The offence is evading duty. There is a legal limit for what you can carry, and it is assumed it is for personal use.

If you carry above this limit, you will be stopped by UK Customs. For a first timer, you pay a fine, pay the duty and go with your cigarettes. It only gets to court if you are a repeat offender. By then, the cigarettes will be seized.
