mrvitalis:Did you allow the court to rule before declaring emphatically that the stay of execution would be granted? Are you the court as well? Maybe you need to start by taking your own advice as well. |
Cajal:Yes. FG through CBN aligned with the argument of Rivers state that the order should not be granted but the court ruled otherwise. So, why blame Tinubu for this? |
ceevictor:How can you appeal against a judgement that has not been given? |
mrvitalis:A stay of execution has not been granted so the judgement remains valid and enforceable. Btw, my intervention has nothing to do with the appeal of the judgement. This is just to clarify the misinformation and misunderstanding that politically biased commentators like Chidi Odinkaku and others are trying to pass that President Tinubu is the one behind the order despite what happened in Lagos in 2004. This current order was not issued by the president but by a court of competent jurisdiction. |
To start with, the Supreme Court rightly ruled in 2004 that Mr. President has no power under the Constitution to unilaterally withhold the allocation of a state.

Kobojunkie:To start with, the Supreme Court rightly ruled in 2004 that Mr. President has no power under the Constitution to unilaterally withhold the allocation of a state. So what happened in 2004? Governor Bola Tinubu of Lagos State created additional 37 Lgas to increase Local Governments in Lagos State to 57 from 20. Obasanjo disagreed and ordered him to revert back to 20 since the additional 37 were not listed in the constitution. Tinubu disagreed but changed the name to LCDAs. Obasanjo then ordered the Minister of Finance and CBN governor not to release the Local Government allocation of Lagos state until the new LGA/LCDAS are scrapped. Tinubu went to court and the then CJN, Hon Justice Uwais ruled that Mr. President does not have the power under the law to unilaterally withhold the allocation of any state without a court order. In the case of Rivers State, Mr. President did not give anybody any order to withhold the allocation of the state. Elected lawmakers from Rivers state approached the Federal High court to determine the legality of the state’s 2024 budget passed by 5 members out of 32. The Federal High Court ruled that the budget was not legally passed and should be represented to the full house for passage. The judgement was also reaffirmed by the Appeal Court. Instead of the governor to obey the court judgement, he opted to disregard the judgement and continue with the implementation of an illegal budget. Following the governor’s disregard of a valid court judgement, the lawmakers again approached a federal high court to get an order to stop the CBN and Minister of Finance from further releasing Rivers state funds to the governor since the state budget he is implementing has been invalidated by a court of competent jurisdiction. The Court agreed with the lawmakers opinion that releasing further allocation to the governor would amount to encouraging unconstitutionality and disregard to rule of law. The court then gave an order stoping the Minister of Finance, Accountant General of the Federation and the CBN governor from further releasing allocation to Rivers state till a proper budget is passed into law. Again, let me also state that CBN was a party to the case and they objected to the relief sought by the plaintiffs. That is, they supported Rivers state government’s position that the court should not grant the order to withhold the allocation. The court in its wisdom overruled the objection of CBN. So, it’s very clear that there is a huge difference between what happened in 2004 and resent court judgement in respect of Rivers state allocation. President Tinubu did not issue any order to stop the release of funds to Rivers state because he has no such powers. In fact, he objected to the order through CBN but was overruled. The order was issued by a court of competent jurisdiction and until it is set aside by a superior court, it remains valid and enforceable. Instead of trying to blackmail Mr. President with a decision he’s not even a party to, we should all encourage the governor to do the right thing by obeying the judgement of the appeal court. |
Why is BTC crashing so fast? What’s the bad news? |
gare:Ehn ehn 🤣🤣🤣. Which section of the constitution did you get this nonsense from? |
gare:A lawmaker can defect and cite division of his party as reason. When that happens, it is not you or the governor that can decide whether there is a division truly in the party or not. If the lawmaker says there is a division in is party, you either believe him or go to court to disprove his claim. It is only the court that can order him to vacate the seat and not any governor or nairalander. If the court of Appeal has already ruled that the 5-member loyal to Fubara are not properly constituted, the implication is that the remaining members are still valid lawmakers until a superior court rules otherwise. Since no court has ruled otherwise, the governor must respect the law and stop resulting to self help. Take the budget and other matters that requires legislative approval before them until the court rules that they are no longer members of the assembly. |
FFK’s leftover. Tinubu self go chop clean mouth ![]() |
gare:Their are process to be followed in leaving a party. For the princess to be completed, they must write to their ward chairmen notifying them of their withdrawal from the party. They will the go to join APC at the ward level and write to the Speaker of the house notifying him of their switch of party. In this case, nothing of the above happened. They never withdrew their PDP membership at the ward level and never joined APC at the ward level. In fact, they never notified the speaker of the house of assembly of their defection. And even the PDP national leadership already told the court that the 27 lawmakers are still PDP members since there is no record of them informing the party of their defection. So, they remain valid members of the Rivers State house of Assembly from the point of law. |
Segxydube:They did not join APC. They never wrote to anyone that they are no longer in PDP. PDP national leadership made it very clear in court that they are their party members. No court has declared their seats vacant. They remain valid members of Rivers State house of Assembly and several courts have made same pronouncement. Most importantly, the Appeal court has declared the budget illegal and until a superior court rules otherwise, the budget remains illegal. |
Macphenson:Judgement has already been delivered by the Appeal Court on the illegality of the 2024 budget. Except the Supreme Court rules otherwise, nothing is going to change that judgement. He either represents it or he will be impeached once the case is finalized at the Supreme Court. He still has the time to do the right thing before it is too late. |
Fubara should stop acting like a saint because he’s not one. One of the major point of the agreement was that the 2024 budget should be represented to the full Rivers State House of Assembly. The governor defiantly refused to do this and he’s now saying he was ambushed. He wanted to ambush the other side by tricking them into withdrawing all their court cases and then refusing to implement the other parts of the agreement but they outwit him. He should go back and do the right thing before it is too late. |
The reason adduced by the house of reps is watery. |
Macphenson:You’re very naive. Appealing a judgement doesn’t automatically amounts to a stay of execution. He will have to apply and the judge will have to grant it. As at this morning, no stay of execution order has been granted. Even if the case gets to the Supreme Court next year, he will still lose because the budget he’s implementing was never passed into law by the Rivers State house of Assembly. And guess what, that would be the end of Cubara. Implementing an illegal budget is a serious violation of the constitution and a very good ground for impeachment. The Supreme Court will never validate the affront on the Constitution so he’s going to enter into more troubles once the case is decided at the apex court. At this point, you all should be telling him to retrace his steps and do the right thing. It is not too late to represent the budget to the Rivers State House of Assembly. No one should be allowed to violate the constitution because of political differences. |
Fubara should do the right thing by representing the budget to the proper Rivers State house of assembly. You can’t be implementing an illegal budget and be crying for help from the judiciary. The court will not authenticate that illegality. The court of appeal judgement on the matter is as clear as daylight. 5 members cannot sit and pass the state’s budget in a 32- member house of Assembly. Allowing Fubara to get away with such illegality would amount to serious slap on the rule of law and our sacred constitution. Retrace yourself and stop committing impeachable offenses. |
OVB123:Peace is not an option on Nairaland. It’s all round trouble. |
Blessedman98:Northerners are the ones punishing themselves for politics. Tinubu is not responsible for the blackout but irresponsible northern politicians who paid bandits to destroy electrical installations so that they can blackmail the president with it. Pray tell, where in the world do bandits willfully destroy electrical installations? What’s in it for them? Left to folks like me, the electrical installations won’t be repaired for a year. Let the big mouth northern influencers who were paid to trend the story keep the threats coming. |
kettykin:No. He will appoint only Yorubas to that position. When you become president, you can appoint people outside of your region as COAS. |
SmartPolician:After Ihejerika, he appointed Ijaw man Kenneth Minimah as COAS. So, what’s your point? You want Tinubu to appoint an Igbo or Fulani as COAS so that he can be compromised against the president, right? |
kettykin:I guess you would have preferred General Simon Ekpa or one of his Biafran boys ![]() |
LegendHero:I guess he’s incapacitated. |
This is a welcome development. General Olufemi Oluyede is a very gallant and competent officer who is well respected in the service. He will command the Army to the admiration of all officers and men of the Nigeria Army. |
The lawmakers are bunch of clowns. The judgement is fully enforceable. The appeal already gave a final judgement on the constitutionality of the Rivers state budget so today’s judgement is simply to enforce the earlier judgement of the Appeal Court since the governor has decided to go ahead with implementing an illegal budget. |
This should be settled out of court. No need for all these drama. Sit down together man to man and settle the matter. |
mrvitalis:Stayed by who? Can you provide evidence to support your claim that the judgement has been stayed? |
Court case over what? No need politicizing this abeg. The guy is a human being like the rest of us and he has apologized. The bolt driver should sit down with the lawmaker and resolve the matter like men. No need allowing attention seeking activist like Deji Adeyanju to start using the case to seek public relevance. |
mrvitalis:The state governor has no power to implement an illegal budget. There is already a judgement on the illegality of the current Rivers State budget and until it is rectified by way of a proper passage into law, no judge will issue a stay of execution of the judgement. The era of disobedience to court judgement is gone. Fubara either obeys the constitution or forget the state’s allocation. |
mrvitalis:The judgement will be implemented immediately and no court will grant a stay of execution. The appeal court that Sim will run to already ruled on the unconstitutionality of the Rivers state budget. Instead of thinking of more illegal and unconstitutional ways around this, why not advise the governor to do the right and legal thing by taking the state’s budget to the authentic Rivers State house of Assembly as required by law and affirmed in the judgement of the court of appeal. Why should the governor be doing the wrong thing because of politics? Why can’t he obey a simple court judgement? |
Racoon:Yeah, fellas like Abia governor who budget 81% of the entire IGR of the state for government house expenses. |
helinues:Seen. No be fight. |
