It has been a gruelling yet wonderful experience and I am very proud to have been part of the team and so deeply involved. It is now 7.00a.m. in the morning and the final results of those elections have just been formally announced by INEC. They are as follows. Governor Rauf Aregbesola of the APC polled 394,684 votes whilst Senator Iyiola Omisore of the PDP polled 292,747 votes. It is clear from the foregoing that Aregbesola has not only won but he has also won convincingly. I hereby congratulate him and his party on their victory. I commend INEC for conducting a free and fair election in which there was no rigging. I commend the security agencies for maintaining law and order and ensuring that no-one was killed or maimed. I salute the courage of my friends and colleagues in the PDP in Osun state for putting up a good fight. I thank my kinsmen and the good people of my district, zone and hometown Ile-Ife particularly for standing by the PDP in this election and delivering virtually all the votes in their four local government areas to our son and candidate Senator Iyiola Omisore. Hundreds of Boko Haram gunmen, dressed in military uniforms, in the wee hours of Wednesday, invaded the rocky border town while riding on different types of armoured vehicles and trucks, residents said. They initially attempted an attack on the town on Tuesday but were said to have been repelled. But on Wednesday, at about 4:00 a.m., the insurgents mobilised and launched a major offensive, residents said. Witnesses, who telephoned journalists from Gwoza, said the gunmen first dislodged soldiers guarding the town, took over some of their arms before attacking fleeing residents. As usual, members of the Gwoza community had to turn to the rocky mountains for refuge. A resident of Gwoza who spoke to journalists from his mountainous hideout, using weak signals from Cameroon’s major national carrier, ‘Orange’, said: “ Most of us are up in the mountains, many may have been killed, but from our height here we could see the Boko Haram people driving some armoured tanks with iron wheel towards the direction of the Emir’s palace.” “I lost a friend with whom we were fleeing when a bullet hit him from behind. We are scared, we don’t know what will become of us by night fall because the entire town is now taken over by the terrorists,” said the caller who would not mention his name for fear of being targeted. PREMIUM TIMES gathered that the new Emir of Gwoza, Muhammed Timta, escaped to an unknown destination, even as fears mounted amongst residents that he could have been captured by the insurgents. The immediate past emir, Mr. Timta’s father, was killed on May 30 by the Boko Haram insurgents. Some parts of Gwoza, especially behind the rocky mountain that borders Cameroon had been taken over by Boko Haram, who sacked the residents and hoisted their flags in June. The military is yet to comment on the recent takeover of the town by the insurgents, but had vowed to dislodge them from the town after the June attack. A top source at the Borno State Police Command, however, confirmed that the police was aware of the attack and the ongoing occupation of Gwoza by the insurgents. The source, who sought anonymity as he was not permitted to speak to journalists, said: “We have received signals from Bama that Gwoza is under attack, but we could not give details now because the Commissioner of Police himself is out of town.” Apart from the attack on Gwoza, gunmen suspected to be members of the Boko Haram sect, also attacked and used explosives to bomb a bridge near Garkida Village of Hawul Local Government Area. The bridge is located near the spot where the late Emir of Gwoza was attacked and killed in May when he was travelling alongside two other emirs to attend the burial of the late Emir of Gombe. Attacks on Borno communities by the Boko Haram sect have continued despite the state of emergency imposed on the state last year. The insurgents are said to have killed over 13,000 people since 2009. How Nigerian Military Arrested 14 Key Members Of Boko Sect In Maiduguri Nigerian soldiers Our correspondent gathered that the incident happened at a popular night club on Pen Crescent, Apapa area of Lagos. The PUNCH learnt from a reliable source that Hilary, a corporal in the Nigerian Army, had gone to the club with his girlfriend who was donned in a military outfit. The source said, “The bouncers at the club stopped the lady and challenged her, asking if she was a soldier. But Hilary asked why they would question his girlfriend in his presence. “Abdullahi, a naval officer, who was equally at the club with his girlfriend, came out to intervene. After listening to the bouncers, he told Hilary it was wrong for his girlfriend to wear a military uniform when she was not one. That was how Hilary left the bouncers and decided to tackle Abdullahi.” Another source told our correspondent that the fight began after Abdullahi slapped the soldier’s girlfriend for disrespecting him. He said, “The soldier was angry and went after the naval officer. He stabbed him with a jackknife and he died on the spot.” Our correspondent gathered that Abdullahi’s colleagues, after getting wind of the situation, mobilised to the scene. It was learnt that in retaliation, the men pounced on Hilary, and beat him to a pulp. The affray was said to have escalated after the soldier gave up in their hands. A resident was said to have made a distress call to policemen at the Apapa Police Division who arrived the scene on time to prevent further bloodshed. The Deputy Police Public Relations Officer, ASP Lelma Kolle, while confirming the incident, said the police made two arrests at the scene. He said, “Yes, the incident happened. Actually, two people died. We received a distress call from someone that there was a situation at the club and we instantly rushed to the scene. We were able to bring the situation under control and prevent further loss of lives. It was just unfortunate that by the time we got there, the two officers had died. But the police arrested two military officers in connection with the incident.” He added that the case had been transferred to the State Criminal Investigation Department, Yaba, and the corpses of the slain officers, deposited in the mortuary. The Army Public Relations Officer, Lieutenant Colonel Omale Ochagwuba, said he was at a programme and would appreciate if our correspondent could visit his office. The seven-member panel investigating allegations of gross misconduct against Governor Umaru Al-Makura has dismissed all the charges. The panel dismissed the charges after concluding its work and listening to the counsel to the Assembly on Tuesday morning. The State Assembly had on Monday declared the inauguration of the panel by the State Chief Judge, Suleiman Dikko, as unconstitutional saying it would stay away from the probe. But on Tuesday, the Assembly made a u-turn, and sent a legal team led by Ocha Ulegede to represent it before the panel. The other members of the Assembly’s legal team were John Mathew, P. A. Daffi, Steven Idikwu, Ache Obande and Abraham Aruta. The legal team arrived at the venue of the sitting around 8.45 a.m. and took the seats marked for the state assembly. The legal team said the panel was breaching the Nigerian constitution. Mr. Ulegede then presented a protest letter written by the legislators and argued that some members of the panel were also members of a political party and that their appointments negated the provision of Section 188 in the composition of the panel. He said that the provision did not give the Chief Judge absolute power to appoint members of the panel. Mr. Ulegede also said the provision stated that panel members must not belong to any political party, be a government appointee or be a person with questionable character. The legal team said the panel had no right to set guidelines for the conduct of the sitting. “Section 188 of the constitution spelt out clearly how the panel should be composed. They are three fundamental issues among which is that member of the panel cannot be a card carrying member of a political party. They cannot hold government appointment and that the panel does not have the power to set the rules of proceeding guiding the sitting”. The legislators’ legal team said two members of the seven-member panel, Abdu Usman and Mohammed Keana, are members of the Peoples Democratic Part, PDP. The legal team also said Joel Galadima is on the payroll of the state government. Mr. Ulegede told the panel that the house does not recognize the panel and then requested to leave the premises. After the panel heard the protest of the counsel to the State Assembly, it went on a brief recess. Reynolds Tobacco Company, the second-biggest cigarette maker in the United States. The judgment, returned on Friday night, was the largest in Florida history in a wrongful death lawsuit filed by a single plaintiff, according to Ryan Julison, a spokesman for the woman’s lawyer, Chris Chestnut. Cynthia Robinson sued the cigarette maker in 2008 over the death of her husband, Michael Johnson. Johnson, a hotel shuttle bus driver who died of lung cancer in 1996 at age 36, smoked one to three packets a day for more 20 years, starting at age 13, Chestnut said. "He couldn't quit. He was smoking the day he died," the lawyer told Reuters on Saturday. During the four-week trial, lawyers for Robinson argued that R.J. Reynolds was negligent in informing consumers of the dangers of consuming tobacco and this led to Johnson contracting lung cancer from smoking cigarettes. After 11 hours of jury deliberations, the jury returned a verdict granting compensatory damages of 7.3 million dollars (5.4 million Euros) to the widow and the couple's child, and 9.6 million dollars to Johnson's son from a previous relationship. The same jury deliberated for another seven hours before deciding to award Robinson the additional sum of 23.6 billion dollars in punitive damages, according to the verdict forms. R.J. Reynolds plan to appeal the court decision and verdict, vice president and assistant general counsel J. Jeffery Raborn said. The landmark award was "far beyond the realm of reasonableness and fairness," he charged in a statement. ‘Grossly excessive’ Reynolds is "confident that the court will follow the law and not allow this runaway verdict to stand," Raborn added, calling the damages "grossly excessive and impermissible under state and constitutional law." Chestnut countered, "This wasn't a runaway jury, it was a courageous one." Robinson's lawsuit originally was part of a large class-action litigation known as the "Engle case," filed in 1994 against tobacco companies. A jury in that case returned a verdict in 2000 in favour of the plaintiffs awarding 145 billion dollars in punitive damages, which at the time was the largest such judgment in US history. That award, however, was tossed out in 2006 by the Florida Supreme Court, which decertified the class, agreeing with a lower court that the group was too disparate and each smoker smoked for different reasons. But the court said the plaintiffs could file lawsuits individually. Robinson was one of them. The Florida high court also let stand the jury's findings that cigarettes are defective, dangerous and cause disease, and that Big Tobacco was negligent, meaning those issues did not have to be re-litigated in future lawsuits. Smoking remains the leading preventable cause of premature death in the United States, killing nearly half a million Americans each year, health experts say.
