With due respect to APC and PDP in Osun State,Osun election was keenly contested by APC PDP and SDP..However APC was announced as winner by INEC.The tribunal gave its majority judgement with a lot of confusion and contradiction. The Appeal court corrected the judgement with recourse to precedences , constitution and electoral law..The supreme court will hear the oral submission of the two parties and may give judgement same day or later....In my humble opinion Osun election case is all about reasoning and facts within the gambit of the law...Justice Obiora of the. election tribunal gave the majority judgement .He however did not come on the February 6 when the APC was presenting its witnesses. According to the supreme court judgement which appeal court quoted a judge should listen and watch in person witnesses in both sides before giving its judgement. or else the whole processes is a nullity or a mess. This is the case with Obiora..The judge was assessing witnesses he did not see and was judging them.In legal practice it is an aberration....On 17 contested polling units the electoral act position in Section 140 is clear and that is what the appeal court used against the tribunal. In addition the appealed court ruled that in each of the seventeen polling unit, the votes were counted and when the results were . not reconcilable they were canceled in the presence of all the party agents .The cancellation was approved by the state returning officer. Thus there is no case of non compliance that could affect the results of the election. It was thus decided in favour if APC. Also thee tribunal majority judgement described the election as free and fair, no non compliance and it was violence free but it went ahead to deduct votes and announce a winner. is it not conflicting and confusing ? No wonder the appeal sustained the minority judgement of the appeal given by the most experienced judge and the chairman of the tribunal ..justice Sirajo. Finally from my opinion in view of the salient facts in the appeal court judgement and section 140 of the electoral law the hope of Adeleke to become Osun governor is a mirage and an exercise in futility.

Yes,absence is important that is why it was brought up.it is a very important technical issue.if you have been following court proceedings, you will notice that whenever a judge is not around or wont be able to be there, the sitting will be postponed.
In the case of an election tribunal, all the judges are singular and all must be always present.aparr from that, they were 9 other grounds which the appeal course upheld including the evidence.
Intact, the turning point was when yusuf alli the inec lawyer told the panel that a full panel of the supreme court have once affirmed section 140(2) of the electoral law.the judges were surprised.it was clear that oyetola was going to win
. The absence of Obiora on February 6 marred the tribuna majority l judgement though it was filled with confusion and contraction. The Supreme court once ruled that if a judge was not around to assess listen and observe witnesses from both side the entire process is a nullity.Obiora did not come on 6 February and he read the lead judgement assessing witnesses he did not see.his absence means all the judges were absent on that day. There other grounds in the appeal too which were ratisfied.....From all indications the simplest case the Supreme court will rule on this year is Osun election matter.Adelekes case hold no water there

Sen. Ademola Adeleke, the Peoples Democratic Party (PDP) governorship candidate for Osun 2018 Governorship Election said he had instructed his counsels to challenge the appeal court judgement which upheld Gov. Gboyega Oyetola’s election at the Supreme court. Adeleke, in a statement made available to newsmen in Osogbo on Thursday said he received the appeal court judgement with dissatisfaction.

According to him, the judgment of the appeal court relied on weak technical foundation, while the substantive issue which formed the basis of the lower tribunal judgement was relegated to the background. “I received with dissatisfaction the judgement of the Court of Appeal on the ruling of the election petition tribunal which had duly returned me as the validly elected governor of Osun state.

“I have subsequently instructed my counsel to prepare for an appeal against today’s judgement at the Supreme Court immediately. “Today’s judgement relied on weak technical foundation.

“The substantive issue which formed the basis of the lower tribunal judgement was relegated to the background. “We are reviewing the full ruling and action has already commenced to appeal the judgement and ensure the eventual retrieval of the stolen mandate,” Adeleke said. He, however, urged the people of the state not to be downcast, saying that the struggle for good governance and retrieval of People’s mandate cannot be truncated by any flawed judgement. “We are taking the legal battle further to the topmost court in the land. I am confident the apex court will upturn today’s unsustainable ruling.

“To all members of PDP in Osun State and my campaign organisation, the struggle is now at the most critical stage. “We cannot waiver nor slow down. We must forge ahead in high spirit until final victory is attained.

“In this endeavour, I promise to provide the leadership as the genuine governorship mandate holder in Osun State” Adeleke said. The News Agency of Nigeria (NAN) reports that the Abuja Division of the Court of Appeal nullified the judgment of the Osun State Governorship Election Petition Tribunal. The tribunal had in its verdict of Friday, March 22, 2019, declared the PDP and its candidate, Sen. Adeleke, the winner of the Sept. 22, 2018 polls. However, Justice Jummai Sankey, read the lead judgment of the Court of Appeal on Thursday. Justices Abubakar Yahaya, Isaiah Akeju and Bitrus Sanga agreed with the lead verdict.

A fifth member of the appellate court, Justice Ita Mbaba, disagreed and upheld the election tribunal’s verdict that gave the victory to Adeleke.

The only thing that can make ADeleke has hope in supreme court is if Section 140 of electoral law is removed from the constitution before the case get to supreme court. The supreme court judgement will be subsumed in the section. My observation

This case was decided based on technicality- The appeal court nullified the tribunal judgement because Justice Obiora was absent on Feb 6; My question- out of over 40days of proceedings, does been absent for a day affect the whole process? Pdp should approach the supreme court...I wish both parties well..

Please did you mean Section 140? Because i can't find 240 rather 140 states what you quoted
. Section 140 please ....I am sorry for the mistake......Your opinion is respected ...In my assessment however I believe the absence of The judge on the day APC was presenting only its witnesses is very significant. Why did he give the majority judgement when he was not there that day to assess the APC witnesses and their comportment during cross examination? His absence on that day and his delivery of the majority judgement are anomalies to the whole process. It is an aberration in legal practice In addition out of 12 issues raised by the appeal court ten were decided in favour of the APC two in favour of PDP....Also the tribunal has contradictions in its majority judgement which is the bane of the appeal decision.I also wish both of them good luck at the Supreme Court. In view of electoral laws and constitution I forsee APC. winning at the end.

Adagunodo, in a telephone chat with our correspondent, said the panel relied on a technicality in giving its decision.

Breaking: A-Court upholds Oyetola's appeal, says Adeleke has no case

vanguardngr.com

May 9, 2019 11:41 AM

ABUJA – The Court of Appeal in Abuja, on Thursday, upheld the election of Governor Adegboyega Oyetola of Osun State, even as it nullified the tribunal judgment that declared Ademola Adeleke of the Peoples Democratic Party, PDP, as valid winner of governorship election that held in the state in September,

The appellate court, in a four-to-one decision, held that the entire proceedings of the Osun State Governorship Election Petition Tribunal, including its judgment, amounted to a nullity.

Justice Jummai Sankey who read the lead judgment of the appellate court, said it was wrong for a member of the tribunal panel, Justice Peter Obiora, who did not attend the entire proceedings of the tribunal, to deliver the majority judgment that sacked Oyetola from office.

The court noted that the 180 days allowed by the constitution for hearing of governorship election petition cases had elapsed.

Consequently, though Justice Sankey declined to give full details of her judgment, in her final analysis, she held that the petition Adeleke’s lodged before the tribunal was incompetent, including reliefs he sought therein.

She held that both PDP and its candidate failed to prove their allegation that the September 27 re-run election that led to Oyetola’s emergence, was characterized by irregularities and over-voting.

The court further held that the 1st and 2nd Respondents, Adeleke and PDP, also failed to prove that the re-run election was conducted with substantial noncompliance to the Electoral Act.

It held that the failure of the Independent National Electoral Commission, INEC, to produce the ballot papers and record of accreditation to disprove allegations in the petition, did not substantially affect result of the election.

However, the court disagreed with Oyetola’s contention that Adeleke’s petition against his election was statues barred.

Out of 12 issues Justice Sankey highlighted, she only resolved two in Adeleke’s favour.

“The appeal succeeds, accordingly, I allow the appeal and set-aside the decision of the Osun State Governorship Election Petition Tribunal.

” I make no order as to cost “, Justice Sankey held.

Meanwhile, though three other Justices on the panel, Abubakar Yahaya, , Isaiah Akeju and Bitrus Sanga, agreed with the lead verdict, a fourth member of the panel, Justice Ita Mbaba, disagreed and upheld the tribunal verdict that gave Adeleke victory.

Justice Mbaba further awarded N200, 000 cost against Oyetola and the APC.

Meanwhile, the tribunal is currently deciding a separate appeal that was lodged by the APC, as well as a cross-appeal Adeleke and PDP filed to challenge the minority judgment of the tribunal that dismissed their petition.

It will be recalled that the tribunal had in a two-to-one split judgment it delivered on March 22, upheld a petition that Adeleke and the PDP lodged against the declaration and return of Oyetola as winner, based on the outcome of the supplementary governorship election.

INEC had at the end of an initial election it conducted on September 22, cancelled results from seven polling units in four Local Government Areas in the state, and ordered a re-run poll.

However, in the lead verdict that was delivered by Justice Obiora, the tribunal, noted that none of the parties disputed the fact that it was the State Returning Officer that cancelled the initial election

The tribunal held that the State Returning Officer acted beyond the power that was allocated to him under the Electoral Act when he voided results and ordered supplementary election in the affected areas.

“We hold that the cancellation was unlawful and ultra-vires of his powers. The cancellation cannot stand, being a product of illegality”, the tribunal held.

Moreover, the tribunal said the onus was on Presiding Officers in polling units where alleged electoral infractions took place, to cancel the result and report same to Ward Collation Officers.

It held that upon receipt of the complaints, the Collation Officer was mandated by the law to fill Form EC40G and submit to the Local Government Collation Officer who will in turn transfer the information in the Form EC40GI and hand same over to the State Collation Returning Officer.

The tribunal held that in the absence of evidence that it was Presiding Officers of the seven Polling Units that cancelled the results, the action of the State Returning Officer amounted to an act of illegality.

Maintaining that the petitioners successfully established a case of non compliance in 17 polling units during the initial election of September 22, 2018, the the tribunal, went ahead and deducted votes that were credited to both PDP and APC in those units.

Dissatisfied with the decision, Oyetola and the APC lodged separate appea

. it is the review of electoral laws and acts by the PDP to satisfy their interest that is creating problems in Nigeria. In the past Election cases ended in Appeal court. Now it is Supreme court. Also tribunal could deduct votes and declare winner but the section 242 of the act forbids tribunal to do so again.......

. I was in Ilaje area recently and I saw how people live close to water ..sea water..many even live on water. It is their way of life. I was in Igbokoda. Araromi and so on....They have been there for many years with some students even coming for excursion in the riverine areas.Nobody can relocate the Ilaje people.Water is their life.Their life is water. There is a little government can do in the area apart from electricity and good road construction.Ilaje people have passion for their habitat. However in some cases the sea waves may affect them
It usually happens in Florida too because it is close to water.NEMA can evaluate this and assist them accordingly. Finally Ilaje is a permanent base for Ilaje people .No amount of tweeting and retweeting can relocate them.

My expectations tomorrow... 1....Section 240 of the electoral law states that no tribunal should deduct or add votes.. when votes are debated. rerun must be ordered.........In the case of the debated 17 polling units, I expect a rerun there tomorrow.2 Constitution gives INEC and any of its agent right to cancell votes if they cannot be reconciled .The results in the debated 17 polling units may be retained by the appeal court....justifying rerun that made Oyetola win......Oyetola may be declared winner.....3. majority decision and minority decision declared that no case of non compliance and irregularity in Osun election. so why deducting votes?Appeal court may uphold minority decision....
