The Federal High Court in Lagos on Friday granted bail on self-recognizance to the senator representing Delta North in the National Assembly, Peter Nwaoboshi, who was charged with an alleged fraud of N322m. Justice Mohammed Idris instructed him to get two sureties who will each sign a bail bond of N50m within 72 hours. The lawmaker was also asked to deposit his passport in the custody of the court pending the conclusion of the case. The judge stressed that he could not travel out of the country without the court’s permission until the end of the case. Justice Idris adjourned till June 13 and 20, 2018 for commencement of trial. Nwaoboshi walked out of the courtroom, greeted with shouts of “Oshimiri 1” by his legion of loyalists. The Economic and Financial Crimes Commission had on Wednesday arraigned him alongside two firms on two counts bordering on conspiracy and money laundering. The firms, listed as second and third defendants respectively, are Golden Touch Construction Project Limited and Suiming Electricals Limited. The EFCC, in the charges, claimed that Nwaoboshi and Golden Touch Construction Project Limited purchased a property known as Guinea House, Marine Road, Apapa, Lagos for N805m between May and June 2014. The anti-graft agency claimed that N322m out of the N805m, which Nwaoboshi and the firm paid for the property, was part of proceeds of “an unlawful act, to wit: fraud.” The EFCC alleged that the N322m was transferred to the vendor of the property on the order of Suiming Electricals Limited. Suiming Electricals Limited was accused of aiding Nwaoboshi and Golden Touch Construction Project Limited to commit money laundering on or about May 14, 2014. The prosecution said the defendants acted contrary to sections 18(a) and15(2)(d) of the Money Laundering (Prohibition) Act 2011 and are liable to punishment under Section 15(3) of the same Act. The Senate has resolved to summon President Muhammadu Buhari to address the legislature on the spate of killings in Nigeria. The lawmakers, however, agreed to hold a joint session with the House of Representatives which had, on Wednesday, also invited the President. The upper chamber of the National Assembly expressed concerns about the competence of the country’s security chiefs and the need to declare a state of emergency in the states experiencing security crises. Some members of the Senate have asked that the process to impeach President Muhammadu Buhari be started, for failing to get the approval for the withdrawal of $496m from the Excess Crude Account to purchase military aircraft. Senator Mathew Uroghide, who moved a motion at the plenary on Thursday, specifically urged resident of the Senate, Bukola Saraki, to allow the chamber to invoke Section 143 of the Constitution. Uroghide stated that the President had breached Section 80 of the Constitution which stipulates that all government’s spending must be appropriated by the legislature. Also, Senator Chukwuka Utazi stated that it was time for the legislature to be decisive. Saraki had on Wednesday read a letter from Buhari in which the President disclosed that the money had been withdrawn and paid to the United States for the 12 Super Tucano aircraft, ahead of legislative approval. This, he said, was done to beat the deadline for the arms deal. The planes will be delivered in 2020. The President said, “Recently, approval was granted by the United States government but with a deadline, within which part payment must be made otherwise the contract relapses. In the expectation that the National Assembly will have no objection to the purchase of these highly specialised aircraft, which is critical to national security, I granted anticipatory approval for the release of $496,374,470. This was paid directly into the treasury of the United States government. “I am therefore writing seeking approval of the Senate for the sum of $496,374,470 (equivalent to N151,394, 421,035) to be included in the 2018 Appropriation Bill which the National Assembly is currently finalising. The balance of the requirement for critical operational equipment is still being collated from the different security services and will be presented in the form of a supplementary appropriation bill in due cause.” Senator Shehu Sani has described the expenditure as “a gross abuse of the Constitution.” While Sani stated that he was not in support of the impeachment call, he asked that the money should be refunded and the transaction started afresh to allow due process. Senator Abu Ibrahim, however, recalled that former Presidents Olusegun Obasanjo and Goodluck Jonathan made withdrawals from the ECA without seeking National Assembly’s approval. Describing the impeachment as “a PDP conspiracy,” Ibrahim challenged the opposition lawmakers to name any state governor who benefited from the withdrawals from the ECA and sought the approval of the state House of Assembly before spending the money. Makurdi, the capital of Benue State has been brought to a standstill by protesters over the ongoing killings in the state. The protesters, DAILY POST gathered have taken over major streets of the state, calling on the federal government to come to their aide. DAILY POST reports that over 100 persons have been killed between yesterday and today in Guma, Gwer and Logo areas of the state by suspected herdsmen. Chairman of Innoson Motors Nigeria Ltd., Innocent Chukwuma, for the fourth consecutive time, failed to make an appearance in court for his arraignment. He was scheduled to appear at an Ikeja Special Offences Court on Wednesday (today) . The News Agency of Nigeria reports that the automobile boss had previously failed to come to court for his arraignment for charges of fraud variously on January 17, February 9 and March 14. On the last court proceedings held on March 14, it was revealed that Innoson had petitioned the National Judicial Council over Justice Mojisola Dada, the judge, trying the case. During Wednesday’s proceedings, Justice Dada had told Innoson’s defence team that she will not hear any application brought by them before her except the automobile boss was present in court. “No application will be moved in the absence of the defendant, my position remains the same. “You can bring a thousand applications before me for all I care, but no application can be heard in this court without the presence of the defendant,” Justice Dada said. Innoson’s defence counsel, Mr. George Uwechue (SAN), had moved that “where there is an application before the court challenging jurisdiction, the court has a duty to hear the application, even in the absence of the defendant.” Justice Dada, however, insisted that she will not hear any application until Innoson is present in court. The SAN, in response, had an emotional outburst in the presence of stunned onlookers in the courtroom. “You cannot stand me down, My Lord; you cannot stampede me, My Lord, I’m an octogenarian, I’am 50 plus years at the Bar,” Uwechue cried out. “The more reason why you should be better composed and comported, don’t injure yourself,” Justice Dada warned the SAN. Following Uwechue’s outburst, there was an exchange of words between the SAN, Prof. J. N Mbadugha and Mr. Anselem Ozioko, the lead prosecuting counsel for the Economic and Financial Crimes Commission. During the exchange, Uwechue threatened to quit legal practice because of the conduct of Ozioko, the EFCC counsel. Earlier, during proceedings, Ozioko had told the court that proceedings can go on despite the petition written to the NJC against Justice Dada by the defendant. “I have it on good record that where there is a petition against a court, the court can proceed with the matter. “We have the NJC’s directions to that effect so that we can proceed with the case. “I have also been served with many processes today by the defence, one of which is a motion asking the court to set aside a process that my learned friend (Mbadugha) had received in open court. “I’m sure that he realises that it will affect him negatively; that is why he brought the motion,” he said. The EFCC prosecutor added that the anti-graft commission was taking steps to ensure Innoson’s attendance in the next court date. Mbadugha, the defence lawyer for Innoson Motors Nigeria Ltd., had also told the court that he had. via appeal, challenged the jurisdiction of the court to hear the case. “We have not been availed of the NJC’s directive, we have gone to the Court of Appeal as regards jurisdiction,” Mbadugha said. NAN reports that Chukwuma and his company, Innoson Motors Nigeria Ltd., are to be arraigned on four counts of conspiracy to obtain property by false pretenses, obtaining property by false pretenses, stealing and forgery. The offences contravened sections 1(1)(b), 1(3), and 8(a) of the Advanced Fee Fraud and Other Related Offences Act 2016 and Sections 309(9), 388, 465 and 467(1)(j) of the Criminal Code, Laws of Lagos State 2003. Members of the House of Representatives did not mince words on Tuesday when they said President Muhammadu Buhari committed an “impeachable offence” by authorising the purchase of $462million jets for the military without appropriation by the National Assembly. Buhari is buying 12 Tucano aircraft from the US with the money. The planes will be delivered in 2020. The lawmakers became angry as soon as the Speaker, Mr. Yakubu Dogara, read a letter from Buhari, informing the House that the expenditure was done in “anticipation of approval” by the National Assembly. They noted that the letter was a “mere afterthought”, as the expenditure had been done already. The anger caused a brief rowdiness on the floor, forcing Dogara to intervene in a bid to calm down the lawmakers. The eventual decision on Tuesday was that the letter should be properly tabled for debate on another date by the House so that it would take a position on the next line of action. But, before the resolution, it was the Chairman, House Committee on Public Accounts, Mr. Kingsley Chinda, who raised a point of order to draw the attention of members to the alleged “constitutional breach” by Buhari. He said both the 1999 Constitution and other laws in the country did not recognise spending by the President in “anticipation of approval” by the legislature. Chinda stated, “This matter ($462m) came up last week. Today, Mr. President has admitted that the expenditure has already been incurred. “We are supposed to be a watchdog, but as it is, we cannot bite. Atiku Abubakar, former Vice President, on Tuesday declared that he was not desperate to become Nigeria’s president in 2019. The Waziri of Adamawa said this during an interview with BBC Hausa morning programme. He noted that if Nigerians could follow his political antecedent, they would not see him as a desperate politician. According to Abubakar, “If I am desperate, I wouldn’t have stepped down for M.K.O Abiola in 1993 presidential race. “In 1993, I contested with M.K.O Abiola. I later withdrew from the race. In 1999, I was elected a governor of Adamawa state, then invited to be Nigeria’s vice president, under Olusegun Obasanjo. “I could have become Nigeria’s president in 2003 when virtually, all the state governors then, rallied support for me to contest which I declined. I am not desperate to be president as some Nigerians view it. “As a former vice president, I am opportune to know things. If I am opportune to be elected as a president, I will accomplish my mission by reviving the economy, by making Nigeria an investor’s haven. “The present administration discouraged investors into the country, because the Central Bank of Nigeria (CBN) exchange rate policies is too tedious for investors. CBN has three different exchange rate policies, which is not supposed to be. “If elected Nigeria’s president, I will expand the nation’s source of wealth to cater for the growing youth population in the country.
