YesBwoss:
I think Sagay was right, according to Section 88(2). Section 89, which confers the Senate with power to summon anyone, cannot be read in isolation. It has to tango with Section 88, especially subsection 2.

Section 88(2) The powers conferred on the National Assembly under the provisions of this section are exercisable only for the purpose of enabling it to –

(a) make laws with respect to any matter within its legislative competence and correct any defects in existing laws; and

(b) expose corruption, inefficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it.
Thank you for bringing this to the fore.

This Senators think they have suddenly become gods!
They think they can Probate and Reprobate, acting as Prosecutor and Judge at the same time.
They dont even seem to understand the simplest of the Principles of Separation of Power, .....and they call themselves "Lawmakers"!

This is why it is not good to elect 'dofus' as lawmakers

You've raised a big question that the Law will have to interpret..... Is a Presidential aide answerable to NASShuh

Because he is not under any Parastatal or Ministry Pay roll.
That is why l said the NASS should head to Court (the 3rd arm of Govt with Power to interpret laws) .... instead of all these bullying tactics they are trying to use on everyone who says anything or expose their criminality.

Senate cannot MAKE Laws and still want to INTERPRET it while at the same time wanting to EXECUTE it

Why are all of Buhari’s appointees displaying unnecessary ego it must be flowing 4rm d top.
See as he face worwor angry
You are a dunce....... and l am sure you also carry-around, a forged 3rd Class certificate!

Let me give you small lecture here:

We operate a Three tier system of Government, each with separate responsibility and authority.
That is Democracy for you.

The job of the Senate (Legislators) does not go beyond MAKING LAWS (or to put it in lay terms that you will understand, "passing Bills" that will/may later be accented into law, by the President)
They also have secondary oversight responsibilities

The job of the Executive is to "Execute"Laws ALREADY passed into the Constitution.
All "Executive" dealings (Total Control over the Police, Armed Forces, Appointments/Removal of Heads of Parastatals and Agencies, e.tc)

Where there is a "dispute" in the "Interpretation of the Law" between the Legislators and the Executive Arm of Govt, the JUDICIARY is empowered to step-in and make a final and definite (binding) interpretation of that law and then PASS IT to the executive to IMPLEMENT.

This is the whole summary of the PRINCIPLE OF SEPARATION OF POWERS.

I have deliberately emphasised some phrases/words to draw your attention to them because they are KEY WORDS.

*What we have now is a criminal Senate that wants to do the job of the Judiciary (prosecution of anyone that does not toe it criminal line of behaviour or wants to challenge its abuse of power).
*We also have a Senate that wants to do the job of the Executive (Appointing people to head Parastatals and Agencies of Govt).
*We also have a Senate that wants to arrest and lock people up (job of the Executive arm of Govt - The Police )

I know most of the Senators are illiterates elevated beyond their cranial capacity, l know most of them are Certificate forgers that claim to posses various "bought degrees", l know most of them are criminals who murdered others to become Senators, l know most of them are criminals who dont pay tax on items they import or cloak it under the cover of the Senate, so they can avoid paying tax on it, l know most of them have ZERO integrity yet they sit over people with a hundred-fold integrity than them and pronounce them unfit for a role.......
.

...so, l am not surprised they are embroiled in a "battle of ego and self", instead of doing the job they are paid to do - Make LAWS for the betterment of the country.

*That they do not know that they cant force the President to drop an appointee, despite not confirming the person, shows how shallow they are.

*That they do not know they cant force the Head of Customs (A political Appointee) who retired as a Colonel of the Nig. Army, to wear a para-military Uniform of Customs, shows they are learners and used to blowing hot air.

*That they think Nigerians can be fooled with their Kangaroo Panels here and there, which asks and listens to foolish questions/Answers, shows they are still living in the past.

*That they are led by a serial criminal, a thief, a forger and a looter of Kwara State, shows they are all criminals, serving their own personal interest.

The day of reckoning is getting very close.
Nigerians will march on that Senate and bring it down wholesale.
They think it is impossible, so they act willy-nilly.

Prof. Sagay is a "Private individual" who is entitled to his own opinion of the Senators (just like me and You) and the Senators cannot bully him to silence or summon him. That is what the constitution says!

This Legis-looters led by Saraki are trying to muzzle Nigerians, especially now that their criminality is being exposed left, right and centre.

If they have anything against what he said, if they think it is libellous or defamatory.... they should institute a joint suit against him and let the arm of Government empowered by the constitution to deal with interpretation of LAWS, deal with the matter.
To gang-up and think they can intimidate everyone and anyone in the country, to think they have become Tin-gods and above the law or a law unto themselves, shows the level of their idiocy!

All the above are not more than a Secondary school level Govt class, for students that attend class, which l am sure you dont.

timidapsin:
About 2days ago the Video of two Edo girls in Aduro Camp in Italy went viral. See here https://www.nairaland.com/3701945/two-nigerian-ladies-europe-fight if you missed it.

This sparked reactions from Nigerians, In which people presumed the alleged victim to be dead or to have been killed by Happy

The girls released another video earlier today apologizing to Nigerians saying the girl did not die

But Happy Refuses To Show Her Face. WATCH VIDEO after cut...

https://www.youtube.com/watch?v=8rfOZQtnFVI
I watched this supposedly "rebuttal video" and a few thing struck me, that l would like to share:

1.) The "announcer" agreed she was the one that Uploaded the video. - She later tried to deny responsibility that she did not do so intentionally!
Ofcourse, she was "filming' when this "murder' was going-on!
She made no attempt to separate the ladies and because she was filming, it is obvious she wants a record of the "action", for blackmail purposes? To ridicule "Comfort"? Or to share with the world, which is exactly what she did.
No need to feign ignorance.

2.) She said the victims name is "Comfort" and Comfort did not die as speculated: - She was bold enough to show her own face but not bold enough to show Comfort's face, to confirm that she is not dead.
Instead, she has someone moving occasionally under a Duvet!
Even if that were to be Comfort (which l doubt very much).... she doesn't seem to be well enough to be shown openly.
Maybe she is crippled for life?
Until proved otherwise, the Comfort we saw in the first "attack video", was life-less and not moving.
For all intent and purposes, unless Comfort is "produced alive", VERIFIED and CERTIFIED.... COMFORT IS MURDERED and DEAD. Finito!

3.) She said the "killer-girl" (Happy) is to her left side as she is speaking: - 'Happy' Knows that her face and details are public, yet she is not "sorry enough" to apologise by herself, with the same face she used to strangle a room mate?
Why is she hiding her face in an apology she was supposed to be making?
Could it be that Comfort is dead and she knows and dont want her face associated with the ongoing scam?
I smell lies, until proved otherwise.

4.) She accused Comfort of "doing something terrible" and therefore deserving of what she got from "Happy" - Funnily, she did not mention what Comfort did so that the public can determine whether what she did actually justifies being murdered or strangled to death by "Happy"?
So, we are supposed to take her own "judgement" as the gospel truth?
Even if Comfort murdered someone (the height of criminality!), she should be handed over to the Police and not strangled to death by "Happy", like a chicken!

5.) They blamed the Pastor for sharing the video and called him names! - Well, l dont have much to say to this but l will advice her to go and sue the Pastor to Court and claim damages like Dino Melaye! undecided
Every Citizen has a duty to expose criminality, wherever it is found. It is a Citizen's duty to the state and humanity. Thank you pastor, for sharing this.
Ofcourse, eveil and vile humanbeing like these girls like to keep their evil deeds under wraps.

6.) She said the girls name is ........... and she is posting right now on FaceBook .... to imply that she is alive! - We are not fools and we all know that anyone can set-up an account on FaceBook, using anyone's name.
We also know that anyone can hijack a dead person's FaceBook account and post, using their profile! (all you need is their password which is most likely on Comfort's phone!)
They can even upload an "old video" ....showing Happy eating Semovita grin grin it still does not "PROVE" that she is alive after the attack.
All these do not prove that someone is alive!

Moreso, this vicious attack may produce a "delayed reaction" in which the victim dies later as a result of the serious injuries received!
That is 'Manslaughter', at the minimum.

Happy and her Killer friends should do a better job next time.
Let them come before an Italian prosecutor and defend themselves.

BTW: What is Madam and Senator Abike Dabiri doing over this matter?

She's the definition of evil. And the foolish friends recording the video and gleefully shouting "happy leave her" should be jailed too. See the shamelessly blaming a pastor. Useless hopeless gals. Edo ashawos be disgracing us all over Europe.
This is not a fight at all!
It is sheer attempted murder.......That victim "momentarily" lost consciousness - her life! ( l am not even sure if the victim survived this ordeal but even if she did, she will suffer the consequence of this violent attack, for a long time to come in her life) ....but that woman called "Happy" is a murderer, by all standards!
She will go to jail for this.

A few "friends" have decided to UPLOAD this Video to the Italian Prosecutor's office, to the relevant E.U Agency offices and other E.U based Human Rights organisations working against human trafficking and use of young girls as sex workers.

If she gets away with this, then she will certainly murder someone in no distant future.
Thank God we have her picture and face and voice

Just imagine if this happened where there was nobody, maybe in a bush.... do you think "happy" will not snuff the life out of the victim?

No sane person can watch that video and still think "Happy" should be walking free.

Don't argue legal facts if you are not familiar with it, leave legal arguments to lawyers and watch from the stands.

The assumption you made on your last paragraph is nonsense.

Grab a sit and learn, since op did not state in the original post that the former landlord was aware that the guy was a squatter, and neither did the tenant confirm that he was permitted by the landlord to live in the said flat.

His only response according to what op posted here was, where does op wants him to get 500k to rent a new place?

Why are you making the argument then that the former landlord should have evicted him for occupying the flat illegally?

You might have a very nice big lawsuit hanging on your neck. That's an accusation angry

Turbocharged:
I like the fact that you understand the workings of the law, but I want to throw more light what we already know.
In justice, if the LAW is followed, it based on codes. That is when the sections of the law is quoted. But in EQUITY, it is the Judge's calling: just like in PLEA BARGAINING. That is the much I can say for now on that.
Coming to the issue of him occupying the place ILLEGALLY, I dont think that is the case. (I stand to be corrected). If he was illegal, why didnt the former landlord evict him after the original occupant left the country?
Think about it
Your "premise" of this "Tenancy Legality" is based on the fact that the original house owner did not eject him after the original occupant left the house (That much is evident in your submission).

Now, let me throw back some questions at you:
1.) Does "ejection process" take some time ... or you can just go-in and bundle the Tenant out? If your answer is that it takes some time, then can you imagine a scenario where the Landlord tried to eject him (the squatter) and he refused to move-out, citing the same ridiculous excuse of where to get 500K to rent another house? Is there a possibility that this was the case (and can it be argued successfully in court) ...till the Landlord sold his house?

2.) Another plausible reason is that the landlord was "not disposed" to undertake such strenuous exercise, at that point in time (Reasons that may be adduced in a law court for not being disposed include but not limited to: Financial situation, Health situation, time factor, e.t.c)

Limiting ourselves to the two reasons above, would you as a Judge still make a decision that the Squatter was a legitimate tenant, simply because the Landlord did not evict him after the original tenant left....... after the Lawyer makes you aware of any of the above, being reason for his (Squatter) continued enjoyment of such undeserved privilege of living in a house he had no tenancy contract over?

Notwithstanding all the above, the "legal position" is that Tenancy is established when and only when a "Valid Tenancy Agreement Contract" is executed between a House owner and a person looking to rent...and a consideration for such Agreement (The Rent Amount) exchanges hand between the two aforesaid parties.
That you were "left hanging in there" ......does not constitute a Valid tenancy Agreement Contract.

Now, Think about this properly
undecided undecided

BTW: The Law regarding equity is not just based on the whims and caprices of a Judge, it is guided by "Precedence and a lot of common Sense", bearing in mind that the integrity and standing of the Judge is also at stake!

Equity <= Equitable <= FAIRNESS

http://saharareporters.com/2017/03/27/abu-whistleblowers-contradict-vc-insist-dino-melaye-did-not-graduate

A combination of Examination Officers and Librarians at Ahmadu Bello University on Monday repudiated claims by the university's Vice-Chancellor, Prof. Ibrahim Garba during his appearance before the Nigeria Senate Ethics Committee that Senator Dino Melaye graduated from the University.

Shortly after the Senate committee ended the carefully choreographed hearing, more documents from the university, including the Joint Convocation Brochure, surfaced.

Saharareporters was first to release Mr. Melaye's 400 level statement of results last week, where we revealed that unscrupulous professors at the Geography Department manipulated and forged school records to help Melaye "graduate."

It has now been revealed that despite efforts by those professors to get away with the crime of forgery, they were still stuck during Mr. Melaye's final year, unable help him graduate because he could not pass Geography 307 Long Field Trip, a compulsory course required for graduation. A copy of the department handbook made available to SaharaReporters shows that Geography 307 was a compulsory course that couldn't have been waived.

What the late Professor D. O. Ogbonna did was to add 2-course units to Melaye's Total Earned Course Units without recourse to the teacher, Dr. A.L. Bello, who was the supervisor of the course.

SaharaReporters further learnt that after a major academic scandal broke out in the late 1990s and early 2000s, Ogbonna was quietly eased out of ABU, along with some other professors who had engaged in grade inflation. The university allowed Ogbonna to retire and he found another job in Kogi state University, Melaye’s home state, before he died a few years ago of an undisclosed illness.

Several lecturers who reached out Saharareporters after the VC gave his testimony today said the VC had in the past week been coming to them to force the department to endorse Melaye's graduation, but that they explained to him that they could not sustain a public declaration based on their records. According to the lecturers, the Vice Chancellor then took the tainted 400 L third semester results with him to Abuja before the Senate.

As soon as the VC declared that Mr. Melaye did graduate, a copy of the Joint Convocation brochure, with pages related to the Bachelors of Arts in Geography was also sent to Saharareporters, with the Senator’s name clearly absent. A source at the university told SaharaReporters that there was sufficient time for Mr. Melaye's name to have appeared in the Brochure as the excuse of a printer devil or university crises on campuses could not explain away the obvious fact, during the convocation two sets of graduates from two academic sessions were merged together. Convocation took place in the year 2002, two solid years after Melaye reportedly graduated from ABU, but his name was absent from the brochure. His name was also absent from the Alumni directory of ABU.

Apart from the scandal concerning whether or not he graduated from ABU, Mr. Melaye also claimed that he graduated from Harvard and the London School of Economics, claims that have now been debunked by the two renowned institutions.

A diploma Melaye said he received from the University of Jos is also suspect as the Examinations Officers there said they never prepared transcripts him because of [his] course deficits.

Mr. Melaye also claims he graduated from the University of Abuja and has done two higher degrees at ABU. Those claims fly in the face of the fraud associated with his academic background, as Mr. Melaye's classmates who reached out to Saharareporters after the scandal broke said he spent at least 7-8 years studying at ABU before he left under questionable circumstances, unable to fulfill his course work.

When Nigerians go abroad for "academic studies or job interviews" and the White man throws their Certificate in the bin, people like you dont understand that it is as a result of people like Dino Malaye, who has given a bad image/name to Nigerian Certificate!

Two institutions (Harvard and London Business School) of high repute have come out OPENLY to say HE LIED about graduating from their schools......... meaning whatever "Graduate Certificate" of those Schools he is parading, are FAKE CERTIFICATES!

Imagine you go to Harvard tomorrow with your 3rd Class Certificate (God forbid! grin ) and they take one look at the origin of your cert and declare it to likely to be fake!
You will get annoyed and start shouting racism! grin grin undecided
Instead of blaming a Serial Certificate forger like Dino Melaye.

Naija and using panadol for someone's headache. What if he graduated with third class? Does that mean he won't succeed in life? This mentality is bad. There are lots of successful people who have graduated with third class and are doing very well. You guys should know that in developed countries, its not always by degree before you get a job.
Abeg make we hear word joor!

Stop using the "exception" as the "rule".

Why use the 5% that were successful within the 3rd class grade (accident of life! grin ) to represent and mimick the 95% that are still strugglling to use a PGD to cover it up!
grin grin

Or are you not aware that a PGD is the most costly degree in any University......... because it is needed to cover-up that disgrace of a grade!

It's high time we stopped judging graduate based on degree classification. A 3rd class can be more competent on the job than the so called 1st class and 2.1 or 2.2 graduates. If its bad then why is it included in degree classification.
So, if it is better (3rd class), why is the awarding University not placing it above the 1st Class graduands?
Why do 1st Class graduands get all the prizes at convocations?
shocked shocked grin grin

All these "CONSOLATIONS".......... are products of a "feeble and intellectually deficient" minds. grin grin grin

On the "average", if you put 100 graduates of each category (3rd class and 1st class) on the table, the rate of success amongst 3rd class might be like 5% (5 out of 100 become successful by chance!) while the rate of success of the 1st class will be as high as 90% (90 out of 100)

You people can keep consoling and deceiving yourself.

To. Graduate wit 3rd class is not the end of the road some thirdclass are far better than so called 2-1 and 2-2 , is not about ur degree is what u can offer in the head. That is the fact. So I stand with Dino melaye hit like if u Stand with Dino melaye.. don't forget to check my signature
So, you think "An Apple can fall far from its Tree"?

That you could only graduate with 3rd Class, is in itself, an indication of "ONE ASPECT" of your level of intellect!
It shows you have a CRANIAL DEFICIENCY that cannot compete well, among your equals (Classmates who made 2-2-Upper and 1st class)

Is it surprising that fortune 500 companies like Shell, Mobil, Schlumberger, NLNG, e.t.c discriminate against mentally deficient Graduates like you?
SMH.

I graduated with third class from university of Benin, civil engineering
Yea....... not surprised that you stand with criminals.
We know your types when we were in school

Layabouts who bribe Lecturers, carry "expo" or steal question papers out-rightly.

As strange as it is in Nigeria of today, where graduating with a "near-failure" has now turned to a badge of honour!
Where those who are supposed to be at the bottom of the ladder, now stride over the intellectual and hard-workers who have proven their mettle.

Like it is said, "Unorthodox specimen, conglomerate to the nearest proximity" .........In simple English: Birds of the same feather flock together!

I dont stand with "below average" CRIMINLAS.

The dollar jusr started gowing down say about 2-3 weeks now .its not sufficient time for prices to come down as most traders have stock bought at higher prices which needs to be depleted (FIFO)
Lets give a timeline of say may/june and see how it goes before we can put the blame on them, nobogy would like to sell at a.loss taking into consideration the effect of increase in dollar price to their holdings stock
what do you think will happen, if say tomorrow, the Naira depreciates by as much as #3 to the Dollar...... going by previous experience and behaviour of Nigerian sellers/Traders?

Do you think they would wait for two-three weeks .....before jerking-up prices again?
Just asking nii o!

Greed ehn, will kill our people.

That police option can backfire. In justice, there is what is called LAW vs EQUITY.
In law, you have the case. But in equity, the chances are 50-50. It depends on his plea and the Judge on seat.
The best route is the court. Dont use tge police option it can put u in trouble.
Sir, Equity is all about Justice and Fairness.
That is, serving Justice ....and doing it in a fair manner, despite the law "being blind" and "an ass"!
The Sword is for Justice, while the Scale is for fairness (Balance).

Using the information provided by the @Op "as it is", l think we can make a few deductions, using the "Equity route".

*The Squatter has not been paying rent, so is it Equitable to make use of someone's property and not pay for it?
*The Squatter did not "beg for time" or plead mitigating circumstances instead, made a very annoying retort " Where do you want me to get 500K to rent another house".

*Now, is it the responsibility of the House owner, to provide \rent money for a squatter or is it by force that he must expend 500K on accommodation?
*The @Op have made an offer to allow him to package himself and leave, (free, in addition to the free rent he has been enjoying), yet he did not avail of that opportunity.
*THE Squatter has also been a beneficiary of an illegal act viz "Sub-letting"

It is said that "He who must come to Equity, must come with Clean hands".

The Squatter cannot benefit from "Equity" because his hands are not clean, having committed an illegality and in addition, having displayed gross insensitivity to the plight of the House owner.

No Judge will further his act of illegality.

My opinion though.
