I applied for a UK visa in November 2017, it took them several weeks to respond (but they sent an email telling me it's taking them time), I believe it's due to the Christmas Holiday. In January, they responded and denied me the visa. The reason was because they said the balance (53,000 naira) in my company account is too small to fund the trip that I stated needs about 5,000 pounds. This company account has very good inflow and outflow. It had about 19 million for six months, which reflects on the statement. I also submitted a personal statement, with a balance of 2.2 million and very good inflow and outflow because I operate a security business as the MD. I indicated I am self-employed, so no consistent amount flows through my personal account. I was however surprised they did not reference my personal account. I spoke with my lawyer, and they did write a letter for judicial review. After ten days, they still maintained their refusal decision and stated I did not include the evidence (provided in the judicial review letter) in my original application. Now, I don't know if anyone has dealt with a similar issue. Please advise. I plan to reapply, but I have had no activity at all on my personal bank statement since November last year, and the balance in the account since that November is still 1.2million. Please advise. Should I reapply immediately or wait to have funds channeled through the account. What kind of letter should I write in my new application.
Letter from my lawyer for the judicial review:
This application was refused on 27/12/2017 based on the ECO’s decision; the ECO stated in support of your application you have submitted a personal bank statement and a company support documents. I am not satisfied that these documents are an accurate reflection of your personal circumstance because you have stated that you will meet the £5000 cost of the proposed visit however the submitted bank statement has a c losing balance of N54,000 which falls considerably short of the required amount as stated by you. Whilst I acknowledged that you are self employed and accept that you may not have a fixed monthly income deposited into your account, it is reasonable to except your account transactions to be commensurate to your stated circumstance, however as details above I am not satisfied that your statement of account accurately reflects your income as declared on your application. You have not provided satisfactory evidence to show that you will be able to maintain yourself in the UK without recourse to public funds further note that the balance of funds in this accounts fluctuates considerably over the period of the statement. I am therefore not satisfied that the documents you have provided are an accurate reflection of your personal circumstance.
Our client is very grateful to the commission for assessing her application but she is not satisfied with the decision of the ECO therefore she has chosen to seek a REVIEW. We Vindan Consults are respectfully writing on behalf of our client and on her written instruction. The ECO stated that in support of your application you have submitted a personal bank statement and a company support documents, going through the ECO’S statement it is obvious the ECO acknowledged that our client submitted the personal bank statement and the company bank statement with her application, but when making the decision the ECO only focused his assessment on our client company statement without acknowledging the personal account that has enough funds for her proposed trip. Our client submitted two accounts which are personal with a closing balance of N2millon approximately and a company account with a closing balance of about N54, 000 approximately to prove that she has enough funds which is also available for her proposed trip and also to prove the sources of her funds by attaching her company’s document. Our client submitted her personal keystone bank account from the month of Feb. 2017 -Nov. 2017 and our client had money flowing in the account in the month of march –April our client had the sum of 1.2millonNGN flowing into the account, from the month of May- June our client had the sum of 1.1milonNGN flowing into the account, from the month of July-August our client had the sum of about 900thousandNGN flowing into the account, from the month of September- October our client had the sum of 1.1millonNGN flowing into the account. This is the transaction of the personal account she submitted which the ECO is also suppose to acknowledge the transactions as a prove that our client is entitled to her stated fund also our client’s company account shows that she has transaction of about 17millonNGN in a year. The transaction has shown that the funds are avlaiblae even if the closing balance as at then is about 54,000NGN. According to the immigration rules the account which the ECO is suppose to work with is the personal account and not the company account. The decision of the ECO towards our client’s application is not professional.. We therefore write to the ECM in order to reassess our clients application, according to the immigration rules our client has proven to met up with the financial requirement to prove that the funds are available to her and from a genuine source but the ECO chose to ignore the necessary document and information and chosen to assess the document which has no funds in it the ECO’s decision is based on a misunderstanding towards our clients application and the ECO cannot base his decision on his assumption, whereby our client was never called up for an interview to question her. Our client has genuine intention towards her visit. Our clients intention is genuine she has no reason to travel and remain in the UK whereby she has a business which is very resourceful in Nigeria, our client has nothing to hold on to in UK, so why would she end up being a recourse to public fund. Her genuine intention is to visit the UK and return to Nigeria We ask the ECM to review our client’s application and clarify the ECO’s doubt about her application; We would appreciate if her application can be reassessed for a better decision. Thank you for reviewing this decision. If your refusal does not merit an administrative review, requesting for it is a waste of time. You can reapply so far you still have sufficient fund in your personal bank account to cover the trip. You should include a cover note to point out that your personal bank statement which you submitted was not considered by the ECO. The lack of activities in the last two months shouldn’t be an issue. |

Thanks in anticipation for your answers. A tier 2 visa application is more than that. What you need is a visit visa. This does not require TB test. You can check on UKVI website for the cost which depend on duration either 6 months, 2 years, 5 years or 10 years. If you want a quick decision, pay for priority. All these information is available on the TLS website. |

I will advise that you see an immigration lawyer, why? Immediately she disclosed in her application form that her father is a British Citizen. She is more likely to be refuse as she is underage and a potential overstayer. There are centre in Lagos which is recognized by the Home office for DNA parentage test. Bottom line let her and her dad do a DNA test and apply for her British passport. Or use the study route i.e student visa. |

feranmi111: Naturalisation If she was born before her father become a british citizen, then a DNA test is necessary to proof relationship. This could pave a way for her to be registered as a British Citizen before she turn 18. However, this is only true, if her father did include her as his child when he was applying for his naturalization and British passport. Otherwise she can only get a visit visa and that will depend on a lot of documentation from her. |

Hi dotcomnamename. This is a great thread. Please keep up the good work. Be the way I applied for an Irish short stay C visa to accompany my wife (British Citizen) who plan to exercise her EU treaty of free movement in Ireland. The application was submitted on the 12 of January 2018. Our plans is to travel together from Nigeria to the UK and then use National express to travel to Dublin. I have no intention yet of living outside Nigeria for now, just like the idea to ride on my wife British Citizenship to travel together around europe with minimal documentation requirements for visa application. We might eventually relocate to Europe Brexit or no Brexit in the future. I have extensive travel history to USA, UK, Schengen countries, Japan etc. My passport still has valid 2 years USA and 5 years UK visas respectively. I submitted just our marriage certificate and few of our wedding photo as proof of relationship which is all that is require for a visa for family member of Union Citizen. Having seen this thread I don’t know if I should have included more documents. My wife intend to call the Embassy as from next week to find out why the delay. Our travel date is in April 2018. Comments and advise welcome. |

A visit visa is for those with a great potential of returning after their visit. As it stands you’re not qualified, as you are about to loss you job, no strong home, financial and social ties to Nigeria. However, if you are serious with your white lady, why don’t you aim for marriage and then apply for spouse visa to join her. For now all you can do is to encourage her to visit you more often in Nigeria to create a solid and verifiable relationship. Good luck. |

Though I've been applying for visas by myself including explanatory letters and I've been offered just for this last one .. No. You do not need a lawyer. All you need is documents to show that your extended stay in the U.K. was not an intention to make the U.K. your main home, and your current employment would not even permit you to do that. If you can not write this out, you can get a lawyer to write the letter. Remember you need to demonstrate that you have no intention of abusing your visit visa in the future. The ECO is just worried that with a 10 years visa, you can make the U.K. your primary home if your Job in Nigeria is not that stable. So you will need to convince the ECO that the likelihood of been redundant again or out of employment will not arise. You can get your company to give you a supporting letter outlining your job description, salary package and potential of remaining with them for the foreseeable future. Good luck. |

My boyfriend worked in Nigeria briefly before he went to Europe... But because I couldn't secure a schenghen visa we decided to meet in London..and was on 5yrs visa which has expired now. And I stayed up till 5months then, luckily for me my employer called me back exactly 6months after. Within the 5months of my stay my boyfriend visited me thrice and I was given enough cash for my expenses But every other months he sent western union to me... I do not have any family ties over there except in Nigeria .. I rented an apartment belonging to a family which was cheaper for me though they were not around at the moment I occupied the apartment ..just a room ..I got back to my job in oct 1st , and when you are away from job for up till six months you'll have to take a refresher class and its mandatory...
I tried to apply for 10yrs in December but was refused And reason was that..
1. I declared that I recently travelled to the uk for 5months and that I have not provided an explanation regarding my extensive stay in uk and this cast credibility on the intention of my visit. 2, I stated that I have been employed by my company since 2008..and that they did not find it credible that I have remained employed throughout my 5months stay in uk

I didn't think it was necessary I explained how I stayed that long and to include my redundant letter which I still have a copy with me, Please advise. Sorry oh! For a 10 year visa of $1023, you really threw caution to the wind in packaging your application. All applicants are considered as a potential immigrant no matter your previous travel history of visas. You can always reapply if you enough documents to explained the reasons for 5 months stay in the UK. Your responses should be hinged on the fact that you were unemployed/redundant during that period and you decide to take a long vacation in the UK with support of your Europe based boyfriend. Make a list of all the activities during those 5 months and how you funded it. Lay emphasis to the fact that throughout your stay you did not recourse to public fund and that you did not break any UK immigration law. That you reason for this renewal is simply because your 5 years has expired. That you are gainfully employed in Nigeria etc. |

wayno: Hello Mr, Justwise, I applied for UK visa in the year 2010 which was granted and I travelled around March, 2011 while I slept just 2 weeks out of the 6 months Visa issued. After the Visa expired, I re-apply for renewal which was denied due to insufficient documents to support my applications. So I re-apply again which was also denied due to fake Tax clearance certificate. So inside the letter of refusal their is a condition given that if I should try to re-apply again in future, I will be ban. I sent 3 letters of reconsideration of decision to the Embassy last year 2017 without any response. So what do you think I can do again? . Submission of a fake document is automatic ban for 10 years. Just wait until your ban is lifted. |

That is why I asked if it can be used once it has not expired. Please see the content of the rules as attached At the time of application could also refer to time of assessing your application which may be or may not be in February. Anyway if feel strongly against getting a new TB test, go ahead and reapply. |

I'm Single, working in a bank(this is my 5th year on the job ) Earning 372k monthly, was promoted last year(salary structure is 150k monthly, 535k every quater and 518k rent allowance paid only in january)
No travel history, will be travel alone and staying at a hotel.
Balance in my savings account now is about 280k but will receive 535k payment in april.
So I'm thinking of applying in april. My concern now is if the balance of 815k(280+535) is enough to apply?
And if i can work my travel expenses around it(spending 10days or less).
Also if the personal loan of about 800k i took last july will raise eyebrows.used it for some investment. The repayment is being debited monthly from my salary account, about 72k. Some months it throws my account into debit for a few hours. That is when the loan is taken at 12mjdnight and salary is paid around 7am same day.
Also, In addition to my 815k I'll have by april I'll be attaching my treasury bill certificates(1million and 3.8million) as part of the documents I'll submit.
@justwise please assist. Only the ECO can determine your chances. Some ECO may focus more on your finances, other may focus on your family ties, still other may be more concern about your travel history. You can give it a try since you only need to submit a 6 month bank statement that will not reflect the loan. Mind you, you will need to convince the ECO how you got the cash to aquire the teasury bill certificates which is 3x and 9x your monthly salary respectively. Being single is not a crime, however, you must have solid family tie to convince the ECO as a tourist. No travel history is not also a crime, however, traveling to the UK as a first time tourist will raise questions which you must address which is why your interest in the UK first? Do you have family member living in the UK? Why not US or Canada, Schengen countries? If you can address this issues convincingly, put in your application after April 2018. |

He's just providing accommodation while I have more than enough for feeding and living expenses. Is it enough to include just invitation letter, mortgage bills and utility bills? You wil also need to provide evidence of his status in the UK such as passport data page and indicate that you will stay with your uncle for 3 days. |

justwise: I don't always disagree with you but in this case i have to, he applied for British passport before and was refused for some unclear reasons and now you want him to apply for visiting visa without mentioning his British citizenship status, have you forgotten that they have his record already and the reason for the previous application? You can only do that if you have never applied for British passport before and they have no record of you as British citizen. @Justwise. Thanks I also know that we have been in agreement in most cases. Permit me to share another experience. My brother in-law is also British by birth like my wife. Later he started working for a Big company that sent him to UK for 9 months trainibg on a work visa, where he attempted again but his application was not processed. Because he is a big man, he successfuly applied for 6 months, 2 and 5 years UK visit visa and currently have a 5 years visa till 2018. When I asked him to apply again for his British passport, he told me that he was not interested as he had tried it twice. So in 2013, when my wife and I visited the UK to see an immigration lawyer, who advise that it was more stronger that my wife and his brother apply together. That was how my brother reluctantly came to London and went with my wife to Home office to make enquire and put in another application, which was eventually issued in 2015 after several delays including using a immigration lawyer to fight the case. So it quite possible to apply as a Nigeria if the OP has never been issue a adult British passport before. He will only raise issue if he declare in his nationality as British when in fact he his techincally not until he get his British passport. My brother in law in all his applications for UK visit visa, only disclosed that he was born in the UK and not that he was a British Citizen.
