majekdom2: I chose to ignore this post until the latter. I used my dictionary as you advised in the former. Sexual harassment is bullying or coercion of a sexual nature, or the unwelcome or inappropriate promise of rewards in exchange for sexual favors.[1] In most modern legal contexts, sexual harassment is illegal. As defined by the US Equal Employment Opportunity Commission (EEOC), "It is unlawful to harass a person (an applicant or employee) because of that person's sex." Harassment can include "sexual harassment" or unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature. The legal definition of sexual harassment varies by jurisdiction. Sexual harassment is subject to a directive in the European Union.[2]
Where laws surrounding sexual harassment exist, they generally do not prohibit simple teasing, offhand comments, or minor isolated incidents.[citation needed] In the workplace, harassment may be considered illegal when it is so frequent or severe that it creates a hostile or offensive work environment or when it results in an adverse employment decision (such as the victim being fired or demoted, or when the victim decides to quit the job). The legal and social understanding of sexual harassment, however, varies by culture. In the context of US employment, the harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of the employer, such as a client or customer, and harassers or victims can be of any sex or gender.[3]
It includes a range of actions from mild transgressions to sexual abuse or sexual assault.[4] Sexual harassment is a form of illegal employment discrimination in many countries, and is a form of abuse (sexual and psychological) and bullying. For many businesses and other organizations, preventing sexual harassment, and defending employees from sexual harassment charges, have become key goals of legal decision-making.
I hope you understand the bolded You're obviously getting it twisted. The initial exchange between Donpuzo and I was that the action of the interviewer is improper. The legal profession is not a touchy touchy profession. There exists a code of conduct guiding interactions between practitioners as well as the interactions between lawyers and their clients. Donpuzo reasoned like you're doing that interviews are not limited to academic or social knowledge but can also be moral, which is arguable but he couldn't define when such crosses the line from assessment to harassment. That was his reasoning. While the action of the principal isn't sexual harassment, it's totally dishonourable; except you run a brothel type of practice, where clients assaults your female colleagues while briefing them. Like I stated earlier, if you had read the thread of our conversation from the beginning, this exchange will be totally unnecessary. I reiterate that the action of the principal partner is totally uncalled for and very unprofessional. Issues such as these undermine the growth of the profession nd make a sizeable number of practice in Nigeria unable to compete with their international competitors. The OP reacted just right. That he was testing her moral quality is a depravity of reasoning. The legal practice is not a supermarket or a strip club and ministers in the temple of justice should conduct themselves honourably. |

louismane: i think it was all part of ur interview, hence the reason why u wer asked to cme bck on monday... i wont b suprised if u wer offered the job on monday, you see try n b smart n stop playing victim fr a moment and think.. 1. its normal to always maintain eye contact with someone during an interview and see how they react to the discomfort.. its like putting pressure on the person to see their reaction either through body language or hw uneasy u shift, are u retaining ur gaze, unfazed and fixed back at him or ur lookn away or at d ceiling.. its a big measure of hw confident pple are and their rxn to pressure as ur proffesion deals with various pple of different character traits.
2. from what uve said i am guessing the firm is a property/real estate firm of which its very vital to have good relationships with clients of which mostly will be married men, actually firms like dis could do with a good looking lawyer in sealing certain contracts per say and if u are dealing directly with any of said clients, ur relationship may mke or brk d contract. 3. unwanted body contact from pple is a norm qith xlients in ur field esspecially fr an attractive female, however tactfullness is favoured in handling such scenarios and not aggression. 4. as a good looking lawyer, many clients will be interested in you and how you deal with or handle the problem which is inevitable n key to ur success and that of the firm.. this is where smarts play a part in... concentrate on sealing d business part and relegate the hooking up part as much as u can... all using wit and tactfullness without offending the other party even tho ur d one supposed to feel offended. perhaps u should have told ur boss(supposedly cos u mite still get d job) that u guys should finish with the interview first as u are not a person who likes to mix business with pleasure and that perhaps anoda time u cn talk about that...(note: u still will tell him no, but not at that time when ur priority z d job).
i think ur very smart and a good lawyer but u need more than a good degree and book smarts to land a job... u need to be witty but tactfull and job smart as well... fyi i may be very wrong and maybe he just wanted to sleep with u... but the optimistic me thinks a lawyer like him is not dumb, and seeing u wer even referred from a person he has workd with before.. ur story is nt very convincing... n i dnt think if u gt d job that it wuld b based on ur referal..cos to me.. u failed ur interview... buh hell i might b wrong. You should stop playing ostrich. She's employed to offer professional options and solutions to clients problem and not nanny them out baby seat them... If the client wants more... Go somewhere else. You guys should learn to stand up to bulls**t in whatever form. Quit kissing a**. And if you decide to, be sure it is on your term and not that you're being compelled to. |

Donpuzo: Did he attempt to kiss her, did he fondl.e with her, did he physically molest her, did he expressly state that he wanted to have sex with her as a precondition for the job. Legal issues are devoid of sentiments. Stop being foolishly sentimental.
How does placing hand on someones shoulder become a conclusive act of harassment.
I am not even saying he was right or didnt sexually harass her. Are you her boyfriend? I doubt you are a lawyer. Your statements are ambiguous. You expect her to wait till the silly man assaults her? |
Jobs/Vacancies › Re: My Sordid Experience As A Female Lawyer Job Hunting. by Crieff(m): 8:33pm On Oct 16, 2015 |
Donpuzo: There is no law that draws such line or spell out the limits for pre-employment interview, at least non that I know of. The point is that such issue is circumstantial. Its the facts, such as the actions or conduct within such interview that will determine if the act itself amounts to sexual harassment. Such can be gotten from the relevant laws that generally prohibit sexual harrasment either within or outside workplace. And consideration of the elements that constitutes sexual harassment. However my legal counsel has not been solicited so I cant go beyond here. Bulls. An interviewer that rose up from his seat, went all the way round to where the interviewee was seating and placed his hand on her shoulder is moral test, right? You are ridiculous. |
