If your religious beliefs forbid you from dressing in a particular way that members of a professional group dress, then it is first of all sinful for you to decide to belong to that profession in disregard to your religion and hope that they will change their standard of dressing to accommodate you. This is what we should be talking about, not about whether or not decision of Body of Benchers was right or wrong.

See your President's daughter last year when she was called to bar.

I have been to Turkey, a country that is 90% Muslim and and they hadly wear hijab. Are they going to hell by Naija Muslims standard.

O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments. That is more suitable that they will be known and not be abused. And ever is Allah Forgiving and Merciful.

That is Kenya, this is Nigeria. Until the rule is changed by the council of legal education, no hijab.

People can push for the rule to be changed but as it stands now, the woman is wrong.
That worry it has happened in US so shall it be in Nigeria.......

ON HIJAB, LAW SCHOOL & CALL TO BAR.

“Meanwhile sources at the ICC stated that before the ceremonies were to begin, all Muslims were respectfully asked to remove their hijabs prior to entering the hall. This request was complied with by all the Muslims present except Amasa Firdaus who vehemently refused to remove hers. In the process of her protests and despite entreaties made to her by other Muslims she was denied entry into the hall by the Body of Benchers. During the ceremony, a Respected former Chief Justice of Nigeria also met with Amasa Firdaus to convince her to remove her hijab but she did not heed the pleadings as she reiterated that even at gun point she would never remove her Hijab...” (Culled from a Nigerian Law Blog site)

Dear Amasa Firdaus, I want to address you. Please allow me share a brief story with you so that you may be inspired and remain resolute.

In 2015, my wife, a Soldier with the US Army, was told at the Army Annual Training at Fort Dix, New Jersey, United States that she either take off her Hijab or leave the Annual Training. My wife insisted that her Hijab is part of her and she will never remove it to please anyone or authority. Exactly like you reportedly insisted. Eventually, she was told to leave and she left the Annual Training. After the conclusion of the annual training, her Military unit said she cannot return....At another point, she was invited back to the drill and she went there with her Hijab on her head. Again, she was told she cannot use her Hijab and she had to leave and she left. Away from the limelight she fought this vehemently by escalating the issue to the top echelon of the command. We prepared a memo to the authorities explaining why she should be allowed to use her Hijab .

She was away for almost a year but eventually and in end, the Army Secretary under President Obama released a new regulation allowing the use of Hijab. It was a glorious moment. Her decision to remain undaunted paved the way for others who will come after her. Suddenly, the fight was worth it. All those period she had to cry became a thing of joy. We were elated that her resolve to remain undaunted finally paid off. Today, she proudly wears her Hijab on her uniform, attends her drill sessions and performs well. She’s a badass solider who’ll soon be commissioned as an officer and I’m so darn proud of her. Of course I also know you’ll make a fantastic addition to our profession. I have heard of your academic exploits and it is my belief that it will set you on your way to reach the top echelon of the profession.

That is my message to you today Firdaus. You have a made a huge sacrifice and I cannot begin to imagine how sad you feel that the profession you so much look forward to joining has asked you to choose between your faith and your call to bar. You must be so disappointed that Nigeria let you down. I bet you also feel that your Muslim colleagues who took off their Hijabs when ordered to do so should have stood firm and maybe when they realise that none of you is willing to break rank, they’d have allowed you all to use your Hijab. I get the feeling of sadness. But don’t be. You’re a hero.

You have once again reignited the conversation that has been on for years. You have brought our attention to the way the Nigerian Law School and Council of Legal Education who are empowered to train new lawyers show flagrant disregard to your rights under S. 38 of the constitution. Your courage and sacrifice remind me of that of my wife. Your call to bar may have been delayed but in the end, Justice will prevail and it won’t be denied. Please, cheer up! The road ahead will be tough but Allah will strengthen and ease that burden for you.

To your friends and family, this is the time to rally round one of your own and give her all the support she needs. Her decision to fight this injustice is not stupid. Heroes are not always in uniform.

To my lawyer colleagues, once again, we have been called to task. How do we explain it that the Nigerian Law School & Council of Legal Education who are empowered to train new lawyers will themselves refuse to obey the judgments of the Court? Does that not worry us? As a Lawyer, I’m extremely disappointed. Several courts including the Court of Appeal in the case of Lagos State v Aisha Abdulkareem held that the use of Hijab is a constitutional and fundamental right and no one can take it away. Also in Abidemi Rasaq & ors V. Commissioner for Health Lagos State suit no ID/424M/2004, the Lagos State High Court held that a circular issued by Lagos State School of Health Technology banning students from wearing Hijab is unconstitutional. Similarly in the case of Provost Kwara State College of Education, Ilorin V. Basirat Saliu suit no CA/IL/49/2009, the learned Justices of the Court of Appeal held that the use of Hijab by female Muslims qualifies as a fundamental right under Section 38 of the Constitution.

Despite all these decisions, the Nigerian Law School and by extension the Council of Legal Education continues to victimize Muslim Law Student who chose to cover their hair by threatening not to call them to Nigerian Bar. If the Nigerian Law School and the Council of Legal Education does not respect the decisions of a properly constituted Courts, including the Courts of Appeal, then what the hell are they teaching law students? Are we really going to debate this issue from our religious googles or be objective and err on the side of common sense and humanity?

To MULAN and other Muslim Senior Lawyers and Judges, I once read that the Elders have said that they needed just one person who’s willing to face the consequences and stand her ground to wear her Hijab and they will take it up. Now Amasa Firdaus has given herself up. Will you fail her?

To the members of National Assembly especially those representing the State and district Firdaus came from, are y’all going to fold your arms and let a Nigerian, a member of your constituency be punished unjustly for asserting her fundamental human rights as guaranteed under S.38 of the constitution?

The world is watching...
Let's test the constitution now

usmanktg2:
THE MAWLID-UN-NABI: Q & A

By: Shaykh Fakhruddin Owaisi al-Madani (South Africa)

Q1-What is the ruling (hukm) regarding celebrating the Mawlid-un-Nabi:

A1: Any action we do may be judged by the Shari ah as being of one of the following five categories:

-Fard (Obligatory)
-Mustahabb (Recommended)
-Mubah/Ja iz (Simply Permissible)
-Makruh (Discouraged)
-Haram (Forbidden)

Past and present Ulama from the four Madhabs (Hanafi, Shafi, Maliki and Hanbali) have considered the commemoration of the Prophet (SAW) birth as being Mubah, i.e. permissible, as there is no evidence in the Shari ah that prohibits such an event.

In fact, there is some evidence that actually supports the commemoration of the noble
birth. For example:

- Allah says in the Qur an:

Say in the Bounty of Allah and His Mercy, Let them rejoice . (Surah Yunus,
verse 58).

There is no greater bounty given to creation than the Holy Prophet (SAW).

- The Qur an narrates to us the stories of the births of Prophets Isa, Musa and Yahya (AS) in an honorable manner. As the greatest of the Prophets, the birth of Nabi Muhammad (SAW) is even more deserving of such attention.

- Imam al-Bukhari narrates that when the Prophet (SAW) was born, his uncle, the unbeliever Abu-Lahab freed the slave-girl Thuwaybah that brought him the good news, by gesturing to her with his finger. When Abu-Lahab passed away, his brother Sayyidna al-Abbas (RA) saw him in dream and asked him about his condition. He replied: I am in severe punishment, but my punishment is lessened every Monday as I am allowed to suck some water from that finger of mine with which I freed Thuwaybah .

- It is also narrated by Imam Muslim that the Prophet (SAW) used to fast on Mondays. When asked why, he (SAW) replied: That is the day I was born .

That is why many scholars have been very supportive of the Mawlid. For example, the great 9th Century Shafi i scholar Imam Jalaluddin al-Suyuti writes in his Al-Hawi lil Fatawi:

To commemorate the Mawlid, which is basically gathering people together, reciting parts of the Qu'ran, narrating stories about the Prophet's birth and the signs that accompanied it, then serving food, and afterwards, departing, is one of the good innovations; and the one who practices it gets rewarded, because it involves venerating the status of the Prophet and expressing joy at his honorable birth.

However, while commemorating the Mawlid cannot be considered Haram, it also must not be considered Fard. It must be understood that it is simply a beneficial practice that is nevertheless not obligatory.

Note, too, that while commemorating the Mawlid itself is only Mubah, many of the actions done in it are Mustahabb (Recommended) such as recitation of Salawat, coming together of Muslims, discussing the life of the Prophet (SAW), feeding the hungry etc.

People will undoubtedly be rewarded for these actions. Wa Llahu A lam.

Q2-Is commemorating the Mawlid un-Nabi a bid ah (an innovation)?

Bid ah refers to beliefs and practices that appeared after the era of the Holy Prophet (SAW). Broadly speaking, bidah s are acceptable or unacceptable depending upon whether or not they fall under the general principles and spirit of the Qur an and Sunnah.

Given this they will be classified according to the five Shari ah rulings mentioned above.

Therefore, some bidah s may be obligatory such as writing books on the din and the gathering of the Qur an and hadith into book form. Some may be recommended such as the translation of the Qur an, the congregational Tarawih prayer and the second adhan for Jumu ah. Some Bid ah s may simply permitted such as performing Eid Salah in Mosques, qira ah programs, Qur anic competitions and the commemoration of Mawlid as noted earlier. Depending upon the intention and results, such permitted bidah s may even become recommended.

Discouraged innovations would be to have the Holy Qur an on a cellphone, as some Ulama have said. Forbidden bidah s are any innovated beliefs and practices that are in clear violation of agreed upon principles and rulings of the Shari ah.

The hadith that states that every bidah is a misguidance refers to this last category of bid ah only as explained by hadith authority Imam al-Nawawi in his commentary on Sahih Muslim (Volume 6, p154):

What is meant by it is new matters that are not validated by the Shari ah. That - and that alone - is what are meant by innovations.

Q3-What is the ruling on standing up to recite Salawat (Salutations) and Salam (Greetings of Peace) upon the Prophet (SAW):

It is permissible if done with the intention of respecting the Prophet (SAW), and without the belief that it is obligatory. The Qur an has ordered us to present the Salam to the Prophet (SAW) in a respectful manner as implied in the verse Wa Sallimu Taslima i.e. And send worthy greetings of Peace upon him . (Qur an 33:56)

Furthermore, it is permissible in Islam to stand up to greet any honorable or beloved person. The Prophet (SAW) used to stand up to greet many people, including his beloved daughter Sayyidah Fatimah Zahra (RA).

Imam al-Bukhari narrates that once the Prophet (SAW) was sitting in the Mosque and saw a funeral passing by. So he immediately stood up in respect of it. He was then told that it was actually the funeral of a Jew. So he (SAW) replied; It is still a soul.

The Ulama have also deemed it permissible to stand up for a national anthem. It has for centuries been the custom in many Muslim lands to stand up when reciting the Salawat and Salam on the Prophet (SAW), especially upon hearing the news of his Birth, so as to display love, gratefulness and respect. This practice has been commended by Ulama from all 4 Madhhabs.

The Mufti of the Shafi i madhab of Medina al-Imam al-Sayyid Ja far al-Barzanji wrote in his Mawlid that:

Scholars of great character and knowledge have commended the practice of standing up at the mention of the Prophet (SAW) s birth. So glad-tiding to the one whose goal and purpose is to honor the Prophet (SAW).

This was written by him in Medina four centuries ago, and he referred to scholars before his time.

The Salawat can be recited in all positions: sitting as in the Jalsah (sitting position) in Salah, or standing as in the Salat-ul-Janazah or even while lying down.

Furthermore, it is general command of the Shariah to display all sorts of love, honor and veneration to the Prophet (SAW) [Qur an 7:157; 33:6 amongst others], as long as it does not involve any prohibited action. Wa Llahu A lam.

Q4-Is it possible for the Prophet (SAW) to be present at a Mawlid gathering?

The blessed body of the Prophet (SAW) is buried in Medina. But his Soul, like the souls of all Prophets and pious believers, is free to roam in the Kingdom of Allah to attend blessed gatherings. Evidence for this is what occurred on the Night of the Mi raj when all the Prophets gathered in al-Quds to meet and pray behind our Prophet (SAW). Many of them met him again in the Heavens.

Ibn al-Qayyim mentions in his Kitab al-Ruh that the famous Companion Sayyidna Salman al-Farisi (RA) said:

The souls of the believers are in a partition from the (visible) earth, they go anywhere they want to.

He also quotes the great Imam Malik as saying:

I was informed that the soul is free; it goes anywhere it wants to.

The above has also been confirmed by great Classical scholars such as Imam al-Suyuti and Imam Ibn-Hajar al-Haytami in their Fatawa.

However, a person who experiences the spiritual presence of the Prophet (SAW) at any gathering should normally keep such things to him or herself. In general, this is a matter of the unseen and it is best to not to delve into the issue unnecessarily.

Q5-What are the Riwayats popularly recited in Cape Town?

The Riwayats are basically narrations on the happenings of the noble Birth of the Prophet (SAW), compiled in a book from by the 16th century Mufti of the Shafi i madhab in Medina al-Imam al-Sayyid Ja far al-Barzanji. Whatever is mentioned in them is authentically sourced from the books of Hadith and Sirah (biographies of the Prophet). Its a blessing to recite them as it is a blessing to recite any hadith of the Prophet (SAW).

Muslim throughout the world recite these Riwayat during the blessed month of Mawlud. They are usually referred to in other parts of the world as Mawlid al-Barzanji.

Shaykh Fakhruddin Owaisi al-Madani is a Lecturer in Hadith at IPSA.
Sh. Fakhruddin completed a Master s dissertation on the issue of Mawlid and Bid ah at the University of Cape Town.

IslamRe: Prohibition On Married Couple Forming A Relationship With Someone Else In Islam by yusufbida(m): 3:29pm On Jun 17, 2016
balash:
What is the ruling concerning married muslim men who cheat on thier wives(physically or non physically) and what is the ruling concerning muslim women who knowingly have an affair with married men just for fun?

Praise be to Allaah.
Firstly:

For a man to form an illicit relationship with a non-mahram woman is not just cheating on his wife, it is also a sin and an act of disobedience towards his Lord. Allaah has forbidden such relationships and has barred the ways that may lead to the greater form of immorality which is zina (unlawful sexual relationships), which is what is referred to in the question.

The forbidden acts which people commit when they have such relationships are many and include being alone with that person (khulwah), shaking hands with them, looking at them, etc. These are sins which are forbidden in the texts in and of themselves, and because of the sin of zina to which they may lead.

Secondly:

For a Muslim woman to form an illicit relationship with a man who is not her mahram – whether he is married or not – is also a major sin and is worse than what is mentioned in the first part of the question, because it results in mixing of lineages and it makes the husband doubt whether his children are really his or not, which leads to a great deal of mischief.

There follow the fatwas of some of the scholars concerning something that is less serious than meetings between the sexes, so what about things that are more serious?

1 – Shaykh Ibn ‘Uthaymeen said:

It is not permissible for any person to correspond with a woman who is not his mahram, because of the fitnah (temptation) involved in that.  The person who is sending these letters may think that there is no fitnah involved, but the Shaytaan will keep at him until he tempts the man by means of the woman and vice versa.

The Prophet (peace and blessings of Allaah be upon him) commanded those who hear the Dajjaal to keep away from him, and he said that a man may come to him as a believer, but the Dajjaal will keep at him until he tempts him and leads him astray.

There is a great deal of temptation and danger in correspondence between young men and young women, so they must keep away from it, even  though the questioner may say that there is no love involved.

Fataawa al-Mar’ah al-Muslimah, 2/578

2 – Shaykh ‘Abd-Allaah al-Jibreen said, when he was asked about corresponding with a non-mahram woman:

This action is not permissible, because it will provoke desire between them and will make them want to meet one another. This kind of correspondence often causes fitnah (temptation) and plants the seeds of zina in the heart, which leads to evil actions. So we advise those who are seeking that which is in their own best interests and who wish to protect themselves to avoid writing to or speaking with non-mahrams, etc., so as to protect their religious commitment and their honour, and Allaah is the Source of help.

Fataawa al-Mar’ah al-Muslimah, 2/578, 579

 And Allaah knows best.
May Allah forgive us all we are bound to this act.

ChangeIsCostant:
In a bid to secure her territory (literally), this woman hung on her boyfriend's balcony for hours after being notified that her lover reportedly slept with another woman in his house. The boyfriend locked himself up refused to open despite her screaming and shouting. She had to climb the balcony to see for herself and also wait for him till he comes out. This happened in Bonateki area in Douala, Cameroon.
