The judiciary must be strengthened and released from political interference. The interference of the executive with judicial proceedings and the ugly action of convicting and harassing the accused by the state apparatus before they are charged to court have become painfully apparent in recent times. The courts are independent and subject only to the Constitution and the law, which they must apply impartially and without fear, favour or prejudice. No person or organ of state may interfere with the functioning of the courts. An order or decision issued by a court binds all persons to whom and organs of state to which it applies. In recent developments, although the constitutional requirements are clear, there have been a number of cases where they have been flouted. More over, for fear of both the known and the unknown, the judges have anomalously delivered judgement in favour of the Executive arm and the ruling party. These include nullification of elections in a certain region where the opposition party hold sway, disobedience to court orders, unjustifiable absence of judges on court days, holding the accused in confinement and denying them access to legal counsel, granting outrageous bail conditions, slamming of charges bit by bit to illegally rearrest and detain suspects after meeting bail conditions, extra-judicial detention and sealing off of people's assets, intimidating and teleguiding body language to the judges so as to get their bid done. The Nigeria Judiciary needs to stand up to the interfering and tyrannical Executive or risk being taken unserious. The Judiciary is the last hope of the common man for justice. Otherwise, why should one appear before a court which one has no confidence in? Why would one appear before an obviously compromised court? I believe these are some of the reasons why Tompolo has not appeared before a Federal High court to answer the cases slammed against him by EFCC. He has already been convicted before the court summon and there is no guarantee that he would not be extra judicially detained. Also, there should be no double standard in the court rulings. The measure and standard used in Lagos should also be used in Rivers and Akwaibom. In this light, it is an impartial victory to democracy and judicial independence, the unanimous judgement of a 7-man panel of judges in affirming the election of River State Governor, Chief Bar. Nyesom Wike as duly elected, not minding the intimidating and tyrannical body language of the executive. The Judiciary should not give in to the despotic body language of the executive. Corruption fight or not, anything done outside the armbit of the laws and constitution of the land is barbaric and an illegality. Despotic democracy is unknown to our constitution. Thanks to the Supreme Court for reigning supreme in upholding Gov. Wike's election. It's remaining the irrational judgement of Taraba Appeal Court Governorship election judgement. It is rather curious and a great conflict of irony that the Taraba tribunal sitting in Abuja on security grounds faulted the conduct of PDP primaries shifted to the same Abuja on security reasons. The extent to which the executive arm go dictatorially is dependent on the resolve of the Judiciary to refuse to be teleguided or interferred with. It is better to free 1000 criminals than to convict one innocent fellow. Whatever we do today will set the precedent for other things to follow in future. |

This is because anybody opposing this despotic government does so at his or her own peril. Amidst all this official terrorism, intimidation, impunity, executive recklessness and intolerance to opposition, you want him to still talk. Everyone is afraid of being framed up or linked to a phantom corruption case not necessarily because of guilt but because the judiciary, which is the last hope of the common man has lost its potency. People are afraid of being harassed and arrested by EFFC or DSS and unlawfully detained without being charged to court or given fair hearing. That's is the extent we have retrograded to. It's that bad and hence his decision to keep mute for now. |
With facts and data on ground, whoever says this government is promising is irredeemably deluded. Is 8+ months not a enough time for us to start seeing some rays of hope? Instead, things are going worse than they met them - receding economy; regional balkanization; despotic democracy; tactless, unprepared,trial-and-error, and unschooled leadership without multi-tasking competence; government of official terrorism, intolerance, propaganda, lies, deceit, vendetta and barbarism. They are eager to take credit for all the good things started by the previous administration which are paying off now but would blame the past administration for the ugly results of their crass incompetence in office now. It's quite unfortunate that amidst all these, their(APC) fanatical fans don't even raise an eyebrow. |
