SmartyPants: Lol. But of course it is not for me to determine whether it meets legal criteria sir. It is a fact that it does not because what he did falls under the fair comment exception because it was made without malice/the maker of the statement believed it to be true.
I don't know why i would need to have an idea of EFCC's next move to know what defamation is or isn't. Again, you arrogate the responsibility of a judge by declaring the false statement to be a protected fair comment. The bold is your opinion and nobody will take the opinion of a defendant's lawyer as the law itself. Why do we even have the courts if anyone could just read the law books and summarily decide a case based on their understanding? Believing a statement to be true does not exempt you from libel. No one will ever be convicted if such were the case. The blogger's post was clearly malicious whether it is fair is a different question. |

mrZENographer: Coronavirus has also infected thousands of people in parts of American states like California. The CDC is not testing people believed to be infected so that there are no numbers. DON'T TEST, DON'T TELL
An infected American woman is in critical condition after getting infected from unknown source. She has not travelled outside America. And she came herself and desired to be tested but the test was delayed for 11 days. Now she's in critical condition. There are forcing in deep state attempting to spread Coronavirus in America. This will aid in the forceful/mandatory vaccination agenda and battle against Trump winning the upcoming elections. Go back to the internet sewer you crawled out from. SmartyPants: Sir, the threshold of defamation is a legal -- not common sense -- concept. If you don't have legal knowledge, kindly disengage at this point. This is not a battle for you. Throwing around words doesn't make you look smart to knowledgeable people. You mentioned defamation without context or any idea of EFCC's next move. It is not for you to decide what meets which legal criteria, that shouldn't be too hard for a legal luminary should it? As you rightly said, stick to what you know! |

BanevsJoker: But shouldn't you focus on the fact there was a terrorist attack? I mean, which one is a bigger crime? Mass murder or human error? We do not know if this is a human error or deliberate malice. A terrorist attack is a serious crime but it is not some super-secret affairs that only a few are privy to. What should have been a backlash against the real operators of the center has now been turned into a fake news offense. Remember the recently killed Kaka? If someone had wrongly accused the navy of killing him, the case would have been reduced to accusations and counter-accusations and if the navy were able to show they had nothing to do with it and were able to arrest the originator of the accusation, then people can't focus on the crime itself but the purveyor of the fake attribution. In short, the SARS officer will still be employed, the closed SARS offices would still be in operation and the IG wouldn't even bother to do an eye service. This liar of a guy has done more harm than good since nobody will ever be held responsible due to his impulsivity. |

SmartyPants: He may have made a mistake in his reporting but his point was not about EFCC, it was about the treatment of Nigerians. Secondly, there are no grounds for arresting him. What he did does not even reach the threshold of defamation. If the accusation does not meet the threshold of defamation according to you, then there is no reason why anybody should care about the news. If he had accused the Nigerian police of operating the center, most people won't even bother to react as we expect worse behavior from them. The aim of the guy was to paint EFCC in a bad light and he succeeded. This is a classic case of defamation. |

BanevsJoker: Exactly. If ISWAP attack a community, and I report that Boko Haram attacked a community, will I be arrested for fake news? Or will the terrorists, regardless of their affiliation be arrested and brought to justice? Your analogy does not follow. If you reported that ISWAP attacks the government house when the target is actually an event center, you deserve to be arrested. It is better to not specify when you are not sure. |

SmartyPants: What I am finding so interesting is the fact that the building in said tweet is acknowledged to belong to another agency. So the basic fact of something not looking quite all right with the way the security apparatus treats Nigerian citizens remains glaringly unanswered. It is not the duty of EFCC to investigate detention facilities. Why didn't the liar tell us which agency it belongs to? People will become apathetic to similar news in the future because this idiot failed to do his job. |

Hmmm If what he said is the truth, why is he opposing the divorce? Isn't he supposed to be extremely happy that he will be freed soon? There are only 2 answers here. Oshigun: Dude, you are a backward and unexposed functional illiterate for this retarded statement. Because a man braids his hair, has tattoos and wears clothing paying homage to popular culture, rather than the suit or shirt and tie intolerant and unexposed elements like you worship slavishly, he is automatically a yahoo boy? How are you different from these SARS savages who are nothing but unexposed cavemen and brutal killers? You are suffering from deep inferiority complex. Don't fool yourself, neither tattoos nor braiding are not a popular culture among the Nigerian society. It is funny how someone who is clearly ignorant of popular culture is calling another an illiterate. Look, stop coming here forming informed contributor. You are an unexposed, intolerant and prejudiced nuisance for these views you air here. SARs might as well start shooting and arresting Davido, Wizkid, Burna boy, Olamide, Timaya, Zlatan et al on sight then. Some of these young men are just following popular music and lifestyle culture. That does not make it okay for SARs officers to automatically profile them as Yahoo boys to be persecuted unfairly or killed extra-judicially. Idiat. Just because some crime-infested section of the American populace adopted some lifestyle doesn't make it right. I see you listed artists there even though we all know there stock in trade is largely anti-stability. Only a kid would put them up as a model of a societal model. Anyone wearing a braid or tattoo is sending one message only, "I am different and can be dangerous". The fact that you can't separate 2 different issues; irresponsible fashion and SARS criminality speaks volume to your thought process. You really think lumping the two together will make your vacuous arguments solid? We should encourage modern and thorough investigation of anyone suspected of a crime and not their summary judgement and lawless punishment based on senseless prejudice against their hairstyle and dressing. Again, you haven't shown any sign of advanced thought. Even countries with 10X Nigeria's security budget rely on local profiling to catch criminals. No one will spend half their department budget pursuing low-level criminals so as to look cool. I don't blame you though, you are a victim of Hollywood like many Nigerians. Hollywood has repeatedly lied that the pettiest of criminals are investigated with sophisticated methods when the good ol' profiling is what regular cops use in fishing out small-time criminals. Here you are providing security non-advise to Nigeria using corporate bullshit language. If you choose to adopt a gang lifestyle, don't be surprised if the people and the government suspect you. |
