It won't be good if I didn't feedback to acknowledge your valuable advise

I asked some questions here around late October 2014 with regards to spousal visa application process and I'm happy to report back that my spouse has been granted her spousal visa to UK.

I will give a brief timeline about the whole process below:

Nov 26 2014 - Spouse submitted her application and was interviewed at Teleperformance office in V.I. Lagos;
Dec 3 2014 - I, as the sponsor sent off supporting documetations to Sheffield;
Dec 5 2014 - Spouse received an acknowledgement email from UK Visas Sheffield about receiving the documentations;
Jan 6 2015 - I got a phone call from UK Visas Sheffield to attend an interview on Jan 9, 2015;
Jan 9 2015 - Attended an interview at Battleship Building, London;
Jan 19 2015 - Spouse received an email from UK Visas Sheffield that decision has been made;
Jan 20 2015 - All the supporting documents were returned by post;
Jan 22 2015 - Spouse received a message from Teleperformance to pick up passport;
Jan 23 2015 - Passport was picked up with stamped visa dated Jan 14.

Spouse to relocate to UK soon, pending her resignation from her current employment .

I would advise that you wait the 6 months. Since you have been refused, they are more likely to scrutinise all future applications. So just use this time to make sure you have receipts, payslips etc for all major transactions being credited in to your account. Make sure you meet and can prove all the requirements listed for a family visit visa including the invite from the UK sponsor along with their bank statements and proof of residence. It's also important to make sure that the people you are visiting fit the criteria of "family" as listed on the UKBA website.

Hello house i went to pick up my passport but it was a sad new because the refused me on what i don't really understand,

Firstly...Suitability-entry Clearance requirement------Met
Relationship requirement------Met
Other requirement like English and TB...Met

Refused reason......Your sponsor is not exempt from the financial requirement as defined as paragraph E-ECP 3.3.I am not able to take into account any potential employment you have available to you in the uk or any offers of financial support from third parties. In order to meet the financial requirement of the rules your sponsors need a groos income at least 18,600 Pounds per annum. from the evidence provided your sponsor's has 16,544.62 from her employer per annum. In order to qualify or to meet the financial requirement you and your spouse requires the shortfall between the income threshold and your salary(i.e 2077.38*2.5*1600)=21.193 in savings in order to meet the financial and your salary. I accept that you provided evidence to show that your sponsor have savings of 23.131.27, however you have not provided satisfactory evidence to show that the entire amount has been held in her account continuously for the past 6months prior to your application. i therefore refused your application under paragraph EC-P1.1(d) of Appendix FM of the Immigration Rules EECP.3.1)

Please house i need your advice because I just can't believe if the UKBA look at all the dates on the accounts we provided to them. we have had my savings from 13 April 2012 and the loyalty saving account was open on the 14 February, 2014 and the application was logged in November 2014, that's a 9 months gap that I have the money in my recent account and we submitted a 6months bank teller..Please help me because i need to appeal


Hi Bolssos,

Just a quick observation, hope your spouse haven't got a dependent at the moment?
The reason why I asked this is that, based on your financial resources, you and your spouse are over the financial threshold of £18,600.
This is taking into account your spouse's basic pay and savings which should be around £19k.
However, if there's one dependent, then the threshold amount to qualify for spousal visa will increase to £22k.
Please double check if this is the reason for the refusal and yes you can always appeal.

Hellooooooooo everyone, we had a good news yesterday. My hubby picked his passport and he was granted the visa. Just want 2 thank you all for your support especially justwise and girlfo for ur prompt response to my question. My hubby is joining us for the Xmas holidays. Thank God for giving me my Xmas gift as I requested. We're so happy cos we haven't seen each other since last October.

Here is my timeline
Online application submission-29th sept 2014
Biometric appt-9th oct
Document recieved -9th oct
Interview by Home office in person-29th oct
Wrote to home office-25th November
Response- a week later stating Undergoing assessment by Eco
Document sent back-11th dec
Decision made-12th dec
Documents ready for collection-12th December
Hubby collected-15th dec
Visa stamped on 4th dec.
Total waiting time-2 months

N:B- they were kind enough to sent my hubby tb certificate with his passport which was vry thoughtful of them cos we were worried about it and wasn't sure what to do. God is good.

Praise The Lord with me . I wish everyone the best of luck and a merry Xmas.

congratss cheesy omg we got it too! but it was so weird as my wife got the docs the 8th of january without any letter or email, and i was just waiting till i got my passport ramdonly without any email either, the 22th and i opened it and it was my visa in there cheesy im so happy i can finally come to the uk to settle with her cheesy after that long fight, cheesy i wish everyone the best and hope u guys get it at the end of the big fight cheesycheesycheesycheesy happy times

2nd job salry (weekly just worth of 80 pounds) not reflecting in bank statement ( because it was cash in hand)

dec 18 i have got review deadline of 2 april
but
today i got hearing date of 23 march

im wondering how tribunal can give court date before even review deadline
can any one please help

I've never seen them schedule a court date that takes place before the 19 week deadline but that's because they usually wait so long to book them in after their initial review. Basically the 19 week date is the deadline, they can actually do their review anytime from when they receive your appeal. It looks like they've reviewed your case early, made a decision to maintain their refusal and then booked the court date. Which at-least means you won't have to wait too long to present your case.

In your determination letter it should give you the reasons why they've maintained your refusal. What you then need to do is start gathering evidence to address these points to then present to the judge. Has your lawyer been in touch with you about how you will be defended in court?

In regards to the 2nd job evidence, could your spouse get a letter from their employer, on headed paper, stating that over the 6 month period stipulated in your application that £80 per week was paid as wages. My only concern here is that if they did not receive payslips that issues may be raised with the paying of taxes etc.

yes my spouse get the letter frm employer and yes we have got wage slips too and paid tax too

as far as determination letter is concern i will contact my inlaws and will ask them about review tht bhc has upheld or still reviewing our case

Nope no dependant and we gotten a letter from her bank giving a good details of her bank account till date with saving up too 23,800 Pound even more then what they requesting for..I pray it all goes well at the appeal!

Hello everyone! I just picked up my passport frm teleperformance and was refused. The reasons stated : were 1. My closing balance is less than 10,000 naira except for the last recent transatciton of about 620,000 naira. and secondly I do not have travel history, which might offset his/her initial concerns as to knw if I comply with other countries immigration rules. Lastly, I don't have family or friends in the UK that cab accommodate me during my trip(though I provided hotel booking). Please advise, how soon can I re-apply and on what grounds should I file my application? @Justwise , pls advice on wayforward.

I need to ask this question since you had the similar case in the past.

What kind of supporting doc you put with your first and second application before got refused?
*** Did you write any statement to explain the whole story along with those applications? ***
How long did you waited before putting second application in, while your first application was refused?

Although, I remembered you said you had to wait for like 2yrs after all those are came unsuccessful, before submitted the third application and was granted at the end.

pls i nid help,it has been 3week since i submitted my passport to d embassy after my appeal was overtuned,i only received a email frm d embassy dat my visa is ready for collection,i went to d application center at ikeja today bt passport is nt still ready for collection.wat am i gonna do.

Last January, meaning January 20th 2014 or January 20th 2015?
If the latter is the case, all the while your application was been rejected, and all through the appeal process, factor all that time, and you will understand, that you are @ the final hurdle and would soon receive your passport.
Patience is a virtue. London remains the same and it's another set of hustle that awaits you in London!!!

Interpretation of your reply, simply put. We need time to conduct some enquiries.
How long would this enquiries take? How long is a piece of string?
Remember they have applications from other people as well and the case workers might be having back-logs.

Congratulations!, your waiting time is almost over, if you don't hear from them by next week send them an email or call them.

It usually takes between 3 and 5 months for a spouse application to be processed. They could be verifying the documents that you submitted. It's also worth remembering that processing during December is also slow due to the Christmas period so this could have also further delayed everything. Best thing is not to worry, praying that you get your good news soon.
