after five years, I wanna know what the families act would be like.

we have problems in this country that will continue to hinder our progress as a nation. A man does a crime , he does the time but in Nigeria a man steals and his kin protests when he is convicted (Ibori) a woman kills a man and instead her professional body ary whipping up sentiments. Why do we have laws if when it comes to application we get bogged down in sentiment. If our laws dont work, then how do we expect the country to function?

A man is dead due to your own actions, whatever you do his life is gone forever, you are asked to serve a meager 5 years for taking another mans life and you are going on as if you have been sentenced to death. After the 5 years you have your life back, Mr Giwa is never coming back!!

yes that is very true and the "anybody" should serve his/her time too. We Nigerians cant drive recklessly, endanger the lives of others, kill people and then expect to walk away like nothing happened, that's the impunity we talk about, it's not just the scourge of govt officials.

This eye witness story even if 100% true does not have any probate value that would have swing the case in her favor.

The eye witness could not and is unable to testify regarding who was at fault or who was speeding.

Though the eye witness, testify to seeing the victim alive immediately after the accident and alleges that, it was the cruel efforts of the good Samaritans that killed the Doctor. This conclusive statement on the cause of death is speculations and opinions deduced by the eye witness. Further, the eye witness is not competent and learned to testify to the cause of death and the eye witness is not an expert in this area and as such his conclusive opinions are just that 'opinions' and should be strike from the records.

Even, if the eye witness were a competent and expert witness on the cause of deaths and his conclusions are backed with scientific facts; this does not still absorb the defendant, as she was the principal cause of the chains of the events that eventually lead to the death of the Doctor. Further note that, contributory cause of death, even if they were as a result of the actions of the victim or passerbys are ignored under the de minimis principle of the law and I therefore pray that should the court find such de minimis contributory factors, that they should be ignored and not given any probate value as a matter of law.

Note that, no one is accusing the defendant of murder and she was not charged for murder. She was charged for manslaughter which is a lesser charge, which involves the unlawful taking of another's life without forethought or malice...more so, she was not even charged with voluntary manslaught which is more severe and carries a harsher punishment, but she was charged with involuntary manslaught, which is the barest minimum culpability if one is directly involved in something as painful as the taking of another's live.

Let her serve her time whatever happens after will be dealt with at that time. One step at a time.

Dont know about the court details but if she was unconcious at st Nicolas hospital,her case would av being presented better,what I think the court had problem with is the fact that it was hit and run,we should respect the family of the late doc,its the Govt vs Ibinabo pls.Even at that,there is no way she can escape manslaughter like that without spending time,atleast 3 to 5years its unfortunate but its the law,i pray for her for more strenght.

That is the way it is in other countries, not only in Nigeria. It is called manslaughter. There a lot of people serving various jail terms across the penitentiary facilities in the US for manslaughter.

I don't know how this man's testimony has helped ibinabo in anyway. She was responsible for the accident, and even if he was alive immediately after the accident, he was bleeding and would have probably still bled to death even if no passerby tried to help him out. He was trapped in the vehicle.
We all know there's no functional emergency paramedic/ ambulance services in Naija, no emergency fire services with cranes and the likes to lift the vehicle up and remove the victim.
In my opinion, he has just further confirmed she was the one by the wheels.
He didn't make mention though if the vehicle plates were removed and the driver of the SUV ran away though.
I think that's the part that got me heartbroken the most. You hit a vehicle, caused a serious accident, and yet had the presence of mind to remove your license plates before running away offering no help whatsoever to the victims.
That was COLD and CALCULATING.
