mushystuff: The Executive can and does investigate itself; that is why Babachir Lawal was investigated by a committee set up by the same Executive and he was removed yet the Executive refused to bring him before the judiciary for trial and judgment. It is also why when a police officer commits an offence, an orderly room trial is first set up for such an officer by the same police authorities before he is subjected to the judiciary/courts. It is also why the action against the former DG, DSS was handled within the Presidency and he was eased out of office yet no trial for the numerous charges against him. In fact, it the self-regulatory powers of the three arms of government that ensure the principle of separation of powers. The Executive should not be seen to attempt to over-reach itself for any reason!

If we are to go by what Femi Falana and Afe Babalola have said, that no external bodies can investigate a seating judge for any crime, then wherein lies the doctrine of Separation of Powers. Even the Executive with its clearly spelt out immunity cannot investigate itself. Does the NJC have any agency that can conduct a detailed investigation on a criminal case? Obviously, we have a lacuna here and the Judiciary is exploiting that ambiguity. But the obvious is inevitable because either way, the chicken will come home to roast.
If the CJN can only be investigated by the NJC then he has a moral burden to step aside for a proper investigation. |

truthfulparrot: It is obvious that some people deliberately misadvised the president on this issue. A lot of people who have not read the petition have been busy running thier mouths. The CJN was never accused of stealing money. He was accused of not declaring some domiciliary account in 2009. It is important to note that he eventually declare all these accounts in 2016 The people who deliberately misadvised the president are only interested in causing more problems for him. It's the constitutional duty of the Attorney General to receive petition and take appropriate action. He doesn't need authorization from the president . What everyone is referring to has no constitutional backing. It's an Appeal Court pronouncement which has not even been tested at the Supreme Court. That aside, if everyone is claiming the judiciary cannot be investigated by external bodies, wherein lies the doctrine of Separation of Powers? Even the Executive, with its clearly stated immunity, cannot investigate itself against irregularities. But we always see the Legislature and Judiciary claiming to have such powers. Obviously, there appear to be a lacuna here and the Judiciary is just using its position as the interpreter of the law to protect it own. MadamExcellency: Do you know that CCB lost both Tinubu and Saraki's cases because they never called the culprits to point out the discrepancies to allow them the opportunity for correction or denial before CCB takes the next step? I must admit, there's clearly a lacuna here if everyone had to refer to an Appeal Court case that had been appealed . This case has not even been tested at the Supreme Court. MadamExcellency: Absence of Declaration of Assets is not listed as a criminal offence but it is a statutory obligation to check against fraudulent enrichment by public officers.
In this case, he declared his assets as required by the law but failed to update it at a time required. He wasn't accused of bribery or fraudulent enrichment which are crimes.
