Advice 2 d man fix deposit 43 million tru ur brothers account and then use 2million to run some business. Or u should fix deposit 44million and then go inside a timid village where not even glo nor airtel network exist and hide for 3 to 4yrs while enjoyn ur 1million, then u can come out to withdraw the accumulated interest and d main money, return theirs and keep urs chikina |

iamauxin:A bank is a financial institution/organization where utmost care and attention must be given even to the smallest transaction. Hence there are no rooms for errors and incompetence. One who works in a bank must possess an eagle eye for every transaction. Any error that is traceable could be reversed with the permission of the operation head or in cases where it is not traceable, such person will be asked to cover for his/her errors. In this man's case, the error was traced to his acc and I strongly believe that they must ve contacted the man or at least tried with no avail . The simplest thing they should ve done is to follow the man up and ask for the money back peacefully. Now, what if the error wasn't traced to his acc? Would they ve gone ahead to state their errors and incompetence online? Let me summarize by sharing with u a brief story of what happened in my branch. An ET ( executive trainee) who is yet to be confirmed a staff overpaid a certain man from witchtech industry who came to cash a cheque addressed to him for a certain job. The money overpaid to him was 500k. The witchtech guy on reaching his company discovered that the money was in excess, he called the man who gave him d cheque and told him that the money he wrote was in excess. The man quickly drove by and requested for the 500k. Not quite long, d same banker who carried out d transaction came to d office of d witchtech guy and started pleading for his money back. Without wasting time, the wichtech guy quickly called the man who claimed the money to return it. The man said that he is already in Maiduguri instead of Enugu where the whole thing happened. He wired 300k via internet banking and refuse to release the other. The man stated it categorically that nobody should disturb him any further since he has done no wrong. The money was peacefully given to him without any force as no one could prove any forceful collection. The ET guy had to make up for d rest. The big question is. "Why couldn't they arrest or report the man if they are so right?" Same goes to this man in question here. He didn't steal or con anybody so why defaming him . Theyveedo: I don't think the CBN and EFCC are telling the truth about this money. How can a GENERATION BANK ACCOUNT now turns into an individual account? It seems CBN was transferring the money to personal account that is the only way it can be mistakenly credited. 1 Like 1 Share |

First it shows inefficiencies on the part of CBN and secondly the account owner should not have withdrew the money afterall he does not have such in his account nor did he transact a business of such. I have personally had this experience in a different way. I drove to my bank to make a withdrawal of 350k at the counter, while am left with 50k in my account. An hour later i decided to make another withdrawal using my ATM card having at the back of my mind that i have 50k left, so i never counted how much i had withdrew so far until it occur to me that i have taken out extra 30k, then i wondered and insert again to know what the problem was and withdrew 40k and the system paid again then i was afraid and checked my balance only to discovered that i was never debited after payment at the counter. few minutes later a call came him from the cashier requesting my presence at the same bank in a nervous tone, so i decided to drive back and see what the problem was, on meeting with the cashier, he was panting seriously and i have to calm him down to explain what happen then he said after he paid me he forgot to debit and now what i have left is not enough for him to debit me any longer so i have to make returns fo the excess withdrawal. |

Let us reverse the situation If this happended between two commoners will EFCC call it stealing? We would not say the man was a thief because the money was in his account, but he should have inquired for the real owner for morality sake. He could not have withdrawn all the money at once, could he; in today banking system in nigeria? May God help us. |

This is called OVER CREDITING A CUSTOMER'S ACCOUNT in law terms.. as a practitioner, Nobody can fully claims to infallibility. mistakes do occur and over crediting a customer's account cannot be ruled out. the problem is not with over crediting an account but recovering the over credit. if a genuine mistake is made in passing wrong credit to a customer's account and he refused to give his consent to get it reversed, the bank can go to court to seek its permission to reverse the entry. in the case of UNITED OVERSEAS BANK V. JIWANI (1976) it was held that in order to claim amount wrongly credited to his account a customer must show that 1. the bank had misrepresented the state of account to him. 2. he had been thereby misled as a result by the misrepresentation. 3. as a result he had altered his position in such a way that in equity he SHOULD NOT HAVE TO REPAY. I rest my case!!! |

However, looking at the story or news, as the case may be, is it possible to withdraw #45million at once without drawing attention to self? How many times can one successfully withdraw such a huge amount before it can be noticed? How long did it take CBN to discover that the money was 'mistakenly' paid into his account and he has withdrawn it? There are so many questions to ask...not to talk of BVN security that is now in vogue. Truth is, something is fishy. I don't know what the rules are in Nigeria. Something similar happened to me. I left a job for a new company and the old company i worked for did not update their payroll and paid me for another extra month. When they realized their mistake, which i didn't notice, they withdrew the last withdrawal from my account!!!! I got pissed off only for the fact that my bank would allow an unauthorized withdrawal from my account and i filed a complaint with the bank along those lines! The bank credited my account sharp sharp!!! |
