I say it's a nice strategy!
Learnt something new bro.

Definitely quite involved and relies on a lot of "ifs" tho....like getting a particular graduate job.
Jobs are hard bets everywhere in the world right now.

Well, you have no business studying in US if you don't have full tuition waiver plus a steady monthly stipend. US is not a place where you can work and study on F1 visa. It's just not possible.

But a PhD student with a guaranteed funding for five years can easily bring his wife and children and live happily thereafter. Folks even give birth and bring grandma for omugo or what's it called. it's so common and widespread that I wouldn't call this a strategy

Well, you are wrong. Let me give you one example.

2buffagain is a student on F1 visa but to bring his wife to US, he needs to show a balance of $6000 in his bank account to secure Form I 20 for partner's F2 visa interview. 2buffagain is obviously on a struggle level as a student but could rally round friends and pull resources together to meet the target. Personally, I know more than 50 people who did it and it's not illegal. It's perfectly legitimate; just networking to survive. This is how foreign students studying in US bring their partners. If you have a child, that includes additional $2000.

Now, a graduate student on a monthly $2000 stipend can live perfectly okay with his partner. And your child(ren) can attend school free of charge up to secondary school level. There is difference between hustling to make it and then saying it's altogether impossible. The only expensive part is buying ticket which folks put on credit card and keep transferring from one card to another to avoid accumulating huge interests until it's paid off. So what do you say?

Ah yes.
Having a US citizen as a sibling or step-sibling makes you eligible for a green card.

Having DIRECT (sibling, parent, spouse, child) family links in general in the US makes you eligible to apply for a green.

So my female cousin (against the will of the family) married a Nigerian-American. Marriage will be three years in January. 8-month old son. But it has been turbulent.

Turns out man is a 3 time divorcee. With kids (2,3?) almost in their teens and his parents. All living together Stateside. Man's military. After so much turbulence man has filed for divorce and cuz is still on Conditional green.

What options are possible for cuz regards maintaining her green?

Sorry I'm a bit cryptic. Man's military and they somehow get to track these things

My cousin thinks she can play with me. She took my phone and sent a break up SMS to my girlfriend. I then stole her phone and saved my number as JOB UPDATE and sent her job invitation message. Now She's on her way to Abuja from warri for the interview.

Escuse me sir, you are not been totally sincere.

Everyone who was able to do what you have described above must have done it illegally or they had rich parents or support financially from somewhere. Please when we are saying things on a public forum, let us always say it as it is and not paint red blue.

I am not saying it is impossible but you and I know that most of the people who achieved it broke the law in the process.

In the USA, your partner is not allowed to work. So you telling me a student who is only allowed to work part time and wife cannot work will use that meagre money to feed himself and wife and then pay bills for 5 years?

You were silent on breaking the law bro. I am not saying I am holy but let us spill everything out.

The only exception is if the PHD student got funding/ scholarship (which is also support) and most times, the wife go still work for side.

Well, I am not responsible for your inability to comprehend my post. Don't give an opinion on issues you don't understand.

I have just one question for you. Were you at anytime a graduate student in US? I asked because what I explained here is so common and widespread that's not even worth arguing over.

1. A student on F1 visa can bring his wife/partner and dependents to US legitimately.
2.Wife or dependents will have to come on F2 Visa but can't work on F2.
3. However, dependents less than 18 on F2 can attend school up to high school free of charge in US
4. Wife can't work but can volunteer
5.If the principal visa holder has a guaranteed funding of say $2000 monthly for five years as a PhD student, then he can take care of his wife and kids. House rent gulps a substantial part of that money but can live modestly on the rest.

Can you please point out any part of this that's illegal or not doable?

She'll have to get a family and also immigration lawyer.
It is possible that she might be able to still snag a normal, unconditional green.
I'll leave it to her and her lawyer(s) to discuss those options.

Then the chances are certainly higher that she can score a clear green.
But she needs to get her lawyers involved fast so she can be sure she is setting things up well.

@2buffagain,

You nailed it, but the truth is your scenario about a fiancée or fiancé traveling on a non-immigration visa, with the hope of settling down and coming for the other is not the worst case.

The worse is for both spouses to travel together on a non immigration visa and hope to still remained married while also wanting to settle down in yakee.

This is a double jeopardy as both of them have represented that they are married unless one is lucky to adjust their status to one of those non immigration visas that have paths to citizenship e.g. H1b, R1, etc... the marriage will be tested in many unimaginable ways.

Triple the wahala if they made the mistake of traveling with their kids....as each weakness in that link e.g. yourself, your spouse or your kids can lead to all of you getting into trouble as the authorities can easily re-link everyone.

Also, your options are very limited e.g. getting arangee as you guys have to first go through divorce first before you can form any other legal relationship.

There are couples in similar problem now; the far easiest way to get your green card in the USA is to get marry to a citizen either arangee or true love and seeing you are already married; you have to first undo that marriage and if kids are involved, the court will ensure that they are supported by both parents, but a non immigrate visa holder is not suppose to obtain work or earn salary...good luck in telling that to the Judge, even in a no fault marriage with no assets; the the divorce settlement must account for how the kids will be supported and by who plus their medical insurance.

There are many twisted taggled web through which many couples in situations link these find their ways around these issues. The truth is, you will cut some illegal red tapes that may come back and bit you real hard because the exposure is way too much compare to if you had left your spouse back at home, go to USA and when settled come back and take them with you.

Well, comprehension is still an issue. Tuition waiver plus stipend is NOT so common. You will have to apply to study the right course, and be competitive to get one. What IS common is the PRACTICE of bringing over one's partner and dependents without much hassle and WITHOUT having a green card. Let me know if you have questions.

The point I am making is simply creating an exception to the general rule the OP seemed to have postulated. And the exception is this, if you are dating a guy or a lady who is pursuing graduate studies in US, S/he can bring you over legitimately without much hassle and as such, no point ditching him or her just because there is no green card. Again, don't date losers!

One thing I know out of experience is that...mediocrity is contagious.

Having a smart wife, who actually has experience, means I can value her councel/opinion/advise more on sensitive relevant issues... As opposed to someone who just wants to talk because she feels she has to.

Ah! Ope O! You've spoken like a long married man with experience.

At the end of the day, this strategy falls under employment green card or "extra-ordinary person" green card.
Both of which I already listed in the opening post and have been made notably harder by Trump.

Nice one, 2buffagain

This is a perfect reason why a married person should be extremely involved in politics at home. You can always vote for new guys like Sowore Donald Duke, etc to get your country moving forward in the right direction as opposed to backwards with those same old thieving clueless failures y’all keep recycling.
But that’s another topic for another thread.

You’re right. It is even more challenging for a married couple. Seeing as I never reach that level, That is why I cannot give advice on that one. UNa wahala senior pass me smiley

Lol @senior wahala. Weyrey! grin cheesy

Quite interesting how you succinctly analysed the situation. If you're migrating irregularly and you're above 25, oh boy, do not tie anybody down in Nigeria. Even if under 25, still think it over very carefully. Or you might spend your youth in limbo in a foreign land. And make your lover miserable thousands of miles away. If after 3 years you have not brought your bf/gf from 9ja, everyone will conclude that you have moved on. No matter how hard you have tried to seek ways to bring him or her over.

Unless your gf in 9ja can at least secure a visiting Visa while you are there. If she comes over at least once yearly, she might understand the challenges. But the temptation for her to kukuma overstay and battle for her own resident papers could be difficult.

Many people are caught up in the situation where they cannot secure "green card" and hence have not visited 9ja in 10 or even 20 years.

People need to be more informed about the hurdles to overcome to stay in foreign countries. That would spare many people much headache & heartache.
This thread is therefore timely.

You were against absolutes and I agreed with you..But you have made an absolute here..I'm referring to the "you have no business...."

It is actually possible to get partial (not full) tuition waiver and work your way here while you study...I say this because the friend I referred to in my earlier message did this, and a family member did it too..But three bad things fit happen..1) Grades will suffer, 2) The person can overwork and thus destroy their social security records and 3) The person can be frustrated out of schooling..

But in terms of possibility, it's possible. I know so. However, in general, your point holds a lot of water...E go harrrrrrd. The partial funding needs to be close to 100% to increase the possibility of pulling it off.

It is much easier, as you said, if people came to the US fully funded, i.e if dem get tuition waiver plus monthly stipend. Many Nigerians get such opportunity - a lot. Abi me I get am for 2009/2010..Lol.

MOD, please take note that I am not here to advise or reply anyone hence the change of ID.

OP is wrong on the path of citizenship by marriage and the advise for a woman to forget a man who plans to immigrate to the US without a GC.

If a man and woman have the mutual understanding, and have reached an agreement to "wait", then the man can travel to the US on a B, J, F or H visa; get married to a USC and still have his GC under Twelve Months. To succeed with this plan, the original couples/parties must be committed to its success and the key to sustaining the arrangement is mutual understanding, cooperation and adjustment.

Adjustment of status through marriage whether "orijo or dagbo" is not rocket science once you're married to the right person (petionioner) with a decent standard of living and a general understanding of the entire process and the will to help. The onus is on the petitioner and applicant to prove that their marriage is bona fide.

Once married, you're called an immediate relative of a USC and you can file your application for AOS immediately.

After submission, it takes the USCIS about 90 days or more to issue the EAD and SSN which authorizes the non USC to work in the US, and also make emergency travels for a specific period of time pending when they're invited for their GC nterview which generally takes from six Months to twelve Months from the date the application is submitted.

If everything goes well at the AOS interview, the USCIS officer will approve the I485 application, and the GC will be mailed to the address on file. If an application is placed on review at the end of an interview because the USCIS officer isn't satisfied with the answers provided by the petitioner and applicant, the officer will place the application on review. The review takes from one weeks to six months after which GC is issued.

Some applicants are not so lucky because they are unable to prove to the USCIS officer that their marriage to thier USC spouse is "bona fide". They will either be reschedule for a second interview (stoke interview), or get denied which can be handled by an immigration attorney without stress, but long delays and legal fees. So women, your your husband or boyfriend can still travel and return back to you in One year Six months if you can wait and take the risk. The decision is yours. I'll stop here.

I am glad this thread came up. To all those who are in the USA with visiting Visa or with student visa, PLEASE DO NOT LET YOUR VISA EXPIRES. I REPEAT PLEASE DO NOT LET YOUR VISA EXPIRES or status expires. DO WHATEVER U CAN TO SEEK HELP AND MEET AN IMMIGRATION lawyer, Your Pastor in Church, ask for help to see how you can extend your visa. You have a better chance when your status is extended for a longer time. The immigration lawyers can give you advise on what you can do next. Do not wait till it is too late Because after your status expires, the only option is to marry an American Citizen. Ask for help, seek help and do not be quiet.

This is why I pity all this people lining up at the American embassy to get visiting visas with the intention of overstaying and living in the US illegally.

That is basically jumping from frying pan to fire especially in this Trump era, you will suffer so many indignities you will hate your life. You can't even work in a minimum wage job now without valid papers.

My wife sister was telling me about their fine arts teacher in primary school who absconded in the US during a competition over twenty years ago, and left two small children behind whom has not seen because he is still living illegally and cannot return to Nigeria even for a visit

Just imagine what people are going through for the papers? It is well o. I always advise, if you are travelling as a hustler, it is better if you are not yet married because you never can tell what you will do when you get to “the abroad”.
