Hello team,
pardon me if this has been answered before. I have been rejected Uk visa twice (in 2009 and 2013). I am currently filling a form for visa to another country and i need to indicate any country where i have been refused visa and state the reasons. Truth is, i cant remember the reason as i was too bitter to read what was sent to me. Is there any way i can get the reasons for the refusal without having to compulsorily find the hard copy letter?
Most UK refusal are due to lack of home ties or insufficient documents. If the country is in doubt, they will cross check with UKIV.

Thanks for your prompt response.
You didn't comment on my remark on the lady who got a temporary travel document to UK though.
Emergency travel document are only issued if your British passport is missing/stolen and you need to travel back to UK urgently. In this case you are not qualified for ET as you have never held a Adult British passport before.

Hello House, Happy New Year all

Great job Op and all contributors here.

Kindly advise;

I want to know if applying for a UK visa would be okay as I intend travelling to appeal my UK passport denial. (I am a UK citizen by birth but have lived in Nigeria and never had a British passport).

Passport application was refused in last stage due to Nigerian countersignatory (a pastor) referring to me as his brother back in 2000 or so. My wife travelled to London early 2017 and we plan going together by March/April.

Thank you

P.S.
Someone told me of a lady who got a temporary travel document to UK from Accra (she never had a UK passport before). Would this approach work in my circumstance?

Thanks again for your prompt response.
If you have Nigerian passport with good travel history and good financial income in Nigeria, you can apply for visit visa. Just dont disclose your British Nationality in the application. Just apply as a Nigerian born in the UK. My wife was in your shoes as she was born British by birth, but grew up in Nigeria. She got a UK visitor visa by applying as a Nigeria in 2013. However, her two subsequent application in 2014 was denied because she had a pending British passport application she submitted upon arrival in the UK in 2013. Thank God she go her British Passport issued eventually in 2015 in Nigeria. If you want to fight for your British passport contact an immigration lawyer.

No wonder people are cutting corners any how to remain in the country. That's a huge some of money. And I believe the income must be earned there in the UK right?
Not necessarily. The document shows a variety of ways to meet the financial requirement with fund within and outside the UK. Most Nigerian in the UK are able to meet the financial requirement through income, as such there is a huge application and a thread on nairaland for UK spouse visa. This financial requirement is mainly targeted at low income earners or those living on social benefit in the UK. For the British Citizen who is desperate to bring their non-Eu spouse into UK and unable to meet the financial requirement, hop for SS route, where the British Citizen moves to any Eu country to work and live for about 6 months and return back to UK with the non-Eu souse using Eu immigration laws at UK are bound to implement. This perhaps is why Brexit was voted for so that UK can leave the EU and take full control of UK border.

£18,600 Is the income amount expected

£16,000 Is cash savings
According this document see section 7

https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/636618/Appendix_FM_1_7_Financial_Requirement_Final.pdf

The cash saving y requirement is
(X-£1600) /2.5 = y
So to meet the £18,600 (y) financial income amount by cash saving only you would need a cash saving (x) of minimum of £62500.

That is
(£62500 - £16000) /2.5 = £18600

So when home office say above £16000. It is actually deceptive and does not mean that you have met the financial requirement if you have a cash saving of £16100, unless you are combining cash saving with other sources of income. I stand to be corrected.

Not that much, it's £16,000 if no child is involved, if the children are British then there is no additional financial requirement.
£62000 applies for spousal visa using entirely the cash saving route and not UK employment. I don’t know if the amount have changed as you have stated.

Many thanks once again. If this is the way forward then I will start looking in to it pronto.

Cheers mate you have been really helpful.
No problem. You’re welcome. One thing I can assure you is that you will certainly get a response from your MP. Provide as much details as possible in your letter to your MP to debunk all the issues raised by ECO. For instance, it is not the business of home office to question what the kids are doing in the UK. They’re British Citizen and you want to give them British education. That your wife is a full time Home maker and does not need to work as you can comfortable take care of her. Your kids cannot visit Nigeria as they are underage and cannot travel unaccompanied. You do not have plan of returning to UK soon because of your job. That the reasons for the refusal are unfounded, discriminatory and abuse of your wife’s right to family life. This is affecting your kids emotionally etc. Good luck.

Thanks Ekpotek, but I really wasn't considering the falsification of stuff, that would be foolhardy. It is something I have always rejected when advised to do so because I believe she can get the visa without going through all that. I just hope I wont be proven wrong.

Thanks for your advice but does some one like me that isn't living over there have an MP or can my sibling write his MP?
All you need is a UK based home address and phone number for correspondence. You can use your folks UK address. You can send the letter via email or post. So, just identify your MP representing your constituency. Focus your letter on rights of your wife to family life and that she was been unfairly deprived of visitng her kids for no reason. You can also enclose a copy of the redusal letter. Writing from experience, my wife had to use her MP to intervene, when home office was delaying the issuance of her British passport, eventhough she lives with me in Nigeria.

Ok cool...I understand all that. But isn't there a way to convince them that she wont be staying until we are good and ready. Can't I get a guarantor or something. Or have an agreement of some sort that will lead to me having my British Nationality revoked if we default. I really dnt want to bring the kids back after settling down over there and they miss each other so much.
Do I need to go the way of some others by falsifying stuff in order to get her a visa?
There has to be another way guys.... sad
Garantor or no garantor, nobody can revoke your British nationality if it is by birth. You may consider writing your MP to complain and intervene. Your MP will in turn write the home office to make a case for your wife. If successful, the refusal will be revoked. I do not know of any other legal ways. Trying to falsify stuffs will only led to a 10 years ban, so dont try it.

There used to be a way to link it. When you open the online portal, after applying for yourself, there was a place to apply for someone else. Then, the applications will be linked.

Cc cindylee
There is an option within TLC website to do a group submission for more than one applications. Applying for someone else within the application portal does not link the applications for submission.

But I work here and our last kid is also here with us. The kids school documents were attached to prove all that.
Doesn't the fact thatI have a British passport and could decide to move over there with every one else any time mean anything to them? Why would we complicate things and spoil the chances of doing everything legally? This is just the point I would like them to understand. How does one go about doing it?
Home office have one goal: To reduce net immigration into the UK. You could relocate to the UK but you will need to apply for a spouse visa for your wife and meet the financial income requirement of £18,600 per annum or £62,000 cash in savings. This stuffs are not easy for spouse living and working outside the UK. Unless your wife circumstances changes she will always be refused. That is the home office rule irrespective of your nationality.

Goodmorning. Pls is it advisable to book an hostel or shared bathroom for 5day visit? Won't this make a negative impression on the VO?

2. Does US share data with UK. The question in the form where it's asked if you have been denied visa to any country. My friend feels it's not necessary to say she hasn't been denied. I feel it's right to say the truth that she has been denied.
3. The question: do you have another income or any saving, my friend has another small business apart ftom her constant salary. its not registered and money isn't constant and the closing balance can't even be up to 100k. Can she answer this as savings or other income?
Pls help. @justwise
1. Yes. Most tourist goes for budget accommodation for save money.

2. Yes. If you do not disclose your refusal and it’s discovered. You will be ban for 10 years for misinformation and false documentation.

3. Yes if the fund and business is substantial enough to contribute to your financial home and economic home ties

Good morning Justwise,

Please find below the list of documents submitted

1. Our bank statements
2. Kids school documents
3. Printed whatsapp chats between wifey and the kids
4. Kids birth certificates
5. My brothers wife's Resident Permit
6 Data page of our British Passports (mine, my brothers and the kids)
7. My payslip
8. Letter of Introduction from my place of work
9. My land documents
10. Letter of invitation
11. Bills and letters written to my brother as proof of address
Your documents are okay. Except missing are documents to proof strong home ties and the circumstances of the applicant (your wife). This was pointed out by ECO, who also refered to the previous refusal. To be honest with you as it stands, it will be very difficult for your wife to get a visitor visa given her circumstances and not your in Nigeria. The ECO know that there is strong possiblity for your wife to over stay and not return back to Nigeria since she does not have a job or any compelling reason to leave the UK after her visit. I also know of cases where mothers have successful apply to remain in the UK as the mother of British child (children) needing care. Just my thoughts.

Well the things I did was that i provided the evidence of the payment, because the estate is for the family. After they have collected the rent, every member of the family gets share. So I provided evidence of my share.

I m not in custody of the documents.
There is no way an eagle eyed ECO will believed your explanation and mere rent receipts in the absence of the property documents. To re apply and convinvce the ECO. Include the house documents, or documents of your share of inheritance with regarding the estate dully notarize, letter of authorization from other family members that rent should be paid to your account. These documents will serve as support for any explaining to the ECO and clear all the doubts.

Yes significant amount or suspicious payment was made into the account and the reason was quite explained. It was the rent payment from our family estate, alongside the payment receipt.
Okay. Did you provide documentation concerning the family estate such as the land documents, agreements that rent should paid into your account etc. The evidence of rent payment receipts and the explaination was not enough. If you are collecting rent on any landed property, you need to provide documentation to show the owner of property and even the value.

Kindly advise house , @justwise, @ekpotek please advise on what to do
The issue of traveling with your spouse is obviously an error. The main reason for the refusal is your bank account statement. The ECO discovered that as at 20/11/2017 your account balance was as low as stated, but rises to N1.9M in just 16 days given that you submitted your application on 6 Dec 2017. This is unexplainable since your salary is about N165K per month. Did you explained in a cover note any lodgement that might have been suspicious?

@Justwise, Ekpotek. I was just refused a family permit. Please find the attached. according to them, I did not submit my husband's divorce certificate. But I submitted it, the document was in Spanish so I submitted both the original and the translated, i also included a personal statement and listed all the documents that I was submitting. I don't understand how they missed that one. I want to reapply immediately. My question is, can I write something (eg divorce certificate) on the document? so they can easily see it.
Sorry for the refusal. If you have the divorce certificate and other documents relating to divorce you can reapply immediately and enclosed a cover letter to point out the mistake made by ECO. You can also appeal the decision that the divorce certificate was submitted in spanish and translated. Sure you can make a note on certificate for the ECO to identify. Make sure that all submitted documents are scan by TLC, Do not allow them to tell you what to submit or not. It is well. Just a minor setback.

Your salary and home ties is solid. However, you still need to convince the ECO what informed your choice of the UK to visit? Have you travelled out before as a tourist? Do you have friends or family member in the UK? All these will count to a successful application.

The budget will depend on how many days you intend to spend in the UK? The rules is that your budget should not be more than 2-3 times your salary.

Hi Everyone,
Random question abeg.
Do the U.K immigration officers know when you leave their country?
For example, if i travel to london and spend 5 months, next time I'm going, when I get to the immigration point [that place where they ask you useless questions] and they ask how long I spent the last time I was there [they asked me before, not always] can i say I spent only 3 weeks instead of 5 months?
Will they see on their 'system' the date I Left or they can only see the Date I entered?

[I know the stamp on arrival to nigeria should show this, but assuming our nigerian immigration brothers 'mistankenly' stamped 3 weeks] grin Mistakenly o

Thanks
The UKIV no longer issue exit stamp. Your exit from the UK is retrieved from airline check in system. So they know the actual date you left the UK including the airline name and even your seat number. The system works this way at the POE. They collect and swipe your passport on their system and all your information and immigration entry and exit from the UK is shown. So telling a white lie at POE if asked can actually delay your entry or your visa can even be cancelled for misinformation.

5years ago i got refused due to lack of home ties and insufficient fund in my mum's account.
She is a citizen so she invited me and wanted to sponsor the trip. Now i'm married with a child

My questions:
1.can i go ahead and make hotel booking and include her as part of who i will visit,
or will it raise concern that my mum should invite me knowing well her savings is not ok for now?
2.will my statement of 1.7m be ok?

Thanks
1. Yes
2. Yes
She will need to send you her passport data page and evidences of UK resident permit. No need for any invite from her, since you have no plans to stay with her nor she is not sponsoring the trip. . Ensure that you address the reason for the refusal.

Simply means that you had misinformed the Australian embassy. Check showed that you were refused US visa multiple times, which you did not disclose to the Australian embassy in your application form. If this is true, be honest and accept their investigation and applogize that it was not intentional. If however, you have never been refused a US visa, then response to counter their accusations! Note this is a UK visa thread, so do not expect responses.

Good Afternoon Gurus In the House,

Please i will like to make an enquiry. I was denied a uk Visa over 5 years didn't apply since then. Last december i was invited to germany but was denied too reason been that they don't know my plans after the expiration of my visa. Anyway i want to apply for UK VISA for say 5 day with an invite from a friend (we are dating actually) a divorcee though and i will be staying with him so my accommodation is sorted. my take home is 140K after tax & pensions and i plan on spending between 300 & 500k what is my chances of getting visa .
This is not to discourage you. Your chance is very slim. The relationship need to develop to a point where he will visit you first. You will require tons of documentation to proof this relationship than just dating/calls. Secondly your finances is not strong enough to convince the ECO that you will return back despite that you have enough money to cover the trip. But if you still want to go ahead, I suggest that you leave your boyfriend out of the application, apply as a tourist, address the issues raised 5 years back and if they no longer exist, hope for the best outcome.

Just wise and other gurus in the house.

1) In the standard visitors visa online application, there's a section asking for how much we spend each month on living expenses.

Is this the amount spent from our salaries only? Or in the case of a wife who's supported by her husband...will this include the amount given by the husband to run the house too. Even though the amount is given in cash and does not reflect in my account?

2) though my main purpose for visiting is to write an exam. The ukvi is asking for any immediate family or that of my spouse living in the UK.
My husband has a sister who lives in the UK. I most likely will not visit her and I've been advised to deny that I have a relative. She's on a legal visa and all. Lives with her husband and children in the UK.

Pls advice.

Thank you

1. If you do contribute to living expenses from your salary. Indicate the amount, if not put zero

2. Please include your sister in-law as someone you know in the UK. You do not need to staybor visit her.

Walk on proving sufficient documentation to convince the ECO that you are going there to write an exam and will return back to your work.

hello All, happy new year.

i have a bit of complicated request. i was born in UK but based in Nigeria since i was a kid. i have got my certificate of registration, orignal birth certificates(long and short), leave of remain. about 8 years ago i tried applying for a right of abode but was refused on the basis that they dont believe i am the same person with the rights due to passage of time.

i am planning to visit Uk and trying to sort it out from there, however i am scared my visa application will have issues.
i currently work in a financial institution and earn about 230k net. i have friends and family members in Uk but not sure what type of visa to apply for Tourist or through family.
If you were born before 1st January 1983, you are a British Citizen by birth, regardless of your parents nationality.
Getting a visitor visa approved will depend on your ability to convince the ECO that you will return after your visit. Since you have tried applying for a right of abode and was refused by the Home Office, the likelihood of another a visit visa refusal is very high as your previous application records are there. I would suggest that if you’re sure of your DOB, apply for your british passport and start gathering solid documents beside what you have now to proof your case.

Thanks for your reply, work visa or entrepreneur visa what are the requirement sir.
For work visa, you will need to go through work agencies in the UK and its depends on qualifications and skills. The UKVI website also post shortages of jobs requiring international workers. For enterprenuer visa you will need £200,000 deposible cash to invest in the UK and you will get a 3-5 years visa.

Study visa, work visa, entrepreneur visa or marry a eu citizen and immigrate into UK before March 2019. Tourist visa etc will only earn him illegal stay in the UK doing nothing. UK is like not USA where you can switch you visa category easily.

I quite disagree with this. Once you submit a statement of account indicating your salary monthly without discrepancy, then pay slip is not needed. I know about 4 different pple that submitted just statement of account. I am also a witness. My first application and the second application, I never submitted pay slip. I submitted my salary account and explained other cash flow.

Thanks

Sure you have every right to disagree with me. However every application is assessed base on its own merit. It is the duty of the applicant to declare his/her financial circumstances with documentation. The fact that your visa was approved twice without the submission of payslips does not means that its a standard practice. There is a question on application form asking applicants to enter their earnings (salary) after tax. Many applicants earning entering their bank account also exclude other deductions such as loans repayment, pension, cooperative etc. How best can a ECO verify your earning without a payslip? Many visa are approved with less than N200K bank balance, and many refused with over N2m bank balance. The OP is required to provide enough evidences to explain his/her financial circumstances. If he is able to satisfy this without payslips, the ECO will decide either believe it or not.

Kindly submit your statement of account for 6months. You may not need to submit pay slip. Not all organisations give staff payslip. Besides your statement of account would not even state basic salary. It will only show the totality of the salary. Statement of account suffices for financial aspect.

Thanks
A 6 month payslips is a mandatory documentation if you’re working for govt or a big private organization. If the organization does not issue payslip, then you need to explain this in a cover letter. Please. Check the UKVI website for more detail.

So are you suggesting i leave out the payslips completely? My account statement reflects the monthly salary. I would also appreciate response and suggestions to other concerns raised.
Your payslip is very important as it enable the ECO to trace your income within your bank statement and also as evidence of working. All you need to do is to explain why your basic is N5000 and may be get a letter from your human resources to suppoort this baisc pay. The ECO is more interested in seeing consistency in your finanacial in the last 6 months vis a vis your travel budget, and not necessarily the breakdown of you salary.

Knowing someone in the UK who is not a family member can be tricky as you will need to prof the relationship and justify why he need to invite you. If you have enough travel history and cash to spend, I suggest you leave your friend out of this application and book hotel. Having said this, you must disclose your friend as someone you know in the UK, but you will not visit or stay with him.

I stated that my mum will be helping out with my brothers and that was another point stated. I want to reapply for him immediately as I feel the officer judged his application wrongly and we can't appeal.
Sorry about this refusal. From the letter, the ECO is right. Your dad do not have any financial home tie. Without evidence of pension payment or RSA statment of account, evidence of other financial supports from your mother, the ECO thinks that your dad may over stay if approved. This is what you need to address if you intend to reapply immediately. The fact that you have assumed full sponsorship, does not means the applicant personal and financial circumstances does not count.
