a matter of tradition, allow the apex court decide the matter first before taking over.

“In my capacity as a Senior Advocate of Nigeria, I have not seen where this kind of conduct will be exhibited against the apex court of the country. The action of this Code of Conduct Tribunal is an affront on the constitution and to the Supreme Court and, from my own side, I will not wish to be part of this act.

“I find it most impossible to sit down here and participate in a proceeding whose legality is being challenged at the Supreme Court.”

Earlier, both Magaji and Raji had asked the tribunal to stay proceedings pending the time the Supreme Court will make pronouncement in Saraki’s appeal in which he is challenging the legality of his trial.

They cited several authorities to buttress their arguments on the need for the tribunal to grant adjournment.

But in a ruling, the chairman of the tribunal dismissed the application for adjournment and agreed with the prosecution counsel, Mr. Rotimi Jacobs (SAN) that trial should go ahead in spite of the appeal at the Supreme Court.

The tribunal chairman held that the action of the defence was a ploy to delay the trial, adding that the arguments canvassed by Saraki’s lawyers had been overtaken by the Administration of Criminal Justice Act (ACJA) 2015 which, he said, gave no room for delay in trial.

“It is an obvious fact that where a party wants to delay trial, the party normally rushes to the higher court, as in this case, but the intendment of the ACJA has taken care of such attitude where criminal trials are unjustly delayed. We will not allow that; we are going ahead with the trial,” he had ruled.

The tribunal, however, ran into trouble when no lawyer showed up to defend Saraki yesterday and he was then asked whether he would defend himself.

But the Senate president told the tribunal that he was trained in the medical line and not in law, and that it would be unfair to ask him to defend himself in a terrain he knew nothing about.

He pleaded for one month to enable him persuade his lawyers to come back or for him to look for alternatives but the tribunal insisted that one month was too long.

The case was subsequently adjourned till November 19 for trial.

The presidency monday said workers’ salaries for the month of October which were unpaid at end of the month would be cleared today, following the restoration of the computers that crashed as the salaries were about being paid last month.

The presidency said the delay was caused by unforeseen technical challenges, a statement issued on monday by the Senior Special Assistant to the President on Media and Publicity, Mr Garba Shehu said.

According to the statement, the president “is seriously concerned about the ordeals of civil servants on account of delayed payment of salaries.”

The statement explained that the happiness and welfare of the people was one of the cardinal objectives of any democratically elected government.


Shehu also emphasised that President Muhammadu Buhari was committed to these objectives not only on paper but also in practice.
