Nope. By law, unless there's a stay of execution order by the trial court or an appellate court, the ruling stands, and the "Governor" stands removed and must vacate the seat, even if there's an ongoing appeal process without a stay of execution order on the judgement of the trial court.

I've instructed My Lawyers To Appeal Tribunal Ruling - Gov. Diri

Bayelsa State Governor, Senator Douye Diri, has said he will appeal Monday's ruling of the state election petition tribunal sitting in Abuja and has consequently instructed his lawyers to file the necessary papers.

Governor Diri, who spoke shortly after the tribunal ruled that the Independent National Electoral Commission (INEC) wrongly excluded the Advanced Nigeria Democratic Party (ANDP) governorship candidate from the November 16, 2019 election, said he has implicit confidence in the judiciary that he would triumph in the end.

His words: "We trust in the judiciary and we are appealing the judgement. With God on our side, we will get justice.

"This is a court of first instance and I have instructed our lawyers to file an appeal. We have a right of appeal even up to the Supreme Court."

The governor urged members of the Peoples Democratic Party (PDP) and his supporters not to panic and to continue to remain calm and law-abiding.

The way I understand it, yes.

Honestly, parties are inherently inter-dynamic in the way they choose candidates, vis-a-vis what other parties are doing. So in my mind, the law will be an ass to allow just one party to conduct it's own primary at a time and under circumstances very different from those conducted by other parties.

I expect the courts to give a simple meaning to the ruling: Just conduct a fresh election from the beginning; this time, get it right.

The governor can't appeal cos the case is between that small party, tribunal and INEC not PDP. The only person that can appeal the case is INEC and APC will participate in a fresh election by substituting the name of their deputy like the supreme court ruling of the former Bauchi state governor who won election but the supreme court nullified his victory for presenting a deputy that forged his certificate and order for a fresh election. The ex Bauchi state governor presented a new deputy, contested and won the fresh election. I'm very sure you were young then to know this history. grin

The "fourth position" only because many votes cast for him, were criminally excluded from the votes count to begin with. ICYF, the courts reversed those criminal exclusions and corrected that shenanigans.

The Tribunal just gave its verdict. Diri has about 21days to Appeal the judgement. He remains governor of Bayelsa, pending the determination of his Appeal.
Unless the current ruling is stayed by the same court or an appellate court, Diri stands removed and must vacate, even if an appeal is entered and ongoing.

Diri remains the governor, except he doesn't challenge (in a higher court) this judgement after the expiration of the stipulated period. In which case, the Speaker of the BHA will be sworn in as interim governor, pending the conduction of a fresh election by INEC.
Whether or not the ruling is challenged, the ruling stands and Diri must vacate, even if the appeal is ongoing, unless the current ruling is stayed by the trial court or an appellate court.

On a good day APC should be the way to go considering the harm done to our collective good by the PDP. But APC is nothing but a change in the wrong direction. GMB and his minions are daily demarketing the special purpose vehicle called APC.

Anyone jumping into APC with the hope of gaining a mileage in the next general election will wake up on the wrong side. The little good done by previous administration is either been bastardised, destroyed or deployed for crude politicking.

The divisive nature of most of APC members is a disincentive - Oshiomole is an example. Masari is an example of power without responsibility - today he blames the people and traditional rulers for the ongoing security crisis, the next he blames the opposition for the crisis, next he blames the security chiefs, El - Rufia is another two faced character living a lie. he likes making outlandish statements to gain media visibility but all na wash. The moment he claimed, he paid the Fulani militia I knew more organised mayhem was on the way. Kogi and Osun are bad examples.

We must look beyond APC and PDP but if he must choose one out the two... definitely not Association of Political Contractors.

No government is perfect, including any of the current ones. But at least, we're now seeing real-world quality roads across the country; support infrastructures such as the 2nd Niger Bridge; standard railways and modern coaches; bailout funds to recklessly distressed governments and salary arrears by the previous regime cleared; the FG not having to borrow to pay salaries;

the TSA and IPPIS to help with transparencies even if far from perfect yet; previously untouchable looters being brought to book even if such is viewed by some tiny and vocal special-interest groups as selective;

and terrorists no longer able to fly their terror-flags over the 14/17 LGA's as they did with reckless abandon under the previous regime and now life is returning to relative normalcy in the Northeast, even as there are serious lapses still, just to mention a few — all in the face of seriously dwindled resources shaped by the larger world thrown into repeated recession.

I don't belong in any political cul-de-sac. And whatever comes from 2023 is anyone's duty to help shape and mold, but may it never be back to the PDP — ever!

The simple trick is that the meager 4000 MW is rationed to different areas over different periods of time — sometimes for as long as several weeks nearly continuously to that area — so the currently benefiting area thinks "NEPA" has improved, LOL. Meanwhile, the gains to the benefiting area, is a terrible loss to other areas during the same period.

Put another way, one area having near-constant public utility power supply, simply means other areas are paying for that with darkness. I believe such rotations are neither structured, nor guaranteed for any particular areas or time frames.

In my zone along the Lekki corridor, public utility power supply has been available for 20 hours per day, for the last three days. During last week, there was power for only an average of four hours per day. From experience, these cycles are by no means guaranteed.

To further buttress my point, I have a niece who lives in another part of Lagos and with whom I share data on power supply to our different areas: "Power offs" in my zone, sometimes coincide with "Power restored" in her area, but not all the time, of course.
