Oyetola has satisfied the requirement of having the highest valid votes and spread
Section-51..Sub-section-4 should not be thrown away.

The Tribunal performed the Functions of INEC in determining over-voting..
Then it should also complete all the INEC functions in Section-51.. Sub-section-4, which has to do with the CONCLUSIVITY of the election.

A rerun was not part of the prayers.rerun is for inec during the election proper
If the requirements for “A DIRECT WIN” are not satisfied, then there should be a rerun.

Meanwhile,, in the appeal, the PDP might include it in their prayers

Do you know the funny thing, go through one of your threads. You wrote that even days after the election (I think it was Anambra or so), that INEC was yet to update some results in their portal. This is what exactly happened...

Section 136 subsection 3 States that a tribunal can declare a winner after deduction.the section you quoted applies to inec
Read the Section-136.. Sub-section-3 again.

The Tribunal or the courts can declare the highest number, provided the candidate satisfied the requirements of the Constitution and the Electoral Act.

Thus,, even the Tribunal and the courts must check for the requirements too..
If not, then the results are INCONCLUSIVE..
(It's not only INEC that gets to check the requirements)

AND YOU KNOW WHAT THAT MEANS??

INEC issued an updated one and adduced reasons why the first was issued.

Even if you follow the evidence act, you don't jettison primary evidence for the secondary one.
Well..

Until I read the full judgement.
So I can see the logic behind their reasons for accepting the BVAS-Report which the APC provided.

This is exactly what I said in my comment up there.

INEC should have done Justice to this before declaring winner and that is what the amended law says.

So I don’t know why OP is citing a law that is not even the bone of contention when INEC should have already did that before getting to court.

Law talk say make INEC themselves cancel in area where there is over voting. INEC no do anything, declare winner, and Oyetole took them to court.

Tsefini.
When I was blaming INEC,, people thought I was joking.

Now, the system has scattered them.

All those Presiding Officers and APO-1 and APO-2 in all those 700+plus Polling-units must be severely punished for bringing bad name to INEC.

See, the Tribunal Chairman based his evidence on the BVAS report which is a secondary evidence rather than the primary evidence, the machine itself.

What about the voter's register.... Useless to Justice Kume.

One of two things will happen at the Appeal Court, either it is upturned or a retrial will be ordered but since there is no time, it should be upturned.

It is funny....just take a look at the majority judgement and tell me you wouldn't laugh.
The APC were able to establish beyond every reasonable doubts, that the so-called BVAS-Report was generated from the Primary Evidence (which happened to be the BVAS Machines), and then, INEC themselves couldn't refute the very established fact that the BVAS-Report came from the BVAS Machines, and they also accepted that the information that were contained in the BVAS-Report was generated under their supervision, and signed as certified true copies from them..
(Only if they knew what it really meant for them to certify such a document)

The lead judgment of the Osun Tribunal was hinged on over voting.

But what did the 2022 Electoral Act say about over voting?

Read the provision of the Electoral Act on over voting as captured in section 51 and decide for yourself if justice was truly served in Osun or not.

You were referring to Sub-section 3, that there won't be any return, until the election in such cancelled Polling-units were re-conducted..

However,, consider the Sub-section 4...
Where it says that, if the cancelled Polling-units are not going to affect the over-all results of the election, then a winner would be announced.

So..
We are assuming that they considered the 4th Sub-section too, and it was satisfied.

INEC HOLDS MOCK ACCREDITATION ON FEB 4TH..
Commends Nigerians’ Enthusiasm For PVCs

By Dominic James

Friday 27th January 2023

The Independent National Electoral Commission (INEC) has fixed Saturday 4th February for the mock accreditation exercise at which some of the Bimodal Voter Accreditation System Machines (BVAS) procured for the 2023 General Election will be tested. The Commission has also commended Nigerians for showing enthusiasm to collect their Permanent Voters’ Cards (PVC).

Speaking at the Commission’s meeting with Resident Electoral Commissioners (RECs) which began today in Abuja, the INEC Chairman, Prof. Mahmood Yakubu said that having taken delivery of and tested the BVAS machines procured for the general election, the next step “is to conduct field tests across the country involving actual voters in readiness for nationwide deployment.” The Commission conducted a similar mock accreditation exercise ahead of the Ekiti and Osun State governorship elections.

According to Prof. Yakubu, 12 polling units have been designated in each State of the Federation and four in the Federal Capital Territory (FCT) on the equality of the country’s 109 Senatorial Districts for the exercise. A comprehensive list of the polling units, including their names, PU Code numbers and distribution by State, Senatorial District, Local Government and Registration Area (Ward) will subsequently be uploaded to the Commission’s website.

The INEC Chairman appealed to registered voters in the designated polling units to appear on the scheduled date with their PVCs for the mock exercise. He explained: “Doing so will help to reassure the public of the robustness of our system and to strengthen our processes ahead of the General Election. Civil society organisations, the media and the general public are welcome to observe the process. At the end of the exercise, the 436 BVAS machines involved will be reconfigured before they are deployed for the General Election.”

On PVC collection, Prof Yakubu said the Commission was encouraged by the determination of Nigerians to collect their cards. However, he also acknowledged a few issues to be addressed.

His words: “The Commission is encouraged by the determination of registered voters nationwide to collect their PVCs and the actual level of collection so far. For instance, in Lagos State, which has the highest number of registered voters in the country, the Commission delivered 940,200 PVCs from the recent voter registration exercise (June 2021 to July 2022) for both new registrants and requests for transfer and replacement of cards.

“As of yesterday Thursday 26th January 2023, 839,720 PVCs have been collected, representing 89.3% of the total figure. This meeting with RECs will consider reports from other States of the Federation and the Commission will not hesitate to consider additional measures to ensure that all citizens have ample opportunity to collect their PVCs ahead of the General Election. We wish to assure Nigerians that the Commission will always be responsive to the needs of the electorate.”

With exactly four weeks to the general election on 25th February 2023, Prof. Yakubu also affirmed the Commission’s readiness for the polls. His words: “I am glad to report that movement of materials for the election to various locations nationwide is being concluded. Training of officials will commence shortly. Ongoing consultations with stakeholders will be intensified. Airlifting and delivery of sensitive materials to States of the Federation has gone far. Accreditation of national and international observers and the media is being finalised. Critical service providers in the area of transportation have reassured us of their commitment to efficient logistics for the movement of materials and personnel to various locations while the security agencies have reaffirmed their readiness for the election.”

Now..
I need some statistics...

The number of cancelled Polling-units are now much,, which leads to more Numbers of corresponding Affected Registered Voters Who Had Collected Their PVC’s In The Cancelled Polling-units.

Thus, I need to know the total number of such affection Registered Voters who have collected their PVCs, but the votes in their Polling-units were cancelled in this recent judgement.

I hope the Judgement captured Such Numbers??

Because, I want to independently apply the “Margin Of Lead” Principle, and ascertain whether “A WINNER” should be announced, or “A RE-RUN” should be ordered in all those affected Polling-units..

Ok..

This is exactly why I would like to see the Judgement myself and study it properly.

Is it stated anywhere in the existing Constitution, and in the amendment bills for the Accountant-General of the Federation and the Minister for Finance (same with AG of state governments and commissioners for Finance of States) to work together and “Compulsorily Publish the ‘AUDITED’ Government Yearly Financial Reports (both for the FG and the State Governments)”, and make them open and publicly available for the people.??

We really need such prompts to be included inside the Constitution as the Functions of the AG and The Minister.

The case is still on. Forget the sensational topic, it is nothing out of the ordinary.

There is a difference between admitting documents and admissibility. At this stage, the tribunal will admit anything and everything. At this stage, even if you submit a tissue paper, the Court will accept. When the legal gymnastics starts, then any already admitted document that is not admissible will be expunged.

The last sitting, the Tribunal urged INEC to present Adeleke's nomination forms and certificates he contested with in 2018. Oyetola is claiming they are forged.
Good Evening.

Please, is there a link where I can download today's Osun Tribunal Judgement.??

Thanks

If you know you would be exposed by the BVAS, the best thing to do is to play within the BVAS rules.

And then also...

Remember that the Principle of “Margin Of Lead” also applied in the Electoral Act.
It is the “Margin of Lead” principle that would determine whether the “Section 56” of the Electoral Act should apply or not.

So,, it is up to us to check the values again and determine whether the Tribunal checked the “Margin of Lead”.

How did they know the figure combination?

How?
The Tribunal accepted the BVAS Accreditation report which APC presented.
Thus, all those 700+plus polling-units where it was established that there was over-voting were totally cancelled., And thus, the whole of the other remaining polling-units were re-calculated.

Cancelled all the votes from the affected area, for all candidates. Actually That's what the law says and I think that's a big flaw in our electoral laws. You can't cancel people's mandate because INEC decides to be useless and not do the needful
