kirajustice: @POLITICS NIGERIA
A Nigerian Doctor by the name of James King is being praised by Several people online for saving the life of a dying passenger onboard an Azman airlines flight. Politics Nigeria learned that Dr. King bravely saved the life of the yet-to-be-identified passenger who collapsed on the flight from Kano to Lagos on Saturday, May 25th. Narrating the incident, Dr. King stated;
“Its getting clearer now, …why I was born.
I just saved a life who would have possibly died midair in the aircraft I was a passenger in.
I was on seat 14F of BOEING 737-300 of AZMAN AIR from Kano to Lagos.
Suddenly, his head dropped.
A passenger on seat to my far left on the other side of the aisle.
The Indian man sitting besides him screamed and called the attention of the air officials.
The Indian said it seems the man passed out.
We were still several miles above sea level.
Far from Lagos our destination.
As it is with my nature, I was listening to some music with my earpiece on board this flight. I was rocking myself head forward and backward, my hands slightly moving up to the powerful music of SHOW US MERCY by Will Adiks.
The movements to the unconscious passenger got my attention.
I removed my earpiece.
In 5 powerful long strides I got to the dying patient.
To the Air Hostesses, “I am Dr James King. I want to take over. He is deteriorating fast.”
The Air Hostess said, “Ok sir. Go ahead.”
And she gave me way.
I quickly checked his pulse around his radial artery. It was small volume, irregularly irregular rhythm.
I shouted, “Any doctor, nurse or paramedic here?”
No response.
All the other passengers on board were staring at me with a forlorn look.
As if there was an impending danger to all of them.
I turned to the immaculately dressed 3 Air Hostess around me. “We can save this life together. His life depends on us now.”
I turned to one of the hostesses, “Can you please get us all the medical boxes and kits in this aircraft”
She responded, “Ok sir” and walked fast away.
I asked two other male passengers to help me lift the dying man from his seat to the aisle between the airfraft seats, …so I can have more space to start my intervention on him.
We placed him on the ground.
I immediate positioned him supine and also freed his respiratory airways by tilting his head backwards a bit.
I again asked, “please can I have any cloth or anything to support his neck.”
The air hostesses removed their top suits and handed them to me.
I was encouraged.
I folded two of them and placed them under the neck the of dying man.
At this point the dying man was already having rolling up eyes, …all white.
I listened to his apex heart beat.
It was very weak and faint.
I knew in seconds, he would be dead if I don’t do something fast.
I commenced CPR (Cardio-pulmonary resuscitation) on him.
He responded.
Then he began to convulse uncontrollably.
At the top of my voice, I shouted “Can someone get me Diazepam please?”
An air hostess ran somewhere to get it.
It was 30 minutes before landing.
If nothing was done fast he will die in less than 10mimutes.
I repeated CPR again.
And again. And again….
I listened to the heart using my stethoscope.
Some mild activity commenced.
I turned to the chief air Hostess, please call Murtala Mohammed Airport and tell then to arrange an Ambulance before our landing.”
She said, “Right away” and began to rush toward the cockpit to inform the Pilot to do so.
When I was sure the patient’s ventilation improved a bit, I quickly withdraw 5mg of Diazepam and gave him straight intramuscular on his buttocks.
Returned to the supine position again.
Commenced CPR.
Checked his radial pulse.
I then announced to everyone that… “I AM buying time. He will survive.”
I was on the floor of the aircraft kneeling around him.
Monitoring every single thing I can pick from his reflexes.
The chief air hostess came back.
I asked her, “How many minutes do we have more to land?”
She said, “in 5 minutes.”
I again announced to everyone on board, “HE will survive.”
Then there was a loud sudden noise in the aircraft.
Then we landed on the runway.
Three men/passengers carried him.
We evacuated him very fast out of the plane.
At the foot of the plane there was no ambulance waiting.
I was visibly angry and now shouting at the top of my voice to all the airport officials.
That the ambulance is at the other side.
In a rage I said to them, “This is wickedness. We did all our best with God’s help to keep this man alive for 30 minutes and you people could not even get an Ambulance to wait here?”
Someone suggested that he should be taken in one of the Toyota Hilux van.
I said “No, it will kill him before we get anywhere”.
I screamed, “Any clinic in the airport?”
That was when their brains came back to default reset and they chorused, “Yes.”
I said to the good men still carrying him let go.
That was when we rushed him to the clinic you are seeing in the photo of this post.
Its the airport clinic that is close to the Arrivals of the Murtala Mohammmed airport, Lagos.
I explained everything I did and the medications given to the doctor on call.
She took over.
Then I walked out and looked up to heaven and said, “I know You are involved in this. Thank you Lord.”
Addendum: I actually came to Lagos for a humanitarian programme, an absolutely FREE Medical outreach that is poorly funded meant for the sick and abandoned Prison inmates at Kirikiri Prison.
We are all born to save lives.”

c . There is joy in saving life.Thank you doctor.Thank you all the medical team.Thank you everybody on board for your prayer. This is what we need in Nigeria ..Team work .God bless Nogeria |
Christianity Etc › Re: Will Great Tribulation Take Place Before The Rapture? by ejimatic: 11:22am On May 26, 2019 |
FreshGreen: WILL GREAT TRIBULATION TAKE PLACE BEFORE THE RAPTURE? This question is from Sister F.T. in London, asking if Great Tribulation will first take place before the Rapture.
ANSWER: Glad to hear from you ma. The teaching that Great Tribulation will take place before the rapture is a misconception that some denominations are teaching. We need the help of the Holy Spirit to have the right understanding of what we read. Some particular Scriptures have different and deeper meanings and it is the Holy Spirit that will guide us accurately.
Rapture will first take place before the Great Tribulation. According to the Book of Luke 17, Rapture will not take place during tribulation and sorrow, but during merriment, false peace and enjoyment. That is the clear cue of when the rapture will take place, and the current situation of the world perfectly fits in. From Luke 17 verse 26, "And as it was in the days of Noah, so it will be also in the days of the Son of Man:27 They ate, they drank, they married wives, they were given in marriage, until the day that Noah entered the ark, and the flood came and destroyed them all. 28 Likewise as it was also in the days of Lot: They ate, they drank, they bought, they sold, they planted, they built;29 but on the day that Lot went out of Sodom it rained fire and brimstone from heaven and destroyed them all. 30 Even so will it be in the day when the Son of Man is revealed."
That is going to be the condition of the world when rapture will take place. Then He said, " I tell you, in that night there will be two men in one bed: the one will be taken and the other will be left. 35 Two women will be grinding together: the one will be taken and the other left. 36 Two men will be in the field: the one will be taken and the other left.” Luke 17:34-3
The teaching of Tribulation before Rapture will only mislead people to think that Rapture cannot take place now, by so thinking, it will make them to feel relax and relent of their expectation for the rapture, thinking that Rapture cannot take place any time now, whereas Jesus Christ told us to expect His Rapture any moment, but since they believe that Great Tribulation will first take place, it will be impossible for them to believe the warning of Jesus that rapture will take place any moment, because they expect Tribulation before Rapture. That is the extend a little misinterpretation of the Scripture can go. When we misinterpret the Scripture, no matter how small, it will lead to serious error. The question is that what will cause the Great Tribulation to start if not the Rapture? There cannot be Great Tribulation without the Rapture.
There is no such thing in the Bible that children of God suffered with the sinners before God came to save them. Before the flood, God first rescued Noah and his people; before the judgment of God on Sodom and Gomorrah, the Lord first rescued Lot and his children, and Jesus Himself said His coming would be exactly like those previous two incidents, so where did the pre-rapture Great tribulation teachers got their teaching from? It's from the pit of hell.
So, we should not wait or worry about Great Tribulation, instead we should prepare for the Rapture which can happen any moment from now. After we are caught up with Christ in heaven through the Rapture, the Left-behind on earth are the people who will face the Great Tribulation of the Anti-Christ.
I hope you understand?

Be blessed in the mercies of the Lord . The word Rapture is not in the BiBle...However it is in the Bible that there will be a great tribulation. The time of the tribulation will be short because of the chosen one ones .That means chosen Christians with heavenly hope will be on earth when it begins...After the great tribulation those that are on earth with heavenly hope will be taken to heaven ...transformed...and be with Jesus..Then the war of Armeggodon will strike destroying the wicked ones.....That is what I saw in the Bible.......Any different opinion by anybody is respected |
Politics › Re: 2023: Why Yoruba Will Produce President After Buhari – Clarke by ejimatic: 9:36pm On May 25, 2019 |
Ecstasy154: Elder statesman and Senior Advocate of Nigeria (SAN), Chief Robert Clarke has said that the South West region is already well positioned to produce President Muhammadu Buhari’s successor in 2023.
He noted that since 1999, presidential power goes to any region where two of the three major tribes of Igbo, Yoruba, and Hausa/Fulani decided to take it to after forming an alliance.
Against that backdrop, Clarke posited that with the current collaboration between the Southwest and President Muhammadu Buhari, presidential power was certain to shift to Yorubaland in 2023.
He said it was unfortunate for the Igbos that they have never had a partnership with either the Hausa or the Yoruba in any election since 2011.
Speaking in an interview with Sun Newspaper, the elder statesman said, “The problem in Nigeria is that the politician has created for themselves a situation where if two of them gather against the third one, they will want political power to be rotating among themselves.
“There are three major tribes. The Igbo, Yoruba and the Hausa. Where two of these major tribes gang up, that is where the power is going.
“In 1999, when the constitution came in, Obasanjo wasn’t sponsored by the Yoruba, even though he was a Yoruba man; the Yoruba rejected him, and sponsored Falae. But the Northerners and the Igbo voted for him; the Yoruba never voted for him and he still won because the Northern Hausa and the Eastern Igbo decided to support him.
“In 2003, Obasanjo came for the second term; again, he was not sponsored by the Yoruba; the Yoruba put up another candidate but still he won.
“In 2007, Yar’Adua was not supported by the Yoruba but the Igbo supported the Northerners and he won.
“In 2011, Jonathan came in, he’s not a Northerner but he was supported by the North and the Igbo, and he won. Having realised that power is between two of these sects, the Yoruba and the Hausa merged in 2015 and they produced Buhari.
“In 2023, if the Igbo don’t find themselves holding onto the Yoruba as a friend or the Hausa as a friend and allow the Hausa and the Yoruba to hold themselves together as in 2015, then that ticket will produce the president. That means the Yoruba will produce the president, the Northerners will produce the vice president because that is the reality of the number. Politics is in number.
“Since the demise of Zik, the Igbo had never had a leader and that is the fault of the Igbo race today. If tomorrow, the Igbo bring out a young vibrant Igbo leader who can now find his way either to go with the Northern Hausa and form alliance or the Yoruba and form alliance, then the hope of an Igbo president in Nigeria will come up.
“But I as Robert Clarke seeing the terrain of politics in Nigerians do not see any hope for an Igbo presidency except they change their attitude in aligning themselves with one of the two tribes. I’m looking at Nigeria consisting of three ethnic groups; between two of these three groups, there the power lies. So, if the Igbo can fix themselves in any of the two alliances, then there’s hope for them.”
https://dailypost.ng/2019/05/25/2023-yoruba-will-produce-president-buhari-clarke/amp/ . Since 2011 Igbos have not formed any alliance with Hausa or Yoruba...You are right sir and it will cost Igbo's presidency in 2023.The era of being in isolation has gone in Nigeria... I said it here once but .Some Nairaland analysts said it is an epistle. We shall see when it becomes part of the Nigerian holy writing in 2023...Igbo's missed a great chance in 2019. Thank you for your analysis. Politics is in number......Thank you for sharing my opinion and conclusion. However with due respect I want to say that Yoruba supported Obasanjo in 2023..It was Yoruba agenda then Only Osun State did not vote him because firmer governor Aregbesola of. APC just defeated Oyinloka of PDP at the appeal court.. and he did not PDP to come back to the state in any form...At any rate thank you sir for your reasoning and objective conclusion. “ |

OndoFirstBorn: The Supreme Court on Friday dismissed the appeal filed by the Peoples Democratic Party and its governorship candidate in Ekiti State, Kolapo Olusola-Eleka challenging the election of Governor Kayode Fayemi.
Affirming Fayemi’s election, the five-man panel of the Supreme Court led by the Acting Chief Justice of Nigeria, Justice Tanko Muhammad unanimously held that the appeal challenging the outcome of the poll lacked merit.
Justice John Okoro, who read the lead judgment, affirmed the judgments of both the Ekiti State Election Petition Tribunal and the Abuja Division of the Court of Appeal, which had both dismissed the petition challenging the outcome of the July 2018 poll.
The Independent National Electoral Commission had declared Fayemi and the All Progressives Congress polled a total of 197,459 votes to defeated Olusola-Eleka and the PDP who placed second with 178,121 votes in the July 14, 2018 election.
Dissatisfied with the outcome, PDP and Olusola-Eleka had filed their petition before the Ekiti State Election Petition Tribunal which sat and delivered its judgment in Abuja.
The petitioners alleged among others in their petition that the election was marred by a lot of wrongs including non-compliance with the Electoral Act.
But the tribunal on January 28, 2019 dismissed their petition and affirmed the results declared by INEC.

But OBJ as he is fondly called have vehemently refused.
On Tuesday, Prof. Wole Soyinka expressed the same fear similar to what Chief Obasanjo released on his press release. Femi Fani-Kayode has for long being expressing this same fears but people tend not to take it seriously because he is an ardent critic to APC and President Buhari's government.
FFK is however happy that notable Nigeria are now seeing what he saw and have been shouting about. He tweeted this this morning...
I am glad that Baba OBJ and Prof. Wole Soyinka agree on one thing: that the Fulanisation agenda is real. I am glad that they have both cultivated the sincerity of purpose and courage to join the rest of us and speak out against this great evil that seeks to consume our nation.

damiloladuke: The reason why Federal Government demolished Caramelo Nightclub has been stated by the Minister of the FCT, Muhammad Musa Bello.
Bello, who was speaking to State House correspondents in Abuja yesterday, said that Caramelo, a popular nightclub in Utako District of Abuja, was demolished in a renewed effort to ensure compliance with the city’s master plan.
He further mentioned that the decision to pull down the structure was painful but necessary to restore the master plan, Daily Trust reports He said the government was not in place to destroy but that the violation of rules and regulations won’t be tolerated, adding that the business of running a city is a very serious one.
The minister said the building was meant for a clinic but was converted to a nightclub. He said it was neighbours of Caramelo that drew the attention of government to what he tagged “flagrant abuse.”
Bello however assured that government under the present leadership would not stop Abuja residents from enjoying nightlife.
The Coordinator, Abuja Metropolitan Management Council (AMMC) , Mallam Umar Shuaibu, had said that operators of the night clubs contravened the law by converting residential buildings for other purposes.
Shuaibu, at the time of the arrest of the strippers at the club, had said the Department of Development Control had to demolish the fence of the compound as a form of warning to the owners of the club.
https://lailasnews.com/why-federal-government-demolished-caramelo-nightclub-minister/ . I disagree with you on this decision. We don't throw a baby away with its bathing water. Why not ejecting people there and converting the place to what is meant for? Since it was built according to structural regulation there is no justifiable reason for demolishing it because the premise is being used by prostitutes. It is an abberation. |

Ademola Adeleke, Peoples Democratic Party (PDP) governorship candidate in Osun state, has filed a notice of appeal at the supreme court over the verdict of the appeal court. The appellate court had declared Isiaka Oyetola as the duly elected governor of Osun, dismissing the verdict of the tribunal which favoured Adeleke. In a statement, Niyi Owolade, a counsel to Adeleke, said the PDP candidate asked the apex court to set aside the verdict of the appeal court and uphold that of the tribunal. Owolade said Onyeachi Ikpeazu, a senior advocate of Nigeria (SAN), is leading 23 senior lawyers to file four appeals against “each of the four majority judgements of the appeal court.” “The appeals are against [the] majority judgement in favour of Gboyega Oyetola, All Progressives Congres, the Independent National Electoral Commission and the striking out of the cross appeals of Senator Adeleke,” the lawyer said. “The first Appeal was against the majority lead judgement delivered by Justice J.H Sankey, it is premised on 13 grounds. Senator Adeleke is seeking the following reliefs from the Supreme court; To allow the appeal, Set aside the judgement of the appeal court delivered in favour of Oyetola and Dismiss Oyetola’s appeal against the decision of the Tribunal. “The second appeal is against the judgement delivered in favour of the APC, is premised on 31 grounds of appeal. Senator Adeleke listed particulars of errors committed by the appeal court and sought the following reliefs from the Supreme court: To allow this appeal, Set aside the decision of the appeal court and Dismiss the appeal of the respondent against the judgement of the tribunal. “The third judgement appealed against was the ruling in favour of INEC, it is based on 17 grounds Senator Adeleke listed particulars of errors committed by the judges of Appeal Court and sought the following: An order of the supreme Court allowing his appeal, An order of Supreme Court setting aside judgement of Court of Appeal and restoring the judgement of tribunal delivered on the 22nd of March.” |

ejimatic: How Supreme Court Justices arrive at judgments – CJN May 9, 2019Halimah Yahaya
The acting Chief Justice of Nigeria (CJN), Mohammad Tanko, on Thursday spoke on how the Supreme Court arrives at its judgments.
Receiving the management of Asset Management Corporation of Nigeria (AMCON) who paid him a courtesy visit in his office, Mr Mohammed said the justices of the apex court are independent-minded and cannot be intimidated by anybody.
He said the judicial officers are only answerable to their conscience and God while writing and delivering judgments in all cases that come before them.
This was contained in a statement issued by the Director, Press and Information, Supreme Court of Nigeria, Akande Festus, at the end of the visit.
Other Justices of the Supreme Court at the event were Olukayode Ariwoola, Kekere-Ekun, Musa Dattijo, Ejembi Eko and Uwani Abba-Aji.
“We take our time in taking notes and writing judgments to avoid making mistakes. We subject every case before us to intense debates and arguments during our conferences in order to be as dispassionate and objective as possible.
‘’Let me state clearly that we are not answerable to anybody and can never be intimidated by anybody whatsoever in taking our decisions.
“But for certain, we are only answerable to God Almighty because he is the owner of our lives. No human being, living or dead can influence the reasoning or judgments of the Supreme Court of Nigeria.
“We are very independent in the Supreme Court because of the enormity of the trust and responsibility reposed in us by the Almighty God, the Constitution and our dear nation,” the acting CJN stated.
According to the statement, Mr Mohammed told the AMCON visitors that the Supreme Court of Nigeria has so far remained the busiest and most hardworking Supreme Court in the world.
He said this is in view of the number of appeals received and heard on a weekly basis as well as the number of judgments delivered within a short duration.
“I beat my chest to say that there is no Supreme Court in the world that works the way the Supreme Court of Nigeria does.
“Except when we go on our annual vacation between late July and early September of every year, we keep hearing appeals. It is on record that there is no day of the week, between Monday and Friday that we don’t sit.
“We deliver judgments on Fridays. Sometimes, we give as much as 35 judgments on some Fridays. We oftentimes over-stretch ourselves, as we work assiduously day in, day out.
“If you see the number of appeals that come to this court on a regular basis, it will shock you. Basically, as it is today, there is nothing we can do about it for now, except there is a Constitutional amendment. Ideally, it is not every case that is supposed to reach the Supreme Court. Some ought to be terminating at the Court of Appeal.’’ . “We take our time in taking notes and writing judgments to avoid making mistakes. Justice Mbaba called it hearsay evidence because it was based on a paper he didnt sign. He said since he wasnt called to testify,or a sworn affidavit from him confirming his absence then it cant be proven as fact. That it could be as a result of mischief of the people transmitting the written record of appeal. The OP was writing his as if justice obiora absence wasnt contentious. garfield1: Guy,you clearly have comprehension issues and i cant help you.seems am wasting my time on you.this will be my last comment here. That pdp called thousands of witnesses or brought several evidences means nothing if they cant be compelling or damning.whether apc bring witnesses or evidences doesnt matter.it is now left for pdp the accuser to prove its case and they didnt beyond doubt.only the testimonies of 5 pdp witnesses were taken and they were even originally termed speculstivs and hearsays.adeleke only concentrsted on proving over voting which he failed to prove. Section 140 says tribunals cannot declare a winner or subtract votes.yusuf alli during the hesring at the appeal coúrt ssid a full supreme court panel has affirmed this section before.the judge asked if the tribunal were aware.this was the turning point.engineer boat was the op who opened that thread.him and the rest of you were mocking me but now all of you are tearful. Non appearancr or absence of a judge at the sitting is enough to nullify the case.this particular op opened this thread to show us how the supreme court have been ruling when a judge is absence yet you said its rubbish. the judges did not rule only on non absence but on the 17 units, rerun and other matters.stop wasting my time.commonsense should tell you that for 4 judges out of 5 to rule agsinst Adeleke means that he lost well . You know where his problem lies.....Kudos to you...Good analysis |

garfield1: You are wrong as usual.apart from the rivers case which i wasn't serious about, its only the osun tribunal case you won.in rivers, apc were always going to lose and i didnt quote any law to support them. your comments shows that you are new to legal matters that is why before the appeal court ruled, you were celebrating childishly common errors and moods in the courtroom.in every case before the substantive matter are looked into, they will first deal with preliminary objections which deals with technicalities.the tribunal made a lot of technical errors and apc duly took advantage of that.once you lose the technical battle, its over.they cant look at the main issue.even in rivers, apc lost based on techniques.in osun, the minority judgment recognised the technical error made by the tribunal and clearly tried to defend it.it is the first issue the supreme court would look at. Apart from the technical error, issues in the main case were ruled in favour of apc.you lied that the judges did not rule based on exhibits or evidences.though there was no need for that but they still dealt with that. Looking at results of 17 polling units, what they tribunal found out was improper balloting and alterations which did not affect the final results.results in copies held by pdp were same with the originals.pdp did not prove over voting or voided votes.what they proved is alterations which does not constitute substsntial non compliance with the electoral act.even if it does, the electoral act calls for a rerun which the tribunal failed to call.take note of this mistake.i also predicted this earlier. Section 140 of the electoral act gives the courts powers to only cancel polls or upheld and nothing else which the tribunal went beyond.take note. Concerning the 7 polling units were supplementaries took place, they were no elections there, even the tribunal agreed with that yet went ahead to nullify the rerun polls when clearly inec were right in csncelling and ordering a rerun.the electoral act provides that presiding officers can cancel elections but when they are not able to or partake in subverting the process, their siuperiors will do so and this was done.this is a case if disenfranchisement which the constitution dislikes and the supreme court will surely comment inec for allowing this that couldn't vote to do so.it is universal. Adeleke may have actually won but he didnt provide compelling evidences and also the tribunal made errors which destroyed his case.too many loopholes.it is over.mourn no mor . Johnnyessence: you have started posting your epistles and propaganda as expected, you will be surprised with the ruling of supreme court of justice. Supreme justices will rule based on the tribunal judgment. If you read the minority judgement from the minority judge in the appeal court last week , you will be surprised that the majority judgment was bought by the APC .Infact the minority judge award 200k against the appellant and APC in his judgement. Keep on posting your epistles as expected. It will never hold any water. my comment is reserved till after Supreme court judgement... |

The legal tango over the Osun State gubernatorial election held on 22nd and 27th September 2018, would be determined by the Supreme Court if the Peoples Democratic Party (PDP) carriers out its threat to appeal the judgment of the Court of Appeal delivered last Thursday, setting aside the March 22nd judgment of the Osun State Governorship Election Tribunal, which sacked Governor Adegboyega Oyetola. While awaiting the apex court, let us examine some gravamen of the legal dispute. Of particular interest to this column is the issue raised at the appeal by Wole Olanipekun SAN: whether the absence of learned Justice Peter Obiorah (who authored and read the lead judgment) at the tribunal sitting on February 6, has not rendered the majority decision of the tribunal a nullity. The learned Justice Obiorah was a member of the three-man panel that heard and determined the petition of Senator Ademola Adeleke and the PDP. On a majority of two-to-one, Adeleke carried the day at the tribunal. That judgment has now been set aside on appeal, by a four-to-one majority panel, led by Justice Jummai Sankey. While Justices Abubakar Yahaya, Isaiah Akeju and Bitrus Sanga agreed with Justice Sankey, Justice Ita Mbaba dissented. Interestingly, there is a plethora of cases on the validity of a judgment delivered by a panel different from the one that heard a case. In Awolola v Governor Ekiti State (2019) All FWLR, (Pt. 971), 1-55, the Supreme Court was invited to overrule its decision in Ubwa v Tiv Area Traditional Council (2004) 11 NWLR (Pt. 884) 427 as well as Sokoto State Government v Kamdex (Nig.) Limited (2007) 7 NWLR (Pt. 1034) 466. In Ubwa v Tiv Area Traditional Council , Magaji JCA who did not participate in hearing the appeal wrote and delivered a concurring judgment, in the case heard by Akpabio, Umoren and Chukwuma-Eneh, JJCA; while in Sokoto State Government v Kamdex (Nig) Ltd , Justices Ogebe, Aderemi and Chukwuma-Eneh heard an appeal, however Justice Galadima who did not hear the appeal, wrote and delivered a concurring judgment, instead of Ogeb JCA. In Ubwa’s case , the apex court had after considering sections 247(1), 294(2) ad (4) of the 1999 constitution declared the judgment a nullity and ordered a retrial. Also in Sokoto State government’s case, the Supreme Court held that the judgment was not a complete judgment of the Court of Appeal ‘because one of the Justices who heard the appeal did not reduce his judgment or opinion in writing capable of being delivered … as required by section 294(2) of the 1999 constitution.’ However in Awolola v Governor Ekiti State , the Supreme Court reversed its earlier decisions, including Shuaibu v N.A.B. Ltd (1998) 5 NWLR (Pt. 551) 582, (1998) 4 SCNJ 109. The learned Justices referring to section 258(1), (2) and (3) of the 1979 Constitution held: “Sub-section (3) (supra) clearly provides a solution like the one at hand in this case, as it stated that where the decision of the court consists of more than one judge, the concurring opinion expressed by the majority justices shall be the binding.” They further held: “The sudden appearance of the name of Adio JCA as delivering a concurring judgement must be without doubt a genuine mistake made in the course of compiling the record.” Interestingly, in Awolola v Governor Ekiti State , if the judgment of the judge who is not a member of the original panel is discountenanced, the judgment still stood as judgment of the majority. However, in Oyetola v Adeleke’s case at the tribunal, the panel is made up of three members. So should the Supreme Court find the judgment of Justice Peter Obiorah, one of the panellist invalid, because he did not sit with the other two members on February 6, as shown by the records of appeal, there will be no majority judgment left to stand, since the tribunal was made up of only three judges. The surviving judgment, will become a minority judgment, just like the dissenting judgment of the chairman of the tribunal, and may therefore not meet the threshold established in Awolola v Governor Ekiti State and Shuaibu v N.A.B. Ltd, or even the earlier case of Adeigbe v Kusimo (1965) NMLR 284, wherein the Supreme Court held: “We are therefore of the opinion that variations in the bench do not make the judgment a nullity; they may make unsatisfactory; and it may have to set aside for this reason, but whether they do or not depends on the particular circumstances of the case.” The circumstance in Oyetola v Adeleke may be such that the sitting of only two members out of three at a stage of the proceedings, may render the judgment nugatory as held by the dissenting judgment of Mary Peter-Odili JSC in Awolola v Governor Ekiti State. In her judgment, Justice Peter-Odili, quoted Justice Kutigi JSC in Ubwa v Tiv Area Traditional Council , wherein he said: “The entire proceedings before the Court of Appeal were a nullity because all members who heard the appeal and those who wrote the judgments were not all present throughout the hearing of the appeal which includes delivery of judgment.” Should the Supreme Court come to the conclusion that the absence of learned Justice Obiorah “throughout the hearing” of the petition (a position affirmed by section 285(4) of the 1999 constitution: which provides that the quorum of an election tribunal shall be the chairman and two members) affected the validity of judgement at the tribunal, and choose to order a retrial, Senator Adeleke and the Peoples Democratic Party may then face the challenge posed by the provision of section 285(6) of the 1999 constitution (as amended). That section provides that an election tribunal shall deliver its judgment within 180 days of the petition. No doubt, should PDP and her candidate proceed on appeal, the coming days will be days of anxiety for Governor Oyetola and Senator Adeleke and their supporters. That is because section 285(7) of the constitution (as amended) provides that “an appeal from a decision of an election tribunal or court shall be heard and disposed of within 60 days from the date of delivery of judgment of the tribunal.” Clearly, the reversal of the judgment of the trial tribunal brought a lot of excitement to the people of Osun, and many of them look forward to a favourable judgment at the apex court. Reacting to the victory at the appeal court, Adeniyi Adesina, the Chief Press Secretary to Governor Oyetola, on behalf of the governor wrote: “After months of uncertainty and wait in judicial wilderness, truth has finally prevailed over falsehood….” The next 60 days will determine who finally carries the day in the legal matter. |
