henrypsexy: Alleged N2.2bn fraud: Fayose’s trial begins today
Hearing will today (Monday) commence in the trial of the immediate past Ekiti State Governor, Mr Ayodele Fayose, who was charged with an alleged N2.2bn fraud by the Economic and Financial Crimes Commission.
The EFCC arraigned Fayose, alongside a firm, Spotless Limited, on October 22, 2018 before the Federal High Court in Lagos, six days after he bowed out of office as governor.
The 11 counts pressed against him bordered on criminal breach of trust, theft and money laundering.
But Fayose and Spotless Limited pleaded not guilty to the charges.
Following an application by his lawyer, Chief Kanu Agabi (SAN), a former Attorney General of the Federation, Justice Mojisola Olatoregun admitted Fayose to bail in the sum of N50m.
She adjourned till November 19, 2018 for commencement of trial, stressing that the case would be heard on a day-to-day basis in line with the provisions of the Administration of Criminal Justice Act, 2015.
In the charges, the EFCC alleged that on June 17, 2014 Fayose “took possession of the sum of N1, 219, 000,000 to fund your 2014 gubernatorial campaign in Ekiti State, which you reasonably ought to have known formed part of the proceeds of an unlawful act, to wit: criminal breach of trust/stealing.”
He was also accused to have, the same day, “received a cash payment of $5,000,000 from Senator Musiliu Obanikoro, the then Minister of State for Defence, which sum exceeded the amount authorised by law.”
In another count, Fayose was accused of “taking control of an aggregate sum of N317,000,000,” which he allegedly deposited into the bank account of Spotless Limited, “a company controlled by you and your family.”
He was also accused of “using an aggregate sum of N1,151,711,573 to acquire chalets 3 and 4, and 5 and 9 of the property situate at Plot 100 Tiamiyu Savage Street, Victoria Island, Lagos in the name of JJ Technical Service.”

The Federal Road Safety Commission has said its screening and physical fitness assessment for potential new recruits will commence from September 24 to 29.
The FRSC public education officer, Bisi Kazeem, said in a statement sent on Friday night that the screening would be conducted in all the state capitals.
According to him, applicants are advised to check their emails used for the submission of the applications on September 19 for relevant information.
He said the information will contain details like the venue, date, time of screening and items to be taken along for the exercise.
“Shortlisted applicants are to come with the summary data page earlier received and email notification slip which shall admit them to the screening venue,” he said. He said any candidate without the print out of the summary data page and notification slip for this phase of the exercise shall not be admitted into the screening venue.
The corps marshal, Boboye Oyeyemi, during an interview with News Agency of Nigeria in July said the corps will recruit 4,650 officers and procure new logistics vehicles to improve road safety management in the country
The corps started the recruitment exercise across the country in May 2018.

abc115: Ahead of the 2019 Presidential elections, there are indications that the Peoples Democratic Party (PDP) has concluded plans to cut down the number of its Presidential aspirants before the primary election.
The plan, our correspondent gathered, is aimed at preventing unnecessary dissipation of energy by supporters and members of the PDP as well as nipping in the bud, possible fragmentations within the ranks of the party. Although the leadership of the party has continuously reiterated its commitment to fairness and justice, the current move is being orchestrated with the active cooperation of some of the aspirants. A highly-placed party source told this medium in confidence that those that have been told to drop their ambitions would be “compensated in one way or the other,” adding that what is of utmost importance is victory at the polls for the party. “The number of Presidential aspirants keep increasing by the day and this is a bit worrisome for us as a party. Yes, all those that have indicated interest in the ticket are eminently qualified but we must be realistic that this is not the time to have our house unnecessarily divided. “It is very easy to say all of them should battle it out at the Convention to choose the Presidential candidate. There is a need to cut down the numbers whether we like it or not, these people (aspirants) are already leaders in their own right. “So whether they emerge the candidate or not, they have paid their dues. The party has made steady progress in this regard and I believe it will turn out a win-win situation for all of us,” he said. Beyond the need for an efficient conduct of the Presidential primaries, our source added that the leadership of the party is also mindful of the Memorandum of Understanding (MoU) it signed with 37 other political parties a few week ago. According to him, these parties would have their say in the processes leading to the emergence of the candidate as all 38 signatories and members of the Coalition of United Political Parties (CUPP) agreed to field a joint Presidential candidate to confront the All Progressives Congress (APC) in the 2019 polls. “Let us not forget that the PDP is irrevocably committed to the formation of a government of national unity. What that means is that while our members can aspire to govern this nation at the highest level, we are also mindful of other members of this grand coalition whose input would be vital,” he added. This recent move, Vanguard learnt, is not unconnected with the recent return to the party of Senate President, Bukola Saraki and Sokoto state governor, Aminu Tambuwal, both of whom are reportedly nursing Presidential ambition in 2019. abc115: The speaker of the House of Representatives, Yakubu Dogara, was disallowed from voting after arriving late at the polling station for Saturday’s Bauchi senatorial bye election.
Mr Dogara was at his country home, Gwarangah, in Bogoro local government area of Bauchi state days before the bye-election for Bauchi-South senatorial district.
Having coordinated support for his preferred candidate, Mr Dogara failed to turn up at the polling unit, which is near his house.
Voting at the polling unit closed at 2.20 p.m. amidst a rancorous protests by some irate youth who accused INEC officials of not allowing them cast their vote.
Some of the youth said they were denied their voting right on grounds that they were at the polling unit with temporary voters card.
Others insisted on voting even after the closure of accreditation, saying they had to go to their farms first before coming to the polling centre.
Others said the polling officials must share the remaining ballot papers among the party agents to cast their votes in favour of their respective parties as they did not trust the officials going away with unused ballot papers.
It was in the midst of this tense situation that Mr Dogara eventually left his house to the polling centre.
His arrival further infuriated the youth who began to protest loudly that they won’t accept the officials giving the speaker special treatment after they were denied the chance to cast their votes on grounds that they did not show up early enough.
The speaker was seen having a chat with officials who explained to him that they had long closed accreditation and transmitted the result electronically to the INEC headquarters.
Mr Dogara later pleaded with the crowd to be calm.
He explained even himself could not vote. It took some time to calm frayed nerves.
Journalists were almost violently lynched for daring to take photographs of the rancorous situation.

The mere fact that their minority leader who knows all the happenings in the party defected to APC and at the rally clearly said " I AM HERE TO CONNECT AKWA IBOM TO THE CENTER". This shows he as a former insider in the PDP knows PDP has failed already and cannot win in 2019.
Now Saraki in another desperate move has gathered 45 chairmen of other parties all so the CUPP can be expanded further
A CUPP that is already at breaking point due to inordinate ambitions of those in it is finally about to shatter into tiny pieces.
The funniest part is that even the followers of the other parties believe in Buhari and would rather stand with him than with someone as unreliable as Saraki whom his own kwara people have rejected.
I want to believe this is him following the council if Babangida whom he met with the other day. Alas APC is too strong a movement to challenge right now. Its too late.
The chairmen of those other parties will also defect to APC in the coming weeks and leave saraki out cold.

The obligation to adhere to religious duties (including prayer), according to Islamic teachings, is based on whether a person is of sound mind. If your brother is of sound mind, and his disabilities do not affect his mental functioning, then he is accountable. If his mental faculties are affected to the extent that he has no power of discernment, or his discernment is weak, like that of a small child, then in that case he is not accountable and is not obliged to pray.
If your brother is accountable, then his disabilities mean that some of the obligatory parts of the prayer are waived in his case, namely the obligatory parts that he is not able to do. If he is not able to pray standing, then he may pray sitting; if he is not able to recite al-Faatihah correctly and in full, then he should recite it however he is able to, and so on.
It says in al-Mawsoo‘ah al-Fiqhiyyah (10/79):
If the worshipper is able to recite part of al-Faatihah, then the Maalikis, Shaafa‘is and Hanbalis are of the view that he must recite it. The basis for that, according to the Shaafa‘is, is the principle “what is possible cannot be waived because of what is not possible (to do)”, i.e., not being able to do something in full does not mean that the part that one is able to do is waived. According to the Hanbalis, the principle is: Whoever is able to do part of an act of worship must do it even though he is not able to do the entire act, and there is no difference of scholarly opinion concerning that. End quote.
Shaykh Ibn Baaz (may Allah have mercy on him) was asked:
My grandmother can only memorise a little of the Holy Qur’an, as she makes mistakes in Soorat al-Faatihah. Some people in our village told her: if you do not recite Soorat al-Faatihah properly in your prayer, then your prayer is not valid. Is this true?
He replied:
Her prayer is valid and she is excused, praise be to Allah. Allah, may He be exalted, says (interpretation of the meaning): “So fear Allah as much as you are able” [al-Taghaabun 64:16]. So long as she has tried hard but has not been able (to recite it correctly), her prayer is valid. The Prophet (blessings and peace of Allah be upon him) said to the one who was not able to recite al-Faatihah: “You may say, ‘Subhaan Allah, wa’l-hamdu Lillah, wa laa ilaaha ill-Allah, wa Allahu akbar (Glory be to Allah, praise be to Allah, there is no god but Allah, and Allah is most great).’”
She should try her best if she is not able to recite it, then she should recite “Subhaan Allah, wa’l-hamdu Lillah, wa laa ilaaha ill-Allah, wa Allahu akbar, wa laa hawla wa laa quwwata illah Billah (Glory be to Allah, praise be to Allah, there is no god but Allah, Allah is most great, and there is no power and no strength except with Allah)” instead of reciting Qur’an, and that will be sufficient. As for the one who deliberately omits al-Faatihah, when he is able (to recite it) but he deliberately omits it, his prayer is not valid. But in the case of an old woman, or an old man, who is not able to recite it, then Allah says: (interpretation of the meaning): “So fear Allah as much as you are able” [al-Taghaabun 64:16].

So strive hard to teach your brother al-Faatihah and how to pray, and be kind in teaching it to him, and let him do whatever he is able to do. If he is unable to pronounce some of the letters, or he mixes them up, there will be no blame on him and his prayer will be valid.
With regard to inheritance, he is entitled to a full share of inheritance. Being sound in mind and body are not conditions of being entitled to inheritance; rather every Muslim is entitled to his share of inheritance, even if he is insane or sick.

Questioner:_What are the explanations on Hadeeth Soheeh, Hasan, and Do’eef?
Dr Sharof: Al Hadeeth Soheeh, Al Hadeeth Hasan, and Al Hadeeth Do’eef are the three main categories from the wide classification of Ahadeeth. Soheeh has categories; Hasan has categories; and Do’eef has categories. Do’eef has the widest categorization. Simply put, if a narration is said to be Soheeh, it means that its chain of transmission requires no comment. It has been transmitted in an authentic way. This is regarding hadeeth Soheeh, just like the ahadeeth in Soheeh Bukhooree and Soheeh Muslim. This means there is no objection as to its chain of transmission.
Hadeeth Hasan is a narration that almost meets the requirement of Soheeh, but the people who reported it are not as sound as that of the people of Soheeh Hadeeth. For example, a person from those who reported it is good at listening and memorization, but he may not be exact in transmission. For example, the statement he heard may come with ‘waaw’ while he reports it as ‘faa’; (like) reporting wadhahaba (And he goes/departs) as fadhahaba (Then he goes/departs). The scholars would say a person like this should be noted. As for the one who writes ahadeeth whenever he hears them but has a bad handwriting such that whenever he recites the ahadeeth there are minor mistakes, his hadeeth will be Hasan. And so on.
As for Do’eef, it implies that there is a liar amongst the reporters or there is a person in the narration who has forgotten all the ahadeeth he reported or the narrator relates the hadeeth from a person he never met. For example, he says, ‘so and so told me…’, and it is discovered from the history of his life that the person had died before he was born. Did they meet in the grave? Therefore, this kind of hadeeth is Do’eef.
(Sometimes) it is certain that he (the narrator) heard it from a person who lived with that person he ascribed it to, but he does not want to mention the person’s name because the person is a liar. Do you understand? That is why it will be regarded as Do’eef. That is why if one is well versed in Mustolah, people cannot deceive one with lies. Nowadays such thing is obvious. For example, if a person hears a statement from someone who heard it from another person who also heard from another person that the VC said ‘so and so’ and he reports it as, ‘the VC addressed us saying such and such’. How is this correct? This is what is referred to as Tadlees. The people who are in the chain are not mentioned and yet he says the VC said ‘such and such’. How come? Do you understand? If a person gives you this kind of report, ask him to tell you the time and give you other details. Do you understand? This is what is regarded as Tadlees. So if a person brings a statement without telling us who he heard it from, it will be regarded as Do’eef. Statements like that are neglected.
That is why the scholars have said if you apply the principles used in ahadeeth transmission upon the people who exist today, only (the statements of) few people will be regarded as important. For example, a person travels to Libya and comes back to Nigeira saying, “when I was with Shaykh Albaanee, we discussed ‘so and so’”. How possible is this? On what day (did the meeting take place)? He is saying it because he knows that he can easily deceive you. Another person says, ‘there was a day we were discussing with Shaykh Ibn Baaz’. When did you go to his residence? You know there are many people who deceive others with statements like this in Nigeria. A person may claim that he studied under the tutelage of Shaykh Ibn al-‘Uthaymeen. I hope you understand. This is what is regarded as Tadlees. Na’am. This is what is regarded as Hadeeth Do’eef. The discussions regarding ahadeeth Do’eef is the reason for the extensiveness of ‘Ilm al-Mustolah. This is because there are many categories of Do’eef. Na’am.
