The 2018 Federal Government’s Appropriation Bill currently undergoing debate on the floor of National Assembly may have come under threat as former president, Civil Liberty Organisation (CLO), Dr Olisa Agbakoba (SAN), on Wednesday threatened to approach the court to stop its passage if within seven days President Muhammadu Buhari did not withdraw the document, describing it as unconstitutional. Agbakoba issued this threat in a letter titled, ‘Is the 2018 Appropriation Bill Constitutional?’ date 3rd January, 2018 and separately addressed to the Senate President, Senator Bukola Saraki and the Speaker, Honourable Yakubu Dogara, citing a subsisting Federal High Court decision in Olisa Agbakoba vs. Attorney General of the Federation General of the Federal & others suit no. FHC/ABJ/CS/63/2013. According to Agbakoba, the 2018 Budget is unconstitutional and should be withdrawn based on fact on ground that it was singularly prepared by the Executive Arm as against the court ruling which affirmed that each arm of government, including the Executive, Legislature and Judiciary should prepare its budget separately and lay it before the National Assembly for passage. “Sections 81 to 84 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) set out the procedure for preparing the Appropriation Bill. “The Constitution requests each arm of government (the Executive, Legislature and the Judiciary) to lay before the National Assembly its estimates of revenue and expenditure for each financial year after which it is appropriated, harmonized as a bill and presented to the President for his assent. “Unfortunately, the Executive has failed to comply with this procedure by laying before the National Assembly estimates of revenues and expenditure for the Judiciary. This inspite of a subsisting Federal High Court decision in Olisa Agbakoba vs. Attorney General of the Federation General of the Federal & others suit no. FHC/ABJ/CS/63/2013. That has declared this practice unconstitutional,” Agbakoba said. Agbakoba, while saying that he was unaware if the National Assembly had laid its budget estimates, called on the parliament to draw President Buhari’s attention to the decision of the court and request the National Judicial Council (NJC) to lay before it the Judiciary’s estimates of revenue and expenditure for 2018, while the Executive be made to represent its estimates for the current financial year. “We suggest that the National Assembly draw the attention of the Executive to the decision of the Federal High Court. THE Federal Government is considering payment of N800 billion fuel subsidy arrears to oil marketers, provision of tax holidays and other incentives as part of measures targeted at ending the lingering scarcity. These and other issues were pushed forward at the engagement of stakeholders, Nigerian National Petroleum Corporation, NNPC; Department of Petroleum Resources, DPR; Major Oil Marketers Association of Nigeria, MOMAN; Independent Petroleum Marketers Association of Nigeria, IPMAN; Depot and Petroleum Products Marketers Association, DAPPMA and others, hosted by Dr. Ibe Kachikwu, Minister of State for Petroleum Resources in Abuja, yesterday. Mr. Idang Alibi, Director, Press in the Ministry of Petroleum Resources, who spoke with Vanguard on phone, yesterday, declined to provide information, noting that the engagement was still ongoing. But a source, who attended the meeting, but preferred not to be named, told Vanguard that the payment of the debt was adopted, as it will enable the oil marketers settle huge debts to commercial banks and embark on new importation of petroleum products. He said other measures adopted to tackle the crisis, include maintenance of local refineries, preferential allocation of foreign exchange to oil marketers and increased monitoring of petroleum products by DPR. The source said stakeholders, who agreed not to increase the price of fuel, also resolved to adopt cost-cutting strategies, while four sub-committees were inaugurated to address the challenges of fuel supply across the country. He said: “There is no planned increase in fuel price. The minister said it should not be contemplated. None of us want fuel price to rise. What we talked about was tax holidays and other things in that line. “Also, all stakeholders have agreed to look inward and improve efficiency so that we can cut down cost and resume our business. Nobody is concerned about price increment. “The Minister also inaugurated some sub-committees, about four in number, some of which are logistics and business conduct committees. Some individuals were appointed into all the committees.” The source said all the agreements reached at the meeting, which was still ongoing at press time, would be relayed to the Presidency, hopefully by today, before they are made public. The committee was headed by the Minister of State for Petroleum Resources, Dr. Ibe Kachikwu and has as members, heads of some parastatals under the ministry, the Group Managing Director of NNPC, DAPPMA, IPMAN and labour officials. Diversion Also, another source at the meeting told vanguard that it was discovered that diversion played a major role in the current scarcity in the country, “as between 30 and 50 percent of petroleum products in other African countries are from Nigeria. This is because the products are more expensive in those other countries than Nigeria. “It was discovered that most of the diversion take place in the Northern part of the country. That is why you hear that some number of trucks have been allocated to certain parts of the country, but will never get to the filling stations. A Muslim student, who is about to attend a historic military academy in South Carolina, is attempting to force the school to allow her to wear a hijab. The school refused her request and told her she is not above the rules. The military college, the Citadel, has a long history and has operated as a school for 175 years. It has not allowed an exception to the dress code once in its entire history. Now, an entitled Muslim student is demanding the school break tradition and guidelines to support her religion and protect her feelings. The Citadel’s dress code is strict. Students are required to be in uniform at all times while on campus, with only two exceptions. They may wear bathing suits while swimming, and be out of uniform during a furlough, which only upper-year students enjoy. The academy’s president announced the decision earlier this week explaining that, “The standardization of cadets in apparel, overall appearance, actions, and privileges is essential to the learning goals and objectives of the college.” “This process reflects an initial relinquishing of self, during which cadets learn the value of teamwork to function as a single unit,” the president said, justifying the almost two-century long guideline. The Citadel allows for religious accommodation so long as it does not undermine the objectives of the school such as morale, health and safety, or good order. Breaking unit cohesion for a head scarf is not acceptable. The Muslim student is not accepting the school’s decision in good spirit. Instead, she is suing the school with the support of the terror-funded Council of American-Islamic Relations. She says the lawsuit will go through unless the school allows her to attend in a hijab. The Muslim-led attack on our historic institutions is being launched in an attempt to undermine our history. Muslims have convinced short-sided liberals to abandon their principles in the name of protecting the supposedly oppressed. The Muslims are not fighting for equality, as the school policy treats people of all faiths equally. Instead, they demand special privileges for only themselves. Normal things do not happen normally in Nigeria. There must always be a “spiritual” side to everything. This is why a dissipated man would wake up from a frightening dream, and then start to “cast and bind” the devil with psychotic inanities. I have read a volume of reactions to the unfortunate motorbike accident of Yusuf Buhari, son of President Muhammadu Buhari. I must say, most of the reactions lack compassion; some had a sense of schad en freude to them, while a few were utterly ridiculous. The reactions I considered as the looniest were those giving a spiritual bent to the incident. To religious shareholders, Aso Rock is a pub for blood-thirsty demons; hence any resident of the place must be spiritually fortified. According to this group, the incident is a spiritual attack on the first family. Reuben Abati’s “the Spiritual Side of Aso Rock” is not helping matters because his article is often cited as the Magna Carta of spiritual warfare at the presidential villa. Abati, who was a tenant in Aso Rock under former President Goodluck Jonathan, claimed that the seat of power was in the grip of malevolent supernatural forces. I did not believe this then; I still do not believe it now. To inveterate cynics, the president is getting his comeuppance for his “crime” against a section of the country. According to this group, karma has come for the president. This is really disturbing. It says a lot about our humanity. In all of these, I hope the presidency does not succumb to suggestions and shadow whispers of targeted spiritual attacks on the president’s family. Life happens.
