The Premier League has criticised legal advice which could allow pubs and clubs to screen its matches at any time.

The European Union's advocate general has said that a Portsmouth publican was entitled to show top-flight games decoded from a Greek satellite signal.

But the Premier League said such a policy would "damage the interests of broadcasters and viewers of Premier League football across the EU".

Sky Sports and ESPN hold the rights to live Premier League matches in the UK.

That means pubs, clubs and other public venues wishing to screen games have to pay a monthly subscription of approximately £5,000.

The European Court of Justice is there to enforce the law, not change it

Premier League statement

However, if advocate general Juliane Kokott's advice is upheld, subscribers would be free to use the cheapest decoder available to watch football matches even if it sidesteps exclusive national broadcasting agreements.

That could also mean football is broadcast between 1500 GMT and 1700 GMT on Saturdays which the Premier League says could have a detrimental affect on attendances across the country.

The Premier League receives nearly £2bn for the rights to screen English football's top flight but this ruling could affect that figure.

BSkyB has pumped billions of pounds into English football since the league was founded in 1992, with the money distributed to clubs allowing them to buy some of the top names in the world.

The satellite broadcaster makes about £200m annually in revenue from pubs and clubs, according to analysts at Jefferies Research.

They estimated an adverse ruling could have a £60-£70m impact.

The advocate general's advice comes after Portsmouth pub landlady Karen Murphy, fined for using Greek decoders, had argued the EU single market should let her use any European provider.

"The exclusivity agreement relating to transmission of football matches is contrary to European Union law," said Kokott in her opinion.

But the Premier League countered: "The European Court of Justice is there to enforce the law, not change it."

It added: "If her opinion were to be reflected in the ECJ's judgment, it would prevent rights holders across Europe from marketing their rights in a way which meets demand from broadcasters whose clear preference is to acquire, and pay for, exclusive rights within their own territory only and to use those rights to create services which satisfy the cultural preferences of their viewers within that territory."

The full court often, but not always, follows the advocate general's advice. A ruling is expected later in the year.

@ all See what i stumbled upon

The Advocate General of the European Court of Justice has put forward the view that it is against EU law to stop broadcasters across the continent from showing football matches using foreign decoder cards.

Juliane Kokott gave her thoughts to judges at the ECJ, who are expected to deliver their verdict on an issue that could have major ramifications on the Premier League and Sky later this year.

In a press release, the ECJ revealed: ''In the view of Advocate General Kokott, territorial exclusivity agreements relating to the transmission of football matches are contrary to European Union law. European Union law does not make it possible to prohibit the live transmission of Premier League football matches in pubs by means of foreign decoder cards.''

The Football Association Premier League Ltd (FAPL) is attempting to stop the practice by means of a judicial ruling, after a Hampshire pub owner, Karen Murphy, found a cheaper means of screening Premier League games by subscribing to a Greek broadcaster, NOVA.

The FAPL argues that such subscriptions are in breach of UK copyright law, as they do not screen games through an authorised broadcaster.

However, Kokott said: "The freedom to provide services is also in line with the Satellite and Cable Directive and with European competition law. Equally, neither does the Conditional Access Directive constitute a barrier to the use of foreign decoder cards."

While it may deliver a significant blow to those seeking exclusive rights in the UK, Kokott's opinion is "not binding on the Court of Justice" and the ECJ judges will now consider their own verdict in "complete independence".

Why is it that suddenly members are beginning to pick on each other. Some of the language and words are uncalled for honestly. Are we pressing the self destruct button. Lets look inward and respect the rules of the forum, respect each other and also learn to take good advice without feeling inferior.

It is unfortunate for people to disrespect the gurus who have brought us this far. I think i understand all those who have a thing against the g-group members but u see this group was created to prevent the current scenarios on this our beloved thread. Now information that are against the fundamental pillars of this thread are shared in the open. Should this continue our beloved thread stands the risk of being shut down. This is the main reason why we have the g-group. I am not a member but in my part of the world we have a proverb that says '' the chicken that walks by its mother's side swallows the thigh of the praying mantis'' and also '' the child who knows how to wash his hands properly dines with adults'' . A word to the wise is enough. Please dont let us get too emotional about the g-group members being selfish or the wicked, believe you me they are keeping the fta flame burning by doing so. Just play your cards well thats all

@ all GH members i salute. especially S & S

Hmm, I hail all the gurus in the house. I side with the frustration of some of the gurus of this house but honestly i dont think locking down this thread is the way to go. Sometimes it is frustrating to know and teach someone who should also know and one way or the other not getting it. I understand all that due to my background but try putting yourself in the person's position and you will understand. it is through this forum that some of us have now been taking serious or even seen as gurus in our own small way. We have also come into contact with people who otherwise would never have met (shout out to men like sathob, salamander, captainus, etc thanks for watching our back).

In a nut shell i dont think locking down the forum and lets refrain from bringing attention to it by 'wishing' for it to be locked down. Now my utmost advice to all those posting what shouldnt is that they should also respect first the governing rules by which this forum exists and then secondly the moderator of this forum. Lets not bring harm upon ourselves by suggesting what we dont wish for ourselves. FTA has brought enlightenment upon masses in our part of the world and lets not curtail that due to the insolence of a few. Long Live FTA, Long Live the Moderator, Long Live the Gurus, Longer Live New Developments and Longest Live the Forum. I salute all javascript:void

Has any member of the house used an Mpeg 4 STRONG receiver?if yes does is still have similar functions of the their Mpeg 2? Has it been patched, can the 6969 code work with?

Answers by members to the above questions will be very much appreciated. Thanks to u all for the wonderful contributions

@ Blackstrs

I checked from the strong office and was told the Mpeg 4 decoders would be in August end. I was told the Mpeg 4 had similar functions to the Mpeg 2. It has also been patched for etv i.e is 6969 code works so dont worry.

Hope this is helpful

@ all especially Oga moderator

I think it is about time u put up ur foot on the ground. The last time i checked this forum was strictly for FTA and not a judiciary for settling disputes. Am not saying that problems between members should not be discussed but i think we are now jumping the gun. Like someone said we should know this forum is visited by people outside Nigeria and Africa why then would we want to wash our linen in public.

I believe what ever differences both parties have could be settled amicably outside.

That is my take on the issue

Thanks guys you guys really made me feel welcomed. I hope to do my possible best to last the whole entirety of this forum. Kindly let me in on any literature concerning FTAs. I tried reading the posts from the first season but it seems i have to get abreast with most terminologies and stuff. Am doing my best all the way.

I have done the blind scan from MY TV position but had e tv and new Christian channels from my receiver. Are these the only channels from this position?

All the same thanks guys.

Thanks for responding.  You see my decoder is SRT 4663x (strong decoder) and my dish is pointing towards MY TV.  Now if you can help by at least running me through the steps to do a blind scan ill be grateful.

@emexi

I understand if you say "take it easy" but dont know if you have ever been in my situation.  Imagine if you travel to Russia and want to learn the language but joined the class a bit late with no other member speaking English.  Imagine how funny you would look when the lecturer enters speaks in Russia and the whole class respond in Russia.  Can you imagine that day.  Thats how am feeling.

I want to know more about FTAs, but it seems you guys are way ahead.  All i need is a little push and i will catch up.

Hope you understand.  Thanks anyway for your concern. (xdodos@hotmail.com)

@ urfriend

I bought a new HiTV branded decoder. When i plugged it in, i realised the standby button had a blue light around it. This light was on. Now when i pressed the button to activate the decoder it did not respond. Also nothing showed in the LCD screen to say it was booting or something like that.

I have since bought a SRT 4663x decoder which i am using at the moment but i still believe i should be able to use my HiTV decoder cause i paid serious money for it please advise.

Also do i need to upgrade my STRONG decoder or the version am using does not need the upgrade adversitsed on the HiTV website. If i do, kindly take me through a step by step process on how to, please

Please get back to me soon.

NB: Please try and also convince all and sundry why we should not suspend our subscriptions till August, 2009.
