Justice Moore Adumen of the Court of Appeal this morning upheld the trial of Senate President, Bukola Saraki at the Code of Conduct Tribunal.
Adumen, reading the unanimous verdict of the three man panel, said the tribunal, which docked the Senate President on 22 September and 21 October was properly constituted.
He said the tribunal led by Danladi Umar could sit with the chairman and one other member.
He relied on section 28 of the Interpretation Act to reach the decision.
He said the CCT and CCB Act and the constitution did not talk about a quorum.
Adumen said the judgment could not be delivered on 19 October as earlier planned because the justices have to struggle to reach a consensus.
Saraki wanted the appellate court stop his trial at the CCT, where he has been charged on 13-counts with false asset declaration.
Judgment was initially fixed for 19 October, but was postponed at the 11th hour, with the court promising to communicate a new date to parties.
Notices were sent to parties informing them about today’s date.
Arguing the appeal on October 16, Saraki’s lawyer, Joseph Daudu (SAN), urged the appellate court to set aside the entire proceedings before the CCT, including the charge before it.
He argued that the CCT was not properly constituted on when it assumed jurisdiction to entertain the charges because it was made up of two members as against three, which is provided for in Paragraph 15(1) of the Fifth Schedule to the Constitution.
Daudu contended that the provision of Section 28 of the Interpretation Act relied upon by the respondents to argue that the tribunal could validly sit with its Chairman and one other member, was a contradiction of the three-member provision in the Constitution.
He also argued that the tribunal not being a superior court recognised by the Constitution could not exercise criminal jurisdiction.

Nigerians should all remember Saraki in their prayers. He needs prayer of intercession at this point.

Saraki went tru a difficult situation ysday to confirm Amaechi against all odds. I saw it in his eyes, he was stammering. I felt for him. To me, he was only paying for his misdeed. But then, nobody will outrightly fault his ambition.

We might be controlled by our emotions and feel that he should be forgiven(my feelings too), but Politicians don't play it that way. Even he(Saraki) could become unpredictable after everything.

But in all these, I think he will be pardoned and freed with a rope still on his neck.

I said to myself earlier. If the court of appeal rules in favor of Saraki, I ld lose all hope in this administration.

Saraki must have been dancing to his party's tune in expectation of a real big favor in return. I am sure he wasn't expecting this.

How Relieved I am to read this...because the Wailers and the town criers would have used this particular case to shout themselves hoarse on how Buhari traded off Amaechi for Saraki's corruption case.

There would have been thousands of threads on politics section on how Buhari's anti-corruption war was just smoke screen, with the moderators helping by making sure there were on the Front page. grin


Femi Aribisiala and Fani Kayode would have written acidic articles to ridicule Buhari.

Akpabio, Deziani etal would have 'seen' a ray of hope....

Contrary to what people have been thinking, APC, nay the presidency has a hand in Saraki's trial. Some departments just want to be seen to be doing their job including EFCC.

All of you that spewed nonsense against PDP senators in the former thread while applauding Saraki for confirming corrupt Amaechi and insulting Uguru.
This is when you will know how your Apc can use and dump one of their own.
We shall know who will laugh last, between APC and PDP Senators.

Again, when events which are obviously no co incidents unfold like this: Appeal Court having to adjourn hearing on the CCT against the Senate President only after he has confirmed the nominees of Mr President and other make-believe coincidental body 'ordours' of the present administration, it calls for real thoughtfulness.
Can they deny manipulating the Judiciary again?
Could the Chief Judge of the nation keep mute, forthwith, an stop crying wolf over Nigerians criticism of the judiciary?
Back to the APC administration and her ignorant council of followers, if this interference / dictatorship continues, even the the present economic realities bedevelling the nation, what future do they think Nigeria has.

Let's get something straight, did Apc actually cease power to destroy our democracy, Nigeria and her people?

Yet folks are all over here expressing blind applause, commendation and excitement.
They seem to be happy that the executive Arm of the APC administration has the judiciary in its pockets, an are now reaching out to the Legislature to turn it to a complete rubber-stamp.

Don't use anti-corruption mantra on Nigerians any longer, five months gone, we have seen that your anti-graft war is targeted at opposite and only members of APC that the party has displeasure with.

You might have been in a hurry to chant 'change' and 'sai baba', because you were blind-folded.
Don't also be in a hurry to chant hurrah on seeing this. It is too early to jubilate. Today it might be Saraki, PDP and other energy of Government's turn, tomorrow it might be yours, your kith or kin.
You never can tell which loyal and subservient, and as such favoured APC member will dare to contradict the party's 'right' or 'wrong' doing tomorrow and because of that, will be hounded down.

bro, the "the more you look, the less you see" nature of Nigeria politics is why no one can tell who is behind this..But one thing is for sure, if Mr president and some other powerful ones in the APC were interested in helping Saraki, he just 'might' have had his way(thank God baba doesn't have interest in controlling the judiciary). Saraki must have been dancing to his party's tune in expectation of a big favor in return.
