The APC and its candidate, Alhassan, had gone before the tribunal to challenge the victory of Ishaku of the PDP at the polls.

The petitioners prayed the tribunal to void the governorship poll for corrupt practices and substantial non-compliance with the provisions of the Electoral Act 2010, as amended.

They also urged the tribunal to disqualify the 1st respondent, Ishaku, and hold that all votes credited to him during the election were “wasted and thrown away votes”.

The petitioners through their lead counsel, Mr. Abiodun Owonikoko, SAN, told the tribunal: “Contrary to the provisions of Section 85 of the Electoral Act, which requires the service of at least 21 days to INEC before the holding of congress for the conduct of primary election, the 2nd respondent (PDP) only delivered their notice to INEC on December 11, 2014, at exactly 6:04pm and held the purported primaries on the same day. This was apparently after they have conducted the said primary.

“That in defiance of the requirement of Section 87 of the Electoral Act, the 2nd respondent held the purported primary at Abuja as against Jalingo, Taraba State capital.

“That relying on their earlier notice to INEC for the holding of the primary at the Taraba State capital, INEC (3rd respondent) sent their monitoring team to observe the primary election on December 8, 2014, but the congress did not hold without any explanation from the party.

“That in flagrant disregard to the demand of the Electoral Act 2010, the 1st and 2nd respondents held their primary in Abuja without approval from INEC.

“That by reason of paragraphs i, ii, iii, and iv above, the 1st respondent was not duly sponsored by his political party as required under section 177(c) of the 1999 constitution nor duly sponsored, the 1st respondent is/was not qualified to have contested the gubernatorial election that held in Taraba State on April 11 and 25, 2015”.

There were no primaries in APC in Imo state. In short APC held primaries for presidential election only.
Unanimous Endorsement of candidate is allowed as long as due process is followed and inec is properly informed. After all, even GEJ was endorsed.

You should read the submission of inec as it concerns the case of PDP and Darius Ishiaku, maybe that will give you a clearer picture of what happened at the tribunal

The onus is on the accuser to prove a case. If PDP had a good case against Buhari, don't you think they would have pursued it to a logical end? There was never a missing certificate. The military was simply politicized by the PDP.

I don't support a one party state myself. But the law is the law. You don't expect the law to be jettisoned because there shouldn't be a one party state.

TARABA STATE

The three-member tribunal held that Mr. Ishaku was not validly nominated as candidate of the PDP and therefore did not qualify, from start, to contest the governorship election.
Specifically, the tribunal held that the governorship primaries purportedly conducted by the PDP in the state was done in violation of section 78 (b) (1)(2) of the Electoral Act which guides parties nomination to the position of governorship candidate.
It held that contrary to the provision of the section, PDP conducted the purported primaries at its national secretariat, Wadata Plaza, in Abuja with no clear delegation from the local government areas in the state.
The tribunal sustained the testimonies of the head of election monitoring of Independent National Electoral Commission that the commission was not aware of any primaries conducted by the party in line with the provision of the electoral act which produced Ishaku as the party’s flagbearer".


RIVERS STATE


The spokesperson of the party in the state, Chukwuemeka Eze, confirmed the development to PREMIUM TIMES.
“Yes Hon. Dakuku Peterside was unanimously endorsed in a peaceful atmosphere. It was done in a family affair and there was no bickering at all,” Mr. Eze said.
He also said by the decision of the caucus, the forthcoming party primary in Rivers State is expected to merely confirm the selection of Mr. Peterside as a formality.
Also, the Rivers APC Chairman, Davies Ikanya, who addressed the press after the meeting at the party’s secretariat in Port Harcourt, said the decision of the caucus is not final as primary election will still have to be held to ratify the decision.
“There must be primary elections for all positions in the APC. So, we will not jump the gun,” he said.


FYI information, Jonathan was also adopted by the Pdp before the convention.
