Gowon, as the Head of State, had power to create states, which he did. It's not only the defunct Eastern Region that was split. Western Region was split into two. Northern Region was split into six.

In Eastern Region, where Rivers and South Eastern states were carved out from, the action could be argued as allaying the fears of the minority.
