A US lawyer advises: America is not ruled by decrees. The laws of the land do not permit retroactive application of new directives. If the ban eventually holds it can only affect those whose documentation are still in the loop and not those already qualified and asked to proceed to interview. Otherwise watch out for legal fireworks within next week. sad

Diversity Visa appointment dates cannot be rescheduled. If you have an interview date scheduled, you must attend your scheduled interview. WHAT IS THE COST TO FILE A WAIVER? HOW DO I CHECK THE STATUS OF MY WAIVER?
The fee to file an I-601 waiver is $585. The fee to file an I-212 waiver also is $585. As of June 2012, all waiver applications must be sent directly to U.S. Citizenship and Immigration Services (USCIS) at the Phoenix Lockbox facility at the following address: USCIS, ATTN: 601/212 Foreign Filers, 1820 E. Skyharbor, Circle S, Suite 100, Phoenix, AZ 85034. For more information and waiver instructions, please refer to www.uscis.gov/i-601 or www.uscis.gov/i-212 or call the USCIS Customer Service center at (800)375-5283. The U.S. Consulate General, Lagos, no longer accepts waiver applications, nor do we adjudicate waiver requests.

For the umpteenth time the US Consulate in Lagos has NO POWER OF DISCRETION over family immigration, and not even to summarily deny you your immigration visa . It is all handled by USCIS. Even USCIS decides when you are ready to be interviewed and they only ask the Consulate for available dates. The only job of the Consulate is to verify your submitted documents and hand your travel package over to you. Unlike work based on diversity immigration applications the waiver process may not be an available option for family immigration and really does not seem to make any sense for family immigration since you are not even the original petitioner .This is the advice I received from a US Immigration lawyer.

I don't owe you or anyone any 'positive' news , any information about ban is PUBLICLY AVAILABLE from the same DHS that released the Proclamation.

It is not new, other countries have faced this same ban and visas were only issued if applicants got their waivers approved. All at discretion of CO

So til US consulate in Nigeria provides information on what happens to EVERYONE waiting inline (you are free to ask them) or DHS updates that ban has been lifted then all we have is what the ACT explicitly says and precidence from other travel ban affected countries. Anything else is conjecture

Public charge rule is different from Presidential Proclamation ban that includes Nigeria. Very separate things

No immigrant visas will be issued to applicants from Nigeria after 21st of Feb except the CO determines that such an applicant qualifies for a waiver, then such person would go through the waiver process

Again I am asking the question: how do you know this? Someone earlier told me it was a foolish question but with the varieties of opinions on this forum I don’t know what to believe anymore except that we are all just guessing. My second question is will interviews still go on ? And then again is the moral issue of a retroactive decree which punishes people who have passed the “documentarily qualified “ stage especially family visa applicants. Again if you are refused because of Presidential proclamation and you decline waiver, when the ban is lifted do you begin the entire process all over again? These are things you ought also to be telling us and not just the negative . Please also advise on practical way forward

I just spoke with a US lawyer and he says the ban can only legally affect those who are about to apply. Given the reason for the ban (document control), it will be both immoral and unjustified to ban those that are already "documentarily qualified" since they have scaled the controls. Banning on those grounds alone can be challenged in court because applicants are being retroactively punished. Will they then be required to go submit their qualifying documents all over again? Since the consular officer has "no discretion" to issue or deny a family immigration visa, he must state the reason for denial if any, by the hard fact such as "visa ban". And as the lawyer says, this can be challenged.
Be hopeful if you have scaled the "documentarily qualified " stage. Legal help can be an option.

Responding, the US Ambassador Leonard said the visa issue was not a ban and that the action was not meant to be a permanent one. saying it would hopefully be resolved “in a single-digit month.”

Since the introduction of the waiver in 2018 following the supreme court ruling, the DHS has not introduced a form for those seeking a waiver to file for one, neither is there a fee for it. The procedure has been that consular officers at the end of the interview would ask applicants if they want to apply for a waiver; this question is an indication that the Visa has been denied on the basis of the travel ban. So all that is required to be enrolled in the waiver is a verbal consent. Therefore, anyone who is going for interview after February 21st (if Nigeria is not withdrawn from the list by that time) is advised to go with any additional document they think qualify them for the waiver.
The approval rate so far is at 6% and about 2% has actually completed the entire waiver procedure successfully as it currently takes time. It's still unclear to what extent the bar for waiver will be raised for Nigerians, irrespective, a proof of undue hardship, qualifying family ties and economic value to the US govt remain the crux of evidence required for waivers.
If the ban is not lifted by 21st, it would make a lot of sense for anyone going for an interview to request their relative here in the USA to contact an immigration lawyer to evaluate their chances for a waiver. A number of immigration lawyers here give free consultation in that regards. If the immigration lawyer feels good about your chances, you can contract them to handle it for you if your relatives here can afford it, otherwise you could proceed with the waiver on your own. Applicants reserve the right to put their interview on hold pending the lifting of the ban.

There are TWO classes of Family-based immigration - Immediate Relative and Family Preference. How does the ban affect Immediate relatives (IR). The immigration webite states that availability is UNLIMITED.

"Immediate Relative – these visas are based on a close family relationship with a U.S. citizen, such as a spouse, child or parent. The number of immigrants in these categories is not limited each fiscal year"

I speak from a point of authority. Immigration travel ban has been in existence since 2017 and contested in court until 2018 when the supreme court here finally lifted the injunctions and a revised document was produced. The details of these documents are available everywhere for those who put in effort into seeking information. It's unfortunate that you couldn't make effort to lay hold on an information that is freely out there yet speak so lowly of an attempt to get people like you informed.

Sadly any case with an interview date beyond 21st February 2020 is affected except the applicant is for the National Interest waiver (NIW) class or qualifies for a general waiver. Candidates are automatically enrolled for the general waiver and if they do not meet the waiver conditions, their Visa are denied. The NIW is a different application route and not family based.

How do you know so much? Even people working in US embassy can’t yet tell for certain what will happen, but here you are making up scenarios from “common sense”. Na wah for Naija people o.

Look at it it this way... They are not in any hurry to let in immigrants from Nigeria and those other countries mentioned. I am sure they will take their time and also sure the Nigerian govt will slack off on putting their house in order. Brace yourself, prepared for the best and expect the worst.

Very true. You have forgiven the person for his hatred. You have even prayed to God to forgive you for anything you may have done in error. Regardless of every attempt to contact the person both personally, email and any other means always end in disaster and you can even feel the hatred in his writing. So, how do you ask how to make amends?
It is like continuing to pray for him is like giving him more strength to make you more unhappy. This is why shutting him out of mind becomes so relieving, because of the feeling of inadequacy the alternative option is weighing your life down with. I think Shutting him out of your prayer and thoughts is the route to remain sane and useful to yourself and your own family.

The bible says we should pray for our enemies and people who hate us. Supposing there is a relation who doesn't like you but you pray for him every day without fail anyway because the bible says so. But the more you pray for him the more his hatred for you increases.
