There's no overvoting anywhere, there are cases of bvas not reading voter's card and the voter will still proceed to vote, another case of replacing a malfunctioning bvas halfway.. Everything is caused by inec
In the case of replacing a malfunctioning BVAS,, then, let all the BVAS that did every accreditation in the Polling-units properly synchronise their details.

This becomes a costly error which the INEC failed to properly establish

Gabrielwilliams:
Good day Guys,

Help me clarify an issue. My friend was telling me about how he had sex at the back seat of his car and the following week, his engine knocked. Another bro said he had sex in his car and his brand new car started developing different faults.
Let me ask, is it true that sex in the car damages your car? Kindly share your story or opinions about this. I just bought a car.
You Just Bought A Car is one issue.

Having sex in a car is another totally-different unrelated issue.

Now, are you trying to relate the two issues by planning to have sex inside your newly-bought car??

the law should just be changed simple...

That is still what I am telling you, why allow violence take place, must people die because election is taking place, if everybody is aware that at the end any over voting done will be removed, I will not be bothered if I am on the queue, do what you want I know at the end what you do will be a waste of time, only accredited voters will be counted by the INEC server, so must we go through the hard way to get things done....

Why don't we make voting easy, do you know the tension everyone will have at each polling unit that their votes can be cancelled also remember that anywhere there is electoral violence the polling unit can still be cancelled, also if you beat up the compromised INEC official.

Why not just avoid all these issues and make voters relaxed and reduce tension and violence..
There were measures put in place to detect over-voting.

The actual thing that happened was that.....

The same methods which the APC used to win PDP in the Rerun of 2018,, that was what PDP came back and used in his own stronghold.
The PDP never knew that the BVAS had changed the game drastically from what it used to be in 2018.

Now, those genuine votes of APC and PDP were affected.

But then, if this could be a huge lesson, let our future Elections get to know that Over-voting is more dangerous than box-snatching, being that, even after the results are called, the over-voting can still be detected and all affected Polling-units totally cancelled.

When the Electoral Law was signed, I was among those who came to this same Nairaland to warn the users that the BVAS is a very deadly weapon against over-voting,, and that the repercussions are merciless..

This is not a deadly virus disease, this is an election, that is why I asked, do you know if the INEC official in your polling unit is already compromised, so is it the voters fault in the polling unit, why make people's efforts waste in things they have no control over....
This Election is a do-or-die affair.
It's even more serious than a deadly virus disease.
It is the people at a polling-unit that would always allow the INEC Official to do nonsense, being that they themselves wanted such manipulations to happen.

But in a situation where they don't want any manipulations, and the INEC Official tries to do any nonsense, that is suicidal on the part of the INEC Official.

INEC on the other part should warn politicians to desist from over-voting, since they would be doing themselves more harm than good by involving in such.

The people have control over it.
And it's very simple.
Don't let over-voting to occur.
In fact, guard against it.

Quarantine is different from deportation, deportation is total cancellation, quarantine is to hold, do proper treatment and then release, that is still he same thing I am saying, quarantine the entire polling units affected do the deductions(treatment and inspection) and release the valid ones( non infected) and then you can deport the ones that are infected, you will not just deport everybody.
You have not experienced an isolated quarantine in an isolated facility.

Secondly, nothing prevents the country from deporting all of them, if the country got to know that they all actually tested negative in their country before leaving.

Deadly virus disease.??
Treat them and release them??

Stop this discussion.

You must tell me which party the 6 votes went for, because they voted for a party or parties first, that was how they were able to know there was over voting without the BVAS accreditation, so the question is wrong in itself...
Oga..
See,, you can only know that there was an excess., And the BVAS could tell the number of such excesses..
BUT NOBODY KNOWS HOW THOSE EXCESSES ENTERED, AND FOR WHICH PARTIES THEY WENT TO.

If someone loaded a bag full of fruits - ALL COUNTED AT 300 FRUITS ALTOGETHER - and sent them to you through waybill, but he didn't let you to know how many each of the individual fruits were..
If you opened it and counted 325 fruits altogether, how would you know which of the fruits exactly were in excess of what the person originally sent??
(Since it was a secret ballot)
In fact,, where exactly along the way did the excess of 25 fruits enter the bag??
(You don't know these answers.. all you know is that there were 25 extra fruits)

Thus, you don't have to disenfranchise the wrong party by deducting wrongly from them.

I agree that the punishment is huge..
But then also, the punishment also gives people the excess powers to join INEC and all the stakeholders involved in avoiding its occurrence.

The judgement is like saying that if a passenger from a particular plane was caught with an invalid passport then you should deport the entire passengers that came with him in the plane, that we are not sure about all the passengers, does it make any sense if you can simply remove the affected passenger and deport and allow the rest go in, if such happens to you in the airport and you were deported because of a particular passenger or a few passengers even if there is a law in that country for it, won't you see it as an erroneous law?, how would you feel, so you just wasted your time money and resources and did not still achieve your aim because of another person or people.

that is just the same thing here....
Take same scenario..
366 Passengers on a plane landed at an international airport.
They were all tested for Ebola (or any other deadly virus-disease) before they boarded the plane, and none of them tested positive..
But when they landed, three people tested positive.

Tell me in all honesty.
How many people should be quarantined.??

My own response:
Everybody on that plane Ooo.
Both passengers and crew..
Including those people who tested them after they landed.
And all those who came in contact with them.

So,, bring up another scenario.

Oga what are you saying, how can you cancel the entire votes when you can simply remove the over votes that went for any of the party involved, that is what the tribunal is supposed to do since we can identify the over votes to any party involved, do you now what this judgement will do to other voters that took the stress to stand under the sun and did the right thing, the law makes them look like people who just wasted their time trying to do the right thing in the same polling unit that was affected.

Please, that thing you wished the Tribunal Judges to do,, do it with the question I asked.

Simply determine those 6-over-voting votes in the practical question above, and deduct them.
Then post the new results here.

And we can continue arguing from there.
Politics › Re: INEC To Test BVAs With Mock Accreditation Exercise by BluntCrazeMan: 9:08am On Jan 28, 2023
Brendaniel:
After finding out the method used for the judgement on the election tribunal that gave victory to Oyetola over Adeleke, I would say it is a recipe for disaster, the method applied was cancelling all the votes of a polling unit because of over voting in that particular polling unit.

The questions I ask are:

1. As it happened that there were over voting in various polling units in the Osun election, what if each opposition connives to perpetrate over voting in polling units in each opposition strong holds?

2. What then is the use for BVAS in over voting if after the BVAS is able to identify the number of over votes only to end up cancelling all votes(valid) and over votes(invalid) ? That is like throwing away a baby with the bath water.

3. If there is an election tribunal like this and a rerun takes place, what if the same over voting keeps occurring over and over, would they keep repeating the election tribunal process and back to rerun again?

In my opinion, the law is just an error or a purposeful scheme to rig an election using what I call reverse voting
Just simply tamper with your opposition strong holds and invalidate their votes, So we might be having a case where a carefully selected and protected minority will determine winners of an election instead of the majority carrying the votes.

Implications:

1. It will make elections become very dirty because politicians will be all about scheming to invalidate votes in opposition strong holds.

2. It will make the voters lose confidence in the electoral process, because a voter will not be sure if his vote will be invalidated or not by someone else scheming with a politician in his/her polling unit.

3. It will make voters wear out easily and may cause voter apathy when you have reruns after stressful elections, thereby reducing voters turn-up in reruns.

4. It may not reflect the true will of the people and also reduce the total number of voter participation, just like the Osun election tribunal, the total number of votes cast for both PDP and APC after the cancellation doesn't reflect the true will of the people to declare Oyetola the winner.

5. Elections will cost more because of Tribunal, reruns and time wasting.

6. It could lead to anarchy and total chaos, like in some volatile states in the north where they riot over political results, just imagine after election and INEC says they have cancelled over 20,000 polling units across the north which were all stronghold of a particular candidate, because of over voting of less than 2000 voters, imagine what will happen in the aftermath of such news.

Solution:

In situations of over voting, Why not just deduct the invalid votes(over votes) and count the rest, the BVAS already identifies the number of over votes(invalid votes), doing so, INEC will avoid a lot of election tribunals, scheming by politicians, reduce cost of doing reruns, make more accurate results, increase voters confidence, reduce time wasting, reflect the true will of the people and avoid anarchy.
One thing is,, we keep trying to make things better with each turn.

One truth right now is that: “over-voting had been technically defeated”.

We are left with “vote-buying”, which would also be defeated very soon.

Now, for an Opposition to cause over-voting in an Opposition’s stronghold.??
Like, taking 10-to-15 infiltrators and going to a stronghold of about 30,000 dedicated voters who are ready to protect their votes and make it counted??

Is that not suicide.??
Especially now that “OVER-VOTING” had been established to be a very bad EVIL that must be avoided by all-and-every means possible.??

Just remove the over voting, because if you claim that the over votes were added, there must be a party those over votes went for, remove it from the party that it went for, you can't tell me you were able to detect over votes and don't now the party the over votes went for because they voted for a party, remove the vote from the part they voted for, the thumbprint is there, that is what made it over votes in the first place that BVAS did not accredit....
Oga Sir.

There is a practical situation in front of you.

A particular polling-unit had a problem.
And you're the PO in the Polling-unit..
And after counting the votes,, these were the outcome.. (As stated in the question above).

Use that magic of yours and determine the number of OVER-VOTING that went to each of the parties, and deduct them here and give us the corrected figures.

Now,, let it be that you were one of the Tribunal Judges.
And this same situation came up.
(Just like in Osun Election Tribunal)..
You were not there in the field where they conducted the election.
You were just a Tribunal Judge.
Use that same magic of yours to determine the number of over-voting that went to each of the parties, and deduct them accordingly.

**(You have a very practical question right in front of you, and you're still quoting theory??
Do the applied practicals already with the demonstration in front of us here)**..

The law will only cause more problems, you don't cancel a whole polling unit when BVAS can tell you the number of invalid votes, read this and see why
https://www.nairaland.com/7544115/implication-osun-election-tribunal-anarchy#120437236
Answer this question below..

If there were actually 353 Accredited Voters on the BVAS inside a polling-unit.

But the INEC Officials in the PO recorded 362 Accredited Voters and 359 total voters in the results-sheet.

And then,, APC Got 165 Votes..
PDP Got 169 Votes...
All the other parties together got 23 Votes.
2 votes were rejected as Void..

Now, if you check the details well, you can see that there is “Over-voting” in the Polling-unit with 6-votes.

So,, if we are to deduct those 6-votes,, tell me how we are going to deduct them.

Use the above example that I have already given.

How would you cancel the entire votes in the polling unit because of a few wrong votes, if the BVAS still identified the number of over votes, why not just delete only the over votes and count the rest, Tinubu is trying to use the BVAS to rig election...

it is a wrong form of deduction, they should have deducted the over votes only...

The price to pay for Over-voting is too much.

There is nothing like "direct" win.dont add or subtract.
Subsection one says if a winner wasn't validly elected on any ground at all, there should be fresh elections within 90 days.take note of fresh elections
Subsection 2 says if if the winner wasn't qualified, the next runner up is declared winner.no rerun.
Subsection 3 says if the winner wasn't validly elected, that is he did not score a majority of lawful or valid votes as in the case of osun, the person who scored it will be declared winner.there is no provision for a rerun, supplementary.it is either a fresh elections or a winner emerges.since cancellations were partial, there cannot be any election. [i]the only authority with power to cancel results and order rerun based on overvoting is inec[/b]
This becomes another Error from INEC..
Their first error in Imo State cost them so much.
They wouldn't learn from it.

Now,, they had committed another one.
