THE acting governor of Adamawa State, Alhaji Ahmadu Fintiri, stormed the national secretariat of the Peoples Democratic Party (PDP) in Abuja, on Friday, to declare that he has retrieved the party’s mandate stolen by the impeached governor, Admiral Murtala Nyako.

Fintiri, who was apparently at the party headquarters to brief the hierarchy of the recent events in Adamawa culminating in the removal of Nyako, had a closed door meeting with the Deputy National Chairman of PDP, Prince Uche Secondus, at Legacy House, Abuja, an extension of the national secretariat.

The former Speaker of the Adamawa State House of Assembly was recently sworn in as the acting governor following the impeachment of Nyako who had defected from the PDP to the All Progressive Congress (APC).

Explaining his mission while speaking to journalists after the meeting, Fintiri noted that his emergence as acting governor has restored the party back to the people of Adamawa State.

“As a loyal and obedient party member, I came on a courtesy call to my party and the National Working Committee (NWC) as my first assignment after the battle to remove governor Nyako who had stolen the mandate of the PDP under which he was elected for eight years,” he said.

He added: “I came here to bring back the mandate and I have handed over to them the mandate. I promise that I will work together with the party, its leadership, the people of Adamawa to ensure that our party is restored to the people.”

Meanwhile, the national leadership of PDP has applauded the removal of Nyako, noting that the removal of the former governor and swearing in of Fintiri will help to address the rot that the people of Adamawa State had been subjected to.

According to the National Publicity Secretary of the party, Chief Olisa Metuh, Fintiri will restore dignity to the party, redress the misdeed of the former governor.

He therefore urged the people of the state to give the new leadership all the necessary support and cooperation to enable him to move the state forward.

Lafia – A lawmaker in Nasarawa State House of Assembly, Alhaji Othman Bala, has appealed to members not to impeach Gov. Umaru Al-Makura, in the interest of the state.

Bala (APC, Keffi-East) said in Lafia on Friday that lawmakers should put the interest of the state above other considerations.

“The lawmakers love the state and will do all within their power to ensure peace and development of the state.

“It is on the basis of that love that I appeal to my colleagues to sheath their swords in order to move the state forward.

“No one is perfect, we should forgive some of the lapses noticed with the governor with the belief that he will learn from it in the overall interest of the state,’’ Bala said.

He emphasised the need for the members to make sacrifice, saying: “there should be no winner or loser under the circumstance but the interest of the state should be paramount’’.

The assembly on Monday resolved to serve an impeachment notice on the governor for alleged gross misconduct.

The news of the impeachment notice, however, led to protest across the state. (NAN)

A senior advocate of Nigeria (SAN), Mr Garba Pwul, has said that Adamawa former governor, retired Vice Adm. Murtala Nyako, has no powers in law to reject his deputy’s resignation from office.

Pwul made the statement in an interview with the News Agency of Nigeria (NAN) in Abuja on Friday.

According to him, the law does not provide for acceptance or rejection when a letter of
resignation is tendered.

It would be recalled that Nyako had rejected his deputy’s resignation, prior to his impeachment.

Pwul said in 1965 the Supreme Court held that “when a person tenders a letter of resignation, that is the end of the relationship, no one has the power to say I reject the resignation”.

He said; “You cannot compel him to work against his will, so when the letter of resignation is received, it takes immediate effect so no one can say it was rejected or it was accepted.

“The same principle applies in employer and employee relationship; once the employee tenders his letter of resignation that is the end of the relationship.

“If there is any other matter against him, you can only go to court to enforce anything; you cannot keep him and tell him to work,” he said.

Pwul said that it did not matter where the resignation was submitted but as far as the former deputy governor had resigned, it was not negotiable according to the law.

He expressed satisfaction that Nyako and the APC had challenged the impeachment in court saying that it was a sign of the people’s believe in the judiciary.

Nyako said that Ngilari’s process of tendering his resignation letter to the assembly was a breach of Section 306 (5) of the 1999 Constitution as amended. (NAN)

The good people of Rivers State gave their mandate to the PDP and not to any individual...!!! Gov. Amaechi being a product of the Supreme Court judgment that specifically stated without any ambiguity that the mandate was to PDP and not to an individual should have known better than selling such mandate to the APC just like his former comrade in Adamawa state did and now regretting. Meanwhile, removal of a Gov. does not only have to be through impeachment; Omehia was not impeached by the House yet he was removed as governor. Nyako and swearing in of the Speaker of Adamawa State House of Assembly as the Acting Governor of the state, the new governor that will be elected after 3 months (July 15th 2014 - Oct 15th 2014) in acting capacity of the acting governor would stay in office for only 4 months (Oct 15th 2014 - Feb 28th 2015) before the general elections will be conducted again in 2015. The Constitution provides that he will only complete the tenure of the former governor.

Section 191 (2) of the 1999 Constitution of the Federal Republic of Nigeria as amended states 'where any vacancy occurs in the circumstances mentioned in subsection (1) of this section during a period when the office of Deputy Governor of the State is also vacant, the Speaker of the House of Assembly of the State shall hold the office of Governor of the State for a period of not more than three months, during which there shall be an election of a new Governor of the State who shall hold office for the unexpired term of office of the last holder of the office.

Before i refer you to the section(s) of the constitution i mentioned, let me first ask you to show me the section of the constitution that allowed the NASS to apply the 'Doctrine of Necessity' when the late President Yaradua's broadcast on radio was translated as the vacation letter to the NASS.

Section 306 (5) states that " the notice of resignation of the governor and deputy governor of a state shall respectively be addressed to the speaker of the house of assembly and the governor of the state"
What this simply means is; whereas the governor resigns to the house of assembly, the deputy resigns to the governor!
The Notice of Resignation from the Deputy Governor can be addressed to the Governor where there is no impeachment proceeding against the Governor. As in the case of Adamawa, an impeachment proceedings has been ignited against the duo. The process of impeachment against a governor is such that automatically makes the office of the governor in a supposed 'state of coma'. Until that process is aborted or concluded, the House takes charge.

"Our attention has been drawn to the purported resignation of the Deputy Governor of Adamawa State Barr Bala James Ngillari which was supposedly read on the floor of the State House of Assembly. We wish to state categorically that Section 306 (5) of the Constitution of the Federal Republic of Nigeria 1999 as Amended requires that the Deputy Governor resigns not to the House of Assembly but to the Governor. As at the time the supposed resignation was said to have been tendered in the House, Murtala H. Nyako was the Governor of Adamawa State. No such letter was written to him, none was received by him and none was approved by him. It should therefore be known that in the eyes of the Law that the Deputy Governor has not resigned.

If the Governor was to resign, who would he send his letter of resignation to if not the House of Assembly? The Deputy Governor is not an appointee of the Governor but a joint elected member of the executive. The Constitution did not give the Governor the power to remove or approve the resignation of the Deputy but the House has such power and had just exercised it...!!!

The Rivers State House Assembly on Tuesday asked the Special Adviser to the Governor on Revenue Generation, Mr. Nwankwo Nwankwo, and the Commissioner for Finance, Dr. Chamberlain Peterside, to appear before it over the dwindling revenue base of the state.

The House also directed the Chairman of the State Internal Revenue Service Board, Mrs. Onene Obele, to appear before it over what it called ‘monumental’ fraud in the agency.

Deputy Speaker, Leyii Kwanee, who presided over plenary, instructed the Clerk of the House to write to the three officers, asking them to be present in the House during the next sitting.

Kwanee cautioned that no excuse would be accepted from them should they refuse to honour the invitation of the House.

The deputy speaker, however, decried the reason given by the State Commissioner for Water Resources for her failure to appear before members of the House over the $280m water and sanitation projects.

He warned that the commissioner must not fail to appear before the House at the next sitting, adding that members would not tolerate the lack of respect to constituted authorities.

Earlier, Deputy Leader of the House, Mr. Robinson Ewor, moved a motion during the House sitting on Tuesday, calling for an improvement in the revenue base of the state to enable the state governor to fulfill his promises to the people.

The All Progressives Congress (APC) has raised the alarm that its members in Osun State are being denied their Permanent Voters Cards (PVC) by INEC, in what seems a deliberate attempt to disenfranchise them in the Aug. 9th governorship election in the state, since only those who possess PVCs will be allowed to vote.

In a statement issued in Benin on Monday by its National Publicity Secretary, Alhaji Lai Mohammed, the party said INEC has resorted to asking those who daily throng its offices in Osun which party they belong to, and that almost all those who have identified themselves as APC members have been told their PVCs are not ready.

”This is nothing but systematic rigging from source,” it said, wondering why INEC, which is expected to be a neutral umpire in the election, will resort to actions that portray it as partisan and bereft of credibility.

APC wondered whether this is the reason why INEC had to push its REC in Osun aside to pave the way for a malleable REC who will do the bidding of the PDP.

The party challenged the INEC leadership to wade into the delay in the distribution of PVCs in Osun, since it is possible that this planned disenfranchisement of APC members may be the handwork of some compromised INEC officials in the state.

It said if INEC cannot ensure that all prospective voters in the state will get their PVCs before the Aug. 9th election, the electoral commission should do the needful by allowing all those who can present their temporary voters cards to exercise their franchise on election day.

”Anything short of an urgent resolution of the PVC crisis, which may have been instigated deliberately by unscrupulous elements within INEC, will not augur well for a free, fair and credible election on Aug. 9th,” APC said.

The party recalled that since it first raised the alarm over the PVC shenanigans in Osun, via a statement it issued on July 6th, the situation has gone from bad to worse, without INEC speaking out publicly to refute the charges of deliberately disenfranchising opposition voters in order to give an unfair advantage to the PDP.

”The continued denial of APC members in Osun of their PVCs and the silence of INEC over the issue have given us a serious cause for concern, and we are calling on INEC to resolve the issues we have raised if indeed the commission has no plan to collude with the PDP to rig the Aug. 9th election in Osun,” the party said.

”When the referee decides to play for one of the teams he is supposed to preside over in a critical match, there can be no grounds to continue with the match or repose any confidence in the calls made by the referee. We sincerely hope INEC is listening.

”We also call on local and international observers to take more than a passing interest in the pre-election processes in Osun, especially the issue of whether or not all those who registered to vote are able to do so without a colluding electoral commission preventing them from exercising their franchise,” it said.

Read the article again, you'll discover that the appeal court gave its ruling between 2006 and 2007 cos Orji Kalu was still in office.

Multiply N232,773.28 by 23 months and also multiply by 132 councillors. N706,699,678.08. LG Chairmen not inclusive.. !!!

The current Gov. may direct them to the former Gov's house to collect their money since no more appeal after a Supreme Court ruling...!!!
