KarlWhyte: Justice Oathman Musa of an Abuja High Court sitting in Bwari Area Council of Abuja on Tuesday Nullified the nomination of Senator Ademola Adeleke as candidate of the Peoples Democratic Party (PDP), in the September 2018 Governorship Election in Osun State.
Adeleke, who represents Osun West Senatorial District at the National Assembly was the PDP’s candidate in the 2018 governorship election in Osun state.
Two Chieftains of the All Progressives Congress (APC), Wahab Raheem and Adam Habeeb, had in 2018 barely few days to the governorship election in Osun State had dragged Adeleke to court, accusing him of not possessing the requisite educational qualification (secondary school certificate) to contest for the office of governor.
They prayed the court for an order to disqualify Adeleke from participating in the Sept 22 governorship election in the state on the grounds that he does not possess the requisite educational qualification.
Delivering judgment in the suit Tuesday, Justice Musa annulled Adeleke’s nomination on the grounds that Adeleke offended section 177 of the 1999 constitution as amended. The section stipulated that candidates for the position of governor must be educated up to secondary school level.
According to Justice Musa, while the court’s findings showed that Adeleke entered secondary school in 1976, there was no record to show that he actually graduated as his name was no longer seen in the school’s register from 1980.
Justice Musa further stated that the result Adeleke attached to his form CF001 which he submitted to the Independent National Electoral Commission (INEC) was fake, as it was found to be different from the one presented to the court by the principal of Ede Muslim High School, Ede, Osun State.
Meanwhile, Adeleke’s lawyer Nathaniel Oke SAN has faulted the judgment of Justice Musa on the grounds that the judge erred in law by going out of hiy way to source for evidence to arrive at his “unjust conclusion”.
He submitted that the court erred particularly when it ignored WAEC evidence that Adeleke was educated up to Secondary School level as required by law.

Press Statement
Flawed Bwari Judgement Against Senator Adeleke Can Not Stand!!!
We received with bewilderment the judgement of a Bwari High Court on allegation of forgery against Senator Ademola Adeleke and his qualification to contest in the governorship election of Osun state. The judgement delivered today subverted justice by ignoring four critical evidence to rule against validated facts and submissions.
While we are set to appeal the judgement, we also find it compelling to put the records straight by listing out the fatal flaws in the ruling and why it cannot stand before any court.
It would be recalled first of all that the matter in question has been addressed by two High Courts’ ruling, affirming that in the face of the constitution, Senator Ademola Adeleke is qualified to run for the governorship office. The two rulings delivered in September 2018 held that Senator Adeleke satisfied all requirements of the law to contest for office. It is trite in law that once a court of coordinate jurisdiction has ruled on a matter, court of similar jurisdiction cannot entertain it. Shockingly, the Bwari judge breached this precept to subvert justice.
Secondly, we want to note that the judge further erred in law by failing to take note of the expiration of 180 days for ruling on pre-election matters. Even when a December 2018 judgement with respect to the issue was presented, the judge chose to ignore it. We note that the judge violated the law by adjudicating over a matter whose filing and hearing period has expired.
Thirdly, the West African Examination Council was also subpoened by the court at the instance of the two APC plaintiffs (working covertly with some moles within PDP) to present evidence of facts that Senator sat for the WASC Exams. The council produced the listing of all students who sat for the May/June examination in 1981 alongside the Senator in addition to the certified true copies of his school certificate result.
From the evidence produced by the Council, it is crystal clear that Senator Ademola Adeleke was indeed educated beyond the minimum requirement of “up to secondary school level” as stipulated by law and therefore qualified to run for the office of governor in accordance with section 177 (D) of 1999 CFRN (as amended). Not withstanding, the judge still went ahead to rule otherwise.
The only statutory body empowered by law to determine authenticity of a secondary results is the West African Examination Council and they confirmed the authenticity of Senator Adeleke’s result by producing a CTC of the same result. What evidence did the judge therefore base his ruling on?
Fourthly, the plaintiffs shocked by WAEC’s testimony, again subpoened the school principal to appear in court to produce evidence of facts as well as to confirm the authenticity of the statement of results. The principal appeared and confirmed that the statement was genuinely issued by the school and that any error noticed on the statement was that of the school, not that of Senator Adeleke. The school did not at any point disown the statement of results. The school owned up to the error which was not about forgery.
From the foregoing ,we affirm that today's judgement of the Bwari court is a travesty of justice, a purchased ruling designed to negatively affect the outcome of Osun governorship judicial process.
We declare unequivocally that the ruling being so glaringly against tested facts and the law cannot stand. It is also clear that the ruling cannot in anyway stop the reality that Senator Ademola Adeleke fulfilled constitutional requirements to be Governor of Osun State.
We appeal to our numerous supporters and good people of Osun state to remain calm This is another failed bid in the efforts of detractors and enemies of democracy. Senator Ademola Adeleke is not only qualified but by the grace of God will soon be sworn in as the legitimate Governor of Osun State.

Reacting to his bail revocation in a tweet on Tuesday, the IPOB leader said the Nigerian constitution prohibits trial and conviction of anybody for “offence not written down.” Nnamdi Kanu who maintained that secession was not written down as an offence in Nigeria hence he can’t be convicted, stated that his bail revocation exposed Justice Binta Nyako as ignorant.
Citing Section 36 sub-section 12 of the Nigerian constitution, he tweeted; “Section 36 sub-section 12 of the Nigerian Constitution PROHIBITS trial and conviction of anybody in a Nigerian court of any offence not written down. He further dared the Federal Government to come for him if it could, stressing that the bail revocation was a ploy by the Federal Government to make the International Police stop him from travelling freely across the world to make a case for the independence of Biafra. Nnamdi Kanu who further threatened to cause trouble for Nigeria if provoked, said in his statement;
“I am not a Nigerian citizen; therefore, your bail revocation is completely meaningless to me. My devotion to the absolute and puritanical pursuit of the total restoration of the sovereignty of the Republic of Biafra is unwavering.
“My lawyers are waiting for an Interpol red notice against my name and all hell will break loose. If the intention of Binta Nyako is to curtail my travels, thereby limiting IPOB diplomatic offensive, then let me assure Biafrans that our enemies have failed.
“Should they request Interpol intervention in this matter, I will give my lawyers here in the UK the instructions we need to launch a no-holds-barred legal assault against Nigeria. So, I am waiting for them. Europe and Interpol are not a bunch of wild beasts like Nigerian law courts and her security services. In Europe there is rule of law which is also binding on Interpol.
“The treasonable felony charge they levelled against me is not a crime that could be committed by merely carrying Biafran flag about and preaching secession, but one that could only be committed using guns, bombs and other weapons, which my group has never been associated with. I warn the Federal Government not to dare me because I’m capable of causing trouble for Nigeria.”

ELVISHOT: The Director-General of the National Agency for Food and Drugs Administration and Control (NAFDAC), Mojisola Adeyeye, has revealed some ‘abnormalities’ she has experienced during her time on the job.
According to her when she assumed her role as NAFDAC DG, some House of Representatives members demanded bribes from her and even threatened her upon refusing to concede to their demand.
“When I came to NAFDAC, there were a lot of things that were wrong. Take oversight function or whatever that is done, I was shocked when I was told to give money, I said money for what? … money to the committee that visited us. The Health Care Services Committee of the House of Representatives,” she said on Friday during an interview on Channels TV’s Sunrise Daily.
Adeyeye further stated that the request from the federal lawmakers came at a time the agency was ‘bleeding profusely’ from a paucity of funds.
Beyond shocking, she described the day as the worst day of her life as ‘a chief regulator.’
“I said I cannot. For just the visit? I couldn’t believe my ears because it saddens me. Yes, it can be referred to as them asking for a bribe. It saddens me. This is an organisation that was bleeding profusely.

nairavsdollars: Igbos Have Themselves To Blame For Voting Atiku - APC
The ruling APC said it does not deserve any blame for not zoning the position of Senate President or Deputy Senate President to the South-East.
Rather it said the South-East should blame itself for queuing behind Atiku Abubakar, presidential candidate of the PDP in the just concluded general elections.
The party was reacting to the outburst of Orji Uzor Kalu, who said that unless the APC makes him the Deputy Senate President of the 9th Senate, he will fight to become the Senate President.
Yekini Nabena, Deputy National Publicity Secretary of APC, in a chat with Daily Independent said while nobody is stopping Kalu from contesting for the position of Senate President, the reality is that he cannot win since the zoning arrangement didn’t favour him.
According to him, rather than getting angry with APC leadership, Kalu should blame his people in the South-East for putting all their eggs in one basket by rejecting President Muhammadu Buhari and casting over 90 percent of their votes for Atiku.
“That shouldn’t be a problem. He can contest for the position of Senate President. But the issue is, can he win? Nobody is stopping him from contesting. Igbo people always play themselves out. So, Kalu cannot blame APC.
“He should blame his own people from the South-East. He should blame them because they don’t know how to play politics. They play politics like a one-way thing. They all voted for Atiku in the presidential election. So, now that Atiku lost, who will help people like Orji Kalu? 99.9 percent of them followed Atiku.
“So, what is Kalu crying for? He should go back to his people and educate them on how politics is played especially at the national level. They should play 50-50. If this one didn’t work, the other can work.
“So, Orji Uzor Kalu must go back to his people and educate them because he himself is not worthy to be Senate President or Deputy Senate President. So, if he wants to contest, he can do so. Nobody is stopping him. But I know that he cannot win”, he said. https://www.independent.ng/lawans-senate-presidency-forgone-conclusion-apc/ . I have been saying this several times. You cannot eat your cake and have it. But truth is bitter always. We will say it. I once said it here that the future of the South East is in their hand. ikorodureporta: The Nigerian Communications Commission (NCC) has revealed that subscribers to mobile telecommunications services in Nigeria spent about N767.23bn on airtime purchase between November 2018 and January 2019,
The figure is derived from the number of subscribers in the three months under review obtained from the NCC, and the industry’s Average Revenue Per User provided by network operators.
It was gathered that, in November 2018, the monthly subscriber data from NCC showed that there were 168.73 million active GSM subscribers from MTN, Globacom, Airtel and 9mobile.
In December, the number of active subscribers rose to 172. 63 million while in January 2019, the country had 173.63 million active GSM users.
With the telecommunications companies’ ARPU amounting to $4.87 (N1490.22) per month, Nigerians spent N251.44bn on airtime in November 2018. Based on the same estimated monthly revenue per user in the industry, expenses on airtime purchase increased by two per cent to reach N257.04bn in December 2018.
Also, in January this year, about N258.74bn was expended by active Nigerian subscribers on airtime, giving a total of N767.23bn in the three months under review.
The data indicates that sales of airtime remain the core revenue earner for telcos and generate income for operators via voice calls, SMS, data subscriptions and value-added services.
It will be noted that Nigerians buy airtime through various platforms such as physical recharge card, the virtual top-up via USSD code, subscribers’ bank accounts domiciled on mobile devices, vending on web-based platforms and on Automated Teller Machines.
The rise in airtime revenue has out to rest worries and predictions by analysts that voice and messaging revenue would decline due to the proliferation of instant messaging apps.

How will it be if NITEL is the sole mobile network provider? All this money will be in the account of Federal government. First, under the law and by extension of his fundamental human right, Oyetola does not have to vacate office IMMEDIATELY. Subsection 5 of Section 285 of the 1999 Constitution and through its First Alteration via the Electoral Act 2010 says: “An election petition shall be filed within 21 days after the date of declaration of results of the election.” Adeleke satisfied this by filing his petition before the expiration of the TWENTY-ONE days after Oyetola was declared. Now, Subsection 6 of the Act says: “An election tribunal shall deliver its judgment in writing within 180 days from the date of the filing of the petition (six months).” The Tribunal had met this because it would have been SIX months tomorrow that Oyetola was declared winner. (September 27, 2018). And Subsection 7 says: “An appeal from decision of an election tribunal or Court shall be heard and disposed of within 60 days from the date of the delivery of judgment of tribunal.” Implication: Oyetola has SIXTY days (counting from the day the Tribunal declared him a usurper, TWENTY-ONE of which he must file his appeal) and those 21 days must be within the original 60 days for the appellate court to determine the merit or otherwise of his appeal. If after those 60 days, Oyetola failed to file his appeal and the appeal has not also heard it, he will be REQUIRED by law and COMPELLED by extant injunctions to vacate office! He still has the right to go to the Supreme Court if the appellate court dismisses his appeal. But again, WITHIN A STIPULATED TIME which is also SIXTY DAYS including filing of notice. Therefore, technically and since the mandatory 60 days have not lapsed, Oyetola remains governor of Osun State. |

Politics › Re: Osun Tribunal Verdict: Adeleke’s Lawyers Move To Get Certificate Of Return.. by ejimatic: 8:49pm On Mar 23, 2019 |
ahmedkoded95: Against the backdrop of Friday’s court judgement in Abuja by the election petition tribunal, which declared the Peoples Democratic Party (PDP) candidate, Senator Ademola Adeleke as the winner of September 22 governorship poll in Osun, the legal team of Adeleke has begun moves to get the certificate of return issued to its client.
Delivering its judgment, the tribunal had nullified the election that produced the All Progressives Congress (APC) candidate, Mr Gboyega Oyetola as the governor of Osun State and subsequently ordered the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Adeleke.
Findings by Tribune Online indicated that necessary arrangements were being made by Adeleke’s legal team to ensure that INEC complies with the court order with the service of the court order on the electoral umpire.
Speaking to our correspondent during a telephone chat, one of the lead counsels to Adeleke, Barrister Edmond Biriomoni said “right about now, INEC should have been served because the bailiff of the court or the tribunal had actually went to effect service of the tribunal’s judgment on INEC. We have already gotten the copy of the order and the bailiff had gone to serve them (INEC) officially.”
When asked about the plan by the APC and Oyetola to file an appeal against the judgment, he contended that “they are yet to file an appeal. They are yet to lodge a formal appeal. The appeal they are referring to is on the pages of newspapers or on their press release. They have not filed a formal appeal at the tribunal. This is because I am just leaving the tribunal right now.”
Biriomoni continued “the order of the tribunal still subsist even when they go to the Court of Appeal except they set it aside. Until the Court of Appeal overrules the tribunal, the judgment subsist. Whether they file a notice or not, that does not take away the validity of the judgment until it is overruled by the appellant court, either the Court of Appeal or the Supreme Court.”
It would be recalled that the Osun election petition tribunal, sitting in Abuja had on Friday nullified the election of Oyetola as the governor of Osun State, cancelling results from 17 polling units over the alteration of results by INEC while it also deducted 2,029 votes of the APC and 1,246 votes of the PDP.
https://www.tribuneonlineng.com/197875/?amp_markup=1&__twitter_impression=true . I hate lawyers creating a scene....The APC has a seven day ultimatum to appeal the decision...They will still maintain the status cope until the final judgement in the supreme court . Any lawyer that claims he wants yo get a certificate of return based on Friday Judgement is just making himself a laughing stock.....The appeal court will rule on it before May 23 while supreme court will rule before July 23...Till then certificate of return between Oyetola and Adeleke is just a toothless dog..It is time however for both parties to prepare their appeals and counter appeals because anything can happen to either side on this election crisis... |

ojikeebere12: The chairman of the Osun State Elections Petitions Tribunal in Abuja has delivered a dissenting judgement in the Osun State governorship election petition.
Justice Muhammed Ibrahim Sirajo on Friday dismissed the petition by the Peoples Democratic Party (PDP) and its governorship candidate, Ademola Adeleke, which alleged that there was election non-compliance with the Electoral Act in the election.
Justice Sirajo ruled that the petitioners failed to prove the claims at the tribunal.
He further ruled that where it is established that there is non compliance, the tribunal does not have “the powers to subtract the votes of the non compliance and declare a candidate winner.”
He added that under Section 140(3) of the Electoral Act, where substantial non compliance is proved, the tribunal can only order a supplementary or fresh election.
The chairman however adviced INEC to only comply with the majority decisions concurrently delivered by Justices Peter Chudi Obiorah and Adegboye Ayinla Gbolagunte.
The main judgment of the panel had invalidated the rerun election of September 27, 2018 which returned Governor Gboyega Oyetola as winner and withdrew the certificate of return issued to him by INEC.
