Hello everyone , kindly help liok into this matter before i make a silly mistake .

My partners Brp expired in januaty 20th ,2024 and the agency she came in with has been suspended from renewing and unfortunately ghey were still playing along that the issue will be resolved soon .

Immediately we we realized they couldnt renew we spoke to a lawyer and was told to put in application for FLR so as to keep us legal in the country and we could use that to buy time to look for another employer. LUCKILY she got another COS last week.

MOVING FORWARD .. I STARTED FILLING THE FORM AND I STARTED SEEING SOME LOGICAL QUESTION THAT I NEED YOU GUYS TO GIVE UR ADVISE .

REMEMBER THAT OUR BRP HAS EXPIRED AND WE R STILL LEGAL COS WE APPLIED BEFORE BRP EXPIRED.

1. CURRENT STATUS.
Do you have a current UK visa, entry clearance or grant of leave? YES OR NO
If Yes,
What UK visa, entry clearance or grant of leave do you have?
This will usually be in your passport or on your biometric residence permit.

IF No. SAVE AND CONTINUE.

2. Have you ever had a visa, leave to enter or remain or other permission to be in the UK?

3.What type of visa, entry clearance, grant of leave or other permission did you previously have to be in the UK?

4. What type of visa, entry clearance, grant of leave or other permission did you previously have to be in the UK? WORK.
5 Has your most recent visa, leave to enter or remain or other permission to be in the UK ended?

PLS LET ME HAVE THE CORRECT ANSWER.

I didn’t see the message you sent...I saw the update about the August 40 hrs stuff, but I guess the update is only on paper spoke with the part time people I just got a job with,I even sent them the link but they said no way.. less I forget government still expects your employer to pay your tax ( so the 40 hrs part time is kind of unclear
Wisdom7400:

I saw ur message about the problem ur encountering and sent u a message but u never responded. Bro go start ur work...u can even work more than 20hrs till August. My wife was in similar shoe till she got another sponsor. But her own wasn't a problem of no job it was because of pregnancy.

How do you correct the discrepancy?
leef2022:

You are breaking your visa obligations, the company that offered you a sponsorship should be were you do your main job of around 40hrs per week and a possible 20hrs part-time elsewhere. But as e b here, back deh face front, front deh back. Correct the discrepancies before things bust.

This is very funny& contradictory...Cos without job offer?
slimanyd:

Ask those Nigerians aswell how much they paid. You will realised that u all paid around same amount to get it or probably u got just ordinary cos without any offer letter or job tied to it. Its a pity some Nigerians are falling for such cos because they couldn't afford the real cos amount.

I have not secured another sponsor,I am only asking to know as I am about to start searching.

Dee1504 advanceDNA Is it possible to change employer I.e,transfer from one sponsorship to another (if I didn’t pay tax for the first 3/4 months with my old employer) What’s the likely outcome ? If I only start paying tax after 4 months
Travel / Re: UK Skilled Worker Visa / Health And Care Worker Visa / Qualified Teacher Route by Generalkoke: 9:08am On Mar 21, 2023
Still the same,I just got a 20hrs part time job ( starting next week) I get to realize a lot of Nigerians are in my shoes.brought in from Nigeria,by Nigerians.

Good evening chief,is it now allowed to do more than 20hrs with a different employer?i checked the link you attached but it’s not too clear
dee1504:

1. You can find another care company and work with them but you have to inform your current employers.

2. Find another care company to sponsor (new COS) and apply for a new visa with the COS.

Lol how do you hustle for work? You can only do 20hrs per week legally...Getting a cash payment job is tough, same as off N.I jobs.. You will get frustrated
slimanyd:

It's possible, some agents do tell there clients but some won't because they know we are desperate to japa. No cos is fake. But if u get cos. And u did not do anything like documentations b4 leaving the shores of this country. Then ,its possible the cos no come with work meaning nah u go hustle for job once u enter.

[This is a new question compared to earlier matter 'answered to']
Regarding NI/Tax, employer handles that. 'employee' only handle this themselves when they are outside IR35: in that case, the 'employee' transform to self-employed!!!
In any case. HMRC does not slack on money matter!! If however, outside IR35 gets detected and one's visa doesn't allow self-employment, yawa fit gas!!! Na there Home Office fit enter matter!!!
Note. This response speaks to what ought to be. Whatever, underhand arrangement between 'employee' and 'employeer', na their own water regatta be dat. So far ẹyọ no come out at wrong time!
Travel / Re: UK Skilled Worker Visa / Health And Care Worker Visa / Qualified Teacher Route by Generalkoke: 11:18am On Feb 22, 2023
Chief the question is if NI/Tax is not being paid can the visa/sponsorship be revoked by the home office? Cos I heard people pay their company money to pay their tax .
semmyk:

Can the skilled worker visa be revoked. Yes. It can.

To go alongside labour unions and labour/immigration lawyer is to engage ACAS (not necessarily for dispute purposes).
Should things gets bad to the stage of your current employer withdrawing/revoking your COS, they would most likely, without fail, do everything to rope you in as complicit or accomplice. Why? Because they would want to save face in the hefty fine they'll be slapped with and revocation of their license. Of course, whichever way, they'll still slammed. However, from the way you portrayed them (your employer), they will take you along with their fall.
Also, they (employer) would want to 'punish' you for getting them in the 'dock'. So, they'll not want you to enjoy the 60 days grace to hunt for another job in the UK.

All the best as you 'wisdomly' this.

Thanks a lot chief...I appreciate your help..
Uzland:

Hello Generalkoke, it's so sad to learn about this.angry However, it's the ugly reality some have found themselves in. You'll have to apply great wisdom in how you choose to go about this, cos if you get into a confrontation with your current employer, they may withdraw/revoke your CoS and you know what it means - for them, they may just face a fine or loss of their sponsorship licence; for you it may mean having to go back to Naija.

If you wish to pursue it legally and need some guidance, you may seek professional counsel from a labour-matters or immigration lawyer. First of all, you may have to write an official letter to the complaints unit of your company to formally appeal your redundancy, and follow your company's rules for making such complaints.

Also, you can enquire about labour unions, such as Unison, that may be able to assist you in fighting for your rights. I've specifically searched and found the links below which I hope would provide useful information and assistance to you and others:
-> https://www.acas.org.uk/your-rights-during-redundancy/appeal-a-redundancy-decision
-> https://www.citizensadvice.org.uk/work/discrimination-at-work/discrimination-at-work/checking-if-its-discrimination/check-if-your-problem-at-work-is-discrimination/
-> https://www.citizensadvice.org.uk/work/dismissal/check-your-rights-if-youre-dismissed/dismissal/check-if-your-dismissal-is-fair/

However, at this point, my advice to you, and others in similar situations, is to fall back to aggressive job hunting...
In addition to the suggestion already made by Dee1504, you may also wish to check out your current local county council's careers website and apply for social care jobs, or any other shortage occupation that you're qualified for. You can also apply to other nearby county councils and/or CIC organizations, in case there are no SWV eligible roles in your current local coucil. Most of them are willing to take people, especially in-country candidates with a valid driving licence, for community support worker roles. I wish you all the best of luck.🙏

PS: Please do keep us updated on your progress.

I did as you said,I sent the email but they didn’t reply..When I call they keep posting.’baba The stuff was paid for’ writing the home office is a game over.. thanks for your reply chief & Have been trying to switch but Its been really hard r
dee1504:

Hello. Did you send the email to your employer as I suggested in my last response to you? What was their response? It is ILLEGAL for them to ask you to pay money for tax when you have not even been paid. TAX is to be paid on the money you EARN. If you have done all I asked you to do in my last reply to you and they continually refuse to give you a job, you have 2 options:

1. Report to the Home Office and let them know what your experience has been. Let them know that you are struggling to survive since you haven't started working not to talk of being paid.

2. Start looking for another job aggressively. Target NHS organisations around you. They are very much in need of care workers and will happily recruit you and give you a new COS.

Wishing you all the very best and I hope this helps
