A Federal High Court, in Lagos on Friday, restrained the Federal Road Safety Corps from arresting vehicles with faded number plates. The court also ordered the restriction of the FRSC from imposing any fine or punishment on any driver for driving with a faded vehicle number plate. Justice Aluko made the orders while delivering judgment in a suit marked FHC/L/CS/253/2024, filed by Chinwike Chamberlain Ezebube against FRSC. The applicant, Ezebube, in an Originating Summons dated January 12, 2024 and filed on February 13, 2024, by his lawyer, U.G.Nwokedi, had asked the court to determine the following: “Whether the defendant, pursuant to Section 5 (g) and Section 10 (3)(f) of the Federal Road Safety Commission Act 2007 being the sole designer and producer of Vehicle Number Plates in Nigeria, is not absolutely responsible for the quality and durability of the vehicle number plates as are produced by it? “Whether the defendant, pursuant to Section 5(g) and Section 10(3)(f) of the Federal Road Safety Commission Act, 2007, being the sole designer and producer of Vehicle Number Plates in Nigeria, and responsible for the quality and durability of the vehicle plate numbers as are produced by it not liable for any defect or poor quality and durability. “Whether the defendant can, pursuant to Section 5(g) and Section 10(3)(f) of the Federal Road Safety Commission Act, 2007 vehicle number plates? Being the sole designer and Producer of Vehicle Number Plates in Nigeria, and absolutely responsible for the quality and durability of the vehicle plate numbers as are produced by it, penalise or threaten to penalise the plaintiff and or other Nigerians for the depreciating quality, durability, fading or peeling off of the colours and characters of the Vehicle Number Plates designed and produced by the defendant? “Whether the defendant can make it an offence and impose a penalty against the plaintiff and or other Nigerians for driving a vehicle with faded vehicle number plates due to poor quality production as designed and produced by the defendant? Whether the defendant is not obligated to replace at no cost to the plaintiff and or other Nigerians, the vehicle number plates when same is faded due to poor quality manufacturing by the defendant?” The plaintiff said should the above questions be determined in his favour, urged the court to make the following orders, “An order of the honourable court restricting the Federal Road Safety Commission, from declaring it an offence for the plaintiff to drive with a faded vehicle number plate. An order of the Honourable Court restricting the Federal Road Safety Commission, from imposing any fine or punishment on the plaintiff for driving with a faded vehicle number plate. “An order of the honourable court mandating the Federal Road Safety Commission, to replace at no extra cost, Vehicle Licence Number Plate LSD905EQ or any faded vehicle plate numbers of the plaintiff’s vehicle or vehicles upon the payment of the initial vehicle plate number issuance cost. “And for such other declaration(s), and/or order(s) or modifications of any or all of the foregoing reliefs already claimed hereof as the Court may deem fit to exercise its Inherent Jurisdiction to grant and/or make in the circumstances of this case. However, FRSC through its lawyer, B. O. Nnamani, filed a counter affidavit, urging the court to dismiss the plaintiff’s suit with punitive cost. In his judgment, Justice Aluko held, “While the defendant cannot criminalize the use of faded vehicle number plates, the plaintiff has a duty to approach the defendant for a replacement of his faded vehicle number plate upon payment of the requisite fees for that purpose. “By way of conclusion, I hold the view that the defendant cannot criminalize the use of a faded vehicle number Plate and has no power to impose a fine on the plaintiff for using a faded vehicle number plate or impound the plaintiff’s vehicle on such grounds without the order of a court of competent jurisdiction. “Having examined the affidavit evidence before the court and determined the above questions, judgment is entered as follows: “An order of the Honourable Court restricting the Federal Road Safety Commission, from declaring it an offence to drive with a faded vehicle number plate is granted. “An order of the honourable court restricting the Federal Road Safety Commission, from imposing any fine or punishment on the plaintiff for driving with a faded vehicle number plate is granted. Justice Evelyn Maha of the Federal High Court in Abuja has issued an order restraining the Directorate of the Road Traffic Services, commonly known as the Vehicle Inspection Office, from stopping, impounding, or confiscating vehicles on the road. The court also barred the Road Traffic Services from imposing fines on motorists. The judgment, delivered on October 2 by Justice Maha, stemmed from a fundamental rights enforcement suit filed by human rights activist and public interest attorney, Abubakar Marshal. Justice Maha, in the judgment, agreed with the applicant’s contentions that there is no legal basis for the VIO and its officials to stop, impound, or confiscate vehicles or to levy fines against motorists. The applicant, in a suit marked FHC/ABJ/CS/1695/2023, sued the Directorate of Road Traffic Services, the Director, Directorate of Road Traffic Services, Mr. Leo, the Area Commander, Directorate of Road Traffic Services (as of December 12, 2023), Onoja Solomon, the Team Leader, Directorate of Road Traffic Services, Jabi Area Command, and the Minister of the Federal Capital Territory as the 1st to 5th respondents, respectively. In his originating motion, Marshal sought, among others, a declaration that the “1st to 4th respondents under the control of the 5th respondent are not empowered by any law or statute to stop, impound, or confiscate the vehicles of motorists or impose fines on motorists, and that doing so is wrongful, oppressive, and unlawful, as it violates the fundamental human rights of such motorists to fair hearing, freedom of movement, and presumption of innocence, and is therefore unlawful by virtue of Sections 6(6)(B), 35(1), 35( , and 41 and 42 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), as well as Articles 2(7)(b), 12, and 14 of the African Charter on Human and Peoples’ Rights.”Related News FCT will keep crushing seized motorcycles – VIO spokesperson The court, in its judgment, issued a restraining order against the respondents, preventing them and their agents from impounding or confiscating vehicles or imposing fines, labeling such actions as wrongful, oppressive, and unlawful. Justice Maha further granted a perpetual injunction to protect the rights of Nigerians, ensuring their freedom of movement, presumption of innocence, and right to own property without lawful justification. Pa Josiah OSANEKWU left home since at about 6.30pm 15th September 2023 that he was going to Fadeyi. He never got to Fadeyi nor returned home. All efforts to know his whereabout proved abortive. He was wearing ankara when he was last seen. A rights group, The Human Rights, Liberty Access and Peace Defenders Foundation, on Monday chided the Anambra State governor, Willie Obiano, for allegedly spending N1.35bn on beautification of major cities in the state for the Yuletide. In a statement, the leader of the group, Uzor Dede, accused governors of the South-East geopolitical zone of profligacy, calling on the Economic and Financial Crimes Commission to beam its searchlight on them. It lamented what it called “the abysmal performance” of the governors, stressing that their states were facing huge infrastructural decay. The nongovernmental HURIDE queried the rationale behind spending N1.35bn for Christmas decorations, whereas only N181m was allocated to the rehabilitation of bad roads in the 2019 budget. It said the action showed “the insensitivity and callousness of the government,” wondering what benefits the Christmas and New Year decorations are to the economy and welfare of the citizens. The Anambra State Government has denied the claim. Speaking about the decoration, HURIDE said, “The sane thing to do was to channel the entire money to rehabilitation of damaged roads in various parts of the state, particularly in Onitsha, the commercial nerve centre of the state where virtually all the roads are in deplorable conditions. “It’s pathetic because, throughout the year, the Anambra people have been crying for roads rehabilitation, but the government allocated a paltry sum of N181m to it. “No wonder all the roads in Onitsha still remain unattended, in spite of promises by the governor and his aides to rehabilitate them before Christmas. “We are, therefore, calling on the EFCC to beam their searchlight on the finances of South-East and South-South states, to restrain the excesses of the governors in using their funds for frivolous things such as Christmas decorations, when roads, education and health sector are suffering,” Uzor stated.
