Saraki's lawyer was actually attacking the Chairman, which is an offence on its own. He told the Chairman that his tribunal was incompetent, and incomplete. That the tribunal needed to send another member to the 'senate' for confirmation. That is disrespectful and derogatory. In nations where things work as they should, the Chairman would hold him in contempt and order for his arrest and detainment.
By the way, the constitution didn't stipulate how many members the tribunal should consist, so yes, he was wrong.

It's only in Nigeria you can say that rubbish to a presiding judge and get away with it. Elsewhere, you would be held in contempt, arrested and detained.

That's the kind religious leader we need in this country, one who is not afraid to express the bitter truth even though he knows it's an unpopular truth among his people.

In law, incompetent may not refer to the capability of a person or body, but rather the legal propriety of the actions the person or body is trying to take.

In this case, he premise on saying that was on the constitution of the tribinal. In his own wordings, "the tribunal is not properly constituted ". Which is wrong and derogatory. That is contempt.

Joseph daudu is incompetent.the code of conduct bureau and tribunal act was amended in 2009 to read

" 1) There shall be established a tribunal to be known as the Code of Conduct Tribunal (in this Act referred to as “the Tribunal”).

(2) The tribunal shall consist of a Chairman and such other members as shall be appointed by the President in accordance with the recommendation of the National Judicial Council.

(3) The Chairman or a member of the Tribunal shall be a person who has held or is qualified to hold office as a judge of a superior court of record in Nigeria and shall not be less than fifty-five years of age.

(5) The Chairman and a member of the Tribunal shall hold office for a term of five years and may be re-appointed for another term of five years and no more. "
