Re-apply dear, this particular VO was explanatory on his/her reason for the insufficient fund. There is no problem, put yourself together and reapply this time using your hubby as your sponsor, since he has a good paying job, inflow and outflow also good. You will get your Grant!.. In your letter of explanation/Clarification on your previous refusal, state the steps you have taken to address the issue of insuficient fund raised before. You can as well start now to transfer fund to your hubbys account using different names( pay in and withdrawal to show a good inflow and out flow before he prints his statement of account). The VO calculated the balance of tuition and living expenses for a year and reduce it remains 2000aus dollars to complete. He also said because my mum is retired, she cant use all her pension money to sponsor me. My question is if I address the sponsor issue using my hubby is Visa assured for me? He has a good paying job and is financial statement is very good. |

At first, my application was refused. And as I read the refusal letter with shivers down my spine, I figured the VO based his/her decision singularly on insufficient funds. I was beyond crestfallen. I could not even wish that on my enemy. It came on an afternoon and I thanked God I did not drive to work that day cos I would't know how I would have fared behind the wheels. More painful was the fact that the rejection/refusal came after 134 days of agonizing wait! I had been so expectant since I felt I had satisfied every requirement. Meanwhile, a spike in FOREX rates around early August 2017 had relegated my POF below the LICO by 330CAD. Can you imagine that?! 
I bottled it up. Never opened my mouth to tell a soul. I did not want to share the heartbreak with my family and close friends who knew I was on this train. So I reached out to my e-friends on this platform, chief of whom are Blackbuddy, 40manlappy, and GlitteringStar for solace and advice. I felt the reason for refusal was flimsy -- they thought so too. I was going to appeal!
Now, up until then, it's not been a common thing to see a refusal decision reversed. But my case was going to be different as I went to God in my unspeakable pain and disappointment. I cast all the burden on him with hope and faith. As advised, I sent the first email and raised a CSE showing that I indeed satisfied the POF requirement, with updated POF attached. After 3 days, my appeal was rejected. It was so devastating but I kept my cool. While me e-friends were following-up and asking for updates, I only told them IRCC were yet to respond. I kept praying. One week passed. Two weeks. Nothing. So, I sent another email, trying to make them see my point. I was begging for mercy, as advised. Failed again.
I had given up, turning my sights on PNP as my CRS had dropped to 427 and no chance of having the draws smile on me. This was January this year. Then on one Sunday evening, Tosin, who also experienced same, reached out to me again, saying I couldn't just be quiet and be waiting or just give up. Then I heard a little voice saying I should try again. I sent another email on Monday but instead got a refund of my RPRF. Damn! I caught a cold that night. Managed to get home. Struggled through the week. Then God provoked me himself - a colleague of mine, who applied after me, got PPR. We congratulated him but I was very sad deep inside. Mine was coming, I shrugged. That night, I drafted another email - this time stating my utter displeasure and showing the unfairness in the refusal decision - and I sent it directly to the minister! I remember I said a silent prayer before clicking the send button: Lord, don't let this one return the way others did.
The next day, I saw a notification, my application had been reopened. I was asked to pay the 490CAD RPRF. I returned the money they had earlier rejected back to them. 3 days later, I got PPR! Now happening so fast I could barely remember the pains I had felt a month ago. I was overjoyed and broke the news to my family and friends - they did not know the underlying story, did not need to. The devil is a liar!!!

Bro!... we all have one or two people in OZ who knows about hapenings. We as well don't live in an isolation from the rest of the world. No doubt, there is a Bill before the house until that bill is passed by the majority of the house and pass in to law, such Bill is not binding the initial of 8years PR you said for applying for Citizenship. The Australian Citizenship Legislation Amendment (Strengthening the Commitment for Australian Citizenship and Other Measures) Bill 2018 (the Bill) amends the Australian Citizenship Act 2007 (the Act) and the Migration Act 1958 (the Migration Act) to strengthen the requirements to become an Australian citizen and other key provisions.
To strengthen the requirements to become an Australian citizen, the Bill amends the Act to:
increase the general residence requirement to require citizenship by conferral applicants to have been a permanent resident for at least eight years before they are eligible to apply for citizenship;
require most applicants to provide evidence of competent English language proficiency before they can make a valid application for citizenship;
require applicants to sign an Australian Values Statement in order to make a valid application for citizenship;
require applicants to demonstrate their integration into the Australian community, including by behaving in a manner consistent with the Australian values that applicants commit to when they sign the Australian Values Statement;
amend the Preamble to recognise that people who are conferred Australian citizenship undertake to accept the obligation to pledge their allegiance to Australia and its people, and to share Australian values;
allow for the Australian Citizenship Regulation 2016 (the Regulation) or an instrument made under the Act to determine the information or documents that must be provided with an application in order for it to be a valid application;
allow for the Minister to determine eligibility criteria for sitting the citizenship test that may relate to the fact that a person has previously failed the test, did not comply with one or more rules of conduct relating to the test, or was found to have cheated during the test;
rename the ‘pledge of commitment’ the ‘pledge of allegiance’ and amend the pledge to require a person to pledge their allegiance to Australia and its people;
extend the requirement to make the pledge of allegiance to all persons aged 16 and over intending to acquire citizenship by descent, persons adopted in accordance with the Hague Convention on Intercountry Adoption or a bilateral agreement, persons intending to acquire citizenship by resumption, and persons intending to acquire citizenship by conferral who have satisfied the criteria for a person born to a former Australian citizen, a person born in Papua or a person who has satisfied the criteria relating to statelessness; and
allow for the Regulation or an instrument made under the Act to introduce a two-year bar on a person making an application for citizenship where the Minister has refused to approve the person becoming an Australian citizen on grounds other than failure to meet the residency requirement.

They are experiencing high volume of application as said by them. I don't work with them though. Forget calling today again and call them tomorrow morning from that 7:30am, you will definitely get across to them. Also note that so many persons are calling them as well. @Justwise, I made appeal to them with all the revelant documents and the Bank will still do same on my behalf via my sponsor as their customer. Is also good that one contact laywer for legal and proper advice which he has done in my case. My prayer and wish is that they re-consider their stand. justwise: You are wrong, you can’t sue any country for refusing you a visa or banning you but you can appeal the ban if there is a provision for that. Any country has the right to turn you back at the Poe even with valid visa and there is nothing you can do about it. |

Thanks dear, God bless. I decided to share my refusal here for advice or input, if any have experienced this in the past. There are some persons I spoke to that had the same issues, they appeal and their Ban was overturned and some cases Visa re- issued to them. The reason for my refusal is known now. Yesterday I met our lawyer and after going through all the documents from the bank and all the correspondence, he mentioned were the embassy stated that the applicant submitted the same bank statement of account and reference letter from sponsors bank. That what the embassy simply wants is a new statement of account starting from another date just to show that the account is genuine, that's all. But the bank included the previous statement of account issued to my sponsors to refute the claim that the statement of account is genuine and emanated from the bank. In a nutshell, a new statement of account could have averted this which have turned to a big issue. But the embassy did not requested for new statement of account, if they did, My sponsor could have printed another one and I will upload it, to print statement of account does not take more than 1 minute. Another laywer said the same thing, that uploading new statement simply put the matter to rest. An Agent who had exactly the same issue with her applicant said the same thing, just 2 minutes she read my refusal letter and she made that statement, "new statement of account is what they want", but remember the CO did not state such. Am saying this so that people can learn from my experience. -Reference letter from the Bank stating the needful, -Affidavit of facts and - New statement of account, simple and issue solved. I submitted the first two only and the bank re- attached the same statement that was submitted to refute the claim of non genuine, but what the bank should have done is to print new one from a new date. So my lawyer, has written to the bank officially yesterday, directing them to write to embassy in strong term either from their head office or the bank legal department still maintaining that the statement of account issued to their customer is genuine and emanated from the bank and they are writing and appealing on behalf of their customer for his sons visa refusal and Ban be overturned, that at no point did their customer submitted any non genuine account and that personal investigation is welcome to prove their customer submitted genuine statement of account. An advance copy of this letter was sent to the Bank yesterday, copied the embassy and other relevant body we deemed it necessary. We deliver the soft copy to the bank this morning and wait to see how the bank we draft the letter they will send to emassy as directed by my lawyer. For avoidance of doubt, my documents have no issues at all. This is just what happened!... At least am now at peace with my self for finding out the problem. I want to thank each and every one of you that offered their suggestions, moral support, psychological support and prayers. God bless you. N/B, the case officer is harsh fellow, the case officer did not write to the bank for confirmation of this account. This has been confirmed. The bank both at the head office or the Branch did not received any correspondence. @Mafia91, I included those my personal details as you said, thank you all. @ SantaClause, some of what you just said are assumptions not facts. -Citizenship did not increased to any 10 years. Last year it was brought up on the floor of their assemble, members voted it down, so that bill did not go through. Immigration matter is different from school, even in a situation, the immigration finds out that the school connive with the applicant to short change the country in any way, the school gets purnishment for that. So schools are very careful in what they do. Take calm your nerve bro, in conjunction with justwise advice, please do take time to go through your documents again, you never can tell what you missed, still go ahead with the legal proceedings, even countries can sue and be sued, hence, legal proceedings is allowed(here i disagree with justwise and SantaClause advice),the refusal, its their right but the ban, its not, they have only called you fraudulent by banning you and that is only a measure taken when its has been proven beyond every reasonable doubt that some documents you submitted were fake.

Contact your bank headquarter and present your case regarding the bank statement since you are absolutely sure that the bank statement is genuine. You need those responds from the bank headquarters in writing so as to use it to argue your case with the embassy. |

Good morning @ Justwise, happy new year first of all. This is the first time you actually responded to my post. On the question you asked, I want to thank you for taking out your time to ask this wonderful question. Answers: My sponsor did not print any new statement of account. On the 18th of January, 2018. The DIBP wrote to me requesting for my Canadian student refusal letter and 3 months Statement of account. My sponsor printed the statement of account 5 days after because this mail came on the last day of the week. I also got my refusal letter notorized it with the statement of account and uploaded it. N/B I was given 7 days to do that. On the 3rd of February, 2018, which is our Friday by time zone and Saturday by their own time zone, I got a mail with the heading Natural Justice to comment on the statement of account of my sponsor seen as non genuine, I was given 14 days to respond to that. I responded to the mail on the 6th of February, 2018 with the letter from my sponsors bank affirming to the statement of account they issued to their customer. The bank sent the letter first to the legal department in Lagos for approval before it was now released to my sponsor. I and my sponsor spent the whole day in the Bank waiting for the approval of the legal department after they typed the letter. In the letter, the bank stated they have re-attached the same statement of account issued to their customer previously for them to confirm. This account in question is my fathers account and no such of ill malpractice was done on it. I also did an affidavit of fact in the high court. So dear, there is no shady deals of what so ever you might think or conceived in the mind. With all these, the case officer bent on saying that is non genuine. If my sponsor is guilty of such we won't be wasting our time pursing this. But I can't fold my hands and someone will sit in his or her office and raised a frivolous allegation on my reputation and I will keep mute. As I am typing to you, am in my laywers office were he is drafting out the items with all the letters and correspondence. The laywer will also write mandating the bank to explain what happened and all letter will be copied to the embassy. You have every right to believe what you feel is right for you. A clear conscience fears no accusation. I have 2 or 3 persons on the platform that I worked closely and we all applied together. They know me and my family very well and they have been part of my journey in this application, we share ideas together and all that. For the sake of identity and rights I preserved their right not to disclose their identity here. I will have to get to the root of this and know what really happened. But from my sponsors side nothing happened, the bank have more explanation to do on this. That's all I can on this issue henceforth. But remember, Case officers are human beings and their are Spiritual and Physical dominion in this life. Experience is the best teacher. Some of us have not encountered, experienced or come across some things in life and you ask your self, "why me" of course, it will happen to a human being not a ghost. I have been reading your post regarding the refusals and very few people here have asked you a very important question.. what is the difference between the first bank statement you submitted and the second one they requested?
Please forget about legal action you are taking about because you will be wasting your money and time.
Embassies do verify bank statement with bank head quarters and not the local one, so be honest with yourself and examine what happened to those bank statements |

Thank you very much. They have the right to refuse my visa yes, but the right to ban me for 3 years for something that I know that is not true, my dear I disagree with you on this. Even after sending the letter that the bank issued to my sponsor stating that the statement of account is genuine and emanated from the bank and still not satisfied with it. The CO have pre- determined decision already , the bank will write to them and ask them who confirmed to them that the account is not genuine. N/B : We are talking about my Fathers statement of account not someone else. My dear, my documents was correct and verifiable by any institution. Is it my Degree result, My license as a registered Nurse, my license as registered Midwife, Certificate of seminars attended or my SOP that I took my time to write. At did not mention in any place on my paper how much my Dad earns except his statement of account that I submitted. My employment letter is verifiable from my employer, so which document or documents are you referring?.... I am a very thorough person and have held post in Organization not just my professional body. Their decision was bent solely that the statement of account is not genuine. SantaClause: Sorry about your refusal is sad to hear that you where not just refused but ban....Australia has been really strict with their visa and everything...even those who are permanent resident is being strip off from being permanent resident and sending them home.
You can go ahead with whatever you want to do but my own advise is not to go and waste more money in court and everything...doing that is like suing Australia Immigration which is not just once person but the country immigration which i doubt they would be a head way when you start that.

How about we start by sponsor his bank or how much he has or something. your certificates your working references your SOP what did you state does your age tally with what you provided and so on? is the maths correct.
