Secondus ‘didn’t pay party dues for four years’

Suspended Peoples Democratic Party (PDP) National Chairman Prince Uche Secondus on Thursday faulted his suspension, saying that only the National Executive Committee (NEC) has the power to discipline him or any member of the National Working Committee (NWC).

He said those who purportedly suspended him acted contrary to Article 59 (3) of the PDP Constitution, which is clear on the party’s disciplinary measures.

But, defending the suspension, Rivers State PDP Chairman Ambassador Desmond Akawor said the party chairman was ousted because of his refusal to pay his dues in the last four years.
Akawor, who spoke in Port Harcourt, said Secondus jeopardised his party membership, following his refusal to pay dues.

He said Secondus worked against the interest of the party in the state by balkanising members of his Ward 5, including issuing a directive that the former Chairman of the All Progressives Congress (APC), Davies Ikanya, whose defection to PDP was considered a big harvest, should not be registered in his ward.

He said: “On June 5th, I wrote a letter to all wards that they should furnish us with the names of the party members that are dead and party members that have not paid their dues including those that had defected for one reason or the other.

“Among the wards that responded was Ward 5 in Andoni. And it clearly showed that he (Secondus) had not paid his dues for the past four years. It is an offence in our party.

“For six consecutive months, if you have not paid your dues, your membership of the party is questionable. That issue was kept pending because we had to approach the national to present some of these issues.”

Akawor added: “In his presence, intervention took place and he agreed on all the words that were put down only for him the following week to go globetrotting going from Niger to Ota to continue the course and saying that all that they had agreed was no longer possible.

“In that case what do you do? He’s not ready to listen to the elders, of course, he is equally not ready to look at the constitution of the party.

The members have no option than to go to court and that was the only option.

“I mentioned that at the ward level they set up a committee inviting him to come and defend those allegations, which if he doesn’t he remains suspended.
He said Secondus further kicked against the decision of the Southern governors that the next president should come from the South.

Akawor said for deciding to run for a second term in office, Secondus was prepared to rock the boat and work against the collective interest of the South.
He said: “The southern governors took a decision that the presidency should come from the South as an individual or a politician he should have known that it is now time to come home.
“The position he is occupying is on behalf of the South, he didn’t go there as an Andoni man. he went there because the chairmanship of the party was zoned to the south.
“If southern governors have taken a decision that they desire the presidency to come from the South he should have known that there is no point trying to rock the boat by kicking and running for second term.”
Secondus, in a statement by his media aide, Ike Abonyi, maintained that Article 59(3) of the PDP Constitution states clearly that only the National Executive Committee (NEC) of the party can discipline the National Chairman or any other National officer of the party.”

He urged members of the public and the media to be wary of agents who were out to distract the main opposition party from its focus of rescuing Nigeria

Last week, the PDP Ward 5 in Ikuru town, Andoni, Rivers State suspended Secondus from the party.
His suspension was announced by the Ward Chairman, Mr. George Christopher, at the party’s extraordinary meeting in Ikuru town. He said 11 of the 17 executive members endorsed the suspension.

Christopher accused Secondus of not attracting development to the area, despite being in a strategic position.

He added: ”The ward 5 executive of the PDP in Ikuru town on Aug. 31, discussed issues affecting the party.

“The ward executive suspended Secondus after a duly constituted meeting convened by the Secretary on the instructions of the Chairman in accordance with the party’s constitution.”
Also, former Chairman of Andoni local government and chairman of the ward disciplinary committee, Mr. Benson Alpheous, said Secondus was suspended for disobeying the party’s decision that he step down as national chairman.

“Until further notice, Secondus remains suspended. For now, until you hear from us again, Secondus remain suspended.”

A Rivers High Court had on Monday, Aug. 23 granted an interim order, restraining Secondus from parading himself as the national chairman and member of the PDP.

Justice Okogbule Gbasam of the Degema Judicial Division, presiding over a vacation court in Port Harcourt, granted the order, pending the determination of the substantive suit.

This made the party on Wednesday, Aug. 25 to adopt its Deputy National Chairman (South), Yemi Akinwonmi, as acting chairman.

In another twist, another court of coordinate jurisdiction in Kebbi on Thursday, Aug. 26 restored the embattled national chairman to his position.

However, on Aug. 27, another High Court in Cross River granted an interim order restraining Secondus from resuming office as national chairman.

Edem Kooffreh, the presiding judge, gave the order on Friday, while ruling on a motion ex parte marked HC/240/2021, and filed by Enang Wani.

The court barred Secondus from presiding over any meeting of the party until the motion is heard.

A Chieftain of the New Nigeria Peoples Party, NNPP, Olusegun Bamgbose, has alleged the ruling All Progressives Congress, APC, has planned for 2023 Presidential ticket of Yemi Osibanjo who is currently the Vice President, and the Attorney General of the Federation and Minister of Justice of Nigeria, Abubakar Malami.

Bamgbose, revealed this in a statement to newsmen on Sunday, in Owerri, on his assessment of the current political happenings in the country.

Giving his reasons, Bamgbose, said the cabal loyal to President Muhammadu Buhari, had backed the Osibanjo/Malami ticket concluding that Osibanjo could be controlled by the cabal.

He said: “The All Progressives Congress, APC is not leaving any stone unturned to extend the tenure of President Buhari come 2023.
The cabals have zeroed down on Vice President, Yemi Osinbajo/Abubakar Malami, who is the Attorney General and Minister of Justice, the ticket tentatively.

“The choice of Malami is strategic. He is almost the leader of the cabals at the Presidency and will be in a position to effectively checkmate Osinbajo if their plans work out. Nigerians should beware of this dastardly plan by APC to further worsen the economic and political situation of this country.”

Bamgbose claimed; “The situation under Osinbajo will be worse because he won’t be allowed to be effective just as Garba Shehu, has on several occasions took over his responsibilities. Nigerians must stand up to say no to this grand conspiracy to extend Buhari’s tenure by proxy. We should reject any form of the third term for Buhari.

“Osinbajo won’t be allowed to create any meaningful impact as President and will always be remotely controlled by some cabals in the government. He will always pay homage to Buhari and the cabals in anything he does.


“The one million naira question is if he could not perform as Vice President, how sure are we that he will perform as President when the same cabals will still be at the corridors of power? The APC has also considered the enormous influence of Pastor Adeboye before zeroing down on Osinbajo.”

Wike: PDP must challenge defections of Ayade, Umahi in court

Rivers Governor Nyesom Wike has asked the Peoples Democratic Party (PDP) to drag Ebonyi and Cross Rivers Governors David Umahi and Ben Ayade to court over their defections to the All Progressives Congress (APC).

The Governor also called on the PDP to challenge the defections of former PDP federal and state lawmakers from the two States to the APC.
Wike, who spoke in Port Harcourt on Saturday, stressed the time had come for the judiciary to make a final pronouncement on the incessant defections of Governors and lawmakers to save the country from becoming a one-party state.
He said: “The time has come that the judiciary must have to rise to the occasion to make a final pronouncement of this issue of defection and that will go a long way to strengthen our democracy.

“Because if we do not take action, you will find a the situation where you will have a one-party State and that will not be good for our democracy.

Wike: I have no personal problems with Secondus
“And so, I have encouraged the PDP, they must file a suit against the Governor of Ebonyi State, David Umahi and the Governor of Cross River State, Ben Ayade for defecting to the All Progressives Congress without any reason provided in the constitution or any other enabling law.

“What PDP is looking for is not just that they want to reclaim the seats but that a pronouncement must be made by the judiciary on this incessant defection without no reasons at all, in order to enhance and strengthen our democracy.”

Wike said it was unacceptable for Governors and federal as well as state lawmakers, who had been elected on the platform of a particular party without any proof of division in the party that brought them to power to defect.

He said: “Let it be on record that the party (PDP) has been able to challenge it and let us await the outcome of the decision of the court because the court has a role to strengthen our democracy. And part of the role the court must play is to make a final pronouncement on this issue of defection from one party to the other.”

Nigerian sues UK for denying him entry after landing at Manchester airport

A Nigerian, Adeyemi Opebiyi, has sued the United Kingdom for allegedly turning him back from entering the country after he had been granted a visa and had flown from Nigeria to the Manchester Airport.

Opebiyi, who described himself as the Head of Operations, Sabi Micro Finance Bank Ltd, said on arriving at Manchester Airport on March 14, 2021, he was stopped by the UK Immigration official, who insisted that he must be interviewed before he could be allowed into the UK.

He claimed that he was made to wait for eight hours at the immigration desk before he was eventually interviewed by an Immigration officer, who asked him to draw the logo of Sabi Micro Finance Bank Ltd, among other things, as a way of verifying his claim that he works with the financial institution.

Opebiyi alleged that after drawing the logo as best as he could, the Immigration officer told him that the drawing was not good enough and he would be denied entry into the UK on that basis and related reasons.

He claimed that he was subsequently detained for 10 days before he was finally deported to Nigeria on March 24.

He said in response to his request for the review of the decision, he got a letter from the UK Home Office, reading: “You were asked to draw Sabi Micro Finance Bank LTD’s logo: What you drew bore little resemblance to the logos found on all the official paperwork you submitted for your visa application.

“Furthermore, you were initially unable to state the correct names of the current Chairperson and Managing Director of Sabi Micro Finance Bank Ltd. This is something a Head of Operations would know. You were also unable to describe the core values and mission of Sabi Micro Finance Bank Ltd as described on its website.”

In the suit filed on his behalf by UK-based Nigerian lawyer, Mr Femi Aina, a Senior Consultant Solicitor with Martynsrose Solicitors, UK, Opebiyi is demanding damages for what he termed the unlawful and humiliating treatment meted out to him by the UK Immigration officers.

The suit was filed upper Tribunal (Immigration and Asylum chamber) UK, with the Secretary of State for Home Department (UK) named as the sole respondent to the suit.

In the court papers, copies of which were made available to our correspondent, Opebiyi’s lawyer said, “The applicant spent 16 hours on his flight to London (Lagos-Doha-Manchester). He was held for about eight hours by the respondent for further examination. He was interviewed after eight hours’ waiting and was asked to draw the company logo. Despite the fatigue and the flight stress, he tried his best possible to draw the company’s logo. The respondent’s action is oppressive as it does not have regard for his well-being.
“The applicant showed his ID card, his MD confirmed his employment. The letter dated 9th April, 2018 and the one dated 12 August, 2020 from the CBN relates to his employment. His bank statement shows regular salary payment. All the above are relevant evidence regarding his employment. The respondent’s decision that he was not employed, or that false information was used in obtaining his visa, is wrong.

“By reason of the matters aforesaid, the applicant was unlawfully detained and deprived of his liberty for 10 days at Immigration Detention Centre (Colynbrook) from the date of his arrival, 14th March 2021 up to the date of his removal i.e. 24 March, 2021.

“The respondent has acted in a way that is incompatible with the applicant’s rights under the European Convention on Human Rights, contrary to Section 6(1) as a public authority carrying out Immigration Control.”

Describing the experience as the worst in his life, Opebiyi, in the court papers, said, “I was humiliated and distressed about the whole matter. A week after returning to Nigeria I could not go to work as I was mentally unstable. I have never stayed in detention in my life. The whole experience is affecting me psychologically till now. Anytime I hear detention or see anything about the UK, I cringe. I lost my savings on a fruitless journey to the UK. I am a victim of injustice.”

The applicant, through his lawyer, said he was entitled to a claim of between £5,000 and £20,000, with interest.

He explained that he lost a total of £1,593.00 from the cost of flight ticket, taxi fare to the airport in Nigeria, Administrative Review fees that he paid in the UK and the legal fees he paid to the lawyer who processed the Administrative Review for him.

“The claimant is entitled to interest pursuant to Section 69 County Courts Act 1984 on any sums due to him at such rate as the court shall think fit,” the lawyer said.
