By default couples give birth as long as they have sex and birth control is the subject-matter of contention here; birth control is seen as unacceptable move in the North and some part of Nigeria due to mostly future and traditions of the people. The biggest mistake we do in Nigeria is analysing people's attitude or lifestyle out of ignorance and cooking conspiracy to blackmail others. |
Electoral Act: I did not order Senate to remove Section 84 (12) – Buhari tells Federal High CourtPublished Contrary to the claims of the Peoples Democratic Party PDP in a suit instituted against him and 12 others on the Electoral Act, Buhari said that he only expressed reservations and concerns in respect of the aspect of the Electoral Act. The president’s position was contained in a counter affidavit filed at the Federal High Court at the instance of the Attorney General of the Federation AGF and Minister of Justice, Abubakar Malami. In the joint counter affidavit by Buhari and Malami to debunk PDP’S claims in the suit, the AGF explained that Buhari on February 25, 2022 gave proper, full and unconditional assent to the amended Electoral Act. The counter affidavit by the President and Malami was filed on their authority by a Senior Advocate of Nigeria SAN, Oladipupo Okpeseyi and deposed to by Abimbola Akintola, a legal practitioner. Buhari and Malami averred that the claims of PDP in its suit against them on the Electoral Act are totally false and replete with gross untruths aimed at misleading the court to give judgment against them. The counter affidavit read in part ” The assent of the 1st defendant (Buhari) to the Electoral Bill given on February 25, 2022 was proper, full and unconditional. “The 1st defendant (Buhari) assented to the Electoral Bill 2022 on February 25 but did not give conditions or directives to the National Assembly in the manner erroneously deposed to by the plaintiff (PDP). ” At no time did the 1st defendant (Buhari) give any directive to the management or leadership of the National Assembly as regards the removal of section 84 (12) of the Electoral Act 2022; from the Act. "Prior to assenting to the Electoral Bill 2022, the 1st defendant (Buhari) merely expressed his observations and concerns about the constraints of section 84 (12) of the Bill on serving public office holders and political appointees but gave his assent to avoid further delay as time was of essence. “That the 1st defendant (Buhari) merely expressed his views not only to the National Assembly but to the entire nation as regards the inconsistency of section 84 (12) of the Electoral Act with other provisions of the Constitution. “On March 8, 2022, 1st defendant (Buhari) officially wrote the Senate President and House of Representatives Speaker to express his concerns about section 84 (12) of the Electoral Act and formally requested for amendment to be effected on the section so as to eliminate areas of infarction with the Constitution. “I’m aware that the National Assembly neither accepted nor acted on the opinion or suggestion of Buhari. “In this instance, 1st and 2nd defendant, (Buhari and Malami) truly and firmly believe that section 84 (12) of the Electoral Act disenfranchises and discriminates against Nigerians in public service or public office holders who are political appointees and prevent them from engaging in the electoral process in exercise of their inalienable rights in a participatory democracy. “That Buhari and Malami have never taken it upon themselves to declare section 84 (12) or any provisions of the Electoral Act unconstitutional as such is beyond their constitutional power. Besides, Buhari and Malami claimed that a Federal High Court in Abia State had in March through a judgement by Justice Evelyn Anyadike struck down the section and ordered that it be deleted forthwith for being inconsistent with the Constitution. The two defendants said that both the National Assembly and PDP have since appealed the judgment adding that it is only the Court of Appeal that can restore the section into the Electoral Act and not any high court. Insisting that the PDP suit has become academic and constituted abuse of court process on the strength of the pending Court of Appeal matter, Buhari and Malami asked the court to dismiss the PDP suit. They argued that PDP should not be allowed to take over the functions of the National Assembly since it has no power to amend or enact law. Buhari and Malami also averred that PDP has nothing to suffer if the contentious section is deleted adding that removing the section will deepen the practice of democracy and stop discrimination against public servants and public office holders. Justice Inyang Eden Ekwo of the Federal High Court in Abuja had on March 7 stopped Buhari, AGF and Senate President from tampering with the newly amended Electoral Act 2022. The judge in a ruling on an ex-parte application by the Peoples Democratic Party, PDP, agreed that the Electoral Act having been assented to by Buhari has become a valid law and cannot be tampered with without following due process of law. Justice Ekwo agreed with Chief James Ogwu Onoja SAN, counsel to PDP, that the proper place to challenge the validity of any existing law or the Electoral Act is a court of competent jurisdiction. Specifically, the court had restrained all the defendants in the suit from removing section 84 (12) of the Electoral Act or preventing It from being implemented for the purpose of the 2023 general elections. Who voted for OBJ the most that made him President between 1999-2007? North. FOOTBALL SUPER AGENT MINO RAIOLA HAS DIED Agent Mino Raiola has died in hospital after a short illness, according to reports in Italy. The representative became perhaps the most famous agent in football, with clients including Milan striker Zlatan Ibrahimovic, Borussia Dortmund forward Erling Haaland, Juventus defender Matthijs de Ligt, PSG goalkeeper Gianluigi Donnarumma and Manchester United star Paul Pogba. To be honest, North was supporting him enormously but his alleged link to religious sentiment has portrayed him in bad position and APC must blame herself for handing power to PDP if PYO wins primary election. Most of those advocating for PYO are either ignorant of political structure of Nigeria or PDP members who see PYO as a soft target and easy candidate to smear. Selling Amaechi is much more easier in the North than PYO. |

Barring any last minute change, the top echelon of the ruling All Progressives Congress (APC) will disqualify the minister of labour and employment, Senator Chris Ngige; minister of transportation, Rotimi Amaechi and the minister of state for education, Chukwuemeka Nwajiuba, from contesting in the party’s primaries slated for May 30 and June 1, 2022. The three ministers are running for the presidency on the platform of the APC but are yet to comply with the provisions of the party’s new guidelines for the nomination of candidates for the 2023 general elections by resigning their positions as ministers three days to the deadline. There are reports that the attorney general and minister of justice, Abubakar Malami (SAN), is equally warming up to contest the Kebbi State governorship poll on the APC platform. APC’s new guidelines for nomination of candidates for the 2023 general elections provide that all political appointees must resign 30 days to the party’s primaries or would be disqualified. Sequel to this, Amaechi, Ngige and other political appointees running for various offices on the platform of the ruling party are left with just three days to resign or risk disqualification. The APC new guidelines read in part: “No political appointee at any level shall be a voting delegate or be voted for the purpose of the nomination of candidates. “Any political office holder interested in contesting for an elective office shall leave office 30 days prior to the date of election of party primary for the office sought. “Violation of any of these guidelines shall attract automatic disqualification.” Similarly, Section 84 (12) of the new Electoral Act directs all political appointees seeking elective office to resign ahead of any party primary they plan to participate in. The APC national publicity secretary, Felix Morka, had said the party would ensure that all political appointees willing to contest election on the platform of the party resigned in line with the provisions of the new Electoral Act. I’m not aware of new rules – Labour minister Ngige, while fielding questions from state house reporters on Wednesday, said he had not been informed by the leadership of the party, noting that he would be guided by the provisions of the Nigerian Constitution. He said, “I don’t know about that; I’m hearing for the first time from you. But like I always say, I’ll be guided by the letters and spirit of the Constitution of the Federal Republic of Nigeria. You are pushing me into something that is not necessary to discuss, because that aspect of the law enacted by the National Assembly via the Electoral Act, that Section 84:12, has been struck down by a court of law and the case is on appeal.” Asked about his take on the view of some Nigerians that the N100m fee to buy presidential forms is “outrageous”, he said, “Well, that is the people’s view. I had said earlier that I made a budget for N50m, and it is now N100m. So, I have discussed with my supporters and they are raising the money to augment whatever was before now. So, when they finish augmentation, I believe that we’ll get up to N100m so that we can purchase our forms.” Nwajiuba pays N100m for presidential forms The minister of state for education, Chukwuemeka Nwajiuba, yesterday, bought his expression of interest and nomination forms for N100m and became the first presidential aspirant to obtain the forms at the APC national secretariat in Abuja. The APC National Executive Committee (NEC) had approved N30m for expression of interest form and N70m for nomination form amounting to N100m for presidential aspirants on its platform. N44.2m missing at APC secretariat The sum of N44.2 million got missing on Wednesday at the national secretariat of the All Progressives Congress (APC). The development led to the abrupt end to the sale of forms, especially for the Senate and House of Representatives over the sudden disappearance of the N44.2 million. The party had put up a canopy where the forms for Senate and House of Representatives were being sold to prospective aspirants. But around 4:15p.m, the canopies were removed by the party and it directed the staff to continue the sale of forms at the International Conference Centre, Abuja. DAILY POST equally gathered that due to the inability of the security agents at the party secretariat to control the crowd, the party chairman, Senator Abdulahi Adamu directed that the staff selling National Assembly forms should move to the International Conference Centre (ICC). It was further gathered that the development may not be unconnected with the sudden disappearance of $75, 000, which is equivalent to N44.2 million. A staff of the party, who pleaded anonymity, said the canopies were removed after it was discovered that the money was missing. The source said: “We heard that someone came to the party secretariat today, but because of the crowd, he could not come into the secretariat with his car. Igbo presidency: Stop accusing the north, you’re not sincere – Nwosu slams southern politicians A chieftain of the All Progressives Congress (APC) in Imo State, Uche Nwosu, has said that it was unfair for some southern politicians to accuse the north of trying to retain power while they have refused to support the southeast to produce the next president. According to Nwosu, such politicians are not sincere to themselves, insisting that it was actually the turn of the people of the southeast region to produce the next president of Nigeria. The former Imo State governorship aspirant said that those agitating for power shift to the south without supporting the southeast in 2023 are being unfair. Nwosu said it was double standard to deny the southeast, being the only zone which has never produced the country’s president, the opportunity to do so. The former governorship candidate spoke with select journalists in Abuja, Wednesday, where he insisted that the only way equity and justice can be truly served is for other zones in the South to support the Southeast. Two influential governors from the northern part of the country are behind the return bid of former President Goodluck Ebele Jonathan, Daily Trust reliably gathered. Multiple sources, who are in the know, said the two governors, close to President Muhammadu Buhari, have secured the buy-in of a section of the presidency to actualise their agenda of drafting the former president into the presidential race. The sources mentioned the names of the governors but were withheld by this paper because our reporters were unable to get their reactions as they are out of the country. While one of the governors is from the North West, the other is from the North East geopolitical zone. The sources said the duo began the moves last year but that they jettisoned it to promote the candidature of the Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele. However, when the Emefiele’s project was not flying, the governors returned to the Jonathan bid. The two governors have been playing key roles in the affairs of the APC in the last few years. The former president had since keyed into the move as evident in his body language. He had last week told some of his supporters who were insisting he should declare to “be on the watch”, a disposition political pundits described as acceptance. It was learnt that the Bayelsa-born former president is now waiting for the appropriate time to join the ruling party and declare for the race. President Buhari had defeated Jonathan in the 2015 general election, ending the 16 years of the Peoples Democratic Party (PDP) in the country. In the last seven years, the former president has not been attending activities of his party. This is just as his romance with President Buhari and top shots of the ruling party takes the centre stage, a development that has pitched him against opposition leaders in the country. The move to return Jonathan One of our sources, a former governor said the two governors have reached out and sold the Jonathan project to the presidency. “It is (withheld) that are behind it and they are promoting it to checkmate Asiwaju Tinubu when they discovered that the vice president does not possess the structures to put up a strong challenge,” he said. Asked why the governors who are APC members are drafting the former president, he said, “They are doing it to advance their ambition. They want someone that would only be in power for a term. They also want him to pick one of them as running mate”. An ally of the president, while corroborating the former governor’s statement, said the two governors brought the Jonathan project to advance their ‘’selfish interest.’’ But a source close to the former president claimed that Jonathan is being promoted by his successor. “His number one backer is the president. Do you think he would start if he did not get the backing of Baba? He did not go and say I wanted to (vie for the presidency). He was asked to do so because they are more comfortable with him succeeding Buhari,” he said. A former Chairman of the APC Elders Forum in Bayelsa State, Diekivie Ikiogha, said all is almost set for Jonathan’s exit from the PDP. “His declaration would be based on an invitation by APC to come over and he is considering it. A lot of things have been done; the discussions are ongoing, so, he will be invited.” “We are persuading him and it is still going on, but I believe that he can yield to it. What I am telling you is that, when the platform is clear, he will contest. If it is clear, he will contest,” he said. Also, a public affairs analyst, Mr David West, said though Jonathan had a few years ago announced that he was no longer interested in active politics, he has the constitutional right to contest for any office in the land. He, however, stated that he doubts if Jonathan will perform better than he did during his first tenure. He said: “For me, it is his constitutional right to belong to any political party if he wants and if he wishes to contest for any political office in the country. “I know if Jonathan is allowed to rule Nigeria again, he will not do more than four years tenure, because anything short of that will be a crisis.” Ayade declares for presidency, pledges to step down for Jonathan Governor of Cross River State, Professor Ben Ayade, has announced his intention to vie for the presidential ticket of the APC after informing President Buhari at the State House, Abuja. He spoke on his ambition Tuesday after a closed-door meeting with the president. Ayade, who said President Buhari advised him to do more consultation before declaring, added that he came to seek spiritual and political guidance from the president on who would take over from him come 2023 for the sake of continuity. He, however, said he would step down if former President Jonathan is picked as the party’s consensus candidate. “I have great respect for President Jonathan and so I have no challenges whatsoever. I believe that the party leadership will decide on the appropriate candidate that will take our party to victory. “But at any point in time that the political leadership of my party, the APC feels that President Jonathan is the appropriate candidate that will take us to victory, I will turn my support for him,” he said. Stakeholders reject plan to adopt Jonathan The APC Presidential Support Group has said that the plan to adopt Jonathan as the APC presidential candidate for the 2023 election is a joke taken too far and unacceptable. The Convener of the organisation, Mr Owolabi Dauda and Secretary, Abdullahi Bilal, told reporters on Tuesday in Abuja that adopting Jonathan by whoever is a disservice to the APC, especially that the importance of winning the 2023 presidential elections cannot be overemphasised, in the bid to ensure continuity in the laudable policies and initiatives of the APC led government in Nigeria. “We are constrained to lend our voice to an ugly plot that is being hatched by some members of the APC concerning adopting former President Goodluck Jonathan as the presidential candidate of the party in the 2023 presidential election. “By all stretch of the imagination, this plot is ill-timed and not in the party’s interest at large. Such a move implies that the party might be heading towards a resounding electoral defeat in the presidential election,” the group said. Lawyers differ on Jonathan’s legal obstacles Lawyers have disagreed with the move by Jonathan’s handlers to draft him into the 2023 presidential election, pointing to legal issues. Reacting, Professor Paul Ananaba (SAN) said Jonathan is not qualified to run for the office of the president because the constitution does not envisage that any Nigerian will be in office for more than eight years under any circumstance. “If you add the four years – the two years under Yar’adua, and another four years – it will be more than eight years,” he said. Similarly, Buhari Yusuf said Jonathan is ineligible under the law saying the combined reading of sections 137(1)(b) and 182(1)(b) of the Nigerian Constitution, “Makes it practically impossible for someone who has taken the oath of office twice as president to come on the third one.” According to him, “The fact that the president completed the first term of a demised president does not call you to read meaning into the section and I don’t think there is any manoeuvring space for somebody to escape.” However, Murtala Abdulkareem (SAN) said the decision of the court in the case of Ayuba Sabo and Ahmed Abubakar vs Ibrahim Gaidam over the Yobe State governorship election of 2015 has resolved the issue. “He (Jonathan) can contest, but if he takes the oath in 2023, he will not be eligible to contest afterward,” he said.
