As death toll rises in Nigeria By Abdulmumin Giwa Killing of innocent Nigerians has since become persistent in the country through the various publicized ways. These include the widely publicized terrorism where mostly worship places, markets, motor parks and schools are attacked, villages and people attacked by bandits and even by the state. In 2015 the Nigerian army and the Kaduna state government mass buried 347 unarmed civilians killed by the soldiers in Zaria. More and more people have been killed in different attacks in different places that include Zamfara, Plateau, Kaduna, Taraba, Nasarawa, Benue and other places in the northeast. Although those killed are Nigerians, mischievous sectional and religious outlook is given to the killings that could worsen the situation. President Muhammadu Buhari was issued a warning decently by the US president Donald Trump that they would not tolerate the killing of Christians in Nigeria whereas statistics have shown that most of the victims of the killings are Muslims. The Nigerian government is claiming to be spending so much including the purchase of fighter jets but without any results. The lawmakers are not also doing enough about the killings. The Senator representing Kaduna North Shehu Sani stated on his Twitter handle as one of the few senators that press on the matter that… “Again and again, I will continue to raise the tragic situation of Birnin Gwari on the floor of the senate until it touches the conscience of those responsible for its security to prioritize human lives over 2019 politics.Mass Burial has become ‘a daily ritual’ in Birnin Gwari.We must admit the fact that the police and the army have nothing much to work with to enable them confront the danger and the superior fire power of the armed bandits.” Just of recent another thread of bloodshed is showing its ugly face as Nigeria heads for 2019 general elections. People have been killed and injured, people have been threatened and properties destroyed in the course of the recent ruling party APC Congresses. All the signs so far in the country continues to point at bloodshed unless drastic measures are taken. LOL! Apart from the absurdity of hierarchizing killings while doing nothing about it, what’s the point of these lies? You see, if you tell the truth, you don’t have to remember it because it’s constant. It never changes. If you’re asked to repeat what you said several times after the fact, there will be no contradictions. But lies are never consistent because they sprout from the resources of a duplicitous imagination. That’s why an English proverb says liars must have good memories. WE REJECT THE NEW KDSG PLOT TO KILL SHEIKH ZAKZAKY On Wednesday, 02/05/18 there was a forcible attempt to serve court summon on our Leader Sheikh Ibraheem Zakzaky, who as you all know is in custody of the DSS illegally for the past almost two and half years in Abuja. Sheikh Zakzaky declined accepting any court summon, insisting that when he went to court earlier and obtained judgement, the government has not obeyed the judgement. He described as illogical attempts at charging him to court even as the court had ordered for his unconditional release over a year ago, without the government complying with that judgment. He further narrated before the person who brought the summons that, “We were brutally attacked. They opened fire on us, shot us with guns, killing over a thousand including my sons. I was also shot with my wife. I was dragged over the corpses of my sons. We were then brought here and detained. Our bodies were sore all over, riddled with bullets.” How can any sane person turn around and accuse our leader as the aggressor in this case? We demand that the Kaduna State government, led by Mr. Nasir El-Rufai should charge those who summarily killed more than 347 people as admitted by the government for murder and not the victims of the murderous campaigns. It does not have a moral or constitutional right to arraign Sheikh Zakzaky and others for homicide trial when it is not ready to prosecute and bring to justice, also, soldiers who summarily, willfully and atrociously killed hundreds of Nigerians at their pleasure. It seems the Kaduna state government has now elevated to an instrument of state policy, the bare-faced social injustice of turning victims of a vicious, brutal murderous aggression into its perpetrators, and treating the aggressors as victims and using the resources of the State and tax payers money to pursue these reprobate discriminatory and recriminatory prosecutions. It is indeed sad that a supposedly democratic government now cherry picks the lives, the rights and the people it is supposed to defend, and those that are, in its opinion expendable. The Islamic Movement takes this odious attempt by the KDSG to arraign our leader, Sheikh Ibraheem Zakzaky on the same charge about 200 are being charge in another court, coming after two and half years with a pinch of salt. As usual, the government has misfired again. The step taken by KDSG is prejudiced, parochial and unconstitutional. This court case makes a mockery of justice and democracy. With the recent public confession by the Saudi crown prince, Muhammad bin Salman, that they are behind the Zaria genocide of December 2015, it remains to be seen when the Buhari administration will have enough courage to admit how much the billionaire prince gave it to execute the Wahhabi murderous plan on innocent Nigerians. We once again wish to reiterate our commitment to continue with our protest in major cities of the country, especially Abuja. If the government feels offended by our protests, then it should do the needful – release the oppressed Sheikh Zakzaky immediately and unconditionally to go and look after his health at least. Also the hundreds still in detention over the Zaria massacre carried out by the army, should also be released, because they are victims of aggression not the aggressors that the government want to deceive the public to believe. Open Letter to Nigerian President: Confirm or Deny By Abdulmumin Giwa April 29, 2018 Dear Mr. President, It is a well-known fact that members of the Islamic Movement in Nigeria under the revered leadership of Sheikh Ibraheem Zakzaky have refused to allow the mass killing of their members to be swept under the carpet despite all efforts including the use of excessive force on them and the abuse of their fundamental rights as well as blackmail. The Movement has sustained the tempo and kept everything alive to date since the incident when the Nigerian Army launched a killing spree of its members from 12 to 15 of December 2015. Since the incident, over one thousand members of the Movement have disappeared for which the government declared at the Judicial Commission of Inquiry, JCI in Kaduna that it buried 347 of them in a mass grave at Mando village near Kaduna. The government also demolished properties belonging to the movement and its members including the residence of the leader Sheikh Zakzaky, the Hussainiyya Baqiyyatullah Islamic Center, the Fudiyya Islamic Center, the Darur Rahma Cemetery and Film Village, the residence of Sheikh Zakzaky’s mother, Fudiyya Primary/Secondary Schools in some states, Several Islamic Centers in some states, personal property of members in some states and several others. In addition to all these, over 200 of the members are still languishing in various prisons in some states without charges and in some states especially Kaduna state they are under some concocted charges facing trial for over 18 months now. Most importantly, the revered leader of the Movement Sheikh Ibraheem Zakzaky and his wife Sister Zeenatuddeen Ibrahim are being kept in illegal detention in the name of protective custody, a thing since dismissed by a competent court of jurisdiction as unconstitutional. The Federal High Court in Abuja has ordered the immediate and unconstitutional release of the Sheikh and his wife, payment of damages, provision of another residence and police protection. Sadly, the government has turned deaf ears to the court judgment by acting in contempt of court. The revered leader of the Movement and his wife are being detained in denial of their fundamental rights and in contradiction of the tenets of democracy still in its nascent stage in the country. This detention is despite their deteriorating health condition which has been confirmed by government appointed health experts to require urgent attention. In other words they are being tortured with their health condition by the government which has refused them medical attention. All these and many others not mentioned due to lack of space were said to have happened as a result of blocking the convoy of the Chief of Army Staff, COAS as insinuated by the government. Just of recent, the Crowned Prince of Saudi Arabia Muhammad Bin Salman in an interview with Time magazine, also quoted by the German Radio DW, stated as part of his achievements so far that he has succeeded in breaking Iranian influence in Africa by 95%. He mentioned among others that he had crushed the backbone of the Islamic Movement in Nigeria and its leader Sheikh Ibraheem Zakzaky who he claimed is leading a Hizbullah type of Movement that is trying to overthrow the government. The Saudi Crowned Prince bragged of his achievement of sponsoring a crackdown on the movement and breaking its backbone in Nigeria. Nigerians in the last three years see the government to be exceptionally committed to eradicating the Islamic Movement and have witnessed how the Saudi regime openly congratulated the Nigerian government for the mass murder of innocent and unarmed men, women and children in Zaria in December 2015. In addition to this, Nigerians also witnessed how the Saudi regime gave you its highest national honor by opening the gates of the Ka’abah for you after the mass murder. There are also several statements you made in some Arab media in the Middle East where you mentioned efforts you are making to eradicate the Shia and Sheikh Zakzaky, the video clips of which are widely available. On Tuesday 1 March 2016, the Qatari News TV channel Al-Arabiyya made a report on your visit to the rich oil state. You warned of what you called ‘Iranian missionary activity in Africa’ which you said posed an increased danger by spreading information aimed at sowing division and sectarian sedition and unrest. You also launched a new warning against Iranian activity promoting what you described as revolutionary activity in Africa. More so, Nigerians have seen how you have been receiving and honoring the Wahhabi scholar that are sponsored by at the presidency. These scholars are known to most Nigerians as agents of sectarianism who feed on spreading Shia phobia. Nigerians know you as a Sunni Muslim adherent and a Nigerian president. It is rather unfortunate that you are carried away by sectarian bias and chose to belong to the Sunni Muslims alone by using your executive position to fight against the Shia Muslims with vigor. With these available facts, the implication is that the statement made by the Saudi Crowned Prince rightly implicates you of collaboration with Wahhabi forces to clampdown on and crush the Shia adherents in Nigeria. It is not clear how much has been paid by the Saudis that led to your stamping and approving the killing of your citizens in the most brutal manner one could imagine. Some were burned alive, others were buried alive, others tortured to death and the injured and helpless persons summarily killed at close range when they could easily be handed over to police. This brutality was sustained for over 48 hours just for blocking the way for the convoy of the Army Chief. In this regard, Nigerians deserve the right to know the truth. You should honorably come out to either confirm the statement of the Crowned Prince of Saudi Arabia that you were sponsored by their Wahhabi regime to kill their Shia rivals in Nigeria or deny it. It is by confirming or denying this that Nigerians will understand whether their lives are safe when they belong to religious or ethnic inclinations in Nigeria, that their rivals from any part of the world will not sponsor you to eliminate them. Shiites, El-Zakzaky and APC’s legal snafu Posted By: Adekunle Ade- Adeleye On: April 29, 2018 MORE than two years after he was detained in a so-called “protective custody” shortly after the December 2015 clash between Shiites and the military in Zaria, Kaduna State, Ibrahim El-Zakzaky, the sect’s leader, has been charged in court with, among other counts, murder of one soldier and wounding of another. Nothing was said of the 347 Shiite members killed and buried in two mass graves by the same security forces who engaged them in the fight at the gates of the sect’s headquarters. Nothing was also said about the court judgements ordering him to be released and compensated. Nothing was said, too, about his wife who was charged with him, but whom the secret service had said insisted on her own volition on staying with her husband in detention. An eight-count charge was brought against the sect leader, his wife, and two other Islamic Movement of Nigeria (IMN) members. The Kaduna State government is so powerful that it will not offer the people any explanation why it took more than two years to file a simple eight-count charge against only four suspects. And while the charges seemed to be a response to the continuing protest of IMN members on Kaduna and Abuja streets, it also seems clear that the state government working in tandem with the federal government is determined to keep the Shiite leader locked up indefinitely. The All Progressives Congress (APC) claims to be a great proponent of the rule of law, loves and is eager to promote democratic principles, and aspires to run a responsive and ethical government. But the Kaduna State government, together with soldiers in 2015, did not flinch at the killing of more than 300 Shiite members, was not alarmed by its own insensitivity of refusing to document and identify those killed, flaunted its power by demolishing the headquarters of the sect in Zaria, arguing that the sect was never liked by its neighbours anyway, and celebrated what it described as its proaction in forestalling the emergence of another Boko Haram sect in IMN. Let Kaduna State go on with the trial of the four Shiite members in a mock acknowledgement of the rule of law. Re-FG don’t breed another Boko Haram By Abdulmumin Giwa In this rejoinder to an editorial with the above mentioned heading written by the Daily Trust newspaper, it is very important to begin by explaining that there is no such thing as ‘clash’ between members of the Islamic Movement in Nigeria and the police or any security agency for that matter. What the Daily Trust editorial should be talking about is forceful and violent crackdown on peaceful and unarmed protesters by the police and other security agencies. Such crackdowns have always been in violation of the rules of engagement governing the security agencies. It is the constitutional right of every citizen to express his grievances peacefully where need arises without seeking any form of authorization from the police. The job of the police is simply to ensure that such protests do not escalate into violence, simple. More so, the Islamic Movement has always conducted its activities peacefully except when the police decide to make it violent and they clampdown on the protests using heavy arms that include live bullets. As a result of this clampdown on protests, mostly motivated by interest groups within and outside government, over 100 members of the Movement have killed and hundreds others injured by the police during such attacks on peaceful protests. This is not only an infringement on the rights of the protesters but also an infringement on the tenets of democracy in the country. Hence there is no such thing as ‘clash’ with IMN but police or security agencies violence on protesters. Secondly, the editorial mixed up two separate incidences with the intention of finding a soft landing for the security agencies that messed themselves up, especially the police that molest and torture the members of the Movement and injure a lot of them on arrest irrespective of their sexes. The first incident is the one that took place on the Friday before the week of the violent crackdown by police on the Movement when they took over the Unity Fountain, the venue of the sit out organized by the Concerned Nigerians group calling on the Nigerian government to obey court order and release the leader of the Movement, Sheikh Ibraheem Zakzaky unconditionally. The police simply informed the organizers of the sit out that it was an order from above that henceforth no more sitting is allowed at the Unity fountain. This also affects other protests like the Bring Back Our Girls, BBOG. The organizers of the sit out asked for reasons why the sitting should not hold at the Unity Fountain and why the police was there in a battle ready mode with horses, dogs, shields, guns teargas and water cannon. No reason was given for that siege. The members of the movement present there at that particular time were less than twenty in all including the Concerned Nigerians group members. The police dispersed the participants that came for the sit out using teargas. They shot teargas at them with the intention of injuring them with the canisters and about three members of the movement were injured with the canisters of teargas. The police even shot teargas at the vehicles of the participants with the intention of setting them on fire. They also arrested the Concerned Nigerians convener, Deji Adeyanju after they have dispersed everybody and everybody left the place including Deji. It was when Deji went back with an IMN member to collect his car from the place later that he was then arrested by the commissioner of police who shouted at him asking him what business he has with the Shias. That was briefly what happened on that day to which I am an eye witness. The second incident was the one that members of the Movement went on Monday to start a protest march towards the headquarters of the National Human Rights Commission. The police blocked all roads leading to the place refusing the protesters any exit and they were so pressed by the police using teargas, water cannon and live bullets on them that they had to press the police back, hence what followed. There too the police killed one, injured several others and arrested many. Also, the police never mentioned to the organizers of the sit out that there were military chiefs from all over Africa and USA at the Transcorp Hilton Hotel for which they wanted the sit out to relocate elsewhere as claimed by the FCT Police Commissioner Sadiq Bello. If they had done that everything would have been different. There was a time the sit out was informed that there was going to be a presidential event at the same hotel and that the whole area is going to be cordoned off. The sit out was relocated to Berger Junction on that day. More so, as he was trying to insinuate, there was no participant anywhere in or around the premises of the Transcorp Hilton Hotel as everyone, including the battle ready police, were inside the Unity Fountain. He also claimed that some vehicles parked by some residents were damaged by the protesters, which is also false. They were actually damaged by the police who shot teargas canisters at them and there are even glasses of some buildings that were shot at with live bullets by the rampaging police in the area. Concerning the editorial statement that the government should not breed another Boko Haram says a lot. It is clearly depicting the government as the actual creator and founder of terrorist organizations in the country. It was government that actually founded Boko Haram and is using it for its own political as well as diplomatic gains. The editorial should have observed that there is no single terrorist organization in the world today that is Shia. Boko Haram, Taliban, Al-Qaeda, Al-Shabab, ISIS and all others are all Sunni and not Shia. All terrorist organizations are Sunni/Wahhabi/Salafists and not Shia. This is because the Shia do not succumb to intimidation by enemies to the extent of reacting violently or becoming emotional and sentimental. To the Shia life is sacred and they can never be pushed into terrorism even by virtue of the Shia concepts of leadership-followership principles. Shia is unlike the Sunni where everyone can be on his own. In Shia you have to be a follower or a leader and this is called ‘Muqallid’ and ‘Mujtahid’ respectively. It is difficult to found a terror organization under Shia concept of Islam in the manner in which they are founded under Sunni. We are aware that the Nigerian government under President Muhammadu Buhari as the editorial has rightly mentioned is deliberately planning to breed another terrorist organization that is Shia-based as part of the agreements of flushing out the faith by implicating a phobia against Shia and against Iran. The government is contracted by a clan of imperialists made up of America, Israel and Saudi Arabia to do the bid for them in return of political power and diplomatic protection. The Saudis play a major role of sponsoring Shia phobia in Nigeria using the Wahhabi half-baked scholars. They concoct a lot of lies and feed the ignorant Muslim populace with the intention of firmly instituting hatred against Shia and subsequently Iran to satisfy the political interest of the imperialists. This is part of their fight against what they call the influence of Iran in Africa. Just of recent the Crowned Prince of Saudi Arabia, Muhammad bin Sultan mentioned the same thing to the Time Magazine. He claimed that they have finished with Iranian influence by 95% in Africa and one of such is Sheikh Zakzaky who is running a Hizbullah form of Movement and trying to overthrow the Nigerian government. This implies that they are the sponsors of the crackdown on the Islamic Movement in Nigeria. The Nigerian government’s fight against the Shia is a project and is pre-planned and the Nigerian leaders are involved. The government is illegally keeping the leader of the Movement, Sheikh Ibraheem Zakzaky in detention even as a competent court of jurisdiction in Nigeria has ordered his unconditional release and compensation. They are doing this to instigate his followers into violence from which they will take over and continue to manage a terror group the way they founded Boko Haram and are managing it. The government has been intimidating the movement beyond limits but the movement has remained focused, resolute and unchallenged. They even have their mercenaries in the movement that they want to use in making the Movement act violent. Hence members of the movement are simply victims of a global effort of suppressing Iran from being accepted by the almost two billion Muslims in the world as a guide and leader as this will affect the global hegemony and influence of the imperialist powers. To achieve this, they go about killing Shia groups in Saudi Arabia where a Shia leader Sheikh Nimr an Nimr was murdered by the authorities, they destroyed Iraq, they killed people in Bahrain, Yemen and even Syria and just of recent Qatar all in the name of fighting against the influence of Iran. They spread propaganda and blackmail Shia and Iran whereas the relationship between the Shias and Iran is nothing more than that of the Catholics in Nigeria and Rome or the Wahhabi and the Saudi regime. It is simply about solidarity and brotherhood in faith. The imperialists negotiated with the Nigerian leaders and are using them as stooges in achieving their aims at the extent of the lives of Nigerians, like the over 1000 unarmed men, women and children extra-judicially killed by the Nigerian Army under the stupid pretext that they blocked the way of the Chief of Army Staff in December 2015. It is all about proxy and the government in its incompetency acting as a stooge. In brief, the government can never breed the Islamic Movement in Nigeria into becoming a terrorist organization no matter the amount of oil money it’s agents source from Saudi Arabia. We know the greedy governors, executives and others both in government and religious circles that are part of the deals. The act of contempt of court by the Nigerian government is not the only thing that portrays the government in bad light as suggested by the editorial. The brute manner in which the government descended on the Movement during the December 2015 massacre in Zaria depicts the act of government as state terrorism. The soldiers during the killing spree of unarmed civilians used unimaginable force on them. They burned people alive, they buried people alive and they physically molested them. They even went round shooting at close range and killing already helpless injured persons that would have simply been arrested and handed over to the police. Imagine this kind of brutality. There are hundreds of lucky survivors that are ready to give account of these terror-laden acts by the army. These are part of the things investigated directly by the Amnesty International, Human Rights Watch and the Islamic Human Rights Commission of London and all their reports indicted the army for its violation of its rules of engagement. The said blocking of the convoy of COAS is only dramatic and can never justify the mass murder of hundreds that were not in the scene of the incident. Majority of those the Army killed during the attack were not killed at the scene of the incident at Hussainiyya Baqiyyatullah along Sokoto road in Zaria where the said blocking of the convoy took place. They were killed in Gyallesu several kilometers away from the scene while others that took refuge at Darur Rahma along Jos road were killed there. What is worse is that they took over 48 hours in that killing spree of unarmed citizens, from 12th to 14th of December 2015. The issue is not that of blocking the COAS but that of deliberate and pre-planned genocide against the members of the Islamic Movement in Nigeria. Is not just enough for the Daily Trust editorial to call for the release of Sheikh Zakzaky, there is more to it. The perpetrators of the killings must be fished out and punished accordingly. This is where the International Criminal Court, ICC comes in for which based on facts before it has since escalated the charges from preliminary examination to preliminary investigation. The facts are solid and the Nigerian government jitters. The revered Sheikh Zakzaky must be freed by the Nigerian government and the government on its part the government must learn to respect the judiciary and stop acting on sentiments and impunity as all Nigerians have the right to practice any faith of their choice. The Nigerian president must learn to belong to nobody and also belong to everybody and to stop his plan of breeding another terrorist organizatioon that is Shia based. |

Contemptuous Buhari & Elrufai Charges Sheikh Zakzaky & Wife to Court: A competent Nigerian Court ruled in December 2016 that the Buhari regime should free the leader of the Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky, from detention. The Federal High Court declared Sheikh Zakzaky's detention as illegal and unconstitutional. President Buhari refused to obey the order of the Court and is still holding Sheikh Zakzaky and his wife in illegal detention for more than two years. The recent Free Sheikh Zakzaky protest in Nigerian capital, Abuja, has put huge pressure on Buhari and his cabal to obey Court order and Free Sheikh Zakzaky and his wife. The Daily protest and Sit-out have attracted both National and international attention on the gross injustice and extreme wickedness of President Buhari against sheikh Zakzaky. In a desperate moves to maintain the illegal detention of Sheikh Zakzaky beyond the tenure of this government, Elrufai has finally charged the leader of the Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky, to court in Kaduna. Charged along with the Sheikh are his wife and two others. The charge number KDH/KAD/60C/2018 between the State and Sheikh Zakzaky and 3 others was dated the 18th day of April, 2018 by Chris Umar Esq on behalf of the State. In the eight count charges filed at the Kaduna High Court, the Sheikh and others were alleged to have abetted the commission of culpable homicide punishable with death by members of the Islamic Movement when they allegedly blocked roads in December 2015. Other charges were those of abetting unlawful assembly, wrongful restraint, disturbance of public peace, voluntarily causing grievous hurt without provocation and inciting disturbances. Further, they were also accused of promotion of unlawful assembly. The eight ( charges are trump-up charges to distract attention from the successful Free Sheikh Zakzaky protest in Abuja. These fraudulent charges can not stand the test of justice and fairness in any court in the whole world. Nigerians can now see the desperation of the murderous criminals that brutally slaughtered 1000+ Shia children, women and men in Zaria in December 2015 and wickedly dumped their dead bodies in mass graves at night to bury the evidences. Another reason why Buhari and his murderous gang charges Sheikh Zakzaky and his wife to court in Kaduna is to transfer the Sheikh to Kaduna. Their gross miscalculation is that the Abuja protest will end simply because Sheikh Zakzaky is in Kaduna. The Rise and Fall of Buhari. This write up coming from the London Economist, a magazine that endorsed Buhari for President in 2015, is perhaps the most significant, objective, unbiased, unsentimental and deeply incisive analysis of the policies and actions of this president so far. The facts are unimpeachable by any objective mind. The Unprecedented Level of Patience Shown to Buhari---the ECONOMIST Nigerians have never shown such level of patience and tolerance towards any of their past leaders for his record and strange policies as that shown to their current leader, Muhammadu Buhari – a former military dictator now self-confessed democrat who said he came to fight corruption. Buhari, 75, is being plagued with failures across every single sector in the economy, the like as has never been seen before. Less than a year into office, the economy plummeted into recession, an economy which had till then grown at an average rate of 7% in previous years (2011-2014). The nation’s currency lost 70% of its value, unemployment rose from 6.5 to 26%, commodity prices tripled across many quarters and the state-regulated premium motor spirit prices were hiked by 67% without practically anybody batting an eye. There have been stern opposition to his policies however and to his very personality as well, notably in the South East and South- South regions in the country as they are called, where he both received less than 5% of the votes cast at the last Presidential election and where he has always been sternly unpopular for his history of bigotry against the people, perceived incompetence and dictatorial tendencies. But in many other regions across the country the people have rather resolved to suffer patiently, drawing up excuses for him at will, blaming everyone including his hundreds of political appointees, anything and anybody but never the man himself. Buhari’s party, the APC, promised Nigerians unprecedented swiping changes in government and the eviction of all corrupt individuals. One possible explanation for this could be his party’s hope narrative in the 2015 General election where citizens were promised an unprecedented crackdown on corruption and the abolition of all government waste by a man whose financial worth they declared to have been less than N30million ($150,000 then), a historical low for a former top official in the country and most especially a former leader. In a country plagued by acute corruption problems and with the unremitted crude oil revenue scandal of 2014 still fresh in the people’s minds, many were eager for an abrupt change, the like as never been seen before. He was seen an army general, already experienced in government, with a great strength of will, tough to take on the nation’s cabal of hardened criminals. He promised to appoint only technocrats to head the country’s departments and to see out the lingering Boko Haram insurgency from the warfront. For a nation lacking basic amenities such as power supply in spite of its huge energy resources and with the lingering insurgency crises, the choice seemed easy to many- the general with integrity was the man for the country. Talk was cheap then but now reality has taken its course. His earliest opponents pointed out to his track record and not to his speech, noting that the last time Nigeria fell into dismal failure, currency woes and commodity shortages was when he had seized power as a military general in 1983 and stating that the facts of that record contradicted the poems of his image brokers. Many however just wanted “change” as it was then called and so voted the General and sat to wait for the sung promises. But from the onset of his government, the course was as his critics had predefined: Incompetency, bigotry and dictatorial tendencies plaguing the country. He ignored the newly born genocide in the middle belt of the country perpetuated by the Fulani herdsmen of his kindred against the Christian communities in Benue, Plateau and later on Kaduna. He breached the Central Bank’s 2007 Act of Independence, telling it to suspend forex disbursements to steel importers and other manufacturing sectors in a bid to defend the Naira, a disastrous action which kick-started a spiral of recession. He took 3 months to appoint his Chief of Staff, 6 months to appoint a cabinet and now 23 months and yet counting to appoint heads of agencies and board members he was so eager to fire upon his assumption into office and rose import duties on the most basic of commodities in a bid to raise government revenue. And as for the corruption fight, the facts on ground do not show any one at all. Apart from a few officials harassed or imprisoned without court order, the country is yet to witness the first victim of the said campaign at the court stands. Government waste is on the rise, officials publicly caught in graft acts were swiftly excused, the 2016 Budget year passed without implementation and most worrisome, the Central Bank’s foreign reserves were being shared among unknown Bureau De Change operators at variable rates at the detriment of critical manufacturing, business and banking sectors. The government continues to praise itself but the people seem to be increasingly tired of the paraded self-righteousness. The President’s recent illness was greeted with cheers by many. Many are just tired of the government. But the remarkable level of patience shown so far has been unprecedented and many a times the general reactions towards acts of constitutional violations was one of calmness or insensitivity. If the Change narrative of the 2015 election and the songs of man of integrity are to account for this, then Nigerians may have just certified themselves on the world map as a nation easy to fool with propaganda. Abuja Free Sheikh Zakzaky protest: By Mohammed Ibraheem Zakzaky The last time I wrote I was speaking of my mother’s critical arthritic condition, I wrote so that there be no speculation left about the truth concerning her critical condition. We tried our best to remain within the confines of what the professional and objective opinions of the doctors who had examined her reported. The Summary was that she needed urgent knee replacement surgery. I did not detract from expressing the urgency of the report at the time. Sadly since then that matter has remained completely ignored by the government. Furthermore all efforts to have my father’s eye be examined by an independent doctor has been met with ‘administrative’ difficulties. And when those difficulties were overcome and the doctor had made his recommendations, we are now facing a new mountain of administrative difficulties. Nothing has been done since then. Words cannot describe the nature of the monstrous bureaucratic mountains we had to climb to get there. Like my mother, in the case of my father’s one remaining eye I am sad to state that the reality is grim at best. This is more than two years after I had raised alarm about the issue. I want everyone to understand that this government’s message is clear; and so is the intent of its leadership. Their objective is to simply manage and choreograph a convincing case of a natural series of induced disabilities of a permanent nature; that can and will lead to an equally convincing natural death for which they can all claim to have no complicity. All in pursuit of their collective desire to commit the ultimate unsolvable murder. They are trying to ensure the success of the mission of mass murder and genocide that was started by the Nigerian Army back in December 2015. They just want us to calm down, lay low, and relax. They imagine that we are coming from elsewhere to Abuja, the same is true for themselves and everyone else in that city. The real owners of that land have since been oppressed beyond recognition. All they want is to go back to their stealing Ways. Just like the Rats they are. Even though they are too cowardly to bell a kitten, let alone a cat. They are so blinded by the demons of greed that all rats worship. This is why even our most peaceful efforts are always treated with mindless violence whenever possible. For a hundred days we sat at unity fountain, merely just stating our legitimate grievances. A fountain of unity which mind you does not work, I have been mostly in and sometimes out of Abuja a fountain. But I have never seen water spraying out of it. A fountain is supposed to spew water. Nigeria’s unity fountain seems to never work and all who wish to even breath its fumes are subjected to tear gas and whatever madness can be unleashed by the current government of Nigeria. All I can remember whenever I see it is that the fountain at Hussainiyyah worked none stop twenty four hours a day seven days a week for as long as it was required. Of course it was destroyed by the Nigerian Army with extreme brutality, along with any living person or animal they found in the vicinity. In the mad desire for blood that seems to consume this government, they have gone so far as to even to suggest that we move along to a location where they would prefer to kill us all, they’d rather not do it in Abuja. ICC President’s Official Visit To Accused State Of Nigeria: A Threat Capable Of Undermining Independence And Integrity Of The Court (Intersociety Nigeria: 15th April 2018)- The leadership of Int’l Society for Civil Liberties & the Rule of Law is deeply worried and dismayed by the recent official visit to Nigeria, an accused State-Party, by the newly elected President of the Int’l Criminal Court (ICC), Igbo-Nigerian born Chile Eboe-Osuji. Judge Osuji, from Imo State, Southeast Nigeria, was elected as new President of ICC on 11th March 2018 for tenure of three years (2018-2021). Nigeria presently has eight cases at preliminary investigative stages pending against it and its Boko Haram terror group before the ICC and more cases of heinous rights abuses are being compiled across the country by various victim groups against the perpetrators. It must be clearly stated here that the right of the Nigerian born ICC President to visit his mother country (Nigeria) including his Igbo Ethnic Nationality in private capacity is sacredly intact and inviolable. But his recent official or “State Visit” to Nigeria is not only uncalled for, but also capable of undermining the independence, impartiality and integrity of the world permanent criminal Court. It also impeaches the law of natural justice particularly the grand principles of neutrality, fairness, impartiality, independence and integrity; upon which the ICC was established twenty years ago in 1998 through the instrumentality of the Rome Statute. ICC Presidents, elected through Electoral College or among “judges sitting in plenary session” are not elected to embark on shuttling or lobbying missions and courtesy calls especially to member-States or State-Parties and their leaders strongly accused of regime atrocities or crimes against humanity, war crimes and genocide. The Constitutive provisions of the Rome Statute of 1998 setting up the ICC contain sufficient “sovereign rights and remedies” for the accused State-Parties to be properly heard and defend themselves when called upon. These include the grand principles of “Complementarity and No Impunity”; under which member-States or State-Parties can reject impunity for perpetrators of regime atrocities such as crimes against humanity, war crimes and genocide and take further concrete steps at punishing them in conformity with international best practices through legitimate processes of investigation, arrest, detention, prosecution, conviction and sentencing as well as treatment, rehabilitation and compensation of the victims including the wounded and families of the slain and reconstruction of victims’ properties and public infrastructures devastated or destroyed by the aggressors or perpetrators. An accused State-Party also has right of communication and fair hearing during preliminary and substantive investigation of its accused officials by the ICC as well as rights of fair hearing, defence and appeal during the pre-trial and trial or prosecution and after conviction stages involving its indicted officials. Rights of review, exit, suspension and re-entry of membership into ICC are also available for all State-Parties including the accused. However, such rights do not include the referral powers of the United Nations Security Council (UNSC) under Chapter Seven of its Charter (i.e. referring any member-State of UN, whether as a State-Party or non State-Party to ICC for investigation and prosecution of its accused officials by the Prosecutor of ICC; who are accused of committing crimes against humanity, war crimes or genocide against its defenceless civilian population, in part or in whole). This was the case in Sudan in March 2005 through UNSC Resolution 1593 for investigation of President Omar Hassan al-Bashir and other officials of the State on accusations of war crimes and crimes against humanity and genocide and other regime atrocities committed in the country’s Darfur Region. The standard practices geared towards securing at all times the independence, neutrality and integrity of the ICC and its electoral college-produced Presidents do not expressly approve of sworn ICC Presidents visiting countries particularly those under its investigation such as Nigeria. If for any reason requiring such official visits under rare circumstances; the Prosecutor of ICC is officially entrusted with such responsibilities. A clear case in point was the just concluded official visit of the Prosecutor of ICC, Ms Fatou Bensouda to the Republic of Argentina as part of 20th Anniversary of ICC. Apart from the fact that Argentina does not have any criminal investigation or trial pending against it and its officials before the ICC, the country also signed “four cooperation agreements” with ICC including conditions for interim release and release of ICC detainees, protection of ICC witnesses and enforcement of sentences of imprisonment for ICC convicts. Further, we are also saddened by the fact that the ICC President’s official visit was brutally skewed and acutely selective; concentrated only on the country’s key public office holders including principal leaders of the National Assembly (i.e. Senate President, Deputy Senate President, House Speaker, etc) and the Federal Executive Council (i.e. Attorney General of the Federation, Minister of Foreign Affairs, etc). The official visit practically excluded members of the Nigeria’s new mainstream Civil Society Community including legal experts, human rights and media groups advocating for end of atrocity crimes, regime impunity and punishment of their perpetrators in Nigeria. The local Civil Society coalition for promotion of ICC in the country was also excluded; likewise group-victims of crimes against humanity and war crimes in the country. These victim-groups include the Christian Association of Nigeria, Islamic Movement in Nigeria (Shiites), Pro Biafra Movements and individual victims of Boko Haram insurgency and Nigerian Armed Forces’ counter insurgency operations in the Northeast and representatives of ethnic nationalities of Benue, Taraba, Adamawa, Nasarawa, Kogi, Plateau and Zamfara States who are newest victims of ongoing Government protected Fulani terrorism in Nigeria since 2015. We make bold to say that such a skewed and fanfare visit diminishes the confidence of Nigerians especially the victim segment and human rights activists in the ICC. It also undermines the capacity of the ICC to sit in judgment against Nigerian Government and the murderous Boko Haram elements; under fair, credible, independent and impartial circumstances. This is more so when every indication points to the fact that the present central Government in Nigeria is paying a lip service attention to issue of ICC Statute and its municipal compatibility and enforceability as well as atrocity crimes and their perpetrators. Apart from ratification of the Rome Statute creating ICC on 27th September 2001, the Federal Government of Nigeria has refused to take further municipal concrete steps in the areas of domestication and enforcement or complementing the works of ICC. None of the four voluntary international agreements such as those bordering on detention of ICC detainees and protection of its witnesses has been signed by Nigeria; to show its sincere and full cooperation with the ICC. Specifically, the Federal Executive Council charged with constitutional responsibilities of generating executive bills for domestication of outstanding regional and int’l treaties has refused to forward an executive bill to the National Assembly for purpose of domesticating ICC Statute and localization of same; although this does not, in the eyes of int’l law and UN System, exclude the country from being held to account for atrocities committed under the ICC Statute. As part of Government’s lip service attention, too, it has also refused to sign the referenced four cooperation agreements with the ICC. Strongly condemned is the pronouncement of the Attorney General of the Federation during his meeting with the ICC President at which he expressed shock and dismay over “ICC decision to escalate and elevate the eight pending cases against the country (six against Boko Haram and three against Federal Government) to preliminary investigation stages”. Such a callous official statement not undermines the ICC and int’l rule of law but also emboldens the perpetrators of the atrocity crimes to perpetrate or commit more with impunity. This is also a further indication of un-readiness and unwillingness of the Federal Government to fully and sincerely cooperate with the ICC. The statement made by the Senate President, “calling for the reform of ICC especially expunging of its zero immunity against perpetrator-serving public office holders of the State-Parties” and a hoax claim that it is specifically targeted at African leaders, is also strongly condemned. Contrary to the AGF’s statement claiming Nigeria’s full compliance with “ICC’s principles of Complementarity and No Impunity”; it is on record that all the perpetrators fingered in atrocity crimes in Nigeria since June 2015 including retired and serving senior military and police officers have remained on the prowl and protected by the State till date. Nigeria’s present central Government also refused and failed to perform its fundamental obligation as a State-Party to ICC by refusing and failing to invite the ICC Prosecutor for neutral and comprehensive investigations of Boko Haram terror activities and roles played by its Armed Forces in the Northeast counter insurgency operations among other atrocity crimes; thereby protecting the perpetrators and extending its unwillingness and inability status. Specifically, those fingered in the shooting and killing of not less than 400 unarmed pro Biafra activists and hundreds of others shot and injured are still under the State protection since 2015. Those responsible for the death of over 1,130 unarmed Shiite members and supporters as well as hundreds of others shot and injured since December 2015 are still under State protection. Those responsible for bombing and killing of 236 Christian IDPs in Borno and over 50 rural Christians in Adamawa States on 17th January and 4th December 2017 are still under State protection; likewise those that masterminded the death in military custody inside the Giwa Barracks in Borno State in 2016 of 240 civilians including 29 children between newborn and five years. Till date, all the perpetrators or masterminds in the ongoing Fulani terrorism across Nigeria which have led to killing of not less than 4000 mostly Christians since June 2015 are still protected by the State; with none of them facing trial or diligent prosecution till date. The present central Government in Nigeria is also recklessly and indiscriminately freeing scores of Boko Haram terror suspects duly investigated, indicted and arraigned in courts since 2013. This is done using prosecutorial technicalities and questionable presidential swap and amnesty deals. Yet, the same Government turns around to persecute unarmed citizens particularly those of Southeast and South-south parts of Nigeria on account of their faith and ethnicity using trumped up charges, long pre-trial detention and unlawful killing, torture and other cruel, inhuman and degrading punishments or treatments. A clear case in point is the ongoing pre-trial detention of some defenceless citizens of Igbo Ethnic Nationality/Pro Biafra activists since 2015 without proper trial till date as well as vindictive and trumped up charges slammed against them. The central Government of Nigeria also ordered and supervised the killing and maiming of hundreds of them simply because they called for a statehood or geographical reorganization of Nigeria using nonviolence. The ICC which presently has 123 State-Parties and several signees is hereby called upon not to compromise its integrity and independence by allowing itself to be intimidated and its works undermined by Africa’s genocidal leaders and their agents who go about recklessly and brazenly; perpetrating atrocity crimes in office against their defenceless civilian populations. It is on record that countries where preliminary and substantive criminal investigations or prosecutions are ongoing or carried out by ICC are those with most atrocious political records and atrocity crimes perpetrated by their State and non State actors. It remains an irrefutable fact that credible democratic countries and their leaders irrespective of continent of origin have nothing to fear over the ICC and its noble tasks of ensuring an end to global impunity in the corridors of power. Granted that there is need for continuous reform of the ICC especially in the areas of finding common grounds including common definition of Crimes of Aggression as well as ensuring deterrence against external aggressors with respect to their overbearing military influence against lesser powerful nations and territories; with the exception being military activities carried out under UN or regional grouping’s backed peace support operations; but it is the African Continent that direly need urgent and comprehensive political and leadership reforms so as to make themselves less attractive to ICC searchlight and sanctions. Throughout the ages, sanctions had periodically been visited against perpetrators of most heinous crimes against the human race. In the 40s, there were sanctions visited against 2nd World War criminals in Europe and Asia including Germany and Japan. In the 90s and 2000s, sanctions were visited against war criminals in former Yugoslavia, Liberia and Rwanda. Recently, such were also visited against war criminals in DRC, Uganda, Ivory Coast as well as former President of Chad recently convicted and sentenced to life imprisonment by an African regional criminal court. As it stands now, the ICC has secured very few convictions and consolidated its protracted investigations in Congo DRC, Sudan, Darfur, Central African Republic, Kenya, Libya, Uganda, Ivory Coast, Mali, Burundi and Republic of Georgia. Preliminary investigations have also been opened in Columbia, Afghanistan, Gabon, Guinea, Palestine, Iraq, Philippines, Venezuela, Ukraine and Nigeria. In all these, the ICC has not done enough in commensuration of its mandates, yearnings and expectations of the victim populations and generality of the people around the world. The Court must go beyond its present protracted investigations and fanfare shuttling and handshake of the graveyard with accused State-Parties. The long delays by the Court in meeting the yearnings and expectations of the global populations especially the growing victims of State atrocity crimes may most likely push the Court to the brinks if care is not taken. Already the global influence of the Court is beginning to wane across countries and regions. This is on account of its snail pace and perceived rubber stamp status. There are cases still pending before the Court for almost, if not up to ten years or more. Other tasking challenges facing the ICC are occasioned by poor investigations and generation of watery evidence and fragility associated with poor witness management including profiling. While ICC continuously rigmaroles and craws, its space and influence are speedily on decline; taking over by emerging regional and municipal courts assuming int’l civil and criminal jurisdictions over human crimes of heinous nature. A clear case in point is the Dakar based African Special Criminal Court for Chad which had in May 2016 secured conviction and life sentence against former President Hissene Habre of Chad; over his heinous abuse of human rights including rape, sexual slavery, torture and ordering for massacre of thousands of civilians during his days as military president of Chad from 1982 to 1990. In the USA State of Philadelphia, its Federal Courthouse sat for just one year (2016-2017) and convicted Mohammed Jabbateh over his ignorable roles in the Liberian Civil War of 1989-1997 where he was a leader of the National Patriotic Front of Liberia or NPFL. ICC must therefore sit up and protect its independence, impartiality and integrity globally before it is swallowed and overshadowed by the rising influence, acceptability and popularity of emerging municipal courts speedily assuming international civil and criminal jurisdictions in matters of heinous human rights violations and abuses across the world. By joint advocacy accounts of the Civitas Maxima and Global Justice & Research Project groups 2018, Courts in USA, Belgium, Switzerland, UK, etc now assume both criminal and civil international jurisdictions over heinous or atrocity crimes committed against civilian populations by atrocity perpetrators in foreign countries. Key Liberian war criminals including Jucontee Woewiyu (former leader of NPFL), Agnes Taylor (wife of Charles Taylor), Martina Johnson (former commander of NPFL) and Alieu Kosiah (former commander of ULIMO) are billed to face trials this year in various municipal courts located in USA, Belgium, Switzerland and UK for their atrocious or ignorable roles during the Liberian Civil War of 1989-1997. Similarly, Mrs Esther Kiobel, wife of one of the slain Ogoni Nine (Dr. Berinem Kiobel) had also filed a civil claimant suit in far away Netherlands against the Royal Dutch Shell PLC for its complicity in unlawful arrest, detention and death of her husband, late Dr. Berinem Kiobel who was hanged alongside other Ogoni Eight in 1995 during the darkest era of military incursion into Nigerian political space. The civil suit was instituted in 2017 in Netherlands where the Royal Dutch Shell is registered. The Global Protests are planned to coincide with a hundred days of continuous Free Zakzaky protests in Nigerian capital city, Abuja, demanding the immediate release of the leader of the Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky. The protests is expected to simultaneously hold in Europe, Asia, the Middle East and Africa among other places. The oppressive and tyrannical Buhari regime brutally slaughtered 1000+ innocent Nigerian civilians in Zaria in December 2015 and wickedly dumped the dead bodies in mass graves at night to bury the evidences. Buhari and his murderous gang abducted the survivors of the brutal and inhuman genocide and imprisoned them. The biggest victim of the genocide is the leader of the Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky. They murdered his 3 children in his residence in his presence, burnt his 74 year-old sister alive, murdered his young Nephew, burnt his entire properties and rained bullets on him and his wife. The most visible is Adeyanju Deji who organized Daily Sit-Out for Free Sheikh Zakzaky at unity Fountain, Abuja. The Sit-Out is a huge success and that prompted the Buhari regime to recently arrest Adeyanju Deji and attacked the Sit-Out with heavily-armed police. The Abuja commissioner of police categorically told Adeyanju Deji that the Buhari regime is not comfortable with their activities. What makes the wicked oppressors uncomfortable with the Daily Sit-Out is the consistency and attendance by prominent Nigerian activists and Civil Rights Groups. The one hundred days Free Sheikh Zakzaky protests in Nigerian capital city Abuja have been most peaceful though Buhari's security forces murdered some peaceful protesters and arrested hundreds. The most prominent of those killed was Sheikh Qassem Umar. His case was targeted assassination as they shot him in the leg with poisonous ammunition. Three weeks later he died. The Buhari gang tried on many occasions to infiltrate the Abuja Free Sheikh Zakzaky protests to turn it violent but woefully failed on all occasions. We call on Humanity and all people of conscience the world over to organize Free Sheikh Zakzaky activities to raise awareness of the inhuman Zaria genocide and the illegal incarceration of Sheikh Ibraheem Zakzaky and his injured wife. I answered him that to us Martyrdom is a Great Honor and I am waiting! #Love When I recently arrived Iran for Pilgrimage to Shia religious sites, young officials were sent to pick me at the airport. From airport they took me to the Hotel. One of them escorted me to my room. Since I was on air transit I was absent from Internet. I asked the young man how can I get Internet? He was reluctant to answer my question. I said to him: "Give me a paper". He gave me a paper. I wrote "Harun Elbinawi". I handed him the paper and said to him to inform his superiors that this person need an internet. He went outside the room and made a phone call. After a short while he ran into the room sweating and apologizing. He said they told me to give you anything! He respectfully kissed my head. He rushed down to the reception and got me 5 Wi-Fi internet slips! I told him I only need one. The next day when he came to pick me he said I should not use my Crutches to walk. He said he will carry me on his back! I told him I am taller and bigger than you, how can you carry me? He insisted. We later reached a compromise and he brought a Wheelchair for me. Conclusion: Whatever you do there must be polarisation around your personality. Some people will love you while others will hate you but what is important is that we keep to the path of Truth and Righteousness. FG Jitters Before ICC Over Zakzaky, Seeks Concessions The Federal Government has become very jittery over the tremendous progress that has been made by the ICC in the issue of the Zaria massacre and the continued detention without charges of the leader of the Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky. The Buhari government is particularly worried that the International Criminal Court is unrelenting in pursuing the case and seven others against Nigeria. The Attorney-General of the Federation and Minister of Justice, Mr. Abubabakar Malami (SAN) on Thursday shivered while playing host to the newly elected President of the ICC, Prof. Chile Osuji, at his office in Abuja. Malami said the ICC had “escalated” eight potential cases against Nigeria from “the initial preliminary examination to preliminary investigation”. It will be recalled that it was reported that the ICC had completed preliminary investigation into the Zaria massacre. He lamented the stepping up of the investigations against Nigeria as worrisome because according to him, the government had demonstrated its willingness and ability to arrest, investigate and prosecute anyone that committed any offence that fell within the Rome statute of the ICC. This monumental lie by Malami was however incidentally challenged while he was making it as thousands of members and supporters of the Islamic Movement besieged the Justice ministry calling for the prosecution of those involved in the Zaria massacre. The government has not in anyway demonstrated any willingness to prosecute any of the culprits in that heinous crime against humanity. It has rather further perpetrated these crimes with the continued detention of Sheikh Zakzaky without charges for upwards of two years against the judgement of a competent court of the land that ruled that his continued detention was unconstitutional as it breaches his fundamental rights. Additionally, the government at all levels has further persecuted the members of the Islamic Movement and treated them as second class citizens, with no rights to their faith, conscience and beliefs. As a result, a lot more were killed and many more arbitrarily arrested. This has cut across many more states of the country than the original Zaria massacre. Clearly, Malami’s assurances to the ICC president that Nigeria being “a country that believes in the operation of the rule of law, fundamental freedom and the need to fight impunity in all ramifications” was far from the truth and an attempt to deceive the ICC president.

Danfulani Vs KDSG: Activist accuses presiding judge of having personal interest in case. . . . as former Vanguard reporter docked again By: Bomba Dauda KADUNA - A mild drama ensued yesterday at a Kaduna High presided by Justice Bilkisu Mohammed when Civil Rights Activist and former University don, Dr. John Danfulani, whose two lawyers had quit from defending him in protest over alleged curious conduct of the Judge, refused to say a word when docked for questioning. It could be recalled that Dr. John Danfulani had been arrested on the 26th January 2016, arraigned before Chief Magistrate Court 1 Kaduna, Presided by Mallam Awallu Musa in Case No. KDH/KAD/102c/20016 and charged with breeching sections 417 and 418 of the Penal Code. He was accused of posting an insulting post on his facebook wall against Northerners. After series of appearances, he was discharged on 9th August 2016. But on the 26th October 2016, he was re-arrested, arraigned this time at the present court, and subsequently spent 13 days in Kaduna Central Prisons because Justice Bilkisu Mohammed had had to travel for a seminar for that duration and as such, could not attend to his bail application. On the 5th of February Barrister Yakubu I. Umaru had also said he feared that his client may not get justice from the same court based on the conduct of the Judge and removed himself from the case. In the next appearance, Barrsiter James Kanyip, who stood for Danfulani also left in protest alleging the same fears with Umaru. When the case came up for continuation of hearing Tuesday, Danfulani told the court, “ I have gone round and no lawyer is ready to take up and defend me before this court". However, the State Deputy Director of Prosecution, Isiaka Muhammed told the court that "the case should continue since the defendant was under cross examination when his lawyer withdrew from the case". At this point, the High Court Judge, Justice Muhammed asked Dr. Danfulani about his capacity to defend himself at the next adjournment date, but he declined comment. All other questions thrown at him were by the prosecution and the judge were met with stiff silence. For minutes, the court was eerily tense. Puzzle at the development, the trial judge adjourned the case till May 17, 2018 for the accused to continue his defence in the suit. Speaking in an interview, outside the court, Danfulani said "this is Judicial terrorism. I am being persecuted because I am a Christian. “I have written a petition to the Chief Judge of Kaduna state, pointing out that I am unlikely to get justice from the present Judge. I pleaded that the case be transferred to another judge. But to my surprise, the case was returned to her. "If She (Judge) has no interest why can't she quit or step down and ask another judge to handle the case. All the lawyers I contacted said they cannot defend me in her court. "This is the first time a judge is refusing to step down even when my first lawyer withdrew from the case. No force on earth can intimidate me because we are not under apartheid regime in Nigeria". Meanwhile, the case of Mr Luka Binniyat, a Journalist, came up on Tuesday, before Justice Mairoa Mohammed of Kaduna High Court 3, but was adjourned to 24th May, 2017 because the lead counsel to the Journalist, Barrister Elisha Kura (SAN) was not in court. It could be recalled that Binniyat, had been remanded in Prison Custody for 93 days between June and October, 2017, because he could not meet the stringent bail conditions set down for him on arraignment before Justice Bashir Sukola of Kaduna High Court 9. Upon review of the bail terms on 8th October 2017, Justice Sukola passed to glory on the 25th of October 2017 and the case was then transferred to Justice Mohammed. His first appearance was on the 31st of January, 2018 before the present Judge. Though Vanguard newspaper was not joined in the case, Binniyat is charged for breach of public peace and injurious falsehood punishable under Sections 114 and 393 of the penal code laws of Kaduna State. Showing appearance for the prosecution, Barrister Ossy Ehikioya, told the court that there was an amendment to the earlier charges and sought to read the amended charge. But, Barrister Desmond Tabakwot, who appeared for the Journalists said that the lead Counsel, Elisha Kura (SAN) had not given him enough brief on the matter, saying their was communication gap between Kura and the other members of the legal team defending Binniyat, and as such asked for adjournment. The Justice Mairo then agreed for the 24th of May 2018 for commencement of the case. |
REPORT: Newly elected President of ICC, Osuji to meet Malami tomorrow over Sheik Zakzaky The newly elected President of the International Criminal Court, ICC, Nigerian-Born Chile Eboe-Osuji is scheduled to meet with Nigeria’s Attorney General/Minister of Justice, Mr Abubakar Malami Over Sheik Ibrahim Zakzaky, leader of Islamic Movement of Nigeria. The president, LeadersNG gathered, will be meeting with Nigerian Attorney-General over Sheik Ibrahim Zakzaky who has been arbitrarily detained by the Nigerian Government for over 2 years against a valid court that says he should be released and rehabilitated. You would recall that the Nigerian Army had on December 12th 2015 launched a coordinated attack against the Islamic Movement of Nigeria, killing women and children. The leader of IMN, Sheik Ibrahim Zakzaky was arrested and whisked to the Nation’s capital Abuja. A commission of Inquiry was set up to investigate the matter and it was discovered that over 347 meme era of Islamic Movement of Nigeria were killed with some buried alive in mass graves. Amnesty International had in a report, gave a detailed account of the Nigerian military’s massacre of Shiite Muslims in Zaria between December 12th and 14th, 2015. The organization provided evidence not only that the military used excessive force against civilians, killing more than 350 people, but that Nigerian troops went to great lengths to cover up these crimes. In its damning report, Amnesty International said, “the Nigerian Army has provided no evidence to substantiate its claim that IMN protesters attempted to assassinate the Chief of Army Staff or shot at his convoy, or that the protesters’ action warranted the degree of force used against them.” Amnesty International went further to provide images depicting before and after photos of Shiite sites of worship destroyed under the order of the Nigerian military. The organization also provided images of suspected mass graves where the military reportedly hid the bodies of the victims of their carnage. Amnesty International disclosed that it “has identified the location of one possible mass grave in the Mando area near the city of Kaduna, where Amnesty International found a large area churned up by differs, with dried-up large vehicle tracks still visible at the time of the visit.” Satellite images provided by Amnesty International show important Shiite religious sites or property belonging to the IMN leader, Sheikh Ibrahim Zakzaky, being demolished. According to the report, “after the incident, the military meticulously destroyed most of the evidence at the scenes of the clashes. Soldiers sealed the areas around Ibrahim al-Zakzaky’s compound and around the Hussainiya in the afternoon of 12 December 2015 and for several days afterward.” Amnesty International investigators found “that Ibrahim al-Zakzaky’s compound had been razed to the ground and the rubble removed, bloodstains washed off, and bullets and spent cartridge removed from the streets…several other sites belonging to the IMN in Zaria, including the Hussainiya, a recently created cemetery, a shrine dedicated to Ibrahim Al-Zakzaky’s mother, a media/film production center, and a research center, were also completely or partially destroyed in the days following the incident.” The Amnesty International report provided recommendations to various Nigerian institutions and authorities, including the Kaduna State government and the Federal Government. To the Kaduna State government, it is recommended that it “ensure that the Judicial Commission of Inquiry into the Zaria events…be impartial and thorough.” It also urged the government to ensure that the “Commission has the necessary means to carry out its investigation unhindered and the necessary powers to summon and compel the relevant civil and military authorities to cooperate fully.” Amnesty International recommended that the Federal Government “ensure that those suspected of being criminally responsible are held accountable through fair trials…and that families and dependents of the victims of extrajudicial executions and other unlawful killings are entitled to obtain fair and adequate reparation from the state, including financial compensation.” A pro-Democracy group, Concerned Nigerians have in the last 84 days holding a daily sit-out at the Unity Fountain, calling for the unconditional release of Sheik Zakzaky and his wife. The Other Side Of Buhari's Declaration For A Second Term By Abdulmumin Giwa Although not much of a celebration was seen among the said supporters of President Muhammadu Buhari after he declared to contest for a second term, he certainly needs to continue as president to be safe. This is because, in his bid to be accepted by the global hegemony and imperialism, he chose the wrong political dynamics by choosing to fight the influence of Iran in Africa on behalf of America, Israel and Saudi Arabia. This pushed Buhari to implement extra-judicial acts seen by international laws as crimes against humanity. Buhari killed over 1000 members of the Islamic Movement in Nigeria IMN in Zaria in December 2015. He used the Army in the attack which was more of an act of state terrorism. Men, women and children were mercilessly butchered by the army in the killing spree. Some were burned alive, some buried alive and others tortured to death by the soldiers under Buhari' s orders. The leader of the IMN Sheikh Ibraheem Zakzaky and his wife were kept in detention with the secret police, DSS, despite injuries inflicted on them by the soldiers during the brutal attack. The leader lost an eye and the mechanical function of a limb during the attack and has been refused treatment by Buhari despite persistent pressure from his followers and other concerned groups. Despite all efforts by the Chief of the Army to hide the state perpetrated mass murder, where he claimed in an interview with the press that he killed only six people, it was made public during the sitting of a Judicial Commission of Inquiry, JCI, set up by the Kaduna state government, that 347 IMN members were buried in a mass grave in Mando village near Kaduna. The IMN in a newspaper advertorial also revealed the names and profiles of over 800 members of the Movement missing since the pogrom in Zaria. Also, a competent court of jurisdiction, the Federal High Court, has ordered the unconditional release of the IMN leader, compensation, provision of residence and personal security but the Nigerian government acted in contempt of court and is keeping him under continued illegal detention. Several human rights organizations and governments have called on the Nigerian government to release the IMN leader but all in vain. The IMN took its case before the International Criminal Court, ICC in the Hague which has since concluded the stages of preliminary investigations into the pogrom and is approaching the stage of indictment. Nigerian laws provide immunity for the executive in power and that might serve as a protection for the president in his crimes against humanity. Some of the stubborn accomplices of Buhari in the crime, especially the Kaduna state Governor Nasir El-Rufai have earlier challenged the integrity of the ICC suggesting Nigeria to seize being a signatory. For Buhari to be out of power with the coming indictment for crimes against humanity, he rather remains in power to protect his personal interest and those of his accomplices in the crimes. They want to use the next four years to enjoy immunity and change Nigeria's status with the ICC to save their necks. The indictment by the ICC might soon be announced and possibly before the up coming 2019 general elections. This will reveal the real reason why they need a second term by all means. |

SAVE NIGERIA! Dear fellow Nigerians, our dear country is becoming more and more dangerous each passing day. Everywhere we go it is the cry of the victims, friends or families of the victims of a crime. No day passes by without the news of kidnapping, theft, robbery, killings, ritual, etc. One of the major reasons these crimes are been committed is as a result of much poverty and joblessness in the country. This evil of impoverishment is a deliberate system enshrined in the mainstream of governance before and after independence by successive governments and accepted by naive masses who will never see beyond their nose. However, I am not justifying the crimes neither supporting them, but honestly speaking, wherever poverty reigns a godless person would not think twice of doing something very deadly or uncalled for, for the sake of acquiring money in order for him to discharge his responsibilities. It takes the Grace of Almighty Allah, the Exalted, to shun evil in order to meet the end means in such society. The system we operate as a nation encourages corruption in money acquisition. Those who have jobs could not survive with their take home, while a very large number of graduates is unemployed. Most employers take the advantage of high level of unemployment to grossly underpaying their workers. Government agencies in charge of workers welfares and the so called NLC are in their payrolls. Consequently, the nation is gradually tilting towards anarchy. Every now and then we live in a state of perpetual fear, when we are walking in the street, driving, when in any gathering, in places of worship, in schools, in the market, in our places of work, medical institutions, etc, we are being engulfed by fear. Poverty is the root cause of this unprecedented evil. It is not a curse but should the country remain in this state, we are yet to see the worst of this criminals. We may have not been affected in any way by all the crimes and atrocities been committed so far, but we are vulnerable and prone to experience it should things go on this way unabated. Just imagine, our kids are now been scared of going to schools, especially the ones in the boarding schools. When they are there, we are so much scared with the thought of what could happen to them in the next moment. As a parent, I can imagine the pains and agony of the parents of the children that were kidnapped recently. The hirelings are easily lured into this gruesome venture by certain incentive which the country of theirs could not provide. We should not keep quiet over all that is happening and keep supporting this failed government hoping things will get better. As far as I am concerned, this government is a total failure. Why do we keep deceiving ourselves? Why can't we be sincere with ourselves for once? Why don't we wake up from our slumber and admit we were wrong all the while supporting this government and even the past governments. They are one and the same in different guise. It is total overhauling we need not recycling the old mediocre that misruled us. If we had looked critically into the affairs of this nation, then we would have seen that the evil perpetuators of these crimes are always a step ahead of the clueless government. We define our fate in this country, if we want a changed and a better Nigeria we have to take the right step. In as much as we keep silent and still doing the wrong thing as citizens of this great country, we will never get to the promised land and our generation will suffer much more than we have suffered.
