i dint see the case u cited tho.but truth is no right is absolute.for instance,right to freedom of association is expressly enshrined in the constitution but to belong to a 'secret cult' is illegal in our laws.if every right was absolute,u cld as well publicly marry as as gays(u risk 14 yrs),walk naked or even smoke weed openly on the streets.

In the constitution, where a right is given, the limitations to that right are also provided. For example, where the right to freedom of association is given, the limitation with regards to secret societies, etc are also spelled out. Ditto for freedom of movement and prison sentences.

Also restrained over the said act are the Lagos State Commissioner for Health, Attorney General of the State, and Director Lagos State School of Health Technology, Dr. E.K.O. John.

Four female students of the school, Fatimo Abidemi Razak, Titilayo Sanni, Idiatu Asabi Ayinde, and Sunbo Bada, dragged the school and other restrained personnel to court …

Nigerian Muslims hailed a court ruling against a decision by the Lagos state government banning hijab in state schools under claims of inciting sectarian division in the country.

The verdict deals a serious blow to continued attempts to ban hijab in Nigeria, especially in southern areas, Abdul Wahab Baba Nafae, a Muslim activist, told IslamOnline.net Saturday, November 20.

“Some fanatic Christians have been resorting to such attempts [to ban hijab] after failing to contain the growing Islamic tide in Nigeria,” he said.

“They should abandon their provocative schemes and respect the rule of law. We are only exercising our constitutional rights."

The activist recalled that similar legal actions has been taken in several Nigerian states to ban hijab in public schools.

Baseless Claim

[b]The Lagos High Court ruled on Thursday, November 18, that no party or person can force Muslim girls to take off their hijab which, it maintained, is part and parcel of personal freedoms.

In October, the Lagos National Institute of Health and Technology banned Muslim students from entering classrooms, a decision backed by the state government.

Students Fatimo Abidemi Razak, Titilayo Sanni, Idiatu Asabi Ayinde and Sunbo Bada challenged the decision with the high court, asking that the ban be declared illegal and a breach of their rights.

Judge Olubunmi Oyewole of the High Court ruled that the ban was a breach of articles 38 and 42 of the Nigerian constitution.

He further said the institution failed to prove how hijab could spark a religious conflict.

The judge underscored that the institute, a public school funded by tax payers and owned by the Lagos state government, cannot operate outside the provisions of Constitution.

Refuting arguments that the students ought to abide by the institute’s regulations expressed in their admission letters, Oyewole said they did not waive their rights to their religious beliefs and practice merely because they accepted the admission letters.[/b]

According to official statistics, 55% of Nigerians are Muslims while 40% are Christians.

However, other estimates indicated that Muslims make up some 65 percent of the country’s 133 million population.

Twelve of Nigeria’s 36 states have gradually applied the provisions of Shari'ah since the return of democracy to the country in 1999, despite the fierce opposition from the federal government.

Hijab

Islam sees hijab as an obligatory code of dress, not a religious symbol displaying one’s affiliations.

The issue of wearing hijab caught world attention after France adopted a controversial law banning hijab in public schools, which came into effect in September.

The decision, branded as “discriminatory” by the Human Rights Watch (HRW), left many Muslim school girls tormented between religious obligation and education needs.

In October, Cennet Doganay, 15, took off her hijab as she was entering the Louis Pasteur Lycee high school in Strasbourg, eastern France, only to reveal a bald head.

Not necessarily.i.e the limitations.theres probaly no law barring wearing of hijabs in schools.if there was then they dont have a case.

Some relevant sections of the constitution (I have explained these earlier)

10. The Government of the Federation or of a State shall not adopt any religion as State Religion.


38. (1) Every person shall be entitled to freedom of thought, conscience and religion, including freedom to change his religion or belief, and freedom (either alone or in community with others, and in public or in private) to manifest and propagate his religion or belief in worship, teaching, practice and observance.

(2) No person attending any place of education shall be required to receive religious instruction or to take part in or attend any religious ceremony or observance if such instruction ceremony or observance relates to a religion other than his own, or religion not approved by his parent or guardian.

(3) No religious community or denomination shall be prevented from providing religious instruction for pupils of that community or denomination in any place of education maintained wholly by that community or denomination.

(4) Nothing in this section shall entitle any person to form, take part in the activity or be a member of a secret society.


42. (1) A citizen of Nigeria of a particular community, ethnic group, place of origin, sex, religion or political opinion shall not, by reason only that he is such a person:-

(a) be subjected either expressly by, or in the practical application of, any law in force in Nigeria or any executive or administrative action of the government, to disabilities or restrictions to which citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions are not made subject; or

(b) be accorded either expressly by, or in the practical application of, any law in force in Nigeria or any such executive or administrative action, any privilege or advantage that is not accorded to citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions.

(2) No citizen of Nigeria shall be subjected to any disability or deprivation merely by reason of the circumstances of his birth.

(3) Nothing in subsection (1) of this section shall invalidate any law by reason only that the law imposes restrictions with respect to the appointment of any person to any office under the State or as a member of the armed forces of the Federation or member of the Nigeria Police Forces or to an office in the service of a body, corporate established directly by any law in force in Nigeria.

how wld it look like if every student decides to put on a symbol of his/her religion to school its a school for God's sakes.theres a dress code for evry school.in secondary schools,they are suppossed to put on UNIFORMS..

Well the fact that we have to face is that this is what the law says. And laws are needed to regulate conduct in society. If we all did whatever we wanted without recourse to the law, then there would be chaos.

The procedure is that, if you don't like what the law says, then you can challenge it in court or petition your representatives in the national assembly. (It's not about what we feel, it's about what the law says). Disobedience of the law has its consequences.

Section 10 of the constitution of Nigeria 1999 prevents the government from declaring a state religion. But it doesn't make Nigeria a secular state (that notion is gotten from the american constitution).

As the supreme court justice said, "Nigeria is a multi-religious state, not a secular state".

2) Section 38 (fundamental rights) gives citizens the right "to manifest and propagate his religion or belief in worship, teaching, practice and observance." The girls are manifestly observing their religion by wearing the hijab.

3) Section 42 prevents discrimination on the grounds of sex, religion, etc. You cannot allow some people to observe their religious injunctions and prevent others (subject to natural justice of course).

Although all we are doing is academic because Justice Joseph Olubunmi Oyewole has ruled and that's the law today.

Some posters on this thread are HIGHLY unintelligent, while some others are malicious.

A guy took the pain to post the Nigerian constitution and several court judgments(interpretations) in favor of the muslimah's right to an Hijab, yet okija juju and the rest still wouldn't listen.

The Hijab is not an express symbol of purity just as being a catholic priest/pastor is not an express symbol of celibacy/sainthood. Intelligent folks understand all these.

I am not shocked by most of the comments here though, because I am aware the average NL christian is a bigot and is intolerant. We know their exploits here. Moreover, this thread is a perfect example.

Some of you folks are worse than boko haram. You just need blood hungry leaders like the bh boys have to lead you, since your cowardice will not allow you to express these ungodly sentiments you write here in real life.
In plain terms: The Hijab is a constitutional right of a muslim girl and there is ABSOLUTELY nothing you all can do about that! Except to write a new constitution grin

This has nothing to do with intolerance. That constitutional provision is subject to interpretation. I just quoted the exact provision upon which the ruling was given, can you point out where it says a hijab can be worn to class in a public school?!

I am here for a constructive debate not some random hogwash sentimental bullshit.
