The VO will answer questions from Monday through Friday. So for those whose questions were not answered before the close of business on friday wait till monday. Happy weekend everyone. You will get there in Jesus name, amen.

Thanks! You're usually right about weekends -- but with the Eid this week and my plans to take a few days off later this week grin, I figured I'd come in today and get some work done. Eid mubarak to those who celebrate!

Hello VO,
Please I had appreciate for you to recommend between a. Cr1 and a k3 based on the speed of processing and which has better visa approval chances. Can my wife be allowed to d interview with me? Thank you

Greetings! They have equal approval chances because they're based on the exact same thing -- a petition filed by a U.S. citizen spouse. A K3 requires the I-129 petition, which can only be filed after the I-130 petition has been appoved by USCIS. K3s usually get interview dates sooner than CR1s, because CR1s are scheduled by the National Visa Center (NVC), whereas K3s are scheduled by the applicants themselves online; but CR1s are generally processed so quickly that you only save a month or so by going the K3 route. (That said, NVC is experiencing processing delays due to a sudden increase in their caseload; but by the time you file, I think they'll have everything back to normal again.)

We generally don't allow petitioners into the waiting room. You probably noticed how full our waiting room was when you came to your interview -- and that was a slow day, as I recall.

Hi VO
My mum and 2 younger sisters won the DV lottery and left for US in April, they have also gotten their greencards and are all currently working. My elder sister also left in August for her master am left in Nigeria because of my job. Now I have missed them so much and would love to visit them this December. My mom just got a place of her own. The question is
1. Is it too early for my mom to invite me?
2. If not, how do I go about it? And what are the required documents that I need?

If you plan to go just for a visit, you can apply for a non-immigrant visa any time. http://nigeria.usembassy.gov/non-immigrant_visas.html has the instructions for applying for a non-immigrant visa. If your mother plans to file an immigrant petition, she can do so now if you're unmarried; see http://nigeria.usembassy.gov/immigrant_visas.html or www.uscis.gov for more information.

Dear visa officer ,

I have a question about the dv lottery 2016. I have successfully completed G.C.E O/L (10 Subjects) Sri Lanka in 2006. I sat for G.C.E A/L Sri Lanka in 2008 but only completed one subject (Chemistry). Then I came to Australia and completed a 2 year Advanced Diploma of Engineering (Robotics and Mechatronics) in 2012 December from Swinburne University of Technology , Australia which advanced me into the second year of Bachelor of Engineering (Robotics and Mechatronics) in 2013. I'm due to finish this in 2015 December.

I am a bit confused about the minimum education requirement for the application for Sri Lankans. Because in the application form it says the minimum education requirement is to have a high-school dip or equivalent but then it also says vocational school and equivalence degrees are not accepted . I am still not sure if , by "minimum requirement is a high school degree" whether they are asking everyone to have a compulsory US high school degree or an equivalent qualification in their own country....Or by minimum education requirement if they mean that the high school degree is just the basic requirement for someone to apply . which can be over ridden by a tertiary qualification higher than a high school degree qualification such as a Diploma , Advanced Dip, Associate Dp , Bachelors Degree. It's confusing.

My question is , I would like to know if I am eligible to apply using my Australian Advanced Diploma ? without having to provide my Sri Lanka high school degree as it does not fulfil 3 G.C.E subject requirement and I do not have two year work experience requirement to apply through a job experience.

More details about the Australian Advanced diploma can be found on - http://www.aqf.edu.au/aqf/in-detail/aqf-levels/

http://www.engineersaustralia.org.au/sites/default/files/shado/Representation/Government%20Submissions/2010/australian_qualifications_framework_aug_2010.pdf

Much appreciate if you can help me with this question. Kind Regards smiley

It is confusing, isn't it? The good news is that you qualify. smiley As you put it, a high school degree is just the basic requirement for someone to apply, and it can be overridden by a tertiary qualification higher than a high school degree qualification such as a Diploma, Advanced Dip, Associate Dip, Bachelors Degree, etc. One way to think of it is: Could I be accepted into an undergraduate university program with the education I have right now? In your case, the answer is clearly yes, so you're good to go.

I'll check with the investigators and see what's going on.

Hello- Have you heard back from the investigators yet? Since you will be out this week, is there someone else that will be looking at the files the investigators hand in, or will those wait until you return?

They should have everything wrapped up in the next few weeks. It's not likely that they'll have it done this week, but if they do, my deputy will take care of it.

@ hello sir, what are the chances of getting an immigrant visa after I-130 is approved by uscis??what is the percentage of denials compared to non immigrant visas ?what type of denials are most common? nd is it common for a visa officer to return an petition back for revocation?
Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by goodmaya: 9:44am On Oct 06, 2014
Good morning visa officer.

I am wondering if I should wait or fill another application form.

First let me thank you for all the information you provide here!

Concerning my case, My parents who are us citizen have applied for me as an unmarried daughter.

My I-130 have been approved a couple of monhs now.

So i will just have to wait for my priority date to come through, i think not before 2 or 3 years.

Now there is this guy i met in the usa who fancies me, i like him also but we don't know each other that well, as we met each other only a couple of time.

He is willing to marry me and wants to apply for a fiancé visa.

I am wondering if i should accept because he is a nice guy.

but if i do accept, what happens with my visa which is pending at the NVC?
am i allowed to marry a us citizen while my case is pending?

and in case, our marriage doesn't go through it means that i will lose my first place I-130?

so my question is, should i accept to let him fill a fiance visa for me? or would my case be complicated?

my first will is to be with my parents who are getting old, and love come after.

thank you so much for reading me cheesy

Good afternoon. I need your advise on how to go with my k1 visa. My fiancé just came to visit me in Nigeria and she wants to file a K1 visa for us, what are the chances of getting a k1 visa and what am i suppose to provide as the person here in Nigeria?? Also, she has a good job. But she stays with her mum and plans to move out by march to her own place . Is she eligible to file now considering the fact that she's not on her own? I will really appreciate your quick response . Thank you Oluseyi

Hello VO,

Thanks for your response, I do appreciate. I sent both copies of our Neco certificate showing we attended the same high school together with the scratch card to verify the authencity to LagosIVdocuments@state.gov. I am very much aware the consulate did not request this information and please do not see this as an attempt to breach protocol rather please view this as an effort to cooperate with the ongoing investigation. We are planning on getting married on 10/17/2014 and she already applied for her graduate study for Spring 2015 semester. I was advised not to include any information about her previous relationship which I refused to do, Instead to be honest I included that on the petition. This is very frustrating and depressing moment for us. we were very honest on the petition, documents provided and during her interview and will be happy if we are rewarded for telling the truth by approving our case. Thanks alot. LGS2014696014

Hello VO. i went for immigrant visa interview with my 2 kids and was asked to do DNA. immediately we got home, my husband called the DNA center in the States and gave them all necessary information and made part payment online with his credit card. The test kit for my kids was sent the following day which is 19th of Sept. The kit arrived lagos 24th of Sept. my husband swab has been taken on the 3rd of this month. It's exactly 2weeks today since test kit arrived lagos and yet we've not been contacted to come for swab collection. we started this whole journey in June 2012. Over 2years. I want to know how long the whole DNA process takes and if there's any way i can help hasten it, so that I'll get it done with. raising our kids alone without my husband is affecting me alot. Thank you.

Dear VO , Thank you for your prompt reply, now it makes sense to me as for why they strictly ask for a high school education or equivalent , I hope the CO accepts my qualification...fingers crossed. There is one more question is it compulsory to attend the interview at the country that I nominated in the application ? or is it possible for me to attend the interview at the US embassy in Australia. I am doing my Bachelors in Australia so I live here with a student visa.

dear vo,i read on web that the approval time of I-130 depend upon various factors nd one factor is the complexity of the case...more the complex case more time will it took to be approved/denied now my question is that i think consular officers dont have as much time as uscis they have to act fast now how do they reach the verdict soo fast or do you recieve a memo about the particular case from uscis whn you receive petition from visa center??can uscis approve a case just to be denied by visa officer??

thanks smiley

Hello VO,
Thanks for your advices

I currently have a B1/B2.I plan to apply for dv-lottery but since I plan to go to the USA for my masters next year or two am afraid that if I don't win the lottery, I might be refused an F1.

My question is does applying for dv-lottery even if you don't win hurt your chances of getting an F1 later? Thanks
