Such a pity! Even if he gets back to Spain which i believe would be difficult, he wouldn't be able to renew his residence permit. From his story, he was deported last year and its a maximum of 3 months from the expiry of your residence permit to apply for renewal. If its not renewed after 3 months, you lose it. So that is history.

He should have just waited to file for his citizenship, now see where this has led him. I feel so sorry for him.

From my little understanding, having resided in Europe for a while. I think 2 things might be wrong.Firstly, U cannot enter Switzerland just becausru have a EU resident permit. The country is not in the EU and not Schengen state. U cant even enter the UK (even before brexit) without a visa deapite been a memeber of the EU.How can you live in Europe for 13years n not know this.
Secondly, how can you reside in spain ,work n pay taxes in spain and then "solicit" for benfits in Switszerland. If he's telling the truth thwn he dug his own grave. It goes to say that even hia first entry was illegal n instaed of staying quitee he went ahead to lobby for benefits.Anyone who knosws anything about Europe knows u don't travwl close to expiry of ur permit

I'm not here to play hate, blame games. Just here to advise my brethren overseas.

Please oh, while you're there, save a lot of cash in your Nigerian account, as in plenty money in the account, invest back home, build house, buy car, just do something for house, Europe nor be we home, one day dem must see one thing wey you do then just send you back.

The Spaniards connived with the Swiss and sent this guy home, why? Because if they decide to do so themselves he might have an edge and come back, this way he is totally KOed if there is any word like that grin

I will advice anybody I know to do the opposite because investment in Nigeria is not secured and will only expose your loved ones to kidnappers.

The problem with some Nigerians like you is that you love playing the race card and refused to call a spade a spade.

You live and work in Spain but want to claim benefits in Switzerland? Who's money? Did he work and pay into Swiss system?

Some Nigerians enjoy abusing any system given the opportunity.

Appalling ignoramus @ de bolded. Buh he has a still valid residence visa for Spain and was coming from Spain. That means he was still admissible in Spain

Not true. As a Spanish PR holder, u need a visa to enter the UK. It's if you hold a Spanish passport, that you don't need a visa.

All he needs is a good lawyer, he needs to have evidence of being denied entry into Spain as that's where his permanent residency lies, he can use that to make an appeal. His case will be heard and all evidence presented. The judge will advice the Spanish embassy with a decision in a heartbeat.

Getting a good lawyer for such will cost him at least €5000 in this current buhari govt.

@Ateri, let me at least address your misconception. You see, the guy never misunderstood his status. He travelled to Swiss and applied for benefit whilst still working in Spain. He knew he won't get benefit in Spain 'cause he was still working. He needed extra cash and called his friend in Switzerland who advised him to come over and claim benefit. And because of greed and ignorance (not doing his research), he travelled and applied.

Now, after submitting his claim, he went back to Spain. Five months after applying, the result came in, he was denied. And needing to know the reasons behind the rejection, and devising other reasons to apply and appeal his rejection, he travelled again to Switzerland. This time, he was stopped by an immigration officer who digged in into his travel history and hit the jackpot. Officer found out he already applied for benefit whilst holding a resident permit of Spain. He was interviewed, admitted he applied for benefit and was detained. Passport and resident permit was seized and confiscated. Swiss govt approached their Spanish counterpart, and an agreement was made to deport him.

Now, was I there? No, but experience and speculation of events always narrate itself.

He regretted making that decision. In his interview with the press, he time without number mentioned how he would have been a citizen of Spain had he not gone to Switzerland to claim benefit.

Now, does racism played its part in getting him deported? Absolutely. But then, was he the architect of his own misfortune? Absolutely. A white man would have been banned from Switzerland for certain years for committing fraud, but still get handed his passport and resident permit.

"He that comes to equity must come with a clean hand". Let's strive to be honest, at least for once.

Thank you
Your fantasy narrative is nonsensical. It's clear that your fantasy narrative emanates from a pedestal of ignorance on the modus operandi of welfare benefits in Europe. You seemed to agree with the fellows story that it is possible, as a legal non-EU resident of any EEA and Switzerland to go to any other EEA country and Switzerland to claim benefit. It baffles me how some supposedly exposed people will believe such bareface lie. It annoys me that a guy who claim to have lived in Europe for 16years will lie that he went to Switzerland to claim benefit. On what basis.? Does he has a Swiss social security /insurance number?

How on earth will you conceive the idea that the swiss won't detect immediately that he is not a legal resident of Switzerland or EU national therefore not qualify to access welfare benefits. How can you , jeez, oh my gush conceive the lie that it will take 5months for the swiss authority to reach a decision that a deserving or otherwise person should be paid welfare benefits or not. (na hunger and want go don already kill that destitute person before the 6months)..

Permanent residence of an Eu country are not even allowed to work in another EU country not to talk of claiming any kind of benefits whatsoever. Are the swiss foolish that someone(non - eu) working and paying taxes in Spain thereby contributing to public finances of Spain will just hop into Switzerland and extract benefits. Una ignorance dey pain me seriously.

Even eu citizen's right to claim unemployment benefits in other EEA and Switzerland is not absolute. You first have to come, register as an intending resident, obtain social security number before you can claim job seeker benefit..

There are so many areas in the man's story that I find laughable and not factual. I say unequivocally that if truly he is a permanent resident of Spain, there's no way Swiss authority will seize his resident permit and deport him to Nigeria. Except he committed a grave crime (not immigration offense) in Switzerland.

ANY ONE THAT BELIEVES THIS MAN'S STORY BASE ON WHAT HE/SHE JUST READ HERE IS IGNORANT. THE MAN'S LIES AND DECEIT TO GARNER SYMPATHY IS GLARING. HE HIS HIDING THE MAIN REASON HE WAS SHIPPED NIGERIA.

“In 2014, I lost my job and went to Switzerland to solicit for social benefits, which is not a crime. After five months of application, they denied me, saying that I could only apply for that in Spain where I came from. I didn’t argue with them. I left the country. I didn’t fight with anyone and I have never been a terrorist suspect".

Question: who spends five months waiting for social benefits in a country where they are not legal residents? Brother, we all know that generally after 90 days you become an illegal. This is the problem: how could you live in Spain and expect to receive social benefits in Switzerland? Its like saying that since you live in Nigeria, and your country is a member of the African Union, you could claim social benefits in Libya or Algeria. Keep in mind that this guy is a legal resident, not even a citizen of Spain; then again, he seemed to have believed that the Schengen Accord covers Switzerland. Oh well now he knows what knowledgeable people know already: Switzerland is not a "Schengen Country" and even then..These things happen because people are not informed or they are outright liars Another common mistake people make is claiming non-respect of human rights or some fictive persecution in their country of origin. They go to another country from where they travel to Europe, US, or Canada to seek political asylum. They are denied and they hire a lawyer. The lawyer knows its a case you can NEVER win but eh, he needs your money. This is because if truly your life is in danger, the first country you arrive in should be the first country you ask for protection. In international law, a refugee does not have the luxury of choice regarding what country to go.. In the particular case of our friend here, he had been an illegal in Switzerland for at least two months in the past.

My friend, as you know, Switzerland is not a member of the 28 member Union. But in 2002, Switzerland signed an agreement with Brussels providing for free movement between the bloc and the Alpine nation. This allows Spanish citizens a free ride in Swiss nation. This means citizens of Spain can go to Switzerland to work, settle and claim certain benefits.

Now, back to our friend. You should note that I wrote that this guy was badly misinformed. They thought that PR holders were also eligible or included in the agreement signed, hence, the benefit he claimed.

There was no way he went to Switzerland other than the reasons he gave. He has no work permit, nor a student visa which would have enabled him to settle down there.
