Osun guber: Supreme Court decides Oyetola, Adeleke’s fate Friday

Jul 4, 2019 1:26 PM

The Supreme Court will today deliver judgment in the appeals brought before it by the governorship candidate of the Peoples Democratic Party (PDP) in the 2018 governorship election in Osun State, Senator Ademola Adeleke, challenging the judgement of the Court of Appeal, Abuja, which affirmed the election of Adegboyega Oyetola of the All Progressives Congress (APC) as the governor of the state.
Adeleke’s four appeals, marked: SC/553/2019; SC/554/2019; SC/555/2019 and SC/556/2019 are challenging the May 9, 2019 judgments of the Appeal Court, which held that Oyetola was validly elected as governor of Osun State.
The appellate court had also set aside the majority judgment of the Osun State Election Petition Tribunal which had allowed Adeleke’s petition and declared him the winner of the election.
A seven-man panel of the appellate court, led by the Acting Chief Justice of Nigeria (CJN), Justice Ibrahim Tanko Muhammad heard the appeals last month and slated today, July 5, 2015, for judgment.
Adeleke had, in his appeals prayed the apex court to set aside the ruling of the appeal court and uphold the decision of the Tribunal, which declared him as the validly elected governor of Osun State.
Osun State Election Governorship Election Petition Tribunal had ruled that Senator Adeleke was the rightful winner of the 2018 governorship election, having satisfied the constitutional requirements of majority votes and spread across the local government areas of the state.
The tribunal also nullified the rerun election of September 27, 2018.
The Appeal Court had reversed the ruling, nullifying the decisions of the tribunal and reinstating Oyetola as the winner of the said election.
At the last sitting on the matter, the court took submissions from Adeleke’s counsel, Dr. Onyechi Ikpeazu (SAN) and Chief Wole Olanipekun (SAN) for the 1st respondent (Oyetola) in respect of appeal marked: SC/553/2019.
The court said its judgment in the main appeal – SC/553/2019 – will be applied to two other similar one, filed by Adeleke against the Court of Appeal’s decision in relation to the appeals filed by the Independent National Electoral Commission (INEC) and the APC, marked: SC/554/2019 and SC/555/2019.
The court also took arguments from Ikpeazu (for the appellant), Yusuf Ali (SAN) for INEC; Bode Olanipekun (SAN) for Oyetola and Olumide Olujinmi, for APC in relation to the fourth appeal, marked: SC/556/2019.
In their arguments, counsel to the respondents – INEC, Oyetola and the APC faulted Adeleke’s appeals and prayed the court to dismiss them for lacking in merit and uphold the judgments as given on May 9, 2019 by the Court of Appeal in Abuja, which affirmed Oyetola of the APC as the winner of the governorship election held in September 2018.
In relation to the first set of appeals – SC/553/2019; SC554/2019 and SC/555/2019, Ikpeazu urged the court to set aside the judgments of the Court of Appeal and restore the majority judgment given in his client’s favour by the election tribunal.
In a counter-argument, Wole Olanipekun, Ali and Olunijmi faulted the competence of the appeals and urged the court to dismiss them for lacking in merit and to uphold the May 9 judgments given in favour of the respondents by the Court of Appeal.
In arguing the fourth appeal: SC/556/2019, Ikpeazu urged the court to set aside the two concurrent judgments of the election tribunal and the Court of Appeal, in which both courts rejected Adeleke’s request to void the supplementary election held after INEC declared the Osun governorship election inconclusive.
Ikpeazu said his client’s contention was that INEC lacked the powers to have canceled elections in some pooling units and order a rerun, arguing that the supplementary election was unnecessary because Adeleke had won the election and met the constitutional requirement to be declared a winner.
Ikpeazu prayed the court to set aside the Paragraph 44 of the INEC’s Guideline, on which basis the supplementary election was held, on the grounds that it conflicted with the constitution.
Olanipekun’s son, Bode Olanipekun (SAN) argued the fourth appeal for Oyetola and urged the court to disregard Ikpeazu’s contention that the supplementary election was unnecessary and said that Paragraph 44 of INEC Guidelines was not in conflict with the constitution.
Olanipekun, who noted that Section 178(4) of the Constitution provides that the entire state is the constituency for a governorship election and added that “where elections have not held in the entire state, the appellant cannot contend that he won the election, as against the 2nd respondent (Oyetola), who won the election as conducted across the whole of the state.”
Counsels to INEC and the APC argued in a similar vein, with Ali (for INEC) arguing that Ikpeazu’s submission on reliefs 8and 9 of his client (Adeleke’s) petition, overlooked the fact that election tribunal is special tribunal with limited jurisdiction to determine whether somebody was properly returned in an election.
“The quarrel of the appellant is against a concurrent finding of two lowers courts. There are no compelling reasons to make this court interfere with the concurrent findings of the two lower courts,” Ali said.
Olujinmi urged the court to be guided by its earlier decision in the case of Faleke v. INEC 2016 8 NWLR, part 1543 pg 61, in which this court affirmed the limited scope of the jurisdiction of the election tribunal.
He noted that even though Adeleke and his party, the PDP are aware of this court’s decision in that case (Faleke case), but have failed to approach the court for departure on its position on that issue Osun guber: Supreme Court decides Oyetola, Adeleke’s fate Friday tribuneonlineng.com Jul 4, 2019 1:26 PM The Supreme Court will today deliver judgment in the appeals brought before it by the governorship candidate of the Peoples Democratic Party (PDP) in the 2018 governorship election in Osun State, Senator Ademola Adeleke, challenging the judgement of the Court of Appeal, Abuja, which affirmed the election of Adegboyega Oyetola of the All Progressives Congress (APC) as the governor of the state. Before the suplimentsry election he was leading by 235 votes...are you now saying that they should throw away the 3000k votes and make adeleke winner? Our electoral law is wiser than your sentiment . Section 140 and 250 will speak volume tomorrow if they are not removed from the constitution this night... In my opinion APC will be more favoured than the PDP tomorrow |

garfield1: Atiku's case at the tribunal will likely go the way of pastor ize iyamu guber case against obaseki in 2016,delays and time was wasted until the case died naturally and was rightly struck out.atiku filed his petition between 15 and 22 march which means that the 180 days should end same period in September.over 3 months or over 100 days have been wasted without him making any tangible or reasonable headway.no witnesses have been called and no evidences presented, seems there are still at the pre hearing. As of Thursday, the court adjourned till Monday 1st July to hear atiku's application challenging the declaration of the court that atiku didnt reply to the apc motion to strips out atiku petition or remove certain paragraphs from his petition.by my calculation, the court will also entertain counter arguments from the defense counsel and then adjoun till the following week to decide on the pdp application.after that, the tribunal will now consider apc application to strike out atiku's petition and adjourn till the third week to decide. The pdp counsel as of Wednesday asked the tribunal to issue out schedule for witnesses, evidences and the main arguments.this should be out by ending july which will mean 4 months exhausted and two months left. In the remaining two months, atiku will use 3 weeks to present all his evidences and witnesses.within two weeks, akpabio pressnted 10 witnesses which means that atiku will only have time to present 20 witnesses mostly bordering on the existence of the server.apc will have 2 weeks to defend while the tribunal will use the remaining 3 weeks to adopt final addresses and fix a date to rule. In the end, atiku will only have time to argue only one ground out of 5 grounds he raised and the case will be dismissed for lack of merit.the supreme case will do same.

She said, "The absence of proper ballot accounting in the Forms EC8A in the 17 polling units is not a substantial non-compliance and did not substantially affect the results of the election. "The only appropriate order is for a rerun election as provided under section 140(2) of the Electoral Act but not to recompute the results of the election and proceed to declare the 1st respondent or any other person the winner of the election. "The tribunal was in patent error when it set aside the rerun election especially when it found that the conduct of the rerun was not marred by malpractices and non-compliance with the Electoral Act, leading to the unwarranted disenfranchisement of the voters in the seven polling units." Education › Re: I Have Lost Interest In School by ejimatic: 7:36am On Jul 02, 2019*. Modified: 5:37am On Nov 02, 2019 |
nointerestinsch: What you are about to read is the deluge from the heart of a broken National Diploma finalist in one of the Polytechnics in Nigeria. I am 20 years old. I have created a new account to share this, only my coursemates or people in my school would recognize me through this article.
The past week has been the most depressing week of my entire life; as much as I have been living with depression for the past few months, this week has been overwhelming.
I used to be the most-hardworking student I know. I was top of my class in ND 1. I ensured I finished all the textbooks of the courses we offered in each semester. In the euphoria of how well my hardwork paid off, my goal for ND 2 was to graduate with a Distinction, and top my class again. The way things panned out in my first year made me love how a student could be rewarded if the student puts in his or her best in studying.
Fast-forward to ND 2 first semester, I finished all the textbooks and made sure I understood the courses by self-testing and tutoring my colleagues – as usual. Our semester results are released at the beginning of the next semester. I never fret at the WhatsApp Broadcast of Facebook Post that a course result has been released. The first course (Entrepreneurship) result of last semester was pasted in the second week of resumption and I had a ‘CD’ – this was my lowest grade all through my stay in the school till date. I didn’t take it to heart as I didn’t study this course too well last semester and it was a 2-credit unit course. But then, one week later, the result for one of my courses (OO COBOL) was released. I had an ‘F’. To put this in perspective, this is one of the easiest programming languages out there. Plus, it is an outdated language – already says a lot about the standard down here. I and a few of my coursemates were the best at this course last semester. I personally was getting paid to help fill practical manuals. It was basically one of those courses I wouldn’t need to study for prior to an exam the next day. I had an ‘F’. I’m not ‘clouting’, but the best grades in this course ironically belonged to people who would not be able to write a simple “Hello World” program using this programming language. I completely broke down at the sight of my name trailing to an ‘F’ on the result sheet. I immediately persuaded the few “good students” who also got “F”’s and were sure they did well to join me and go make a case to our Head of Department (HOD). I represented the group and told the HOD that this is not what we expect for a course like this. I asked if we could see our marked exam answer sheets. Would you believe it? He said the answer sheets have not been submitted to him, and that if I want a remarking, I would have to pay N15,000 to the school management or the remarking panel (or whatever name they try to scam us with). I was disgusted at these revelations. I mean, how can I be charged 15k for me to just get a chance to prove myself? 15k? Just to see and prove my own exam answers? This is an educational institution, and not a law court or the police station. The HOD said he cannot do anything about it, that we only have the option of going to ‘see’ the lecturer.
The lecturer had on several occasions, after the exam, related to the entire class through the class rep that each student needs to pay at least 7k or else you would fail. I ignored all of those because I thought they were threats and believed I did more than enough to get at least a “B”. It eventually turns out the lecturer wasn’t blabbing about it. I don’t know how I would be able to face myself knowing I paid to get a grade in school. I am at a crossroad. I am lost.
This is my ordeal. I have absolutely lost any interest and passion for school. For real, what is the essence of all my sleepless nights? Sacrificing trendy clothes and sneakers for data subscription and materials to do research? When, in the end, a fellow that did not even attend lectures will have a better grade because he or she has money to give the lecturer? Is this the way it has been from way back? Or did the standard just drop so low? Why have these lecturers taken pride in extorting other people’s pockets and suppressing bright minds? Why have they used money to promote waywardness in higher institutions? Why is money the determining factor of student’s grades and not the student’s academic performance fueled by unwavering passion for studying and learning?
These and many more unanswered questions are the reasons why I have lost all interest in school and education. Nothing actually interests me now. School is a total waste of precious time. People party all semester and show up to sign attendance on the exam day, then pay money to the lecturer to pass. It’s all money, money and more money! All these pot-bellied bastards destroying destinies and killing dreams! Would they do this to their own children?
I want to speak up, but I can’t. I am depressed. I am discouraged. I am tired. I want to quit school.
Thank you for reading up! . Sorry for this development..However is not enough to abandon school even when it is discouraging...... You are bothered because you got what you did not expect...At times when computing results mistakes can be made out of imperfection by dome lecturers.Since you are humble with brilliance you must be a pride for your lecturers.Nobody is interested in failing you.Additionally every system has a procedure.Your HOD has given you advice .You can see the lecturer and express your opinion on it with humility. Please cbntinue with your education and it shall be well with you despite all odds. |

joshuisiukwu: The Alaafin of Oyo, Oba Lamidi Adeyemi, who spoke at a gathering of Yoruba leaders on Thursday, in Ibadan, declared his support for President Buhari as he slammed former President Olusegun Obasanjo 'who never did all they wanted'.
The Alaafin of Oyo who declared his support for President Buhari as he slammed Obasanjo, stated that traditional rulers are ready to work with President Muhammadu Buhari’s administration to restore peace and unity in the country. The monarch who claimed that Buhari is doing his best for the nation, cautioned the people not to blame the president, but support him to achieve the desired results for Nigeria.
“Stop blaming Buhari, we will work with him to achieve the desired nation. We have had our son as the president who never did all we wanted for us. We have had our son as the president who never did all we wanted for us,’’ he said.

BleedingPen: Senate President, Dr. Ahmad Lawan says there is nothing like jumbo pay for lawmakers in the National Assembly, adding that no such payment would be allowed under his watch.
Igbere TV reports that Lawan made the disclosure when he received a delegation of the Senators’ Forum on Tuesday at the National Assembly complex.
Our National Assembly correspondent reports that members of the forum were on a courtesy visit to the Senate President’s office, in Abuja.
Speaking on salary structure for senators, Ahmad Lawan revealed that his monthly salary as a lawmaker and that of his colleagues was N750,000.
He said, “What I want to emphasize here is that I never believed that that there is anything called jombo pay to the National Assembly.
“The National Assembly members both the Senate and the House receive what is their salaries and I receive N750,000 as my salary.
“But I need to function as a senator, my office needs to be properly funded,” he said.
He promised that activities of the national assembly was going to be open to the general public, particularly in the area of funding.
“National Assembly is going to be open to the public, I believe that the national assembly should have everything open, let Nigerians Know, what we are doing.
“I believe that Nigerians need to understand this, we need to continually engage with Nigerians and I will also argue that we continue to explain to Nigerians, they deserve to know how their resources are being utilized.
“I believe that the national assembly needs proper funding because the legislature is so critical in any national development,’’ he said.
The Senators’ Forum is made of both serving and former senators numbering about 600.

ejimatic: . I appreciate my inclusion on this platform. All opinions expressed are respected. Every litigation has an end .and the the end is Supreme court in Nigeria. From my personal observations the issues before the apex court are. 1. Is the absence of Obiora makes the tribunal majority judgement a nullity? The electoral laws and constitutions repealed by the PDP government stipulate that a judge must be present in all sittings to assess the witnesses and observe their comportment. If a judge is absent even in a sitting it makes the whole process a nullity. .Section 258 of the constitution. There are supreme court judgements on this even during the Former CJN. Katisina ALU. Adeleke will loose this 2. Can the tribunal annul add up votes or subtract votes and declare winner? Section 148 of the electoral law states categorically that the tribunal has no right to declare winner from adding or subtracting votes. If votes are debated rerun can be ordered. Adeleke will lose here too. 3 Is the alteration in the seventheen polling units an aberration? The Supreme court opinion is that any INEC official can cancel votes and fill appropriate form for it to back it up...Such cancellation must be acceptable by the state returning officer.Additionally if the party agents agreed to the cancellation and number in the overall result sheets tally with what all party agents have. the results are binding..Adeleke will lose this too. At the collation center nobody raised an alarm when the debated votes were being reconciled. 4 Was the rerun necessary even when Adeleke was leading with 300/votes? The electoral law states that when margin between the winner and loser is not up to number of votes in areas where votes did not take place. a rerun must be ordered. IMO Kogi and Kano elections supra. In the case of IMO winner was leading with over 100 thousand still rerun was ordered. Adeleke will lose here too. as the rerun is constitutional..5 Was the rerun filled with violence? Electoral laws and constitution differentiate between criminal matter and electoral matter. If there is a violence at the polling unit it it an electoral matter.the votes will be cancelled..if the violence takes place far away from the polling booth it is a criminal matter. In all areas where rerun took place no violence report in the polling booths so the results are acceptable. Any case of violence which took place outside the polling Ares are criminal matters and do not affect the results.. Here Adeleke will lose again.....From all indications. for Adeleke to win the case Nigerian laws and electoral laws will be rewritten before July 5 2017....Oyeyola APC has better chances. . There are differences between technical issues and legal issues in supreme court.Technical issues include non filing suit within the stipulated period, use of wrong terminologies and poor filing of a case...Legal issues are what are in the constitution .....Justice Obniora absence is not a technical issue but a violation of the constitution...But for the time constraint the appeal court should have ordered a retrial .No wonder it went ahead to look into the matters and decided all issues afresh. The issues before the supreme court are subsumed in one another since they are appeals and counter appeals. Thus decision on one will affect a related other issue. |

- Shettima says the north will never allow power to shift to the south, adding that it is the only thing the zone has The president of the Arewa Youth Consultative Forum (AYCF), Alhaji Yerima Shettima, has said that the north will produce the next president when President Muhammadu Buhari leaves office in 2023.
Legit.ng gathers that Shettima stated this in an interview published in the New Telegraph on Friday, June 21.
The AYCF president said President Muhammadu Buhari-led administration has not favoured the north, adding that the current government is purely a southwest government.
He said: "I don’t know who is going to be the next president of Nigeria until we see those who will declare interest.
However, talking about the zone, which should produce the president in 2023, I have said it on many occasions that the North will produce the next president and you could see that the issue is becoming very clear. "I don’t just make pronouncement on something I am not sure of.
We are sure that this government has not favoured the North. This government is purely a South-West government. They have taken everything.
" Shettima also said that the only thing that is holding the ruling All Progressives Congress (APC) together is President Buhari, adding that the party will die before 2023. He said:
"Even in the National Assembly, somebody was working to ensure that his interest is protected to make it easy for him to become president come 2023, but unfortunately the party itself will die before 2023.
"By 2023, All Progressives Congress (APC) will no longer be visible. The only thing that holds that party is President Buhari, but he is not coming back.
This is his last tenure and I am sure the Buhari I know will be busy thinking of how to go for his retirement rather than thinking of whether the party survives or not.
"He has achieved all he wanted to achieve. He has become both head of state and civilian president."
"On what informed his belief that APC would die before 2023, he said: "It is because of the characters that formed the party do not share the same ideology. Theirs was completely unholy marriage.
"We will continue to fight until our last blood. We will continue to expose them until the right people come to governance. It is not a personal thing; it is for us. The North must have to retain power.
"You cannot take power, which is the only thing that is left for us now. The current president is not really helping us. Insecurity has destroyed the entire North. We are left with poverty, kidnaping and banditry on daily basis.
"People are dying and you think the little power we have despite the fact it is not being used for the best interest of our people, we will just fold our hands and allowed it to be taken back by the South, which have resources.
The common man in the North is not benefiting anything; the whole thing is held in the hands of few individuals and you think we will allow that."

Politics › Re: Jonathan, Not Dasuki Gave Me N400m – Metuh Tells Court by ejimatic: 3:31pm On Jun 21, 2019 |
silverbirdng: A former National Publicity Secretary of the Peoples Democratic Party (PDP), Olisa Metuh, Thursday told the Federal High Court in Abuja that the N400m alleged money laundering was paid to him by former President, Goodluck Jonathan.
He, therefore, denied that it was given to him by the former National Security Adviser, Col. Sambo Dasuki (rtd).
Metuh explained that Jonathan paid him the money to execute some National assignment for the Federal Government.
Giving evidence on behalf of his company, Dextra Investment Ltd which is the second defendant in the suit and the account where the N400m was paid into, the ex-spokesperson of the PDP told Justice Okon Abang that he could not consider the money for act of any unlawful purpose because it came from the then president.
Metuh recalled that he held a meeting with Jonathan where various issues and challenges facing the country were discussed and, it was on the basis that Jonathan made the N400m available to him to carry out the national assignment.
Further, that the money could not have been for an unlawful purpose because he was helping and contributing to stabilizing the then government because then-president Jonathan was elected on the PDP platform.
Metuh specifically dismissed allegations that the money was channelled to him through Dasuki. “I did not receive any money from Col. Sambo Dasuki. Dasuki represents one of the finest and most brilliant military officers ever produced in the Nigerian military. He has had a distinguished career, served a lot of government and finally served as National Security Adviser for this country, under former president Jonathan.
“Up till May 29, 2015, no individual or group had ever questioned Dasiki’s integrity not to talk of been charged or arrested for any unlawful act. I am not aware of any criminal charge against Dasuki or any unlawful act until we lost government in 2015.
“As I am talking on oath before this court now, I can say categorically that Dasuki has not been interrogated, charged or convicted for any act relating to me and my company.
“The N400m was paid into my account by the then president and I did not conceal or disguise the money and it was not transferred out of jurisdiction”.
It was on this premise, he also urged the court to take a look into the list of disbursement carried out in cash and in cheques.
Metuh also dismissed the insinuation that the N400 million was meant to fund the PDP. He, however, disclosed that at the period under review, the PDP was rich to the tune of N33bn, with N12bn generated from sales of nomination forms and N21bn raked from fundraising.
But Justice Abang adjourned the matter to June 24, 25 and 26 for further cross-examination.
