No fewer than 500 members of the All Progressives Congress in Ughelli South Council have defected to the Peoples Democratic Party.

The defecting members were led by a former House of Assembly aspirant of the party, Olorogun Samson Okomitie.


He said there was no future for the APC in the state.

Speaking during the defection in Ekakpamre community on Saturday, Okomotie said they had decided to dump the ruling party at the centre following the lingering leadership crisis rocking the state and council leadership of the party.

According to Okomitie, “We have decided to leave the All Progressive Congress because of the lingering leadership tussle rocking the party from wards, local government and state level without any attempt by the party hierarchy to settle the crises.

“For some of us, it has become evident that there is no party like PDP in Delta and it was also obvious that APC has a lot to do to compete with PDP in Delta considering extent the party had gone in the state with massive development.”


He added that the development stride of the state governor, Dr Ifeanyi Okowa and the internal democracy within the state chapter of the PDP convinced him and his supporters to join the ruling party from the opposition APC.

Okomotie as the new decampees were received by Ughelli South PDP Chairman, Mr Djegbe Oshetigho and other party leaders from the area.

The Federal Government has argued that the acquittal
granted Senate President, Bukola Saraki, in his trial for false
assets declaration before the Code of Conduct Tribunal (CCT)
cannot stand because the tribunal erred in law in reaching
its decision.
The FG therefore, urged the Court of Appeal in Abuja to
remedy the error committed by the CCT headed by Danladi
Umar, by reversing its decision and ordering the
continuation of the trial.
The FG’s position is contained in a brief of argument filed
yesterday at the Court of Appeal, Abuja, for the office of the
Attorney General of the Federation by a team of lawyers led
by Rotimi Jacobs (SAN).
The CCT, in its judgment on June 14, 2017, upheld the no-
case submission by Saraki, and acquitted him of the 13
counts of false assets declaration brought against him by the
state.



In the FG’s brief of argument sighted by The Nation shortly
after it was filed yesterday, the FG argued in detail, the 11
grounds contained in the notice of appeal it filed earlier this
year.
The FG described the CCT judgment as “unconstitutional and
without jurisdiction.” It added that the CCT erred in law by
upholding Saraki’s no-case submission “when the onus of
proof” was on him to show “that there was no infraction in
the Code of Conduct Forms.
“By the provisions of paragraphs 11 (2), (3) and (13) of Part
1, 5th Schedule to the Constitution of the Federal Republic of
Nigeria, 1999 (as amended), once the Code of Conduct form
filled by the public officer is investigated and found to be
false or that some assets are beyond the legitimate income
of the public officer or that the assets were acquired by
means of corrupt practices, the public officer concerned is
deemed to have breached the Code of Conduct and it is for
him to show to the tribunal that there is no infraction in the
form.
“The honourable tribunal wrongly placed the onus of proof
on the prosecution contrary to paragraphs 11 (2), (3) and
(13) of Part 1, 5th Schedule to the Constitution of the Federal
Republic of Nigeria, 1999 (as amended).



“The Constitution of the Federal Republic of Nigeria, 1999 (as
amended) clearly excluded the presumption of innocence
on the allegation of infraction of the Code of Conduct by
public officers and the Tribunal wrongly applied the
presumption of innocence contrary to the constitutional
requirement. The tribunal’s decision is unconstitutional and
without jurisdiction.
The tribunal’s decision is against its earlier ruling delivered
on March 24, 2016 and the decision of the Court of Appeal in
Appeal No: CA/A/172C/2016 where it was decided that the
defendant need not to be invited. The tribunal wrongly
overruled the decisions of the Court of Appeal and itself,” it
said.



The FG argued that the CCT erred when it described the
testimony of a prosecution witness as hearsay.
It said: “PWIII is an investigator with the Code of Conduct
Bureau who gave evidence of the role he played, what he
saw and the outcome of his investigation.
“The Tribunal failed to consider paragraphs 11 (2), (3) and
(13) of Part 1, 5th Schedule to the Constitution of the Federal
Republic of Nigeria, 1999 (as amended) which imposed the
onus of proof on the respondent to justify his declaration.
The evidence of PWIII is not hearsay evidence.”
The FG also faulted the decision of the co-member of the
CCT, William Agwaza, who held that the joint investigative
team, comprising operatives of the EFCC, the Department of
State Services and the CCB was unknown to law.
It said:”The respondent, by his own application dated 1st
March, 2016, had raised the same issue that it is only the
Code of Conduct Bureau that could investigate him and that
the power of investigation cannot be delegated to the EFCC
or any other body or agency.
“The tribunal, by its ruling delivered on 24th March, 2016,
ruled and dismissed the application of the respondent and
he appealed to the Court of Appeal in Appeal No: CA/
A/172C/2016.
“The Court of Appeal in the judgment delivered 27th
October, 2016, by Aboki, PJCA, dismissed the appeal and
held that “there is nothing in any law preventing the Code of
Conduct Bureau, an agent of the FG, from collaborating or
acting in concert with any other organs of the FG, which are
also engaged in investigations and prosecution of criminal
matters in order to achieve its mandate under the
constitution and the law.



By the ruling of Hon. Agwadza, he has unwittingly sat on
appeal and overruled the earlier decision of the Tribunal
and the decision of the Court of Appeal. The decision of Hon.
Agwadza borders on judicial rascality and impertinence.”
The FG equally faulted the CCT pronouncement that the
prosecution did not tender the original asset declaration
forms of the respondent and his statement when they were
available.
It said: “Exhibits 1 to 6, 26 and 45 qualify as public
documents under Section 102 of the Evidence Act, 2011, and
there is no law that makes only the original of public
documents admissible in law.
“The Tribunal failed to consider the provisions of Sections
102, 104, 105 and 146 of the Evidence Act, 2011 to the effect
that a certified true copy of a public document or part
thereof may be produced in proof of the contents of the
public document or a part thereof.
“The Tribunal effectively overruled the decisions of the
Supreme Court in Odubeko v. Fowler (1993) 7 NWLR (Pt. 308)
637 and the Court of Appeal in Tumo v. Muwana (2000) 12
NWLR (Pt. 681) 370 that courts must presume certified true
copies of public document as genuine and act on it unless
there is a contrary evidence.
“The Tribunal completely closed its eyes to the fact that the
prosecution produced the original of the assets declaration
forms before the Tribunal and requested the Tribunal and
the defendant to compare the original with the certified true
copies without any objection from the defendant.
“The Code of Conduct Tribunal erred in law in upholding the
no-case submission raised by the respondent at the close of
prosecution’s case and in discharging the respondent.
“By the authorities cited, the prosecution only has a duty to
show that there are some infractions of the Code of Conduct
prescribed for public officers under the Constitution and the
prosecution had established those infractions through his
witnesses.”

A former youth leader of the People’s Democratic Party in Ward 3, Calabar South local government area of Cross River State, Mr. Augustine Sunday Bassey, popularly referred to as ‘Kufre’ who was arrested on July 10, 2017, for raping an 11-year-old girl around the Lagos Street axis of Calabar South Local Government Area has been recently released from police detention under very suspicious circumstances.

Mr Bassey who was detained at the State Criminal Investigation Department, Calabar, was alleged to have raped the child in his shop under the pretence of running an errand for him.

While sharing the horrible experience with a correspondent or Cross River Watch at the office of Basic Rights Counsel Initiative (BRCI) a Calabar-based child protection NGO, the victim (name withheld) recounted how the suspect, who is their neighbour had sent her to buy fermented cassava (popularly known as Fufu).

“When I got back and gave him the Fufu, he insisted I drop it inside the shop. When I dropped it and wanted to come out, he pushed me inside the shop covered my mouth and threatened to beat me if I don’t keep quiet.”Augustine then went on to forcefully remove her pants and raped her.

For fear of what her mother might do to her, the victim confided in her cousin who then disclosed the matter to her mother who went ahead to report the matter to the Police Special Anti-Robbery Squad (SARS).

BRCI immediately stepped into the matter and asked the police to charge the matter to court soon after facilitating medical treatment for the child and obtaining a medical report.

However, information filtering in has it that the family of the victim has been under pressure to drop the case with the promise of receiving compensation from the family of the suspect.

The Program Manager of Basic Rights Counsel Initiative, Theresa Okpa who spoke with our correspondent said that the father of the victim, Peter Udo had visited their office in the company of the victim’s mother and another relative, appealing to them to drop the matter as they were no longer interested in charging it to court, but will rather settle amicably with the suspect and his family who had offered NGN300,000 in return for dropping the charge.


All efforts to counsel the victim’s parents on the need to press for justice for their child and other alleged victims proved to be abortive as the family insisted on settling out of court and receiving the said amount.

“If this is allowed to fly, then we have a disaster on our hands, as perpetrators of rape against our children will continue to walk free, and that means our children are not safe”, BRCI’s Program Manager decried.

The All Progressives Congress, APC, in Delta State has
served a quit notice on Governor Ifeanyi Okowa and the
Peoples Democratic Party, PDP, in the state ahead of the
2019 governorship election in the state.
The 2015 governorship candidate of the APC in Delta State,
Olorogun O’Tega Emerhor, told newsmen on Tuesday that
the APC will take over governance of the state in 2019.
The party chieftain noted that Deltans were tired of the PDP
and Governor Okowa’s alleged bad governance.
While decrying the poor state of infrastructure in the state,
the APC chieftain said there were no good roads in the
state, including Asaba, the state capital.



He said, “We served them notice long ago. Look at the
roads in Asaba, this is the capital of Delta State, do you see
any sign of development here? Good government is coming
with us.
“We struggled to pass the Okpanam/Asaba Road to get to
Okpanam town. This is within Asaba. Why should we have a
road like that? Delta State receives resources that should be
used to develop this state. Good government is coming
with us.”
On the state of the APC in Delta, Emerhor said that the
party was strong and intact.

Two suspects who specialized in kidnapping students of the Federal University of Technology, Minna, Niger state been arrested by officers of the State Police Command. The suspects are 30-year-old Abraham Jatto from Edo State and 29-year-old Idowu Mafe from Ogun State. Speaking to journalists when they were paraded at the Force Headquarters in Minna, Mafe, who claimed to be a graduate of the University of Ilorin, expressed regrets over his involvement in crime. He said, “When the issue of getting a job in Dubai came up, my parents could not afford the N750,000 being demanded and Abraham suggested kidnapping which led us into this predicament. “I have dragged my good family name in the mud; I pray my parents forgive me.”


Similarly, Jatto admitted that he decided to go into kidnapping to raise money for a trip to Dubai to secure a job. He explained that he rented a two-bedroomed apartment at the back of the Niger State Trade Fair complex where he kept his victims. “I was a successful businessman who never depended on people for assistance; I only dreamed of going to Dubai. “In fact, I cannot explain how I started kidnapping people,” Jatto said. Meanwhile, the Niger State police spokesman, Bala Elkana, said the suspects have been on the police wanted list for some time before they were eventually apprehended.


He said the suspects, who were said to have successfully abducted three students, had been terrorising the neighbourhood for some time, adding that were arrested at their hideout in the Sauka Kahuta area of Minna by the command’s Special Anti-kidnapping Squad. The police spokesman confirmed that a Honda Accord car with an Abuja registration number, ABJ 583 AE, was recovered from the suspects, adding that investigation was ongoing. He said they were still on the trail of two other members of the gang, who were in the habit of dispossessing residents of their valuables such as laptops, handsets, jewelry and money, besides collecting huge ransoms. One of the victims, Esther Okwe, 24, a 500-level student of Estate Management, FUT, reportedly paid N500,000 to regain her freedom from the abductors. The ransom, it was gathered, was paid by her parents. Other kidnap victims were identified as Agbo Sylvanus, 24, of the Department of Mathematics and Peter Adown, 21, of the Department of Microbiology of the same institution

A man identified as Ogbonnaya Igwe has been arrested by men of the Abia state Police Command for allegedly shooting his lover, Ijeoma Chibuzor, with a double barrel gun over unwanted pregnancy.

While been paraded in Umuahia by the state Police Commissioner, Leye Oyebade, the suspect made an effort to deny the crime.


He said: “Yes. I know the late woman Ijeoma Chibuzor, we were friends and have been having extra marital affair.

“I must confess that the deceased made my life miserable with her continuous extortion and insatiable demand for money when she alleged that the romance has resulted in pregnancy.

“Initially I gave her the sum of N15,000 (fifteen thousand naira), to terminate the pregnancy, but she came back later to demand another N1million(one million naira) saying that there were complications during the process of abortion resulting in excessive bleeding.


“I had to sell my house in Aba to raise the money, but this woman kept coming for more money.

“I cannot explain what happened, I tried to scare her away with the double barrel gun, I did not shoot her. “

But, the Police boss explained that the policemen from Ndiegoro Division rushed to the scene of the incident at 22 Obohia Road Aba when they received information that a woman was shot dead.


On arrival, they met the deceased in the pool of her own blood, the suspect Igwe tried to evade arrest by hiding in the ceiling of his house.

“I want to say that it took the relentless effort of policemen to drag him out of the ceiling to the police station.

“And I want you to know that the double barrel gun with 15 live cartridges has four expended cartridges,” CP Oyenade said.

He further said that the command has embarked on proactive measures to rid the state of all types of crimes and ensure that perpetrators are apprehended.

“The command would not rest on its oars to ensure safety of lives and citizens,” Oyenade added.
