Speaker of the House of Representatives, Yakubu Dogara, said yesterday that the invasion of the homes of senior judicial officers by the State Security Service was a disorganised and worrisome act. According to him, the clampdown is a duplication of the function of other anti-corruption agencies, such as the Economic and Financial Crimes Commission, and promised sweeping reforms to prevent its recurrence. As many Nigerians are still worried why the Court of Appeal curiously declined to judgment last Friday on who the authentic governorship candidate of the Peoples Democratic Party (PDP) in Ondo State between Eyitayo Jegede and Jimoh Ibrahim, a pro-democracy coalition, Coalition in Defence of Nigerian Democracy and Constitution (CDNDC), has accused the presidency of “arresting the judgment to fester it political interest.” According to the group in a statement issued, by its Co-Convener, Ariyo-Dare Atoye, yesterday, “Everything that is playing out in the Ondo State election is about the 2019 agenda to plant the ruling party in that state at all cost. We will see more of this executive impunity in other states in the weeks ahead. “We make bold to say that the axis of Jimoh Ibrahim, Ali Modu and Buruji Kasham, has no capacity to run riots against the judiciary and sponsor such scandalous petitions against revered justices without the support of the powers-that-be,” according to a statement by it. “You could see it written all over the faces of the justices on the Appeal Court panel, that they were practically forced by the power that be, to do a volte-face in delivering the judgment in the PDP candidacy tussle. “Until this wicked interference, Justice Saulawa-led panel had resisted all the mischievous processes in the suits, guided by the decision of the Supreme Court in Agumagu vs NJC, which gives it authority to proceed to judgment despite a curious notice at the apex court. “They want to destroy everything and turn Nigeria into a fascist state ahead of 2019. They are using power with brazen recklessness and subverting all democratic institutions to fester a sordid political interest, but they will fail.” The group in the statement also expressed worry that “these gangs of political predators backed by the hawks in the Presidency might extend their blackmails to the Supreme Court, all in a bid to ensure that the stinking judgment of Justice Abang is not reviewed. “They know that the judgment of Justice Abang that is being challenged and other political rulings cannot stand the test of time. Consequently they want to bring down the judiciary just to protect a wicked verdict that will still fail. CDNDC also allegedly accused these hawks of interfering with the Independent National Electoral Commission (INEC) in a “desperate bid to plant surrogates across the country to strengthen their support base for 2019. “INEC has become a willing tool for the ruling party to do hatchet jobs; we have to say it as it is. The present INEC has been effectively compromised and no longer enjoys the confidence of Nigerians. “To win election now in Nigeria, if you are not a member of the APC, you have to first defeat INEC to be sure of making any progress. It is that bad and very painful,” the coalition said. Less than 24 hours to the expiration of tenure of office of the incumbent Chief Justice of Nigeria (CJN), Justice Mahmud Mohammed, President Muhammadu Buhari, on Wednesday, reportedly appointed the most senior justice of the Supreme Court, Justice Walter Onnoghen as the Acting Chief Justice of Nigeria. The appointment is to lapse after three months. Buhari invoked section 230 (4) of the 1999 Constitution to name Onnoghen as the new Chief Justice of Nigeria. The section provides: “if the office of Chief Justice of Nigeria is vacant or if the person holding the office is for any reason unable to perform the functions of the office, then, until a person has been appointed to and has assumed the functions of that office, or until the person holding the office has resumed those functions, the President shall appoint the most senior justice of the Supreme Court to perform those functions.” Bar and Bench Watch reports that the National Judicial Council (NJC) had recommended the most senior justice of the Supreme Court to President Muhammadu Buhari. But rather than send the name of Justice Onnoghen to the Senate for confirmation to enable him approve his appointment as the next CJN, President Buhari sat on the NJC’s recommendation. Feelers that President Buhari might not approve Justice Onnoghen as the substantive Chief Justice of Nigeria emerged a couple of months ago. The Olusola Oke Campaign Organisation has cried out over the safety of its standard bearer, Olusola Oke. They claim a group within the federal ruling APC government is bent on stopping at all cost, the candidate of the Alliance for Democracy (AD), Olusola Oke, from contesting in the November 26 Ondo State governorship election by resorting to underhand methods. Addressing a press conference in Akure on Tuesday, the Director General of the organisation, Bola Ilori, specifically pointed out some of the supposed arrowheads of the plot. They include: Kaduna State Governor, Nasir El Rufai; Minister of Works, Babatunde Fashola; Minister of Solid Minerals, Dr. Kayode Fayemi and the Ogun State Governor, Ibikunle Amosun among others. Ilori accused the so-called cabal in the All Progressives Congress (APC) of instigating the AD Legal Adviser, a man who is not a candidate in the forthcoming election, to institute a suit in the court. He also alleged that the APC was planning to instigate the Economic and Financial Crimes Commission (EFCC) to invite and possibly detain Mr Oke days before the election over phantom allegations. The Nigerian Judiciary may be on the brink of a constitutional leadership crisis as President Muhammadu Buhari has not accepted the nomination of Justice Walter Onnoghen as the next Chief Justice of the Federation or sent his name to the Senate for confirmation. The current Chief Justice of Federation – Justice Mahmud Mohammed – will retire officially on Thursday November 10, 2016 upon reaching the mandatory retirement age of 70. In line with the provisions of Section 231 of the Constitution, the National Judicial Council (NJC) had written to President Buhari recommending for appointment on October 12, 2016, almost a month ago. As it stands, the Nigerian Judiciary will be without a legal and administrative head once this happens. This will be the first time since democracy returned to Nigeria in 1999 that such a situation will occur. The refusal of President Buhari to accept Onnoghen’s nomination may not be unconnected to his origin. Sources within the Presidential Villa inform us that President Buhari is uncomfortable with the prospect of having to work closely with Onnoghen – who hails from Cross Rivers State in southern Nigeria. President Buhari is said to be uncomfortable with the prospect of being the first President in 30 years to appoint a judge from the southern part of Nigeria as Chief Justice of the Federation. Our sources also say that Justice Onnoghen’s strong will and stubbornness is a source of worry for the President. There are fears within the President’s inner circle that Justice Onnoghen’s nature will make him rebuff instructions from the Presidency on legal and administrative matters within the judiciary. “Many people have advised the President that Onnoghen has a mind of his own and will not adhere to instructions. If you remember well, in 2007 he was the one of the Justices that gave a dissenting judgment nullifying the election of former President Jonathan over non printing of serial numbers on the ballot papers despite the pressure from outside the judiciary to uphold the elections.” our source said.
